LEON – The man whose gun was involved in the accidental shooting of an 8-year-old Amish boy will appear in Leon Court on Tuesday at 7 p.m.

Eli W. Wengerd, 20, of Leon – the older brother of the victim – was charged with fourth-degree criminal possession of a weapon.

On Dec. 12, the 8-year-old victim was shot in the chest while playing with a .22-caliber gun with his brothers.

According to Captain Robert Buchhardt of the Cattaraugus County Sheriff’s Office, the incident occurred at approximately 8:30 a.m. inside the boy’s home, where one of the boy’s brothers allegedly picked up the gun and shot him.

“It appears to be an accident,” Buchhardt said at the time. “They didn’t know the gun was loaded.”

The 8-year-old was transported to Brooks Memorial Hospital in Dunkirk. He is currently in stable condition.

Hanover woman accused of driving drunk during

travel ban

ORCHARD PARK – A Hanover woman is being accused of being drunk while driving during a travel ban on Tuesday.

According to Orchard Park Police, Marilyn Smith, 57, was stopped on Abbott Road at 11:15 p.m. when she told police she was allegedly driving from Buffalo and knew there was a travel ban, but had became lost due to all the roadblocks.

Smith was found allegedly intoxicated during the stop and had a .22 percent blood alcohol content. She was also found to be in possession of an open container and bags of crack cocaine in her pocket.

She is charged with driving while intoxicated, aggravated DWI, a travel ban violation, unlicensed operation, having an open container and criminal possession of a controlled substance.

She was held pending arraignment.

RIPLEY – Dillon J. Ward, 21, of Westfield was taken into custody on Wednesday on a violation of probation warrant.

Ward was removed from the Chautauqua County’s Most Wanted list.
