Inmate charged with spitting in face of jail officer

MAYVILLE — An inmate who spit in the face of a corrections officer is facing charges, the Chautauqua County Sheriff’s Department reported Tuesday.

Deputies said the incident occurred around 1:20 p.m. Sunday at the Chautauqua County Jail. Alyssa Mistretta, 25, allegedly became disorderly and spit in the face of a corrections officer. Mistretta was charged with second-degree harassment and will be arraigned using the centralized arraignment program.

In April, Chautauqua County District Attorney Patrick Swanson announced that any individual who spits or coughs on a member of law enforcement will be prosecuted to the fullest extent of the law. The announcement came after incidents reported by police agencies in Chautauqua County in light of the COVID-19 crisis.

IRVING — On May 11, Joseph Mazzone, 59, was charged with unauthorized use of a vehicle.

Deputies responded to the report of an unauthorized use of a motor vehicle. Investigation revealed that Mazzone allegedly took a vehicle without permission. Mazzone was issued an appearance ticket and is scheduled to appear in the Town of Hanover Court at a later date to answer his charges.

RIPLEY — On May 18, Matthew W Higby, 34 was charged with second-degree menacing and second-degree harassment.

At about 11:38 p.m., Sheriff’s Deputies responded to an address in Ripley for an altercation. It is alleged that Higby struck a person and threatened to harm another person with a machete.

Higby was charged and transported to the Chautauqua County Jail for arraignment.

New York State Police

CLYMER — On May 13, State Police in Jamestown charged Jillian Carris-Davis, 35, of Clymer, with DWI-Leandra’s Law and Endangering the Welfare of a Child.

Troopers responded to a motor vehicle accident on Route 426 in Clymer. Investigation revealed that Carris-Davis was driving north on Route 426 when she exited the west shoulder of the roadway and became stuck in a ditch. No injuries were reported after Carris-Davis and her minor passenger were evaluated by Clymer EMS.

Carris-Davis was placed under arrest after reportedly failing several field sobriety tests and was transported to State Police in Jamestown where she provided a breath sample of .10. Carris-Davis was then processed, issued tickets and released. She is scheduled to appear in the town of French Creek Court on a later date to answer the charges.

CHERRY CREEK — On May 14, Troopers charged Dean M. Walters, of Randolph, with seventh-degree criminal possession of a control substance.

Troopers conducted a traffic stop of a black sports utility vehicle on Route 83 in the town of Cherry Creek. During the investigation of the stop, it was revealed that Walters was operating a motor vehicle with an expired license. During the inventory of Walters’s vehicle, troopers allegedly located one gram of methamphetamine in the center console of the vehicle.

Walters was released on an appearance ticket and traffic tickets to appear in Cherry Creek Town Court in June.
