SILVER CREEK - After a meeting with the Department of Environmental Conservation and a negotiation between attorneys, an agreement for the consent order came before the Silver Creek Village Board recently.

At the last village board meeting Mayor Kurt Lindstrom insisted the DEC had not determined the village would be fined; however, the matter came before the board at its most recent meeting.

The board was faced with three resolutions related to the repeated sewer violations. First, for the work dates submitted by GHD engineering to the DEC for inflow and infiltration projects as well as an engineering report and work dates from Wendel Energy for wastewater plant upgrades. Also, for a $7,600 fine and signing the consent order.

However, during the workshop the board wanted more time to check the work dates before accepting any of the resolutions.

"I am in no way comfortable with these resolutions," Trustee Amy Romanik said.

The board excluded the fine payment from the abstract of bills to be paid and tabled the resolutions "for clarification."

The board called a special meeting for today at 5:15 p.m. in the village hall to sign the consent order.
