Dunkirk man charged with driving while ability impaired

Sunday at about 2 a.m., a sheriff's patrol stopped a southbound vehicle on Route 60 in Pomfret for insufficient brake lamps.

The operator was identified as Nicholas T. Bailey, 22, of Dunkirk. Following an investigation, Bailey was charged with driving while ability impaired by drugs. Bailey reportedly had a small quantity of marijuana concealed on his person.

Bailey was taken into custody and charged with DWAI-drugs, unlawful possession of marijuana, and insufficient brake lamps. He was released and is scheduled to appear in Pomfret Town Court at a later date.

FALCONER - On Sept. 7, Patrick Sivec, 26, of Monroe, Mich., was charged with petit larceny in connection with an incident on Gerry-Levant Road.

The complainant said he called 911 when he saw a male rummaging through his vehicle. He identified the male subject down the road from his residence. A trooper reportedly located about $65 in Sivec's possession, cash believed stolen from the complainant's vehicle.

Sivec was processed at state police barracks in Jamestown, arraigned in the Town of Ellicott Court and remanded to the Chautauqua County Jail.

CHARLOTTE - On Sept. 10, Timothy Payne, 26, of Cassadaga was charged with driving while intoxicated. Troopers pulled Payne over on Route 60 for a reported traffic violation. Payne reportedly failed several field sobriety tests and was transported to state police barracks in Jamestown. The breath sample he provided there was reported to be .13 percent.

He was processed, issued tickets returnable to Charlotte Court and released to a sober individual.

KIANTONE - On Tuesday, Kenneth Ruch, 52, of Ashville was charged with driving while intoxicated. Ruch was pulled over at the intersection of Route 60 and Route 62 for a reported traffic violation. He reportedly failed several field sobriety tests and was transported to state police barracks in Jamestown. The breath sample he provided there was reported to be .17 percent.

He was processed, issued tickets returnable to Kian-tone Court, and released to a sober individual.

ELLICOTT - Randall Rothwell, 23, of Mayville was charged Tuesday with unlawful possession of marijuana. Rothwell was stopped on I-86 at Exit 12 for a reported traffic violation.

While speaking to Rothwell, the trooper reportedly smelled marijuana emanating from inside the vehicle. The trooper searched the vehicle and reportedly located a marijuana cigarette.

Rothwell was issued an appearance ticket for the Town of Ellicott Court.

ELLICOTT - On Wednesday, William Haley, 50, of Jamestown was charged with unlawful possession of marijuana. Haley was pulled over for reportedly driving without headlights after midnight.

While speaking to Haley, the trooper reportedly smelled marijuana emanating from inside the vehicle. The trooper searched the vehicle and found a marijuana cigarette in the ashtray.

Haley was issued an appearance ticket and is scheduled to appear in the Town of Ellicott Court at a later date.
