¯ BEMUS POINT — Erik J. Phillips, 35, of East Aurora, was charged with felony driving while intoxicated, DWI per se and inadequate tail lamps on Thursday.
At 9:59 p.m., sheriff’s deputies pulled over Phillips’ vehicle for inadequate tail lamps on Main Street. After an investigation, deputies determined that Phillips was in an intoxicated state, police say. A computer check revealed that Phillips was convicted of a DWI within the previous 10 years, making this a felony.
Phillips was transported to the Chautauqua County Jail on pre-arraignment and is scheduled to appear in Ellery Town Court at a later date.
