Lakewood man, 48, accused of large marijuana distribution, arrested on Monday

CELORON – Officers from the Southern Tier Regional Drug Task Force, United States Drug Enforcement Administra-tion and the Ellicott Police Department arrested Jeffrey Boardman, 48, of 288 Southland Ave., Lakewood, on Melvin Avenue in Celoron on Monday.

Boardman was taken into custody without incident on a federal grand jury indictment warrant. Boardman is charged with conspiracy to manufacture 100 or more marijuana plants; conspiracy to possess with intent to distribute a quantity of a mixture containing marijuana; and using and maintaining premises to manufacture, distribute and use marijuana.

Boardman was transported to the United States Courthouse for the Western District of New York in Buffalo, where he initially appeared before the magistrate and was then remanded into federal custody without bail pending further court proceedings.

The charges in this indictment are the result of an investigation concluded in February during which several houses owned and operated by Boardman were searched. Several sophisticated marijuana growing operations were seized, along with a large quantity of marijuana. The case was adopted by the Buffalo office of the DEA and the U.S. Attorney’s Office.

Police investigate fire at Westfield VFW on April 11

WESTFIELD – A fire at the Westfield VFW has caused damaged to exterior picnic tables. Westfield Police responded to the VFW on April 11 just before 10 p.m.

According to police, the department responded to 34 Pearl St., for the report of a pile of leaves had caught fire underneath the pavilion. The fire had been allegedly set by a juvenile throwing a cigarette down.

The investigation is still continuing into this matter.

Another scam in area

A local resident recently received a letter claiming he had won $225,000.

The letter, from Suntrust Financial Services of Astoria, NY, claims the recipient needs to pay for processing fees of $3,425. Included was a check drawn on the General Fund Village of Pilger, NE, for $4,510 to help pay the processing fee. The bank was listed as Midwest Bank of Pierce NE.

A call to the Midwest Bank in Pierce was referred to the bank’s Pilger location, which is leading the investigation from the bank’s end.

“We’ve received numerous calls on this. We’ve contacted our local authorities on this and they in turn have contacted the attorney general, the Post Office, FedEx, UPS, … to make them all aware of it,” a Pilger bank spokesperson said, adding the bank has received letters, checks and envelopes from some of the intended victims.

Person in critical condition after Evans crash

OBSERVER Staff Report

EVANS – An unidentified person was listed in critical condition after a single-car accident at the intersection of Kennedy and Erie roads.

According to the Evans Police Department, at 12:40 p.m., first responders received multiple calls regarding the accident. The vehicle reportedly left Erie Road and struck a telephone pole.

The only person in the vehicle, the driver, was transported to Lake Shore Hospital by Rural/Metro Ambulance. The person was later transferred to the Erie County Medical Center.

Erie Road was closed for approximately two hours while the accident scene was investigated. The accident remains under investigation.

The driver’s name was not released pending notification of the family.

The Lake Erie Beach Volunteer Fire Department also responded to the scene.

RIPLEY – Ruth Wheat, 22, of Dawson Drive, Gowanda, was charged with driving while intoxicated and crossing hazard markings on Saturday.

Around 4:20 p.m., deputies responded to the area of Route 20 for a report of an erratic operator. Deputies located the vehicle and allegedly observed the operator commit a vehicle and traffic violation. The vehicle was subsequently pulled over.

An investigation revealed the driver, Wheat, was reportedly operating her vehicle in an intoxicated state.

She was taken into custody and arraigned in Ripley Town Court. Afterward, she was committed to the Chautauqua County Jail on $1,500 cash bail or $3,000 property bond.

Man fires shotgun, charged in domestic dispute

FRANKLINVILLE – A Cattaraugus County man is facing a number of charges after a domestic dispute last week that included threats with a knife, hammer and firing of a shotgun.

The Cattaraugus County Sheriff’s Department reported this morning that Osmond E. Hernandez, 30, of 4677 Golden Hill Road, Humphrey, has been released on bail after being charged in the domestic incident that allegedly took place around 9:30 p.m. Wednesday at 20 Cherry St. Hernandez was charged with two counts of first-degree reckless endangerment, three counts of endangering the welfare of a child and two counts of second-degree menacing.

Hernandez allegedly threatened an individual with a knife and hammer, and then fired the shotgun in the direction of a vehicle occupied by two individuals.

He was arraigned in the town of Great Valley Court.

Dunkirk Police warning of scam

Dunkirk Police Chief David Ortolano is warning citizens about a scam in the local area. According to Ortolano, a resident received a letter from Publishers Clearing House claiming they had won a $2.6 million prize. The letter then claims the recipient must call a phone number to claim their winnings.

Police have investigated the letter and found it to be a scam. According to Ortolano, PCH will not notify you by mail or phone but show up with the Prize Patrol at your door if you are a winner. Police are advising anyone who receives a letter like this to please throw it away.

“As always I welcome anyone to drop off anything they think is a scam to my office so we can check into it,” Ortolano said.

Thomas Petz, 33, of Cassadaga was charged with criminal obstruction of breathing and third-degree assault on Monday.

Lee Seybold, 52, of Route 20, Silver Creek, was charged with unlawful possession of marijuana and violating a sewer ordinance on Tuesday.

Alexander Kriefall, 19, of Schenectady was charged with driving while intoxicated, violation of a restricted license, failure to obey a traffic control device, suspended registration and no insurance on Thursday.

HANOVER – Ronald Viscuso, 50, of Allegany Road was charged with two counts of first-degree harassment on Thursday. These charges stem from a warrant from Hanover Town Court. Viscuso was taken into custody shortly before 9:30 a.m., and arraigned in Hanover Town Court. He was sent to the Chautauqua County Jail in lieu of bail.

A 17-year-old male was charged with petit larceny on Friday. The charges stem from an outstanding probation warrant. The male was taken into custody at 10:17 a.m., when deputies conducted a warrant check at the youth’s residence on Route 60 in the town of Pomfret. He was sent to the Chautauqua County Jail.

Sherman man charged with stealing scrap

SHERMAN – Daryl Freeman, 44, of Sherman was taken into custody Sunday by State Police in Jamestown after an investigation into a report of trespassing and stealing scrap metal.

Freeman was found to be in possession of the stolen scrap metal and was transported to the Jamestown barracks for processing.

He was issued appearance tickets for fifth-degree criminal possession of stolen property and trespass to the Sherman Town Court and released.

Derby man charged with DWI, causing accident

LEWISTON – Timothy J. Cooper, 59, of Derby, was charged Wednesday with misdemeanor driving while intoxicated.

Niagara Falls State Police patrols received a report from the Niagara County Sheriff’s Dispatch of a two-car accident on the Robert Moses Parkway. Patrols responded and found one vehicle on its side. The operator was transported by Rural Metro Ambulance to Erie County Medical Center for non-life threatening injuries, treated and later released.

The second vehicle operated by Cooper was located north of the accident scene.

Cooper was transported to the Niagara Falls barracks where he refused to submit to further breath testing. He was issued traffic citations, released and is scheduled to appear in Lewiston Town Court at a later date.

Farhan Shaikh, 32, of East Courtney Street Upper was charged with second-degree menacing and second-degree harassment on April 16.

Jose Hernandez, 29, of Ruggles Street was charged with failure to register as a sex offender on April 17.

Robert Morse Sr., 71, of Ruggles Street was charged with passing a red light after an accident at Lake Shore Drive East and Main Street on April 17.

Carmen Rodriguez, 33, of Maple Avenue was charged with second-degree harassment on April 18.

Deon Stanford, 21, of Swan Street was charged with unlawful possession of marijuana and operating a motor vehicle while on a mobile device on April 18.

Richard Olson, 32, of Buffalo was charged with third-degree assault and criminal obstruction of breathing on April 19.

Steven Rivera, 36, of Swan Street was charged with forcible touching and endangering the welfare of a child on Monday.

Traiquane Nance, 24, of Plover Street was charged with three counts of second-degree obstruction of governmental administration, resisting arrest, third-degree aggravated unlicensed operation and no insurance on Wednesday.

Maria Concepcion, 31, of Grant Avenue was charged with criminal trespass on Thursday.

Ramon Rosa-Quentana, 33, of Grant Avenue was charged with third-degree assault on Thursday.

Four people were charged with violating a noise ordinance on April 14, including Jabari Noel, 19, of SUNY Fredonia’s Disney Hall, Zachary Jones, 19, of Schulz Hall, Jacob McCoy, 21, of Brigham Road, and Joel Vandick, 22, of Central Avenue.

Jennifer Sheffield, 23, of West Lake Road, Dunkirk, was charged with petit larceny on Monday.

BEMUS POINT – William J. Bean, 30, of Bemus Point was wanted by the sheriff’s office for third-degree felony burglary. Bean’s warrants were canceled due to being recalled by the court. Bean was removed from the county’s most wanted list.

CHAUTAUQUA – Raymond A. Gates, 28, of Potter Road was charged with being a fugitive from justice on Wednesday. Gates was taken into custody at his residence at 8:09 p.m. He was wanted out of Erie County, Pa., for a probation violation. Gates was sent to the Chautauqua County Jail pending extradition to Pennsylvania.

  • ELLICOTT – David W. Swanson, 47, of Jamestown, was charged with driving while intoxicated after a traffic stop on Route 60 for failing to dim his headlights.

Swanson was transported to the Jamestown State Police barracks where a blood alcohol content of .09 percent was obtained.

Swanson was issued an appearance ticket to Ellicott Town Court and released to a third party.

driving on closed road

HANOVER – Two Buffalo residents have been charged after allegedly driving down a closed road.

According to the Chau-tauqua County Sheriff’s Office, deputies observed Ronald A. Shane, 46, exit a vehicle and remove two road closed barriers that were placed on Hanover Road. The road has been closed due to a large sinkhole. The driver of the vehicle, Susan R. Clarke, 43, then allegedly drove her vehicle through the section of roadway that was closed.

Shane was charged with second-degree criminal nuisance for removing the barricades and Clarke was charged with disobeying a traffic control device. Both were released to appear in Hanover Town Court.

  • JAMESTOWN – On Sunday, New York State Police arrested Mark W. Frankson, 46, of Jamestown after a traffic stop on East Second Street.

Troopers observed Frankson driving his motorcycle with no hands and swerving on the roadway.

Frankson was placed under arrest for driving while intoxicated and transported to Jamestown State Police for processing where a blood alcohol level of .16 percent was obtained.

Due to previous convictions and a revoked license, he was charged with felony driving while intoxicated, felony first-degree aggravated unlicensed operation, misdemeanor operating out of the interlock restriction and the violation of operating with hands not on the handlebars.

  • ELLICOTT – On Sunday, New York State Police arrested William R. Swanson, 58, of Kennedy for felony driving while intoxicated and menacing a police officer.

Troopers tried to interview Swanson relative to a complaint of a man driving on Poland Center Road and yelling at residents.

Swanson was located at his residence where he menaced a trooper with a billy club upon answering the door. Swanson was taken into custody and transported to Jamestown State Police where he was processed with a blood alcohol level of .26 percent.

He was charged with felony menacing a police officer, felony driving while intoxicated, fourth-degree criminal possession of a weapon and disorderly conduct. He was arraigned in the town of Ellicott Court and committed to Chautauqua County Jail.

POLAND – Amanda Costanzo, 19, of Jamestown was charged with third-degree assault on Sunday. Deputies took a report of an alleged incident that occurred on Doloff Road around 1 a.m. An investigation led to the charges against Costanzo.

Fatal motorcycle

accident in East Otto

EAST OTTO – A Colden man has died in a single motorcycle accident Monday. Paul Raymond Maddex, 79, died around 5:30 p.m., according to police.

Cattaraugus County Sheriff deputies responded to the report of an accident on Connoisarally Road. According to police, Maddex was traveling south west when his motorcycle left the road and came to rest in a ditch.

Maddex was found in the ditch unresponsive and not breathing. CPR was performed and he was transported to Bertrand Chaffee Hospital in Springville where he was later pronounced dead.

East Otto Ambulance and Rural Metro Ambulance also responded to the scene.

Westfield Police Department

A 17-year-old male was charged with unlawful possession of marijuana on Monday. Police responded to a village residence for the report of an alleged smell of marijuana at 8 p.m. The male was found to be allegedly in possession of marijuana inside the residence. He was released to appear in Westfield Village Court at a later date. Police did not release the male’s name.

Dunkirk Police are continuing an investigation into Sunday morning’s shooting on East Fourth Street in the city that left one person injured.

According to Police Chief David Ortolano on Monday, detectives are still working on the case, which is ongoing. No new information could be released.

A media release stated that around 3:11 a.m., officers were dispatched to Brooks Memorial Hospital’s emergency room for a report of a male gunshot victim. The victim was subsequently transported to the Erie County Medical Center for further treatment.

His condition remains unknown at this time.

SILVER CREEK – Jesse S. Nahrebeski, 19, of Lafayette Street was charged with third-degree aggravated unlicensed operation and unlawful possession of marijuana on Saturday.

Deputies witnessed Nahrebeski traveling on Parkway Street around 7 p.m., and his driving privileges had been allegedly suspended.

During the traffic stop, Nahrebeski was found to be in alleged possession of a quantity of marijuana.

He was released on appearance tickets for Silver Creek Village Court.

MINA – Amanda K. Messina, 29, of Jamestown was charged with driving while intoxicated and driving the wrong direction on a one way street on Sunday.

At 4:30 a.m., deputies received a report of a vehicle traveling the wrong way on I-86.

Deputies located Messina’s vehicle who was allegedly traveling west in the eastbound lane. Messina was also found to be allegedly intoxicated during the traffic stop.

She was released to appear in Mina Town Court at a later date.

WESTFIELD – Carlos Figueroa, 38, of Route 20 was charged with second-degree criminal contempt, third-degree criminal tampering and second-degree harassment on Sunday.

At 10:30 a.m., deputies were called for a harassment complaint that had already occurred in the town of Westfield.

It is alleged Figueroa struck an individual during a verbal altercation.

There was also an order of protection between Figueroa and the victim.

A warrant was issued and Figueroa was taken into custody without incident. He was arraigned in Westfield Town Court and sent to the Chautauqua County Jail in lieu of bail.

FRENCH CREEK – Levi J. Chaffee, 24, of Union City, Pa., was charged with driving while intoxicated, aggravated DWI, failure to dim highbeams, failure to stop at a stop sign and failure to keep right on Sunday.

At 2:30 a.m., deputies stopped Chaffee’s vehicle on Conway Road for alleged traffic violations.

During the stop, Chaffee was found to be allegedly intoxicated.

He was released to appear in French Creek Town Court at a later date.

A 17-year-old female was charged with violation of the curfew law on April 13.

Just before 12 a.m., police investigated an incident on East Main Street. During this investigation, the female was found in alleged violation of the village’s curfew. Her name was not released by police.

The female was released to appear in Westfield Village Court at a later date.

Joshua R. Morton, 20, of North East, Pa., was charged with disorderly conduct on April 14. At 9:35 p.m., Morton was allegedly making unreasonable noise along East Main Street.

He was allegedly operating his truck in a manner causing disturbance.

Morton was released to appear in Westfield Village Court at a later date.

Jennifer L. McArthur, 24, of Mayville was charged with having no or inadequate stop lamps and unlawful possession of marijuana on April 15.

Police stopped McArthur’s vehicle on Jefferson Street just before 9:30 p.m., for an alleged equipment violation.

During the traffic stop, McArthur and her passenger, John P. Houser, 25, of East Main Street were both allegedly found to be in possession of marijuana.

Houser was also found to be allegedly in possession of narcotic pain killers which he did not have a prescription for.

Houser was charged with unlawful possession of marijuana and seventh-degree criminal possession of a controlled substance.

Both Houser and McArthur were released to appear in Westfield Village Court.

LAWTONS – Jose Cruz, 54, of Seneca Road was charged with driving while intoxicated on April 12. Cruz was allegedly driving erratically in the village of Gowanda, where Gowanda Police stopped him in Lawtons. Troopers and Erie County Sheriff’s deputies then responded, where Cruz was found to be allegedly intoxicated. He was processed at the Collins barracks and found to have a reportable blood alcohol content of .14 percent. He was released to appear in North Collins Town Court at a later date.

GOWANDA – Kaleb Mason, 25, of Collins was charged with unlawful possession of marijuana and having an open container on April 13. Troopers stopped a vehicle on Broadway Road for an inadequate exhaust. Mason, a passenger in this vehicle, was found to be in alleged possession of a pipe containing marijuana. He was also allegedly found to be in possession of an open container. He was released to appear in Persia Town Court at a later date.

COLLINS – James Luder, 43, of Collins Center was charged with driving while intoxicated on Tuesday. Police stopped Luder on Taylor Hollow Road and South Road for allegedly having no tail lights. He was found to be allegedly intoxicated during the stop. He was processed at the Collins barracks and found to have a reportable .14 percent blood alcohol content. Luder will appear in Collins Town Court at a later date.

COLLINS CENTER – Joseph Kruszka, 49, of Main Street was charged for felony driving while intoxicated on Wednesday. Police responded to the scene where a witness saw a truck spin out and travel into a ditch. The driver, Kruszka allegedly left the scene on foot, but was located walking on Main Street. Kruszka was found to be allegedly intoxicated. He was processed at the Collins barracks where he refused a breath test. A prior DWI conviction in the past 10 years made this charge a felony. He was arraigned in Collins Town Court and sent to the Erie County Holding Center on $5,000 bail. The Erie County Sheriff’s Office also responded.

SHERIDAN – Lee W. Seybold, 52, of Route 20 was charged with unlawful possession of marijuana on Saturday. At 2:07 a.m., deputies were called to Seybold’s residence for the report of an unwanted person. Deputies observed a leafy green substance in the residence which allegedly belonged to Seybold. He was released to appear in Sheridan Town Court at a later date.

BROCTON – Byron P. Lawton, 40, of Webster Road was charged with a probation warrant on Saturday. Deputies, along with K9 Drago, took Lawton into custody at his residence. He had an outstanding probation warrant for second-degree criminal sexual act. Lawton was taken to the Chautauqua County Jail and held without bail.

JAMESTOWN – James M. Harrier Jr., 51, of Jamestown was charged Saturday with driving while intoxicated, aggravated DWI per se with a blood alcohol content of .18 percent or higher and moving from lane unsafely after a traffic stop on Jones and Gifford streets around 9 p.m. It is alleged Harrier was intoxicated and he was taken into custody. He was released with appearance tickets for Jamestown City Court.

Man asleep behind wheel leads to charges

BRANT – New York State Police have charged an Angola man with felony driving while intoxicated after he was allegedly found asleep behind the wheel on Tuesday.

Daniel Chowaniec, 46, was found in his vehicle allegedly slumped over the steering wheel asleep by police in the Evangola State Park. When Chowaniec was woken up, he had an alleged strong odor of alcohol on his breath. According to police, Chowaniec had turned down a road in the park and was forced to stop at a fence. While attempting to back down the road to leave, he allegedly ran off the road and hit another fence.

Chowaniec was processed at the Collins barracks where he allegedly refused a breath test. A computer check found he had a prior DWI conviction within the past 10 years making this arrest a felony. He was arraigned in Collins Town Court and sent to the Erie County Holding Center in lieu of $5,000 cash bail.

Reservation crash leads to charges

IRVING – A property damage accident has led to driving while intoxicated charges on Friday. The Erie County Sheriff’s Office responded to the report of an accident with a parked car at 12:30 a.m.

Cyle J. Sundown, 20, of Basom was allegedly traveling on Longhouse Road on the Seneca Nation of Indians Reservation when he struck a parked vehicle. Sundown was not injured in the crash but was found to be allegedly intoxicated. He was charged with DWI and other traffic violations. A chemical breath test revealed Sundown’s blood alcohol content was .16 percent, twice the legal limit.

Sundown’s vehicle was towed from the scene and he was released to family members. He will appear in North Collins Town Court at a later date.

HANOVER – On Thursday at approximately 10:55 p.m. deputies responded to a report of a female passed out on the side of the roadway.

The female identified herself as Candi L. Radowsky, 43, of Silver Creek. Radowsky was found to be in possession of a dagger-style knuckle knife and was charged with fourth- degree criminal possession of a weapon.

Radowsky was taken into custody and later released with appearance tickets to appear in the Hanover Town Court at a later date.

NORTH HARMONY – On Thursday at about 8:15 p.m. deputies apprehended Andrew J. Sheldon, 27, of Ashville on a bench warrant out of the Town of North Harmony for failing to appear on a charge of petit larceny.

He was arraigned in the Town of Sherman Court and released to appear back in North Harmony Town Court at a later date.

MAYVILLE – On Thursday at about 9 p.m. deputies apprehended David M. Douglas, 34, of Mayville on a second-degree assault warrant. Douglas was wanted in the Town of Chautauqua for second-degree assault.

He was arraigned and remanded to Chautauqua County Jail on $3,000 cash bail or $6,000 property bail.

Dunkirk man allegedly sold drugs in city

A Dunkirk man turned himself into police Thursday on an arrest warrant following an investigation into narcotic sales in the city of Dunkirk. Nicholas E. Moore, 24, of Brigham Road is charged with third-degree criminal possession of a controlled substance and third-degree criminal sale of a controlled substance.

According to the Southern Tier Regional Drug Task Force, Moore turned himself into Dunkirk Police at 11:30 a.m., on a warrant from Dunkirk City Court Judge Walter Drag. It is alleged Moore sold quantities of opiate-based narcotic substances to agents of the task force. Moore was arraigned in Dunkirk City Court and sent to the Chautauqua County Jail pending further court action.

This arrest culminates a three-month investigation, and was the result of information supplied by members of the community after observing traffic consistent with narcotics trafficking in their neighborhood. Police continue to ask members to report drug-related activity in their area. Residents may call the STRDTF at 1-800-344-8702 or Dunkirk Police at 363-0313.

The Cattaraugus County Sheriff’s Office is warning residents about a phone scam. Police received a complaint from a citizen who was scammed into giving his credit card information over the phone to settle an unpaid debt. The caller stated a company called ACE claimed money was owed regarding a past bill for some tools purchased. This caller also posed as a member of the Cattaraugus County Sheriff’s Office who told the victim failure to comply could result in his arrest. The caller ID showed up on the victim’s phone as 938-9191, the actual number to the sheriff’s office. This can be done through a computer program to disguise the caller’s actual number.

It is not the practice of the sheriff’s office to place calls to residents to collect a debt. Citizens are warned to not give out any personal bank account information or credit card information to any companies soliciting business over the phone unless you are personally aware of them being legitimate. A 1-800 phone number was given to the victim to verify the account information which turned out to be a false number.

Sexual abuse charges dropped against former Randolph bus driver

MAYVILLE – The Randolph school bus driver accused of inappropriate relations with a juvenile male last year had every sexual abuse charge against him dropped Wednesday, but pleaded guilty to endangering the welfare of a child.

According to David Foley, Chautauqua County District Attorney, the seven counts of first-degree sexual abuse against 67-year-old John O. Hitchcock were dropped as a result of a plea agreement between the District Attorney’s Office and the juvenile’s family and attorney.

“I would like to thank my family and the Randolph community for supporting us during this time,” said Nicole Smallback, daughter of John Hitchcock, on Wednesday.

The agreement included Hitchcock pleading guilty to endangering the welfare of a child.

“The guilty plea ensured that the very young victim would be spared the trauma of testifying in court, and held the defendant accountable,” Foley said. “We had several meetings with the family on this case and we all agreed that this plea was in the best interest of the child.”

Hitchcock is expected to receive three years of probation for the charge, Foley said.

Sentencing is scheduled for July 14.

Hitchcock, who had been held in Chautauqua County Jail since his arrest on March 8, 2013, was accused of sexually abusing a 6-year-old male from September to October 2012 between Randolph and Ashville.

Hitchcock was picked up without incident on an arrest warrant after an indictment was received.

He pleaded innocent to the charges on March 11, 2013.

Jamestown man charged in drug bust

JAMESTOWN – A Jamestown man turned himself into police after officers previously raided his home and allegedly found drugs.

According to the Jamestown Police Depart-ment, Cesar Soto, 36, was not at home when Jamestown Police, the New York State Police and the Department of Homeland Security raided his home on April 2 and allegedly found a quantity of heroin, packaging material, prescription medication and stolen property.

Soto is currently being held in the Jamestown city jail and is awaiting arraignment on charges of felony third-degree criminal possession of a controlled substance and seventh-degree criminal possession of a controlled substance.

Anyone who has information on the illegal sales and trafficking of narcotics in the Jamestown area is asked to call the Jamestown Police Department’s anonymous tip line at 483-TIPS. All calls will be kept confidential.

Brocton man, 50, charged after allegedly forcibly touching female

BROCTON – A Brocton man has been charged with allegedly forcibly touching a female.

Chautauqua County Sheriff’s Deputies responded to a call of a disorderly male at an Old Mill Road Saturday at 1:38 a.m. Deputies were informed James D. Seavy Jr., 50, was allegedly highly intoxicated and threatening several subjects at the residence and refusing to leave. Seavy also allegedly verbally harassed and inappropriately touched a female at the residence.

Seavy was located by police apparently unconscious in the yard of a residence on Main Street. He was treated by Brocton Fire Department and transported to Westfield Memorial Hospital.

He was charged with second-degree harassment and forcible touching. He was released to appear in Brocton Village Court at a later date.

JAMESTOWN – On April 10, Jamestown State Troopers stopped Megan E. Ludwiczak, 25, of Jamestown for failure to keep right on Park Street.

Ludwiczak was placed under arrest for driving while intoxicated and transported to Jamestown State Police where a blood alcohol level of .25 percent was obtained.

She was issued tickets for driving while intoxicated and unlawful possession of marijuana returnable to the City of Jamestown Court and released to a third party.

CHERRY CREEK – On Sunday, New York State Troopers stopped a driver for littering on Route 83.

Tina M. Fritz, 47, of Forestville was charged with driving while intoxicated.

Fritz was transported to Jamestown State Police for processing where a blood alcohol level of .10 percent was obtained.

Fritz was issued tickets for driving while intoxicated, uninspected vehicle and littering, and is to appear in the Town of Cherry Creek Court.

She was released to a third party.

Calvin Kinsey, 25, of East Second Street was charged on a warrant with fifth-degree criminal possession of a controlled substance on March 27.

Marcus Singh, 22, of Route 60, Fredonia, was charged with driving while intoxicated, unlicensed operation, failure to use designated lane and driving on a sidewalk on March 29.

Gregory Faso, 38, of Liberty Street, Fredonia, was charged with driving while ability impaired by drugs, no seatbelt, following too closely, no insurance and driving through a red light on March 29. He was also charged with driving while ability impaired on April 11.

Luis Morales, 21, of Swan Street was charged with second-degree harassment on April 1.

Jason Tolbert, 30, of Central Avenue was charged with aggravated harassment on April 3.

Alissa Smith, 23, of Route 5 was charged with criminal tampering and criminal contempt on April 3.

City man facing cocaine charges

A Dunkirk man has been charged with selling cocaine in the city.

According to the Chau-tauqua County Sheriff’s Department, Bobby Allen, 34, of 14 Genet St. was taken into custody Friday on an outstanding grand jury indictment warrant. A warrant had been issued for his arrest following a secret grand jury by the District Attorney’s Office.

An investigation conducted by the Southern Tier Regional Drug Task Force alleges Allen sold quantities of cocaine to task force agents on numerous occasions from his residence.

Allen was charged with third-degree criminal possession of a controlled substance and third-degree criminal sale of a controlled substance.

SILVER CREEK – Aaron L. Green, 29, of Silver Creek was charged with second-degree aggravated unlicensed operation and having an inadequate muffler on Monday. At 12 a.m., deputies stopped a motor vehicle on Central Avenue for an alleged loud exhaust system. Green was found to allegedly have his driving privileges revoked. Green was released on appearance tickets.

HARMONY – Chris-tina S. Blair, 31, of Ashville was charged with driving while intoxicated and speeding Monday. At 6 a.m., deputies stopped a vehicle for allegedly speeding on Blockville-Watts Flats Road. Blair was allegedly found to be intoxicated. She was released to appear in Harmony Town court.

FREWSBURG – Amy Schulz, 46, of Frewsburg was charged with aggravated driving while intoxicated, leaving the scene of a property damage accident, failure to yield the right of way and failure to notify the Department of Motor Vehicles of a change of address on Saturday.

Around 1:35 p.m., deputies were called to the scene of a property damage automobile crash at the intersection of Ivory Street and Falconer Street. One of the motorists involved in the crash reportedly fled the scene before responding deputies arrived.

With help from the public, the vehicle and alleged operator, Schulz, were located at her residence a short time later.

Further investigation led to Schulz being arrested. A New York state license check revealed she had a prior conviction for DWI in 2007, thus making this arrest a felony. In addition, Schulz’s blood alcohol content was allegedly .24 percent.

No one was injured as a result of the accident.

HANOVER – David Schenk, 43, of Erie Road, Irving, was charged with aggravated driving while intoxicated with a blood alcohol content above .18 percent and move from lane unsafely Saturday.

Around 11 p.m., deputies reportedly observed a vehicle eastbound on Route 5 and 20 commit a traffic violation. Deputies stopped the vehicle and upon further investigation, it was found Schenk was allegedly operating the vehicle while intoxicated.

He will appear in Hanover Town Court.

MAYVILLE – Nicholas Coletta, 33, of Harborcreek, Pa., was charged with driving while intoxicated and failure to keep right Sunday.

Around 1 a.m., deputies stopped a vehicle on North Erie Street in the village of Mayville. An investigation reportedly revealed the driver, Coletta, was intoxicated.

He will appear in Chautauqua Town Court later this month.

SILVER CREEK – A 17-year-old male youth from Angola was charged Wednesday with breach of peace, second-degree obstructing governmental administration and resisting arrest after deputies allegedly observed two males making a disturbance on Hanover Street. Deputies allegedly approached the two males and one ran while he was being placed into custody. The youth was arraigned in Silver Creek Village Court and sent to the Chautauqua County Jail. The other suspect was released with an appearance ticket for breach of peace.

BROCTON – Mathew Mulville, 24, of Brocton, was charged Friday with fourth-degree criminal mischief after a report of a rock thrown through an apartment window on Main Street. Investigation into the incident led to Mulville being taken into custody. He was issued an appearance ticket and released to appear in Brocton Village Court at a later date.

JAMESTOWN – Alexandrea E. Emerling, 27, of Jamestown, was charged Friday with unlawful possession of marijuana and inadequate headlamps after a traffic stop on Foote Avenue. Emerling was stopped for allegedly having less than two working headlights and after an interview allegedly surrendered a glass pipe and small baggie of marijuana. She was issued appearance tickets and released to appear in Jamestown City Court at a later date.

DeMario A. Hough, 27, of Dunkirk was charged with driving while intoxicated, having an inadequate muffler and having an unregistered vehicle on Sunday. Deputies stopped Hough’s vehicle on Route 60 in the town of Dunkirk after observing a vehicle apparently dragging its muffler creating sparks around 2:45 a.m. Hough was found to be allegedly intoxicated and to have an unregistered vehicle. He was released to appear in Dunkirk Town Court at a later date.

HANOVER – John H. Stoll III, 24, of Collins was charged with second-degree criminal contempt and speeding on Monday. Deputies stopped Stoll’s vehicle for allegedly speeding at the intersection of Hanover and King roads at 6:18 a.m. Stoll was allegedly in violation of an order of protection issued for him to stay away from four of the passengers in his vehicle. He was arraigned in Hanover Town Court and released to appear in court at a later date.

Student approached by suspicious vehicle in Silver Creek

SILVER CREEK – The Silver Creek Central School District sent out an alert to parents this afternoon about a 13-year-old female student being approached by a suspicious vehicle on Bennett State Road.

According to Superinten-dent Daniel Ljiljanich, the school received the report from the student’s parent that a man in a suspicious vehicle approached the student to ask if she needed a ride. An automated alert was sent out to parents warning of the event.

According to the Chau-tauqua County Sheriff’s Office the man was 50 to 60 years old with white hair and a mustache and wearing glasses with a medium build. He was reported to be driving a green SUV Jeep-type vehicle.

The student did not get in the vehicle and the man drove away. Deputies arrived on the scene shortly after but did not locate the vehicle.

The public is asked to contact the sheriff’s at 753-2131 if they see a person by this description.

Correctional officer attacked at Gowanda Correctional Facility

GOWANDA – A correctional officer suffered injury in an inmate attack. The attack occurred on April 3 during an inmate transfer, according to a press release from the New York State Correctional Officers and Police Benevolent Associa-tion Inc.

According to the release, inmate Michael Ayers, 33, was being processed by an officer for a transfer out of Gowanda. During an inmate search prior to the transfer shortly before 9 a.m., Ayers allegedly punched the officer in the right side of his face. Two other officers and a sergeant came to assist the officer and used body holds to get the inmate under control and into restraints.

The officer complained of dizziness, head, knee and arm pain. He also vomited after the incident as a result of sustaining a concussion. He was taken to Lake Shore Hospital in Irving for treatment.

Ayers is currently serving seven years after being convicted of second-degree burglary in Kings County last year. Following the incident, he was transferred to the Collins Correctional Facility and placed in a special housing unit.

The attack at Gowanda is one of four incidents that occurred last week in separate incidents. The other three attacks were reported at Wende Correctional Facility in Erie County. Statewide, the number of violent felony offenders has increased as well. In 2013, 82 percent of inmates in maximum security facilities were violent felony offenders, compared to 77 percent in 2008. For medium security facilities, 57 percent of inmates were violent felony offenders, compared to 51 percent in 2008.

“Correction officers put their safety on the line every day to protect the public and the people they serve, and these assaults are another reminder that even routine procedures can spiral out of control when inmates become violent. As the officers recover from injuries sustained in these attacks, NYSCOPBA will continue to monitor the situation to ensure that the violence at these two facilities are contained,” Mike Dildine, NYSCOPBA western New York regional vice president, said.

JAMESTOWN – On Wednesday, New York State Troopers arrested David P. Gendron, 42, of Jamestown charging him with felony driving while intoxicated after he ran a red light on Second Street in the City of Jamestown.

Gendron was transported to Jamestown State Police for processing where a blood alcohol level of .08 percent was obtained.

Gendron was issued tickets returnable to the City of Jamestown Court and released to a third party.

MAYVILLE – On April 5, New York State Police checked a residence on State Route 430 in Mayville for a subject wanted on a warrant and arrested the residents for drug possession, growing marijuana and criminal possession of a weapon.

Martin L. Wenzel, 27, of Mayville and Kyle C. Langer, 24, of Mayville were both charged with unlawful growing of marijuana, fifth-degree criminal possession of marijuana and fourth-degree criminal possession of a weapon.

Wenzel was additionally charged with seventh-degree criminal possession of a controlled substance.

A third man Dustin D. Taves, 25, of Sherman was charged with unlawful possession of marijuana.

All three subjects are to appear in the Town of Chautauqua Court.

SINCLAIRVILLE – On Tuesday at about 7:40 p.m., Fredonia Troopers arrested Jessica L. Langworthy, 25, of Sinclairville for driving with a suspended license and possession of marijuana, following a traffic stop on Route 60 in the town of Pomfret.

Charges are to be answered in the Town of Pomfret Court on April 29.

On Wednesday, Fredonia State Police stopped a vehicle on State Route 20 in the town of Pomfret for having no front plate.

Michael Murphy, 34, of Lakeview was arrested for seventh-degree criminal possession of a controlled substance and having a controlled substance in non-original container.

Murphy was issued appearance tickets returnable to the Town of Pomfret Court on April 15.

Law enforcement to conduct cell phone and texting while driving crackdown April 10-15

Governor Andrew M. Cuomo announced that State Police and local law enforcement are stepping up patrols and checkpoints throughout the state from April 10-15 as part of “Operation Hang Up,” which encourages drivers to focus on the road instead of using mobile devices. This effort combines periods of intense enforcement of anti-texting and hand held cell phone laws coupled with advertising and media outreach to let people know about the enforcement and convince them to obey the law.

According to the National Highway Traffic Safety Administration, in 2012, 3,328 people across the country were killed in crashes involving a distracted driver and an estimated 421,000 were injured in motor vehicle crashes involving a distracted driver. Additionally, 10 percent of fatal crashes were reported as distraction-affected crashes.

Current laws include strict penalties for distracted drivers:

For a first offense, the minimum fine is $50 and maximum fine increases to $150.

For a second offense committed within 18 months, the minimum fine is $50 and the maximum fine increases to $200.

For a third or subsequent offense committed within 18 months, the minimum fine is $50 and the maximum fine increases to $400.

Beginning on Nov. 1, new laws take effect for young drivers:

Young and new drivers convicted of texting-while-driving will have their license suspended for 120 days on the first offense.

For second offense, young and new drivers will have their license suspended for one full year.

Governor Cuomo also di-rected the state Department of Motor Vehicles to implement tougher penalties for distracted driving for all drivers. DMV has increased the number of points earned against an individual’s driving record upon conviction for texting-while-driving and cell-phone related infractions from three points to five points.

Troopers will be using both marked State Police vehicles and Concealed Identity Traffic Enforce-ment vehicles as part of the operation in order to more easily identify motorists who are using handheld devices while driving.

Brocton pair burglarize business

BROCTON – A pair of Brocton residents allegedly burglarized a business in the village of Brocton. According to the Chautauqua County Sheriff’s Office, deputies were dispatched to the St. Stephen’s Hotel, 2 W. Main St., on Saturday for the report of a burglary that occurred overnight.

Investigation revealed Ricky J. Grant, 20, and Adam Neubauer, 24, both of 7 W. Main St., allegedly were involved in the incident. Both men were charged with third-degree burglary, fourth-degree criminal mischief and petit larceny. Arrest warrants were obtained for both men. Neubauer was arraigned in Brocton Village Court on Tuesday and sent to the Chautauqua County Jail in lieu of $15,000 cash or $30,000 property bail. Grant was already being held in the county jail on unrelated charges from New York State Police. All stolen items have been recovered.

On Sunday Fredonia State Troopers stopped a vehicle on State Route 5, in the Town of Dunkirk for having a headlight out.

Dierra Leber, 17, of Dunkirk was arrested for unlawful possession of marijuana and issued an appearance ticket returnable to the Town of Dunkirk Court on April 28.

PORTLAND – On Saturday, Fredonia State Troopers arrested Ricky Grant, 20, of Dunkirk for two counts of felony third-degree criminal mischief.

Fredonia Troopers had received a report of criminal mischief to a store front window on Main Street in the Village of Brocton.

Investigation revealed a second window was also broken nearby.

Value of the two windows was $2,000.

Grant was arraigned at the Town of Portland Court and remanded to Chautau-qua County Jail with no bail.

CHERRY CREEK – Fredonia State Troopers stopped a vehicle on County Route 68 for no tail lamps.

Seth Howard, 33, of Cherry Creek was found to be intoxicated after failing standard field sobriety tests. Howard was processed at Fredonia State Police and issued UTT’s for inadequate/no stop lamps, No Plate Lamps, and felony driving while intoxicated, all returnable to the Town of Cherry Creek Court on April 15.

PORTLAND – Fredonia State Troopers arrested Charles Karlstrom Jr., 26, of Fredonia on a warrant from the Town of Portland Court for disorderly conduct.

Karlstrom Jr. was arraigned in the Town of Portland Court and remanded to Chautauqua County Jail on $500 cash bail.

He is due back in Town of Portland Court on April 10.

POMFRET – On April 4, Fredonia State Troopers stopped a vehicle on State Route 20 for not having any headlights or tail lights.

Colin Kilpatrick, 22, of Binghamton was arrested for driving while intoxicated and processed at Fredonia State Police.

Kilpatrick was also charged with aggravated driving while intoxicated and issued UTT’s for the Town of Pomfret Court on May 6.

Gowanda Police

Jeremiah A. Bednarek, 33, of Miller Street was charged with fourth-degree criminal mischief on March 29. Police responded to the report of an alleged disturbance at a Buffalo Street residence. Bednarek allegedly damaged two entry doors with physical force then fled the scene on March 26. Bednarek turned himself into the police department and was released on an appearance ticket for Collins Town Court.

Mary Buckley, 56, of Chestnut Street was charged with driving while intoxicated on March 30. Police responded to an apparent fight on Miller Street where a combatant had left the scene in a vehicle. Police stopped a vehicle on Commercial Street with Buckley’s passenger being the apparent combatant. During the traffic stop, Buckley appeared to allegedly be intoxicated. She was found to have a blood alcohol content of .14 percent. She was released on an appearance ticket for Persia Town Court. The Erie County Sheriff’s Office and the Seneca Nation Marshals also assisted with this call.

Blain Lay, 46, of Chestnut Street was charged with third-degree assault and second-degree menacing on March 30. Police responded to the report of an assault on Buffalo Street. Lay had allegedly attacked and assaulted a male by repeatedly punching him in the face causing injury. Lay then allegedly threatened to cause more physical injury to the victim. He was arraigned in Collins Town Court and sent to the Erie County Holding Center in lieu of $1,000 bail. The New York State Police and the Erie County Sheriff’s Office also assisted with this call.

Derrick A. Struchen, 18, of Palmer Street was charged with third-degree assault, second-degree harassment and child endangerment on March 31. Struchen allegedly assaulted a 13-year- and 14-year-old female on the railroad tracks near Commercial Street. Struchen allegedly punched the victims in the face and the abdomen causing injury. He was released on an appearance ticket for Persia Town Court. The Erie County Sheriff’s Office also assisted with this call.

Wade F. Wampler II, 36, of Aldrich Street was charged on an warrant on April 2. Wampler had previously been charged with third-degree aggravated unlicensed operation by police. When he failed to appear in court, a warrant from Persia Town Court was issued. Wampler was arraigned in Persia Town Court and released on his own recognizance to appear again in court at a later date.

Ian T. Williamson, 33, of Palmer Street was charged on a warrant on April 4. Williamson was previously charged with petit larceny by the Hamburg Police Department. Patrol received a notice of the warrant from Hamburg Town Court and Williamson was taken into custody at his residence. He was turned over to Hamburg Police.

IRVING – A 17-year-old female from Orchard Park was charged with driving while intoxicated, having an open container and unlawful possession of marijuana on Saturday. At 5 a.m., deputies were called to Southwestern Boulevard for the report of a vehicle allegedly leaving the scene of a fight.

A breath test revealed the teen’s blood alcohol content to be .13 percent. She was processed at the North Collins substation and released on appearance ticket. The teen’s name was not released due to age.

VILLENOVA – Fredo-nia Troopers responded to Hurlbert Road for a report of an operator slumped over the steering wheel of a vehicle in the roadway.

Further investigation found Daniel Tyma, 41, of South Dayton to be operating a motor vehicle while impaired by drugs.

Tyma was given appearance tickets for first offense operating a motor vehicle impaired by drugs, seventh-degree criminal possession of a controlled substance and controlled substance in non original container all returnable to the Town of Villenova Court on April 17.

ELLICOTT – On Saturday, New York State Police arrested Kenneth L. Drake, 36, of Ashville for felony driving while intoxicated after a traffic stop on Dow Street in Falconer.

Drake was transported to Jamestown State Police where a blood alcohol level of .09 percent was obtained.

He was issued tickets for felony driving while intoxicated and felony first-degree aggravated unlicensed operation and is to appear in the Town of Ellicott Court.

Drake was released to a third party.

VILLENOVA – On Friday, State Troopers arrested Kevin F. Bailey, 47, of South Dayton after a traffic stop on Smith Road and charged him with driving while intoxicated.

Bailey was transported to Jamestown State Police for processing, where a blood alcohol level of .09 percent was obtained.

He was issued tickets for failure to keep right and driving while intoxicated returnable to the Town of Villenova Court.

Bailey was released to a third party.

Dryer lint blamed for Falconer fire

FALCONER – Excess dryer lint has been blamed for an accidental fire that left one person without a home Saturday evening.

According to the Chautauqua County Fire Investigation Team, around 10:20 p.m., the Falconer Fire Department responded to a reported house fire at 174 S. Work St., Falconer. The first floor of the apartment building there was vacant, and the second floor tenant was able to escape without any injuries.

The fire investigation team announced Sunday morning that lint had ignited in the dryer’s vent pipe, which was being used in the second floor apartment.

The resident is being assisted by the Red Cross.

Chautauqua County Sheriff’s Office

Jonathan Golden, 28, of Lake Avenue, Brocton, was charged with felony driving while intoxicated, third-degree criminal possession of a weapon, speeding, uninspected motor vehicle and refusal to submit a breath test on Saturday.

Around 2:15 a.m., deputies stopped Golden for allegedly speeding on Webster Road in the town of Pomfret. An investigation led to Golden being arrested for felony DWI and he was additionally charged with possessing a gravity knife.

He was committed to the Chautauqua County Jail on bail.

SILVER CREEK – Eric Salisbury, 47, of Amherst was charged with endangering the welfare of a child and second-degree harassment on Saturday.

Around 12:20 p.m. on Madison Street, Salisbury allegedly ensued in an altercation with the victim that occurred in front of a child.

He was released and will appear in Silver Creek Village Court at a later date.

Mayville man charged with forcible touching

MAYVILLE – On Wednesday at around 10:53 p.m., Sheriff’s Patrol responded to a complaint from a female victim reporting that a male had groped her against her will.

Douglas A. Swan, 46, of Mayville allegedly touched the intimate parts of a female in an inappropriate manner. Swan was arrested and charged with forcible touching.

He will appear the Town of Chautauqua Court at a later date.

State Police at Fredonia

SOUTH DAYTON – On March 31, troopers arrested Joseph Gierszewski, 20, of South Dayton after an investigation revealed he had taken a Citizens Bank debit card PIN number from a residence in the town of Leon without the owner’s knowledge or permission.

Gierszewski then used the debit card for three transactions at the South Dayton Super Duper. Gierszewski was charged with three counts of petit larceny and one count of fourth-degree grand larceny, credit card.

Gierszewski was issued appearance tickets to appear in the Town of Leon Court for the grand larceny and in the Village of South Dayton Court for the petit larceny.

CHERRY CREEK – Seth Howard, 33, of Cherry Creek was stopped by troopers on County Route 68 for no tail lamps.

He was processed at the Fredonia barracks and issued UTT’s for inadequate/no stop lamps, no plate lamps and felony driving while intoxicated, all returnable to the Town of Cherry Creek Court on April 15.

SHERIDAN – Troopers arrested Devon Wilson, 19, of the city of Dunkirk for fifth-degree criminal possession of stolen property. Wilson was attempting to sell stolen goods to Pawn Starz from a burglary that had occurred in the city of Dunkirk.

Wilson was processed at the Fredonia State Police Station and issued an appearance ticket to appear in the Town of Sheridan Court on March 20. The city of Dunkirk Police Department was advised.

Troopers ticketed four motorists passing school buses

OBSERVER Staff Report

On Thursday The New York State Police in Troop A participated in Operation Safe Stop, a key component of the highway safety strategy of the Governor’s Traffic Safety Committee.

Troopers are always on patrol responding to complaints and enforcing traffic laws; however, for Operation Safe Stop 2014, Troopers covering eight counties of Western New York, were assigned to follow and observe school buses at the stops and cite violators.

Four motorists were cited for passing stopped school buses while students were disembarking and three other citations were issued for other vehicle and traffic law offenses.

One of the motorists cited was the operator of a tractor trailer traveling on State Route 16 in the Town of Holland. When questioned he stated that he didn’t see the flashing lights in time to stop “I wasn’t paying attention; I was playing with the radio.”

Operation Safe Stop is a semi-annual, one day enforcement campaign, which targets motorists who pass stopped school buses while they are displaying flashing red stoplights indicating that students are being dropped off at their stops.

STOCKTON – Jennifer L. Brown, 37, of Mayville was charged with second-degree aggravated unlicensed operation, speeding and unlicensed operation on Tuesday. At 6:40 p.m., deputies stopped Brown for allegedly speeding on Route 380. Brown’s license was found to be allegedly revoked for a prior DWI charge. She will appear in Stockton Town Court at a later date.

MAYVILLE – On Wednesday at about 7 p.m. deputies located Jenell L. Long, 38, of Mayville at a residence on Plank Road in the Town of Portland. Long had an active forgery warrant in the Town of Busti.

Long was taken into custody by the Sheriff’s Office and turned over to Lakewood Busti Police.

ELLERY – On Thursday at about 8:45 p.m. deputies and K9 Drago located Faith I. Swartz, 39, of Falconer at a residence on Townline Road in the Town of Ellery. Swartz had an active probation warrant stemming from a second-degree grand larceny with property value greater then $50,000 arrest.

Swartz was taken to the Chautauqua County Jail and held without bail.

CHAUTAUQUA – On Thursday at about 7:45 p.m. deputies located Kyle C. Lager, 24, of Sherman at a residence on Route 430 in the Town of Chautauqua. Langer had an active probation warrant stemming from a second degree assault arrest.

Langer was taken to the Chautauqua County Jail and held without bail.

New York State Police at Jamestown

JAMESTOWN – On Wednesday, Jamestown State Police arrested Jennifer A. Seymour, 30, of Jamestown after a traffic stop on South Main Street.

She was transported to Jamestown State Police for processing where a blood alcohol level of .09 percent was obtained.

Seymour was issued traffic tickets for passing a red light and failure to keep right and an appearance ticket for driving while intoxicated. All tickets are returnable to the City of Jamestown Court.

Seymour was released to a third party.

to participate in Operation Safe Stop

Chautauqua County Sheriff Joseph Gerace said the Chautauqua County Sheriff’s Office, in conjunction with state and local police agencies throughout the county, will participate today in a zero-tolerance enforcement dubbed “Operation Safe Stop.”

Operation Safe Stop is an annual enforcement and awareness day intended to educate the public of the dangers associated with unlawfully passing stopped school buses. Children continue to be injured and killed each year as a result of motorists failing to exercise appropriate caution and stop as required by law for school buses that are loading or discharging passengers.

Police throughout the county will be following and observing school buses as they travel their routes today. The New York State Vehicle and Traffic Law prohibits drivers from passing a school bus from either direction when the bus is stopped with its red lights flashing while on a public highway, street or private road, including school parking lots and driveways. Due to the significant danger to children, violations of the law are dealt with harshly. Drivers convicted for the first time face fines of $250 to $400 or up to 30 days in jail, or both. Subsequent convictions within a three-year period can result in fines of up to $850 or 180 days in jail, or both.

Jamestown police seeking armed robber

JAMESTOWN – James-town Police are on the lookout for an armed robber, who according to police, pulled a gun out during a robbery at 7-Eleven at the corner of East Second and Buffalo streets in Jamestown.

The robbery occurred just before 2 a.m. Tuesday. According to police, the suspect is described as a black male in his early-20s being between 6-foot and 6-foot-2 tall with a thin build, wearing a black coat with a black hood and black pants.

The suspect allegedly entered the store and demanded cash from the two employees. He fled the store with an undisclosed amount of cash on foot and ran away to the west toward Buffalo Street.

Anyone who may know the suspect is asked to contact the Jamestown Police Department at 483-7531 or they can leave an anonymous tip at 483-TIPS (8477).

Elderly man charged with DWI

DAYTON – An 80-year-old man has been charged with driving while intoxicated, among others, following a one-vehicle accident on Route 62.

According to the Cattaraugus County Sheriff’s Office, Franklin K. Nephew, 80, of Versailles was charged after deputies responded to the call of a truck in the ditch on Saturday. A passerby had called police about the accident and provided information that assisted police in locating Nephew who had allegedly fled the scene.

Nephew was found and brought back to the scene where he was found to be allegedly intoxicated. It was found he was allegedly traveling too fast for conditions when he lost control of the vehicle. Investigation found there were open beer cans in the vehicle and Nephew’s licensed had been revoked for a prior DWI conviction.

He was charged with felony DWI, first-degree aggravated unlicensed operation, operating without an interlock, speed not reasonable, leaving the scene of an accident, failure to maintain lane and consumption of alcohol in a motor vehicle.

Nephew was arraigned in Persia Town Court and held on $500 bail. He is to appear in Dayton Town Court at a later date.

Cattaraugus County Sheriff’s Office

LEON – Robert A. Wyatt, 40, of Cherry Creek was charged with driving while intoxicated, aggravated DWI with a blood alcohol content of .18 percent or more and failure to keep right on Sunday.

At 12:02 a.m., deputies stopped Wyatt’s vehicle on County Road 6.

He was released on appearance tickets for Leon Town Court at a later date.

  • ELLICOTT – On Monday, Jamestown State Police arrested Randall A. Goodwill, 30, of Jamestown on a drug charge following a traffic stop on Route 60.

He was issued traffic tickets and an appearance ticket for unlawful possession of marijuana returnable to the Town of Ellicott Court.

  • GERRY- On Monday Jamestown State Police arrested Joshua P. Mleczko, 19, of Dunkirk on a drug charge following a traffic stop on Route 60.

He was issued a traffic ticket and an appearance ticket for unlawful possession of marijuana returnable to the Town of Gerry Court.

MAYVILLE – District Attorney David W. Foley announced the following pleas and sentences in Chautauqua County Court:

  • Kevin W. Schrecen-gost, 26, of Celoron, was sentenced to 3 years determinate in state prison with 3 years post-release supervision for two counts of second-degree attempted burglary concurrent with 1-3 years in prison for two counts of third-degree burglary and first-degree possession of a dangerous contraband in prison.
  • Jacob M. Raynor, 31, of Sinclairville, was sentenced to 2-6 years in state prison for each of two counts of third-degree burglary to run concurrently with one another.
  • Melvin L. Jackson, 53, of Kennedy, was sentenced to 2-4 years in state prison for second-degree attempted assault.
  • Rodney G. Clyburn, 33, of Buffalo, was sentenced to 2 years determinate in jail with 1 1/2 years post-release supervision for fifth-degree criminal sale of a controlled substance.
  • Jeremiah D. Toliver, 34, of Dunkirk, was sentenced to 1 year in jail for second-degree criminal contempt consecutive to 6 months in jail for second-degree criminal contempt.
  • Edwin Gibbon, 29, of Jamestown, was sentenced to 5 years probation, 4 months of weekend work release, a $2,500 fine and 36 months ignition interlock device for felony driving while intoxicated.

Westfield man charged with choking woman, endangering children

WESTFIELD – A 30-year-old village man is in county jail after allegedly choking a woman, endangering the welfare of two children and damaging items in a Third Street home.

Westfield police report this morning that officers were called to the home at 7 p.m. Saturday.

During the investigation, it was alleged that Eric S. Morrison was involved in a domestic incident with a female.

Morrison was taken into custody and charged with two counts of criminal obstruction of breathing or blood circulation, two counts of endangering the welfare of a child, and three counts fourth-degree criminal mischief.

Morrison was arraigned in the village court and remanded to Chautauqua County Jail on bail.

Westfield Police Department

Paul E. Morris Jr., 51, of Erie, Pa., was charged with second-degree aggravated unlicensed operation and driving across hazard markings of roadway on Saturday.

Police observed Morris’ vehicle allegedly cross the white hazard lines multiple times for no apparent reason on North Portage Street at 2:28 a.m.

During the traffic stop, it was found Morris’ driving privileges were suspended for an alcohol-related offense.

He was released to appear in Westfield Village Court at a later date.

New York State Police at Jamestown

POLAND – On Monday at 7:15 a.m. New York State Police at Jamestown responded to a report of an erratic driver westbound on I-86 in the Town of Poland.

Driver Martin N. Gomez III, 36, of Bradford, Pa., was placed under arrest for driving while intoxicated after field sobriety tests.

Passenger, Andrew F. Owens, 18, of Bradford, was also placed under arrest.

Both subjects were transported to Jamestown State Police where a blood alcohol level of .13 percent was obtained for Gomez.

Gomez was charged with operating a motor vehicle under the influence of alcohol or drugs, criminal possession of a controlled substance and give or sell alcohol to a person under age 21.

Owens was charged with criminal possession of a controlled substance and unlawful possession of alcohol under the age of 21.

Both subjects were arraigned in the Town of Poland Court and committed to Chautauqua County Jail, Gomez in lieu of $1,000 bail and Owens in lieu of $500 bail.
