Jamestown man charged with making false statements to FBI

ROCHESTER – U.S. Attorney William J. Hochul Jr. announced Friday that Tyrell Fuqua-Hayes, 38, of Jamestown, was arrested and charged by criminal complaint with making false statements and representations. The charge carries a maximum penalty of five years and a $250,000 fine.

Assistant U.S. Attorney Tiffany H. Lee, who is handling the case, stated that according to the complaint, in January Hayes alleged that he met a man who was arrested in another federal case while they were in custody together at the same jail. The defendant claimed that the man provided him with contact information and advised Hayes that he would be reaching out to him.

The complaint further states that in May, Hayes advised the Federal Bureau of Investigation that he was receiving text messages from the man he met in jail indicating that the man wanted to pay the defendant $5,000 to kill witnesses in that man’s case. The complaint also states that Hayes later admitted he created the text messages himself and that lied about the recent conversations between the man and himself.

The defendant made an initial appearance before U.S. Magistrate Judge Jonathan W. Feldman and is being held pending a detention hearing.

The criminal complaint is the result of an investigation by the Federal Bureau of Investigation Child Exploitation Task Force which includes the Rochester Police Department, the Monroe County Sheriff’s office and Immigration and Customs Enforcement, Homeland Security Investigations.

The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.

Ryan A. Strickland, 27, of Fredonia was charged with driving while intoxicated, failure to keep right and failure to use designated lane on May 15. Deputies, along with Fredonia Fire Department and Alstar Ambulance, responded to a motor vehicle accident on Straight Road in the town of Pomfret just before midnight. Strickland was found to be allegedly intoxicated and was taken to Brooks Memorial Hospital for treatment. He will appear in Pomfret Town Court.

A 17-year-old male was charged with disorderly conduct on May 18. Police took a complaint at the LoGuidice Educational Center on Fredonia-Stockton Road in the town of Pomfret at 2:25 p.m. The male was allegedly acting reckless and became disorderly in a public place. The male was released to appear in Pomfret Town Court.

RIPLEY – Anthony P. Meredith, 21, of Ripley was charged with driving while intoxicated and various traffic violations on May 16. Deputies and Ripley and Fire EMS, responded to a one-vehicle accident on West Sidehill Road shortly before 4:30 a.m. Meredith was found to be allegedly intoxicated and he was taken by Ripley Ambulance to Westfield Hospital with unknown injuries. He was released to appear in Ripley Town Court at a later date.

NORTH HARMONY – Brendan M. Kempton, 27, of State College, Pa., was charged with driving while intoxicated and moving from lane unsafely on May 24. Deputies witnesses Kempton’s vehicle allegedly commit a traffic violation on I-86 at 2:24 a.m. Kempton was found to be allegedly intoxicated and was released to appear in North Harmony Town Court.

MAYVILLE – David J. Carlson, 29, of Jamestown was charged with driving while intoxicated, speeding, unlicensed operator and having an open container of alcohol in a motor vehicle on May 24. Deputies stopped Carlson’s vehicle for allegedly speeding on East Chautauqua Street at 12:30 a.m. Carlson was found to be allegedly intoxicated with an open container in the vehicle. He was released to appear in Chautauqua Town Court.

CHAUTAUQUA – Larry G. Burk, 42, of Hollidaysburg, Pa., was charged with driving while intoxicated, moving from lane unsafely, failure to use designated lane and driving across hazard markings on Friday. Deputies stopped Burk’s vehicle for allegedly making a lane violation on Chautauqua Steadman Road just after 2 a.m. Burk was found to be allegedly intoxicated and was released to appear in Chautauqua Town Court.

BUSTI – Mary M. Sperry, 24, of Dewittville was charged with driving while intoxicated and speeding on Friday. Deputies observed Sperry’s vehicle allegedly speeding on Route 394 at 12:16 a.m. Sperry was found to be allegedly intoxicated and was released to appear in Busti Town Court.

HANOVER – Vaughn Q. Milhouse, 22, of Buffalo was charged with driving while intoxicated, failure to stop at a stop sign and parking on pavement on Friday. Deputies working a New York state seatbelt detail observed Milhouse’s vehicle allegedly fail to stop at a stop sign on Alleghany Road at 7:42 p.m. Milhouse was found to be allegedly intoxicated during the traffic stop. He was released to appear in Hanover Town Court.

CONEWANGO – Jeffrey A. Schosek, 32, of Gowanda was charged on a bench warrant from Dayton Town Court on Thursday. Schosek was arraigned in Dayton Town Court and sent to the Cattaraugus County Jail in lieu of $1,000 bail.

Pair charged in connection with Stockton break-ins

STOCKTON – A pair of men have been charged in connection with separate break-ins in the town of Stockton. According to the Chautauqua County Sheriff’s Office, deputies investigated the theft of aluminum siding off two camping trailers off Red Wing Road on May 4.

A concerned neighbor who heard the incident was able to detain Justin J. Peck, 21, of Route 380 and Jacob K. VanDeWark, 20, of Jamestown until police arrived. As a result of this incident, the men were charged with second-degree criminal trespass, fourth-degree criminal mischief and petit larceny. Around the same time of the siding theft, deputies were investigating several other separate incidents where a Route 380 home was broken into.

The residence allegedly had plumbing, heating and electrical systems destroyed by someone cutting out all of the cooper water lines and electrical wires during one break-in. At another time, several items were stolen out of the house and barn. Deputies were able to connect the other break-ins to Peck and VanDeWark. Several of the stolen items including tools, a .22 rifle were recovered along with an ATV and a motorcycle which New York State Police had been investigating the theft of those motorized items.

In addition, the pair of men were charged with second-degree burglary, third-degree criminal mischief and petit larceny. Other charges are pending from the New York State Police investigation. Both men were arraigned in Stockton Town Court and sent to the Chautauqua County Jail in lieu of $15,000 cash or $30,000 property bail.

Jamestown Police conduct crack cocaine raids

JAMESTOWN – A lengthy investigation into the sales and trafficking of crack cocaine in the Jamestown area led Jamestown Metro Drug Task Force and New York State Police CNET investigators to execute two separate search warrants Thursday morning at 84 Falconer St. and 73 Grant St.

Members of the Jamestown SWAT Team assisted with entry into the third-floor apartment at 73 Grant St. Inside, investigators found Raymond Johnson, 35, and Vanessa Figueredo, 27, with more than two ounces of crack cocaine and more than $1,500 in cash. Police charged both with third-degree criminal possession of a controlled substance and criminal possession of drug paraphernalia.

Investigators from the Jamestown Metro Drug Task Force, New York State Police CNET and the New York State Parole made entry into the 84 Falconer St. residence where they found Jason Johnson, 28, and recovered nine grams of crack cocaine and what police called “a small amount” of cash. Johnson faces a third-degree criminal sale of a controlled substance charge.

All three suspects currently await arraignment in Jamestown City Jail. Anyone with information on the illegal sales or possession of narcotics can call the Jamestown Metro Drug Task Force anonymous tip line at 483-TIPS (8477). All calls will be kept confidential.

Disabled boat leads to charges

ELLERY – The report of a disabled boat led to boating while intoxicated charges for a Mayville man on Tuesday.

According to the Chautauqua County Sheriff’s Office, deputies responded to a report of a disabled boat on Chautauqua Lake off from the Greenhurst area. The sheriff’s navigation division along with road patrol responded to the area and found a 32-foot cabin cruiser disabled just off from the shore. All the passengers, including three children, were removed safely from the boat and it was secured. The operator, Joseph A. Blachowski, no age given, was found to be allegedly intoxicated.

He was charged with BWI, endangering the welfare of a child and other navigation law violations. He was released to appear in Ellery Town Court.

NORTH HARMONY – A 17-year-old male was charged with third-degree menacing and disorderly conduct on May 7. Deputies took a complaint at the Hewes Educational Center where the male was allegedly acting reckless and became disorderly in a public place. The male also allegedly made threatening gestures which instilled fear in another person. The teen was released to appear in North Harmony Town Court.

MAYVILLE – Charles Baker Jr., 61, of Blanchard Street, was charged with third-degree assault and endangering the welfare of a child on May 21. Deputies were dispatched to Westfield Memorial Hospital on May 15 for the report of an assault victim receiving treatment. After an investigation, it is alleged Baker punched a male subject who was under the age of 17, causing the youth to seek medical treatment. It was determined the assault took place on Blanchard Street earlier that evening. Baker was released to appear in Chautauqua Town Court.

CLYMER – Rebecca A. Byler, 20, of French Creek Road, was charged with unlawful possession of alcohol under 21 on Sunday. Deputies responded to the report of a large party on Raspas Hill Road around 1:30 a.m. Byler was allegedly found to be in possession of alcohol. She was released to appear in Clymer Town Court.

HANOVER – Chris-topher Muscarella, 29, of Angola was charged with speeding and driving while intoxicated Monday. Depu-ties stopped Muscarella’s vehicle on Alleghany Road at 9:35 p.m., for allegedly speeding. During the traffic stop, Muscarella was allegedly found to be intoxicated. He was released to appear in Hanover Town Court.

SINCLAIRVILLE – Kevin W. Perry, 61, of Jamestown was charged with second-degree harassment on Monday. Deputies responded to a Jamestown Street residence for an alleged verbal domestic dispute at 3:40 p.m. Perry allegedly threatened and became aggressive by confronting the complainant. Perry was released to appear in Charlotte Town Court.

Gowanda Police

Nathaniel P. Dubois, 39, of Jamestown Street was charged under an arrest warrant on May 7. Deputies were notified of an active warrant from Springville Village Court on the charges of criminal possession of stolen property and petit larceny involving Dubois. Dubois was located on this warrant and turned over to the Erie County Sheriff’s Office.

Steven G. Corley, 55, of Route 438, was charged with third-degree aggravated unlicensed operation on May 18. Police observed Corley driving on Buffalo Street and Corley was allegedly known to have a suspended license. A DMV computer check revealed Corley’s license was suspended in 2012 and then again in 2013. Corley was released to appear in Collins Town Court.

Brian McAllister, 40, of Cattaraugus was charged with second-degree criminal trespass on May 23. McAllister allegedly attempted to force his way into a Chestnut Street residence on May 8 contrary to the resident’s protest. McAllister was located on May 23 on these charges and was arraigned in Persia Town Court. He was released on his own recognizance to appear in court.

Deanna J. Waterman, 45, of Collins, was charged on a violation of probation warrant on May 23. While investigating an incident at a Buffalo Street business, Waterman was found to have an active arrest warrant from Erie County Court. Waterman was taken into custody and turned over to the Erie County Sheriff’s Office.

State Police in Fredonia

Angelo Spicola Jr., 53, of Cassadaga was charged Thursday with three counts of petit larceny after State Police responded to a report of a larceny of auto parts from Clemens Auto Sales on Route 60 in Pomfret.

Investigation reportedly revealed auto parts had been disappearing over the last two weeks. A total of eight batteries and two rear end axels were stolen.

Further investigation and area interviews led to the arrest of Spicola for the larcenies, which had occurred on three separate occasions.

BRANT – Ian Wallum, age 29, of Tonawanda was charged Monday with failure to dim lights and unlawful possession of marijuana after State Police stopped a vehicle for failing to dim the headlights. While interviewing the operator, Wallum, the smell of marijuana was allegedly emanating from inside the vehicle.

An investigation reportedly revealed Wallum was in possession of marijuana.

Wallum was ticketed for the above charges and is to due in Brant Town Court on June 11.

HANOVER – Mitchell Minchen, 47, of Cheekto-waga was charged Friday with failure to yield right of way after deputies pulled up to the scene of a two vehicle accident with a rollover on Routes 5 and 20. After getting all passengers out of the rolled-over vehicle safely, it was allegedly found that Minchen was traveling west bound on Routes 5 and 20 and attempted to turn left into a parking lot, failing to yield the right of way to the eastbound traffic, causing another vehicle to strike the passenger side of the vehicle. The vehicle operated by Minchen then rolled over as a result of the impact. All the passengers of the two vehicles were taken to Lakeshore Hospital and treated for minor injuries.

CHAUTAUQUA – Scott Cafaro, 31, of May-ville was charged Saturday with speeding and second-degree aggravated unlicensed operation after deputies stopped him ]for speed in zone. A license check allegedly revealed five New York state suspensions. Cafaro was found to have a reported active warrant in Jamestown as well.

Zachary D Huber, 29, of Fredonia was charged Monday with failure to stop at a stop sign, driving while intoxicated and DWI per se after deputies stopped him for failure to stop at a stop sign in Fredonia. Huber was allegedly found to be intoxicated and arrested.

WESTFIELD – Jason E. Selig, 45, of Portland was charged Sunday with speeding and seventh-degree criminal possession of a controlled substance after deputies reportedly saw a vehicle speeding on Route 5. Upon pulling the vehicle over and further investigation, it was allegedly found that Selig was in possession of several pills that were scheduled narcotics.

CLYMER – Aaron W. Troyer, 20, of Clymer was charged Sunday with unlawful possession of an alcoholic beverage with the intent to consume by persons under the age of 21 after deputies responded to a complaint of a large party on Raspas Hill Road where it was suspected that minors where consuming alcohol.

After an investigation it was determined Troyer was not 21 years old. Troyer was ticketed and will appear in Clymer Town Court at a later date.

SILVER CREEK – Timothy J. Fort, 23, of Cheektowaga was charged with unlawful possession of marijuana and speeding on Wednesday. Deputies observed a vehicle allegedly speeding on Main Street at 10:50 p.m. Fort was found to be allegedly in possession of a small amount of marijuana. Fort was released to appear in Silver Creek Village Court.

HANOVER – Deborah Nye, 61, of West Seneca was charged with failure to yield the right of way at a stop sign after a two-vehicle accident in the area of Route 39 and Hanover Road on Saturday.

Around 11:30 a.m., deputies responded to the reported accident and found that Nye was traveling south on Hanover Road and allegedly failed to yield the right of way at the intersection with Route 39. Nye allegedly pulled in front of another vehicle, causing a collision.

Nye’s passenger sustained minor injuries and was treated by first responders at the scene. The two occupants of the other vehicle both sustained apparently non-life threatening injuries and they were both transported to Lake Shore Hospital by ambulance.

The Forestville Fire Department assisted. Nye was issued a ticket and will appear in Hanover Town Court.

Mallory Zanghi, 31, of Straight Road, Fredonia, was charged with felony driving while ability impaired by drugs, seventh-degree criminal possession of a controlled substance, operating a motor vehicle while using a mobile phone and failure to yield the right of way on a left turn on Saturday.

Around 1:30 p.m., deputies were conducting Operation Click it or Ticket when they stopped Zanghi on Route 60 in the town of Dunkirk for allegedly operating her vehicle while using a mobile telephone and failing to yield the right of way when making a left turn. Zanghi was found to be allegedly impaired by drugs. Following an investigation, Zanghi was found to be in alleged possession of two controlled substances.

Due to a prior DWI conviction, Zanghi’s arrest was on a felony charge.

ELLERY – Erica Sanderson, 26, of West Main Street, Westfield, was charged with driving while intoxicated, DWI with a blood alcohol content of .08 percent or higher, failure to keep right and failure to maintain lane on Sunday.

Around 2:35 a.m., deputies stopped a vehicle for multiple alleged lane violations on Route 430. Investigation revealed the operator, Sanderson, was allegedly intoxicated. She was released and will appear in Ellery Town Court.

GERRY – Deputies investigated a single-motorcycle accident on Sunday around noon.

The operator, Samuel Shreffler, 67, of Gerry was reportedly northbound on Route 60 when a vehicle stopped in front of him to make a left turn onto Salisbury Road. Shreffler reportedly laid his motorcycle down onto the roadway in an effort to avoid the uninvolved vehicle.

Shreffler was transported to WCA Hospital by Gerry Fire Department ambulance with non-life threatening injuries.

No charges were filed. The New York State Police and Alstar Ambulance assisted.

Small city porch fire under investigation

The Dunkirk Fire Department responded to 633 Central Avenue for a reported structure fire at 11:24 a.m. Saturday.

Upon arrival, Engine 3 reported smoke showing with a small fire on the porch. Firefighters reportedly deployed hoses and hand tools to extinguish the fire.

No injuries were reported and the fire crew was on the scene for approximately 25 minutes.

The cause of the fire is still under investigation.

CHAUTAUQUA – Will D. Lutgen, 50, of Mayville, was charged Friday with felony driving while intoxicated, moving from lane unsafely, failure to comply, failure to keep right and refusal to submit to a pre-breath test after deputies reportedly attempted to stop a vehicle on Elm Flats Road for moving from its lane unsafely. The vehicle allegedly refused to stop and lead deputies on a short pursuit before pulling into a driveway on Elm Flats Road.

The driver, identified as Will D. Lutgen, was reportedly taken into custody without further incident, and upon investigation he was found to be intoxicated.

A record check showed that Lutgen had been convicted of DWI within the last 10 years, making this arrest a felony. Lutgen was arraigned and sent to the Chautauqua County Jail in lieu of bail.

CHAUTAUQUA – Daryll V. Thompson Jr., 29, of Brocton, was charged on Friday with driving while intoxicated, DWI with blood alcohol content .08 percent or higher and consumption of alcohol in a motor vehicle after deputies were called to investigate a suspicious situation on Burdick Road.

Following an investigation, Thompson was reportedly located inside his vehicle on the side of Burdick Road. Thompson was alleged to have been operating his vehicle in an intoxicated condition.

He was taken into custody and later released to appear in Chautauqua Town Court next month.

HANOVER – Matthew B. Schrader, 25, of Lancaster, was charged on Saturday with trespassing after deputies responded to a trespass complaint in progress on Newton Road. Upon further investigation, Schrader was allegedly located on the front porch of a residence that did not belong to him. He was taken into custody, released and is to appear in Hanover Town Court at a later time.

SILVER CREEK – Penelope O. Schneider-Smith, 38, of Silver Creek, was charged on May 10 with petit larceny after deputies received a complaint regarding the theft of newspapers from retail vending machines around the village. With the vending machines operating on an “honor system,” it was believed that someone was allegedly paying the required fee for one newspaper, opening the vending machine and removing several newspapers at a time. After an investigation aided by local citizens, Schneider-Smith, was charged and will appear in Silver Creek Village Court at a later date.

MAYVILLE – An-thony M. Spitale, 19, of Dunkirk was charged with second-degree criminal impersonation on Wednes-day. Spitale entered the Chautauqua County Jail and allegedly gave a false identification of another subject.

Spitale had a warrant from Kiantone Town Court and was arraigned in Chautauqua Town Court.

Bail was set at $1,500 and Spitale is to return back to court at a later date.

SILVER CREEK – Ronald J. Kazmierczak Jr., 24, of Silver Creek was charged with driving while intoxicated, aggravated DWI with a blood alcohol content of .18 percent or higher, failure to signal a turn and possession of consumption of alcohol in a motor vehicle on Wednesday. Deputies observed a vehicle allegedly fail to signal its turn on Jackson Street at 2:32 a.m. Kazmierczak was found to be allegedly intoxicated and in possession of an open container. He was released to appear in Silver Creek Village Court at a later date.

Matthew Budniewski, 36, of Dunkirk was charged on May 17 with aggravated driving while intoxicated with a blood alcohol content of .18 percent or higher, driving while intoxicated, consumption of an alcoholic beverage in a motor vehicle, moved from lane unsafely and following too closely after Fredonia-based State Police stopped a vehicle on Route 5 in the town of Pomfret for following too closely and unsafe lane change.

As the trooper interviewed the operator, there was reportedly a strong odor of alcohol emanating from the vehicle.

The operator, Budniewski, allegedly failed field sobriety tests and was placed under arrest for DWI. Budniewski was transported to the Fredonia barracks station and processed. He had a blood alcohol content of .25 percent.

Budniewski was ticketed for the above charges, all returnable to Pomfret Town Court on June 9.

KIANTONE – Stefano M. Clemente, 30, of Warren, Pennsylvania, was charged on May 18 with aggravated unlicensed operation of a motor vehicle, speed exceeding 55 mph and no seat belt after Clemente was pulled over for speeding on Route 62. Clemente, who was driving 119 mph in a 55 mph zone, was also found to have a license suspended in New York state.

Clemente was issued tickets for the above charges and was arraigned in Kiantone Town Court where he pleaded guilty to all charges, paid his fine and was released.

NORTH HARMONY – Nathan M. Lindstrom, 27, of Irvine, Pennsylvania, was charged with driving while ability impaired by drugs, moving from lane unsafely and driving across hazard markings on May 8. Deputies observed Lindstrom’s vehicle allegedly make several lane violations at 10:25 p.m., on Route 394. Lindstrom was found to be allegedly impaired by drugs and was released to appear in North Harmony Town Court.

Adam A. Mancilla, 23, of Central Islip, was charged with speeding and driving while intoxicated on May 9. Deputies observed Mancilla’s vehicle allegedly speeding on East Main Street in the village of Fredonia at 3:29 a.m. Mancilla was released to appear in Fredonia Village Court.

NORTH HARMONY – Larry W. Bailey, 41, of Westfield was charged with speeding, failure to keep right, unlawful possession of marijuana and driving while intoxicated on May 10. Deputies observed Bailey’s vehicle allegedly speeding on Route 394 at 12:51 a.m. Bailey was found to be allegedly intoxicated and in alleged possession of marijuana. Bailey was released to a third party and will appear in North Harmony Town Court.

RIPLEY – Joshua Feltenberger, 25, of Erie, Pennsylvania, was charged Sunday with being an unlicensed operator, speeding and unlawful possession of marijuana after Fredonia-based State Police stopped a vehicle on Route 20 for speeding 70 mph in a 55 mph zone.

While interviewing the operator, Feltenberger, marijuana residue was reportedly observed on the driver-side floor mat. Further investigation allegedly revealed Feltenberger to be in possession of marijuana. A DMV check also revealed Feltenberger was operating with an expired Pennsylvania driver’s license.

Feltenberger was issued tickets on the above charges, all returnable to Ripley Town Court on June 1.

Kansas woman charged with felony firearm possession

OBSERVER Staff Report

SILVER CREEK – A 46-year-old Kansas woman was remanded to the Chautauqua County Jail after police found her in alleged possession of a loaded pistol without a New York state permit.

According to the Chautauqua County Sheriff’s Office, around 5:20 a.m. on Sunday, deputies allegedly observed a speeding motorist on Central Avenue. A traffic stop was conducted and further investigation found the operator, Doreen Mundy of Lenexa, Kansas, in alleged possession of the pistol.

Mundy was charged with criminal possession of a firearm (a felony) and speed in zone. She was arraigned in Silver Creek Village Court and committed to the county jail in lieu of bail.

WESTFIELD – Brett Bisbee, 22, of Irish Road, Ripley, was charged with being a fugitive from justice, unlawful possession of marijuana and speeding on Sunday.

Around 6:30 p.m., deputies pulled a vehicle over on Route 5 for allegedly speeding. Upon further investigation, the driver, Bisbee, was found to have an active arrest warrant out of Pennsylvania. He was also found to be in alleged possession of a small quantity of marijuana.

Bisbee was arraigned in Westfield Town Court and committed to the Chautauqua County Jail. He will appear in court at a later date.

The Westfield Police Department assisted.

KENNEDY – Tyson E. Staff, 36, of Falconer, Aaron A. Benson, 19, of Kennedy, and two 17-year-old males from Jamestown and Falconer were charged on May 11 with petit larceny after New York State Police responded to a suspicious situation complaint on Route 62 at the Kennedy Boat Launch after a witness allegedly reported seeing four people moving a boat that belonged to someone else.

Troopers checked with the owner, who confirmed his boat was missing. The witness also noticed a pickup truck in the area that he believed was involved. Troopers located the truck and obtained information that led to the recovery of the boat and the arrests.

The four were processed, issued appearance tickets and released. They are to appear in Poland Town Court at a later date.

Authorities continue search for missing fisherman

MAYVILLE – Police are still continuing their search for a missing fisherman. The Chautauqua County Sheriff’s Office is searching for David R. Spink, 64, of Varysburg who was last seen Wednesday evening. There was no update as of Saturday evening.

Spink planned to launch his boat at Prendergast Point to spend the night fishing but was last seen leaving Camp Prendergast around 7 p.m., Wednesday. Spink’s truck along with an empty boat trailer were discovered at the Prendergast Point public boat launch while his boat was discovered on the shores of Long Point State Park Thursday.

Anyone with information on Spink’s location is asked to call the sheriff’s office at 753-2131.

CHAUTAUQUA – Kyle J. Cunningham, 19, of Westfield was charged with unlawful possession of marijuana on May 9. At 2:50 a.m., deputies stopped a vehicle on Quilliam Road. A passenger, Cunningham was found to allegedly be in possession of marijuana. He was released to appear in Chautauqua Town Court.

KIANTONE – Dale T. Coombs, 55, of Warren, Pa., was charged with driving while intoxicated, failure to dim high beams and failure to keep right on May 10. Deputies stopped Coombs’ vehicle on Route 62 at midnight for alleged traffic infractions. Coombs was found to be alleged intoxicated and refused to submit to a breath test. He was arraigned in Kiantone Town Court and released to a sober party to appear in court at a later date.

RIPLEY – Michael T. Shrecangost, 38, of Reynoldsville, Pa., was charged with driving while intoxicated, aggravated DWI with a blood alcohol content of .18 percent or higher, having an unregistered motor vehicle, third-degree aggravated unlicensed operation and not wearing a seat belt on Friday. Deputies observed a driver allegedly not wearing a seat belt on Goodrich Street at 8:15 p.m. Shrecangost was found to be allegedly intoxicated and his driving privileges were allegedly suspended in New York state. Shrecangost was released to appear in Ripley Town Court at a later date.

BUSTI Three Busti residents were taken into custody Thursday after police discovered an active methamphetamine operation at the Bosko Trailer Park in Busti.

The raid, which occurred shortly before 9 p.m., involved multiple agencies executing two search warrants simultaneously at lots B-2 and 6 at the trailer park, located at 611 Busti Sugargrove Road.

Edward R. Olsen, 23, who was allegedly using the trailers to manufacture, store and distribute meth, was apprehended by officers on the perimeter of Lot 6 while attempting to run away, police said.

Inside the residence, police found two working “one bottle” meth labs and one spent lab. Five shotguns, rifles, ammunition and a large assortment of unused precursors were also found. As a result of the search and cleanup of the scene by the DEA Clandestine Lab Team, authorities seized approximately 55 ounces of meth oil.

When police entered Lot B-2, they located 23-year-old Sarah J. Deering and two small children.

Inside, police found evidence of meth, marijuana and two additional shotguns with ammunition.

Due to the deplorable living conditions, Chautauqua County Child Protective Services representatives were called to the scene and the children were taken into protective custody, police said.

Olsen and Deering were each charged with two counts of endangering the welfare of a child and unlawful possession of marijuana. Olsen was also charged with second-degree criminal possession of a controlled substance.

While the two residences were being entered, officers located 29-year-old Brian D. Olsen and took him into custody on an outstanding warrant out of North Harmony.

Edward R. Olsen was arraigned before Justice Geary in Busti Court and is being held in the Chautauqua County Jail without bail.

Deering will be arraigned in Busti Court at a later date.

Brian D. Olsen was arraigned in North Harmony Court and remanded to the Chautauqua County Jail.

All additional charges against Edward R. Olsen will be filed through Busti Court after the evidence obtained has been processed by the crime laboratory in Olean.

The Southern Tier Regional Drug Task Force, Lakewood Busti Police Department and the Chautauqua County Sheriff’s SWAT team executed the search warrants, and were assisted at the scene by Child Protective Services, DEA Clandestine Lab Team, Busti Fire Department, Haz Mat, McCutheon Disposal Services and the Busti Lakewood Code Enforcement Officer.

Police indicated that the residences are now sealed and deemed uninhabitable. The investigation will be ongoing into other subjects in the area producing meth.

In December, police located 11 separate meth cooking devices in a single trailer at Lot 6 in the Bosko Trailer Park.

Joe Gerace, Chautauqua County sheriff, said the dangerous, but far easier “one-pot” method of meth production is a huge part of the problem.

“Since meth can be manufactured much easier than the traditional way, we’re seeing a lot more production … and there’s a big profit in it,” he said.

The Southern Tier Regional Drug Task Force is comprised of officers from the Chautauqua County Sheriff’s Office, city of Dunkirk Police Department and the Lakewood-Busti Police Department. The Southern Tier Regional Drug Task Force would like to encourage members of the community to call either the task force at 800-344-8702 or their local police agency to report any narcotics-related activity.

JAMESTOWN – A 15-year-old male student at Jamestown High School was charged Thursday after allegedly being caught with marijuana, cash and three bags of heroin.

Tim Mains, superintendent of Jamestown Public Schools, said the incident marks the first time heroin has been discovered at a Jamestown school to date.

“Sadly, given the wide availability of heroin in the community, I worry (something like) this was inevitable,” Mains said. “If we have a drug problem in Jamestown, then that means we’re going to have a drug problem in Jamestown schools … it’s been a matter of ‘when.'”

Melody Peach, a school resource officer, reportedly nabbed the student shortly after he had entered the school around 8 a.m. Peach, according to Jamestown police, was tipped off by a strong odor of marijuana coming from the student.

“I was thrilled that our staff responded so quickly and appropriately,” Mains said. “(The student) was encountered just after coming into the building, so we’re very confident that no sales or distribution took place in the school.”

Mains, who described drug sales and possession by students as one of the most serious offenses in the school’s code of conduct, said the student will be given due process and will be charged as a juvenile through Chautauqua County Family Court.

“The good news is that the drugs didn’t penetrate far into the school, but this is a warning that if this can happen today, then it can happen again,” Mains said. “We continue to ask all of our students, staff and community to help us by alerting us any time they have knowledge or suspicions that there may be illegal drugs or weapons brought into our schools.”

Mains added that while Jamestown High School only has one school resource officer, adult supervision is maintained via the principal, assistant principals, teaching and administrative staff, as well as off-duty police officers from the Jamestown Police Department.

MAYVILLE – Colita Stilson, 61, of Jamestown was charged with fourth-degree welfare fraud, first-degree offering a false instrument for filing and fourth-degree grand larceny on May 7. The charges stem from a joint investigation conducted by the county sheriff’s office and the Department of Health and Human Services Program Integrity Unit. Stilson is alleged to have received family assistance cash benefits for a person who was not actually residing in her home. Stilson received $1,101 in cash assistance that she was not eligible for due to failing to report the person out of her household from February through October 2014. It is also alleged Stilson filed a false application with DHHS during this time. Stilson was released to appear in Jamestown City Court.

VILLENOVA – Tyler Maynard, 28, of Cherry Creek was charged on May 2 with seventh-degree criminal possession of a controlled substance, a misdemeanor, and unlawful possession of marijuana after Fredonia State Police stopped a vehicle on Route 83 for operating without plate lamps. A strong odor of marijuana was allegedly detected coming from the vehicle. Investigation revealed Maynard was in possession of marijuana and cocaine. Maynard was transported to the Fredonia barracks for processing.

ELLICOTT – James H. Boardman, 27, of Gerry was charged Saturday with seventh-degree criminal possession of a controlled substance, criminal possession of a hypodermic and inadequate muffler after a traffic stop for a loud muffler on Route 60. Boardman was reportedly found to be in possession of heroin and was placed under arrest. He was issued tickets for the above charges.

JAMESTOWN – Jennifer R. Knuth, 42, of Frewsburg was charged Sunday with driving while impaired by drugs and failure to dim high beams following a traffic stop for failure to dim her high beams on Route 60. After interviewing Knuth, field sobriety tests were reportedly performed and she was placed under arrest and was processed .

Robert Boe, 20, of Jamestown was charged on May 2 with possession of alcohol under 21 after Fredonia State Police stopped a vehicle on East Main Street in the village of Fredonia for reportedly failing to dim the headlights. The passenger in the vehicle, Boe, was allegedly found to be in possession of four cans of Bud Light beer.

SHERIDAN – Rachael Kilian, 19, of Derby was charged on May 3 with alcoholic beverage control violation, possession of alcohol under 21 and a uniform traffic ticket for consuming alcohol in a motor vehicle after Fredonia State Police stopped a vehicle on Route 20 for an equipment violation. An open 16 oz. can of Busch beer was reportedly observed in the vehicle. Further investigation revealed that the rear passenger, Kilian, had been consuming alcohol.

Man dies in fall from second story

JAMESTOWN – A 54-year-old man was killed when he fell through a railing at 52 Charles St., Jamestown, on Thursday.

The man’s name hasn’t been released by police.

Jamestown police report responding to a report of an unconscious man lying on the sidewalk outside 52 Charles St. at 10:30 p.m. Thursday. EMS responders were not able to revive the man, who was later pronounced dead by the coroner. A police investigation revealed the man was standing on the porch on the second floor and fell through the railing to the sidewalk below.

The incident has been ruled an accident, and no foul play was involved.

Sheila Jesionoski, 35, of Fredonia was charged on May 3 with third-degree aggravated unlicensed operation and using an electronic portable device while driving after Fredonia State Police stopped a vehicle on Vineyard Drive in the town of Dunkirk for allegedly using a portable electronic device while driving. Jesionoski was also found to have a suspended driver’s license.

Emarquell, L. Marshall, 20, of Dunkirk was charged with driving while intoxicated and speeding on Saturday. Deputies stopped Marshall’s vehicle on East Main Street in Fredonia for allegedly speeding at 2:51 a.m. Marshall was found to be allegedly intoxicated and released to appear in Fredonia Village Court.

Carl N. Frantz, 24, of Celoron was charged with aggravated driving while intoxicated with a blood alcohol content of .18 percent or more, DWI, having no headlights and parking on highway on Saturday. Deputies observed a vehicle stopped at the intersection of Porter and Webster roads in Pomfret just after 11 p.m. Frantz was found to be allegedly intoxicated and was released to appear in Pomfret Town Court.

A 16-year-old male was charged with disorderly conduct on April 29 following an incident at the BOCES LoGuidice Center. Police took a complaint at 9:30 a.m., that the male was allegedly acting reckless and became disorderly in a public place. The male was arraigned in Pomfret Town Court and released on his own recognizance.

Gowanda Police

Ronald E. Dorman Jr., 31, of Fort Lewis, South Carolina, was charged with fourth-degree grand larceny on March 24. Police investigated a cell phone and vehicle theft in 2012 which Dorman had allegedly stolen. An arrest warrant was issued for Dorman when he could not be located by police. Dorman turned himself into police and was arraigned in Collins Town Court and released on $300 bail. The vehicle stolen had been previously recovered in South Carolina.

Danielle M. Gonzalez-Fial, 31, of Jamestown Street was charged on an arrest warrant on March 26. While responding to a minor disturbance on Jamestown Street, police found Gonzalez-Fial to have an active warrant from the Erie County Sheriff’s Office. Gonzalez-Fial was then turned over to the sheriff’s office for processing.

Jeffrey Haynes, 57, of Delevan was charged with an arrest warrant on March 27. Police were notified of an active arrest warrant from Springville Village Court for failure to appear for larceny. Haynes was located at a Jamestown Street residence and turned over to the Erie County Sheriff’s Office.

Quin C. Gates, 20, of Orchard Meadows Drive was charged with speeding and third-degree aggravated unlicensed operation on March 29. Gates was stopped on Broadway Road for allegedly speeding when a DMV computer check revealed Gates only had a permit which had been suspended for failure to appear. Gates was released to appear in Persia Town Court.

Tashia M. Seneca, 29, of Irving was charged with third-degree aggravated unlicensed operation on April 12. Seneca was stopped on Buffalo Street for allegedly having a headlight out. During the traffic stop, a DMV computer check revealed Seneca’s license had been suspended for failure to pay a fine. Seneca was released to appear in Collins Town Court.

Mardi M. John, 21, of Miller Street was charged with disorderly conduct on April 13. Police observed a loud disturbance on Buffalo Street where John allegedly became verbally abusive yelling obscenities at police officers. John was released to appear in Collins Town Court.

Andrew D. Estrada, 20, of Walnut Street was charged on an arrest warrant for aggravated unlicensed operation on April 29. Police were notified of Estrada had an arrest warrant from Evans Town Court for failure to appear. Estrada was located in a vehicle on Jamestown Street and turned over to the Evans Police Department.

Walter Pagan, 47, of West Main Street was charged with having less than two headlights, unlicensed operation and driving while intoxicated on May 1. Police stopped Pagan’s vehicle on Aldrich Street for allegedly only having one headlight. Pagan was found to be allegedly intoxicated during the traffic stop and a DMV computer check revealed Pagan did not have a valid license. A breath test concluded in a blood alcohol content of .10 percent. Pagan was released to appear in Persia Town Court.

SHERIDAN – Megan Termer, 29, of Tonawanda was charged Tuesday with first-offense operating a motor vehicle impaired by drugs, failure to use four-way flasher and insufficient tail lamps after Fredonia State Police observed a vehicle pulled over on the shoulder of Route 20 with its left side wheels still partially in the roadway and no hazard lights on. The vehicle also had a large section of red lens missing on the left side.

The operator, Termer appeared impaired and allegedly failed standard field sobriety tests. Termer was taken into custody for DWAI-drugs and transported to the Fredonia barracks for processing.

CHARLOTTE – Justin Schreier, 20, was charged Sunday with unlawful possession of marijuana and speed not reasonable and prudent after Fredonia State Police responded to Rood Road to investigate a one-car personal injury accident. The operator had reportedly moved his vehicle to the right in an attempt to allow an uninvolved vehicle to pass, but lost control due to high speed and exited the roadway, striking a National Grid pole.

The passenger, John Dewey, 19, of Fredonia complained of pain to his right leg and was transported to Brooks Memorial Hospital by the Sinclairville EMS.

The operator, Schreier, sustained minor facial injuries from airbag deployment and signed off on further treatment. A glass pipe containing marijuana residue was allegedly observed on the ground by the vehicle. Schreier admitted ownership of the pipe.

PANAMA – Deputies responded to a personal-injury accident on Kings Corners Road Saturday around 2:30 p.m.

John Gedz, 50, of Sugar Grove, Pennsylvania, was reportedly operating his motorcycle when he attempted to avoid hitting a dog that entered the roadway. Gedz lost control of the motorcycle and was ejected onto the roadway. He reportedly suffered non-life threatening injuries.

The Panama and Clymer fire departments responded and transported Gedz to UPMC Hamot in Erie, Pennsylvania, for treatment.

HANOVER – Stephen Devaul, 28, of Lakeview was charged with driving while intoxicated, DWI per se with a blood alcohol content of .08 percent or higher, refusal of breath test and speed in zone on Sunday.

Around 3:20 a.m., deputies allegedly observed a motorcycle traveling at a high rate of speed on Route 20. A traffic stop was conducted and an investigation revealed the driver, Devaul, was allegedly operating the motorcycle in an intoxicated state.

He was released to a sober party with tickets returnable to Hanover Town Court.

DAYTON – Kevin Pierce, 27, of Route 438, Gowanda was charged with third-degree assault on Wednesday at 8:30 a.m., after an incident that occurred on Monday in the town of Dayton. He was taken to Dayton Town Court for arraignment and remanded to the Cattaraugus County Jail in lieu of $1,000 bail.

In connection with the same incident, on Thursday at 7:50 a.m., Andrew Knopf, 26, of Cabic Road, Dayton was charged with second-degree assault and fourth-degree criminal possession of a weapon. He was transported to Persia Town Court for arraignment and remanded to the county jail in lieu of $2,500 bail.

PERRYSBURG – Jeremiah Bednarek, 33, of Miller Street, Gowanda was charged Wednesday at 2 p.m. on a violation of probation warrant issued from Perrysburg Town Court, after he was arrested by the Hamburg Town Police Department. He was taken to Perrysburg Court for arraignment and sent to the Cattaraugus County Jail in lieu of $3,000 bail.

RIPLEY – Robert F. Young, 47, of Ripley was charged on Thursday with second-degree harassment following an incident that occurred on April 26 where Young allegedly pushed another individual. Young was issued an appearance ticket and will appear at Ripley Town Court at a later date.

SHERMAN – Justin Whitehead, 25, of Sherman was charged with unlawful possession of marijuana, seventh-degree criminal possession of a controlled substance, uninspected motor vehicle and no/inadequate muffler on Thursday.

Around 12:15 a.m., deputies stopped a vehicle on Freeman Road for multiple alleged equipment violations. Upon investigation, the operator, Whitehead, was found in alleged possession of a small amount of marijuana, as well as a controlled substance.

Whitehead was given appearance tickets for Sherman Town Court.

Small fire at NRG power plant

OBSERVER Staff Report

A small fire reportedly broke out in an electrical transformer unit at the NRG Energy Inc. plant in Dunkirk Thursday morning.

The fire was under control by the time city firefighters responded to the call around 11:30 a.m., according to the Dunkirk Fire Department. Crews were on scene at 106 Point Drive N. for roughly half an hour.

The fire began on a breaker panel for a unit that is not in service and current operations were not affected, WDOE News reported.

School bus engine overheats in city

The Dunkirk Fire Department responded to a call about a problem with a school bus at North Martin and Pine streets in the city Thursday afternoon.

The bus’ engine reportedly overheated due to a cooling system failure, according to an official at the fire department. Crews were on scene at about 3 p.m. and were there for about 15 minutes.

No significant damage to the bus was reported.

JAMESTOWN – Sarah M. Stilson, 33, of Jamestown was charged with second-degree criminal use of a public benefit card, misuse of food stamps and petit larceny on Tuesday. Stilson allegedly purchased a benefit card from someone else who was on benefits and used the card for herself. Stilson was released to appear in Jamestown City Court.

Stilson’s charges are part of an ongoing investigation into food stamp trafficking by the sheriff’s office and the DHHS Program Integrity Unit. Instances of suspected welfare fraud may be reported to 1-800-388-5365 or the We Tip hotline at 1-800-782-7463.

HARMONY – Jennifer M. Nagy, 29, of Falconer was charged with unlawful possession of marijuana on Wednesday. Deputies were investigating a suspicious situation on Open Meadows Road shortly before 12:30 a.m. Nagy was found to be allegedly in possession of marijuana. She was released to appear in Harmony Town Court.
