Silver Creek village board agrees to pay $7,000 DEC fine

SILVER CREEK - After some discussion with the Department of Environmental Conservation, the Silver Creek Village Board has agreed to pay a $7,600 fine.

At a recent special meeting three members of the village board assembled to sign the DEC consent order and pay the fine for repeated sewer violations.

The two resolutions were tabled at the board's regular meeting because of questions surrounding work dates for projects to upgrade sewer plant equipment and repair critical sewer lines.

Trustee Amy Romanik explained at the beginning of the meeting these questions were answered after a phone call to DEC Region 9 Attorney Maureen Brady.

"Kurt and I had a phone conference with Maureen from the DEC ... We just wanted to make sure these dates on here were accurate. There was some confusion that we had to have our engineer reports in with the signed consent order, but she assured us that is not the case. We also talked to her about if this spring is not a rainy spring and we cannot do the wet weather testing, would we be able to adjust the dates? She assured us we would be able to do that as well," Romanik reported.

Mayor Kurt Lindstrom said no paperwork needed to be sent with the consent order and the engineer reports are not due into the DEC until February.

"It was my greatest concern that we would be locked into dates, ... so I'm glad you got some kind of guarantee that we have some flexibility. You never know what's going to happen with Western New York weather," Trustee Nick Piccolo added.

The motion to sign the consent order and pay the fine was passed unanimously by the trustees and the mayor.

Lindstrom explained after the meeting the $7,600 fine will be taken from the water fund.

The next village board meeting will be held Tuesday Sept. 4 in observance of Labor Day.
