Motion for mistrial in Haffa case is denied

MAYVILLE — Chautauqua County Court Judge David Foley denied the defense’s request for a mistrial in the case against Justin Haffa.

Haffa is being tried on attempted murder in an incident with a sheriff’s deputy that occurred on Sept. 11, 2016. Defense attorney Ned Barone made the mistrial motion on Friday after an erroneous statement by the prosecution.

In making his decision today, Foley did acknowledge “serious concerns” with the way the district attorney’s office has represented itself during the trial.
