The Dunkirk Common Council will consider resolutions allowing the city to go ahead with rebuilding the Lakefront Boulevard seawall when it meets today at 5:30 p.m. in City Hall.
Council tabled two resolutions at its last meeting dealing with the project, and those two, along with two new resolutions, are on the agenda.
Resolution 45-2014 would have accepted the SEQRA determination for the seawall project and 46-2014 would have awarded the construction bid for the project. Both were tabled by unanimous vote.
At today's meeting, 45-2014 will likely not make it off the table, while 46-2014 will come up for a vote. If 46-2014 is finally approved, S. St. George Enterprises Inc. of Fredonia will be awarded the bid for the seawall work with a projected cost of $3,895,000.
The SEQRA determination that is necessary will be covered under 52-2014, which is essentially the same as 45-2014 except for a new paragraph. That wording states the resolution is required "in the processes to have the City comply with applicable federal, state and local laws and regulations regarding environmental matters, including complying with the New York State Environmental Quality Review Act."
The resolution also states the city is issuing a negative declaration, "making no further action under the State Environmental Quality Review Act necessary for this project." Mayor Anthony J. Dolce would be authorized and directed to execute the SEQRA negative declaration document.
Resolution 53-2014 would provide the funding mechanism for the project, naming Treasurer Mark Woods to pursue the necessary bonding, set at $4.2 million, to pay for the project. The bonds would be paid off over a period of years, in excess of five years, according to 53-2014. The payback would come from the General Fund (75 percent) and the Wastewater Treatment Fund (25 percent).
Four council members must approve of the bonding for the resolution to pass.
Council will also consider two other resolutions, including one dealing with the NRG repowering project.
Resolution 54-2014 would authorize grant easements through a city-owned parcel to allow the necessary pipeline needed to provide natural gas for the repowering of the plant. The Dunkirk Gas Corporation, 211 Carnegie Center, Princeton, NJ, NRG's pipeline company, will build the pipeline.
The city's Department of Public Works recommends the approval, according to 54-2014, in order to minimize or avoid any interference with the 2014 reconstruction of Route 5 in the city by the state Department of Transportation. The city will be paid an easement fee.
The final pre-filed resolution, 51-2014, would authorize the transfer of $5,000 from the sewage fees paid by Fund II to a Fund II contracted services line. Unanticipated repairs to equipment depleted the line item, according to 51-2014.
There are eight pre-filed communications, three notices of claim and four loudspeaker applications, all connected to events that council is being asked to allow.
Picnic tables and cans are being sought for use by Dunkirk Little League during the 11-12 year-old-girls state Little League softball tournament July 9-15; the Moniuszko Social Club during its annual stag picnic June 21 and for a June 28 benefit at the Dunkirk VFW, which also includes a loudspeaker application.
Justin Porter is seeking the use of city property, either between the Clarion Hotel and Tim Hortons or in Washington Park on July 4 to host a free music event. Porter also filed a loudspeaker application.
The Iglesias Pentecostal Unidas en Savzidad church is seeking the use of Washington Park and loudspeakers on July 11, 12 and 13 from 6 to 9:30 p.m. for church services.
The Family Church of Fredonia is seeking the use of all or part of the city pier on Aug. 24 beginning at 10:30 a.m., along with a loudspeaker permit from 10 a.m. to 1 p.m., for church services.
Blessed Mary Angela Parish is seeking permission to close Jerboa Street from Lake Shore Drive to the St. Hyacinth auditorium property line on Aug. 10 from 10 a.m. to 6 p.m. for its annual summer festival.
The Chautauqua Center is seeking to block off half the Graf Building parking lot on Aug. 15 from noon to 9 p.m. for its TCC Family Day.
City residents Alexis Brandt, Sandra Brightman and Eddy Vega each filed claims for damages to their vehicles that occurred on city streets.
