JAMESTOWN - On Wednesday, a Jamestown man was held in the city jail on numerous charges after allegedly failing to stop for a speeding violation and leading officers on a short pursuit through the city.
Around 12:40 a.m. and member of the Jamestown Police Department was on routine patrol and observed a speeding motor vehicle. As the officer attempted to stop the vehicle, the driver of the vehicle allegedly failed to comply and lead the officer on a short pursuit.
The vehicle, driven by Daniel S. Babyak, 39, of Jamestown, allegedly traveled through three stop signs without stopping and then went into a driveway on Fairmount Ave. near Fairview Ave. in Jamestown.
Babyak was found to have an open container of alcohol in the vehicle with him. Babyak was charged with felony driving while intoxicated (DWI), third-degree unlawful fleeing a police officer, reckless driving, 3 counts of passing a stop sign, speeding and open container of alcohol in a motor vehicle and transported to the city jail where he was held pending arraignment.
Around 9:40 a.m., police were called to 739 E. Second St. on a report of a man at the location with a large rifle. Responding officers were able to identify the subject as Deion J. Carr, 27, of Buffalo.
Officers observed a large assault rifle leaning against a wall next to the subject and were able to safely secure the subject and weapon without incident. The weapon was fully loaded and identified as a 7.62 caliber SKS assault rifle with a bayonet attached.
A record check on the subject did show he had absconded from New York State Parole and a parole warrant had been issued for his arrest.
Subject was transported to the city jail and was charged with third-degree criminal possession of a weapon, a class-D felony and false personation in addition to the parole violation.
Investigators believe that the weapon recovered is possibly stolen and are working with agents from the Bureau of Alcohol, Tobacco and Firearms to attempt to locate the origin of the weapon.
