CHERRY CREEK — A motorcyclist was killed in an accident Sunday night.

According to the Chautauqua County Sheriff’s Office, at about 6:45 p.m. Paul W. Diaz of Cherry Creek, was traveling on Farrington Hollow Road in the town of Cherry Creek when his motorcycle struck a vehicle backing out a driveway.

Diaz was transported to Brooks Memorial Hospital where he later succumbed to his injuries.

Jassen Sherman, 47, of Falconer was charged with failure to yield the right of way when entering the roadway and is due back in the town of Cherry Creek Court at a later date.

Along with the Chautauqua County Sheriff Office, responding to the scene were the Cherry Creek and Cassadaga fire departments, Alstar and Starflight.
