State Police
On Jan. 14th, Troopers out of State Police Jamestown arrested Ryan Roselle, 25, of Ripley, for Driving While Intoxicated. Roselle reportedly pulled into the Ellery Overlook on I-86 for a mandatory commercial vehicle inspection and subsequently failed several SFSTs. Roselle was transported to State Police Jamestown, where he provided a breath sample of .06. Roselle was processed, issued traffic tickets and released, while his truck was placed “Out of Service” by New York State Commercial Vehicle Enforcement Unit members.
Gowanda Police
≤ On Dec. 31, 2018 at roughly 5:57 p.m., patrol responded to a report of a disturbance at an Allen Street residence. Patrol was informed that Brandon J. Brooks, 24, of Gowanda, had been involved in a verbal altercation with a female acquaintance. It is alleged that Brooks refused to leave the residence when asked to and struck the female resident repeatedly in the face, while she was holding two young children. Brooks then left the residence and intentionally broke a door handle with a liquor bottle on his way out. Brooks was later located at his residence and arrested for second-degree harassment, fourth-degree criminal mischief, second-degree criminal trespass, and child endangerment. Brooks was arraigned in Town of Collins Court and remanded to Erie County Holding Center.
≤ On Jan. 7 at around 5 p.m., Ida L. Smith-Weber, 51, of Aurora, Colorado turned herself in to the Gowanda Police Department. On June 30, 2018, it is alleged that Smith-Weber was involved in an incident of harassment on Buffalo Street. Patrol requested a warrant for Smith-Weber’s arrest, and one was issued by Town of Collins Court. After the incident took place, Smith-Weber moved to Colorado. When Smith-Weber returned to the area on Jan. 7, learned of the warrant, and turned herself in, she was arrested on a warrant for second-degree harassment and released on an appearance ticket in Town of Collins Court.
≤ On Jan. 11 at approximately 11:18 p.m., patrol stopped a vehicle on Buffalo Street for insufficient tail lamps. During this traffic stop, a DMV computer check revealed that the driver, Elinor F. Roll, 54, of Gowanda, had a suspended license. Roll was arrested for operating a vehicle with insufficient tail lamps and third-degree aggravated unlicensed operation.
Town of Evans Police Department
¯ On Jan. 8 at approximately 11:36 p.m., patrol responded to an address on Herr Road in regards to a report of a single-car accident. Upon arrival, patrol observed the vehicle, which had crashed into a concrete bridge. The operator, Richard S. Ericson, 28, of Evans was standing outside the vehicle with scratches on his head and face. Ericson insisted he was not injured and refused medical assistance. While speaking to patrol, a heavy odor of alcohol was allegedly detected on Ericson’s breath. Patrol administered an SFST test, which Ericson failed. Patrol administered a second SFST test, which Ericson started, but stopped, claiming he “couldn’t finish the test without failing, so there was no point to do it.” Ericson was taken into custody and charged with DWI, moving from lane unsafely, aggravated DWI per se with a BAC of .18 percent or more, and operating a motor vehicle with .08 of 1 percent or more alcohol in blood. Ericson later provided a breath sample at Evans Police Station, which read .32 BAC.
¯ On Jan. 9 at roughly 6:41 p.m., patrol responded to a reported burglary in progress at an address on N Main Street. While en route, it was reported that a male was leaving the area on an electric scooter. Patrol located the male in front of Bella Terra Green House. Investigation revealed that the male, Robert P. Dubose, 45, of Buffalo was allegedly not welcome at the victimized residence, nor was he permitted to remove or operate the scooter. Dubose was charged with fourth-degree grand larceny – value property greater than $1,000.
¯ On Jan. 9 at around 11:36 p.m., patrol responded to an injury accident at an address on Erie Road. Upon arrival, patrol interviewed both involved parties. Eric D. Kavulak, 44, of Evans stated the accident occurred when he was following the victim and a car pulled out in front of him. The victim stated she was leaving her mother’s residence and noticed Kavulak’s white pickup truck following her with the headlights off. She then pulled into Hogg’s Car Wash in Derby and told Kavulak to stop following her. The victim then drove away and Kavulak allegedly proceeded to follow her again. The victim then sped up to get away from Kavulak, before slowing down to a stop, and observing Kavulak’s next move. The victim noticed Kavulak wasn’t stopping in her rear view mirror. Kavulak’s truck allegedly swerved at the last second and struck her vehicle. The victim stated that Kavulak has followed her in the past and has been following her since she moved in with her mother. A lengthy history of domestic incidents were filed. Kavulak was arrested and charged with second-degree harassment, second-degree harassment and fourth-degree stalking: cause material harm to mental/emotional health.
¯ On Jan. 10 at approximately 12:07 p.m., patrol observed a vehicle fail to stop at a stop sign on the corner of Beach and Lake Shore roads. Patrol activated their emergency lights and the vehicle stopped in the middle of the road, prompting patrol to ask the driver to pull off to the side of the road. Upon initial contact, patrol observed that the driver, John D. Strychalski, 57, of Evans had reportedly slurred speech, glassy eyes and alcohol allegedly on his breath. Patrol asked for a license, which Strychalski was unable to produce. Patrol ran his name in the DMV and came back only with a non-driver ID for a previous DWI. Strychalski refused to take a roadside breath test and patrol conducted initial SFSTs, which Strychalski subsequently failed. Patrol conducted additional SFSTs, during which, Strychalski allegedly needed to hold onto his vehicle for assistance standing up. Strychalski was arrested for failure to stop at a stop sign, DWI: previous conviction designated offense within 10 years, refusal to take breath test, use leased/rented/loaned vehicle without interlock device, first-degree aggravated unlicensed operation: aggravated unlicensed operation and DWI.
¯ On Jan. 10 at roughly 5:52 p.m., patrol observed a truck fail to stop at a red light at the intersection of Revere Drive and Erie Road. Upon patrol’s request, the driver, Christopher C. Evans, 43, of Rochester, was allegedly unable to produce a log book containing a record of hours and date of duty. Evans was charged with log book violations and traffic device violation
¯ On Jan. 11 at around 5:02 a.m., patrol responded to a complaint of a vehicle stopped at a light on South Main Street and Route 20. Upon arrival, patrol allegedly observed the driver, Louis D. Bonthron, 40, of Brant, behind the wheel of his vehicle with his head down on the steering wheel and both eyes closed. The vehicle was still running, in drive, and Bonthron’s foot was on the brake pedal. Patrol reached in the vehicle and put it in park. Bonthron stated he’d had a few drinks and was driving home. Patrol administered a series of SFSTs, all of which Bonthron failed or refused. Bonthron was arrested for DWI, operating motor vehicle with .08 percent or more alcohol in blood, operating motor vehicle .08 percent or more with a prior conviction designated off-10 years, and stop/stand/park highway violation.
