Women recount separate Jamestown assaults in court

MAYVILLE — Two women accusing the same man of sexual assault in July 2018 took the stand Wednesday in Chautauqua County Court.

The woman alleging that 34-year-old Dennis L. Park forced her into a Jamestown laundromat bathroom and raped her remained on the stand in the second day of trial. Both women are not being identified because they are the alleged victims of assault.

The trial is being held in front of County Court Judge David Foley.

The first woman testified Tuesday that she was washing clothes and blankets July 17, 2018, in the laundromat when she went to a bathroom located inside. When she attempted to exit, she said she was “rushed” by Park, who she said put a knife to her side and forced her back into the bathroom.

She said Park forced her to perform oral sex on him. Afterward, the woman called police.

Park is facing charges of first-degree rape and two counts of first-degree criminal sex act for the July 17 assault, as well as a rape that reportedly took place a week earlier, on July 11, 2018

The second woman alleged that a man, who she later identified as Park in the courtroom, approached her from behind on Chandler Street in Jamestown. The woman confronted the individual for walking too closely. Park allegedly threatened her with a knife.

The woman had been walking her small dog near her Jamestown apartment. She said Park directed her behind a factory and demanded she “provide sexual acts” in exchange for her safety.

She told the jury she would never forget the man’s eyes before identifying Park in court.

After the alleged assault, the woman said she went to her sister’s apartment, located just below her own, to alert her that she was assaulted.

“I was just raped,” she remembered shouting to her sister.

The woman was taken to the hospital that night and discharged on July 12. Both women who took the stand underwent what’s referred to as a “rape kit” that hospital officials use to collect any DNA and analyze any injuries. The information is later provided to police.

The woman’s sister also took the stand Wednesday.

Both alleged victims were cross examined by Chautauqua County Public Defender Ned Barone, who is representing Park.

Michael Flaherty of the District Attorney’s Office continued his line of questioning with the woman assaulted at the laundromat.

Prior to court resuming at 9 a.m. on Wednesday, Barone made a motion for a mistrial after Flaherty had sought to include a knife reportedly involved in the assaults in court. The officer who collected the knife is currently out of state.

Barone believed the discussion, which he objected to Tuesday, created a prejudice from the jury on Park.

Foley denied the motion, but did remove the paper bag containing the knife from the courtroom until the prosecution attempts to enter the object into evidence. Barone made a second motion to dismiss the trial, citing prejudice after the second alleged victim was visibly upset upon entering the stand.

The trial resumes today in County Court.
