The OBSERVER

NEWSTEAD - Barry Martin, 26, of Gowanda was charged Tuesday with aggravated driving while intoxicated.

State police at Clarence reportedly observed Martin fail to stop the vehicle he was operating at a stop sign at Scotland Road and Bloomingdale Road. He continued into the Town of Alabama where his vehicle went into a ditch.

Martin was processed at state police headquarters in Clarence where the breath sample he took was reported to be .20 percent, more than twice the allowable level of .08 percent. Aggravated driving while intoxicated results from a blood alcohol level of more than .18 percent.

He is scheduled to answer the charge in the Town of Alabama Court later in November.

Two passengers in the vehicle were also charged. Jeremiah Jacobs, 30, of Niagara Falls was charged with false personation for reportedly giving the wrong name to troopers. Codi Sundown, 22, of Alabama was reportedly found to have a third-degree assault warrant out of the Genesee County Sheriff's department. Sundown was turned over to them for arraignment.
