District 7 Case Returning To Court
The Legislative District 7 case will go to the state Court of Appeals in Albany on Wednesday. The four lawyers involved in the case have been allotted 10 minutes each beginning at 2 p.m., according to Chuck DeAngelo, the attorney representing Democratic incumbent candidate Leon Beightol. Though the case is on the court’s agenda, DeAngelo said Monday that there has been no definitive word on whether the entirety of the case will be heard. After being argued in County Supreme Court in December, the case moved to the Supreme Court Appellate Division Fourth Department in Rochester last month. There, the court made four decisions — two of which reversed prior rulings made by County Supreme Court Judge James Dillon. Of the Rochester court’s four rulings, two were unanimously agreed upon by the five presiding justices. The other two rulings featured splits of 4-1 and 3-2.
