Brocton man charged with sexual contact against a child

PORTLAND - A Brocton man was arraigned in Portland Town Court on a class B felony charge of first-degree course of sexual conduct against a child.

Sheriff's deputies arrested Howard J. Sears, 35, of 47 Lake Ave., Brocton following a joint investigation with Child Protection Services.

According to the arrest report, in June of this year, CPS received a report that between December 2006 and May 2007, Sears allegedly had an inappropriate sexual relationship with a female juvenile. CPS forwarded this information to the Sheriff's office and the District Attorney's office. The county's Child Advocacy Program was also used.

Sears was arraigned on the charge before Portland Town Justice Robert Myers and his bail was set at $50,000 cash or $100,000 property bond.

He posted bail and was released.

District attorney David Foley said his office has six months to get Sears indicted and arraigned in county court where he would then face trial.
