Forestville man allegedly
headbutted victim
FORESTVILLE - On Monday, a Forestville man was jailed on a charge of third-degree assault after allegedly head-butting a victim in his residence.
Around 12;15 a.m., Chautauqua County Sheriff's Deputies responded to a disturbance at 4 Chestnut St. in Forestville. A victim at that residence was found to have injuries as a result of a confrontation with Joshua Stull, 36, of Forestville. It is alleged that during an argument Stull head-butted the victim causing facial injuries.
Stull was arraigned on the charge in the Town of Hanover Court and was committed to Chautauqua County Jail on $1,000 cash/$2,000 property bail.
State Police at Collins
On July 27, troopers charged Michelle Booth, 32, of Meyer Hill Road in East Otto for multiple counts of second-degree identity theft, a felony.
The charges capped a weeklong investigation into a stolen ATM card and 14 unauthorized withdrawals from numerous banks and businesses in the area. The complainant reported to troopers he was told by his bank that two checks he cashed did not clear. A check of his account revealed the unauthorized transactions, totally almost $2,000.
It is alleged that Booth, an acquaintance of the victim, took possession of the card during a visit and made the withdrawals over a two-week period in July. She was processed at state police headquarters in Collins and is due in Erie County Court later this month.
CATTARAUGUS - On July 28, troopers charged Jeffrey Schosek, 29, of State Route 353 with trespass.
Troopers and the Village of Cattaraugus Police Department were sent out to a burglary in progress call at a home on State Route 353.
They interviewed the homeowner and were told that Schosek, a relative, was seen standing by the garage when the motion light turned on. It was reported that Schosek ran off into the woods and emerged a short time later.
He was given an appearance ticket by troopers and is due to appear in New Albion Town Court.
IRVING - On July 30, troopers charged Brian Marrale, 17, of Homewood Avenue in Kenmore with unlawful possession of marijuana after a traffic stop on Routes 5 and 20. Troopers report that he was not wearing a seatbelt.
While speaking with him, the officers smelled marijuana inside the car. They reportedly found 3.5 grams of marijuana and a glass pipe with marijuana in it.
Marrale is due in Hanover Town Court later this month.
Dunkirk Police Department
Luis Vazquez-Ruiz, 47, of East Lake Road was charged with having no registration on Aug. 2.
Justin B. Bess, 22, of Middle Road was charged with a previous charge of resisting arrest on Aug. 2.
Tyrone B. Hoosier, 27, of Robin Street was charged with petit larceny on Aug. 3.
Frank Ameno, 50, of Dunkirk was charged with trespassing on Aug. 4.
Carmen Vazquez-Ruiz, 42, of East Lake Road was charged with having no registration and excessive window tint on Aug. 3.
Edward B. Gagner, 29, of West Fifth Street was charged with speeding and operating out of class on Aug. 5.
Fredonia Police Department
Cecilia Montes, 36, of Dunkirk was charged with having a suspended registration and no insurance on Aug. 3. At 5 p.m. an officer was on routine patrol on Main Street when the license plate reader alerted to Montes' vehicle. Her registration was suspended due to a lapse in insurance. She was released on her own recognizance.
Thomas D. Withington, 62, of Spring Street was charged with driving while intoxicated, operating a motor vehicle with a BAC of .08 or more and failure to use designated lane on Aug. 6. At 12:25 a.m. an officer was on routine patrol when he observed a pickup truck turn on to Hamlet Street from West Main Street, jumping the curb and sidewalk just missing a building. Police then observed Withington almost strike a bicyclist. The operator, Withington, was pulled over on Spring Street was the officer could smell intoxicants as well as bloodshot watery eyes and slurred speech. Withington failed several sobriety tests and his vehicle was towed by Mancuso's Service Center. His BAC was found to be .14. Withington was released on his own recognizance.
Chautauqua County Sheriff's Office
WESTFIELD - On July 31, a Westfield man was charged with several driving while intoxicated (DWI) and other charges, including violation of Leandra's Law, felony DWI, two counts of endangering the welfare of a child, and other charges.
Around 11:47 p.m., a patrolman from the Westfield Police Department was on patrol on East Main Street in the Village of Westfield. the officer observed a vehicle traveling at a high rate of speed for the zone on East Main Street.
Upon stopping the vehicle, it was found to be operated by Anthony F. Price, 43, of Westfield. Upon speaking with Price, officers could smell odor of intoxicants coming from his breath. The officer also observed two young children in the rear seat of the vehicle, without proper restraining devices.
Upon further investigation, Price was allegedly found to be intoxicated and operating the motor vehicle with privileges to operate a vehicle within New York State to be suspended. Price was charged with felony DWI due to a prior DWI within the past ten years; aggravated DWI; felony DWI with child in vehicle (Leandra's Law), due to being arrested with children under 15 years of age in the vehicle; felony first degree aggravated unlicensed operator; two counts of endangering the welfare of a child; unlicensed operator; speed in zone and two tickets for child not in proper restraint device, a total of three felonies, two misdemeanors and four traffic citations.
Price was arraigned in Village of Westfield Court and bail was set at $10,000 cash and $20,000 property. Price will appear in the Village of Westfield Court at a later date.
KIANTONE - On July 30, a Jamestown man was charged with harassment after multiple incidents.
Around 10:30 p.m. on June 1, Chautauqua County Sheriff's patrol took a complaint from a resident on Riverside Road in the Town of Kiantone. The resident was harassed by an unknown male subject who arrived at the residence. The same unknown subject again harassed the complainant on July 27.
On July 30, deputies responded to a report of a suspicious vehicle at a Kiantone Road address. The operator of the vehicle was identified as John W. Genberg, 52, of Jamestown.
Following an investigation, it was determined that Genberg was the individual who allegedly harassed the Riverside Road resident and he was charged with second-degree harassment. He was issued an appearance ticket and will be in Kiantone Town Court later.
MAYVILLE - On Saturday, two Mayville men and one Lakewood man were charged after an alleged fight.
Around 1 a.m., Chautauqua County Sheriff's Office and Chautauqua Institution Police Department responded to Water Street for a reported fight. The initial investigation showed that Rey Vega, 28, of Lakewood, allegedly got into an argument with another individual, punching that person in the face. Vega was issued an appearance ticket for second-degree harassment and will appear in Town of Chautauqua Court at a later date.
While taking the initial complaint, a second fight started at the Lakeview Hotel. As a result, Thomas Gustafson, 50, of Mayville, was charged with disorderly conduct and released on an appearance ticket, also to appear in Town of Chautauqua Court. Darrin Textor, 33, of Mayville, was charged with disorderly conduct, resisting arrest, obstructing governmental administration and criminal tampering.
Textor was arraigned in Chautauqua Town Court and sent to the Chautauqua County Jail in lieu of $1,000 bail.
ALLEGANY - On Aug. 3, a 40-year-old man was arraigned on a charge of third-degree rape after allegedly having sex with 16-year-old in Allegany in 2010.
An investigation performed by the Cattaraugus County Sheriff's Office found the defendant, Timothy R. Retchless, 40, had sexual intercourse with a 16-year-old female. The sexual contact allegedly took place in a vehicle parked in the St. Bonaventure Cemetery in the Town of Allegany during the month of April, 2010.
Justice Porter of the Allegany Town Court released the defendant on his own recognizance, but the recommendation of the District Attorney's Office, to appear in court at a later date.
