SAFE Act is state law

One of the more prevalent issues of election season stems from the passage of the SAFE Act in 2013. Considered the toughest gun control law in the United States, this legislation has been discussed in the District 23 Congressional campaign as well as the race for county sheriff.

There is one problem, however. It is New York state’s law. It has nothing to do with the federal government or the county sheriff.

For the record, all candidates have spoken against the law.

Even Erie County Sheriff Tim Howard has said in the past he does not agree with it, so he will not enforce it. That, in itself, is hypocritical. Anyone voted to uphold the law needs to do just that.

So whatever your position on the SAFE Act, for or against, it does not matter in the campaigns for Congress or county sheriff. Those positions have no say in whether the law exists or is repealed.
