The work has been completed and now it's time for final payment.
That is the notice the city of Dunkirk has received from the company that painted the exterior of the Fourth Ward water storage tank located at the corner of Roberts Road and Benton Street.
Amstar of Western New York was hired under Resolution 51-201 with the Cheektowaga company's bid of $149,900 the lowest according to the resolution. According to the 2010 hiring resolution, Amstar was recommended by Hill Engineering Inc., the city's engineering consultant on the water system repair and upgrade project, and Director of Public Works Tony Gugino.

Amstar has filed a claim with the city for $99,900, which it claims is the balance the city owes for exterior painting work on the water storage tank. The claim is on the Common Council's agenda for today's regular meeting.
According to the claim, by Aug. 31, 2010 Amstar had achieved substantial completion of the project, with only punch list items to be performed pursuant to a final inspection report issued on behalf of the city. The claim states the punch list items were completed and a final bill for $153,300 was issued Oct. 6, 2011.
Amstar had been paid $53,400 prior to the firm notifying Mayor Anthony J. Dolce on June 13 it was requesting payment of the $99,900 it claims it is still owed.
On June 26 the city wrote Amstar and stated the city was asserting a back charge for liquidated damages, but "gave no accounting of said liquidated damages and instructed Amstar to "counter" the city of Dunkirk's claimed back charge, despite offering no accounting of same."
Amstar states it has notified the city the work was done and provided copies of account bills, invoices and back-up documentation but the city has failed to respond. The claim was signed by Amstar vice president John C. Lignos.
The other pre-filed communication from the public came from the Washington Park Action Restoration Committee. PARC is seeking permission to use the perimeter of Washington Park on Dec. 14 from 6 to 9 p.m. for horse and wagon
There are seven pre-filed resolutions on the agenda.
Bids will be awarded for water and wastewater treatment chemicals needs in 2013 under 109-2012. Kemira Water Solutions, Inc. of Lawrence, Ka. will provide poly-aluminum chloride at $990 per dry ton while Amrex Chemical Company, Inc. of Binghamton will provide aqua ammonia solution at 27.5 cents per pound and phosphoric acid at 59 cents per pound.
The city will spend $875 as its part of a study of the possibility and costs of supplying city water along Route 5 eastward to the village of Silver Creek if 110-2012 is approved. The towns of Dunkirk and Sheridan, along with the village of Silver Creek, will each chip in $975 to help fund the $3,900 study being done by the Buffalo firm of Nussbaumer & Clarke, Inc.
A bill from the February 2010 fire that destroyed the Masonic Temple on Central Avenue will be paid under 111-2012. According to the resolution, the city was billed $64,397 for emergency demolition work done by Empire Building Diagnostics, Inc. of Depew that stabilized the building to safely allow firefighters access to extinguish the fire.
After negotiations with the building's owner, Robert K. Lessor of Fairfield, Ct., the city's share will amount to $2,500. The City Code "provides that costs incurred in performance of such emergency work shall be paid by the city, with recovery from the property owner to be undertaken by the city," 111-2012 states.
Council will move its first January meeting from Tuesday, Jan. 1 to Wednesday, Jan. 2 under 112-2012.
Under 113-2012, council will authorize the transfer of $8,222 from the First Ward waterline fund to the Department of Public Works to cover the use of city personnel for certain "clerk of the works" services for the waterline replacement project.
A partnership agreement between the city and Dunkirk City School District for the city's participation in the 21st Century Community Learning Centers Program is covered under 114-2012. The city would receive a grant of $10,000 to participate in the program, which provides outreach to disengaged and disenfranchised youth, according to the resolution.
Resolution 115-2012 would authorize Dolce to execute the necessary paperwork to allow the city to accept and utilize the $1,000 the city received under the Quick Start Arbor Day Grant. The grant will fund the planting of trees in the 100 and 200 blocks of Central Avenue, along with an educational Arbor Day event at Bicentennial Park.
Council will meet at 5:30 p.m. in City Hall.
