BROCTON - As residents in Brocton dust off items suitable for yard sale, the village board reminds them of the local law governing the process to conduct a yard or garage sale.
The local law, established in 1985, is still in effect as Local Law Number 6, in chapter 47 of the Village Code. The law states it was established to "eliminate prolonged, perpetual or extended garage sales in residential zoned areas."
According to the code, the law encompasses any sale type considered to be: "garage sales," "yard sales," "lawn sales," "tag sales," "attic sales," "rummage or flea market sales," or "basement sales" where 10 or more items are for sale secondhand. The village requires an application for a yard sale permit for anyone wishing to hold any such sale, which allows for two sales, two-day sales per 12 months. A yard sale license is still issued at the same fee of $5 for the first two-day sale, and $15 for the second sale.
Mayor Dave Hazelton reiterated the existence of the law during the board's monthly meeting, adding, "I've had a few people from the community bring up this question, and just want to reiterate that we still have this law in effect in the Village of Brocton, which allows for two, two-day sales per a 12-month period. Although it has not been enforced in quite awhile, it is still unlawful to conduct any type of sale within the village without a permit."
Village Clerk Karen Ardillo added there hasn't been a need to enforce the law in recent years, but that her office does maintain permit applications for anyone wishing to hold a sale.
"We're not trying to nickel and dime residents and we're not so much concerned with the fee, as we are with the actual permit process. We're simply trying to keep the village looking nice," added Hazelton.
"The board has reaffirmed that this law is still on the books, and we ask that residents just abide by this law and obtain the proper permit from the Village Clerk's Office."
The law also establishes sale hours to be conducted between 9 a.m. and 6 p.m. and specifies the type of advertising that sale holders are able to utilize.
In other matters, the board approved Mayor Hazelton's signature on an agreement with Municipal Solutions to apply for a Community Development Block Grant for Main Street and Highland Avenue Water Main Replacement project, with the total not to exceed $7,500 including necessary expenses.
Streets Department Head, Tom Allen also reminds drivers in the village of the recently-posted speed limit signs along the little league field, and to use caution traveling down Greenbush Street as increased pedestrian traffic is taking place during the season.
The board of trustees also approved the re-hire of Cody Foy as department of public works summer employee after the review of several applications, and the addition of Tim Tressler Sr. to the fire department roles following an executive session called by Trustee, Nick Rizzo.
An end of the fiscal year meeting of the board has been scheduled for May 31 at 4:30 in order to settle the village's year-end finances, and wrap up any remaining business to come before the board.
