Cassadaga woman brought up on several charges

OBSERVER Staff Report

STOCKTON – On Thursday at 6:15 a.m. Chautauqua County Sheriff’s deputies stopped a vehicle on Main Street in the town of Stockton for a traffic infraction.

After investigation, they found the driver of the vehicle, Bianca M. Swarthout of Cassadaga, to have a revoked New York State drivers license.

Swarthout held numerous suspensions for prior vehicle offenses, which included alcohol related offenses.

Swarthout also had an outstanding bench warrant out of Town of Pomfret Court.

She was arraigned on the warrant in Pomfret and remanded to Chautauqua County Jail on charges of aggravated unlicensed operation in the second degree, along with various traffic charges. Swarthout was issued appearance tickets for the new charges in Stockton.

Dunkirk Police Department

Klarisa Foster, 23, of West Third Street was charged with third-degree burglary on a bench warrant on Nov. 13.

Orlando Vazquez, 38, of North Ermine Street was charged with third-degree aggravated unlicensed operation on Nov. 13.

Allan Barreca, 45, of South Roberts Road was charged with second-degree criminal contempt on Nov. 13.

Selena Ruiz, 17, of Main Street was charged with inadequate headlights and unlicensed operation on Nov. 14.

Anthony Anderson, 32, of East Second Street was charged with disorderly conduct on Nov. 15.

Jerome Sellers, 30, of Buffalo was charged with one count of third-degree, one count of fourth-degree and four counts of seventh-degree criminal possession of a controlled substance on Nov. 15.

Norman Geddis, 44, of Lincoln Avenue was charged with first-degree attempted criminal sex act on a warrant on Nov. 16.

Rosa Malave-Droz, 52, of Dove Street was charged with two counts of having an unregistered motor vehicle on Nov. 16.

Dominick Schrantz, 35, of South Ocelot Street was charged with failure to stop at a red light, operating a motor vehicle with no insurance, having no front license plate and having a suspended registration on Nov. 17.

Isaiah Thomas, 16, of Lord Street Upper, and Kevin Hardee, 17, of Lincoln Avenue, were both charged with first-degree robbery and second-degree menacing on Nov. 17.

Elmer Salaman, 38, of New York City was charged with third-degree criminal possession of a forged instrument, second-degree aggravated unlicensed operation and failure to signal on Nov. 18.

Tara Brooks, 33, of Middle Road was charged with two counts of third-degree criminal possession of a controlled substance on Nov. 19.

Carley Ott, 22, of Lincoln Avenue Lower, and Julio Echevarria-Cosme, 19, of East Second Street, were both charged with unlawful possession of marijuana on Nov. 19.

Bridget Putman, 21, of Jamestown was charged with petit larceny on Nov. 20.

Allie Sharp, 16, of Middle Road was charged with disorderly conduct on Nov. 21.

Norberto Mercado, 54, of Main Street was charged with failure to stop at a red light and having no insurance on Nov. 21.

Rafael Castro, 69, of North Main Street was charged with third-degree aggravated unlicensed operation on Nov. 22.

Charlotta Thomas, 25, of Lincoln Avenue was charged with disorderly conduct on Saturday.

Andrew Snyder, 23, of Armadillo Street was charged with third-degree aggravated unlicensed operation and having a tail lamp out on Saturday.

Andre McQuiggan, 17, of Townsend Street was charged with criminal obstruction of breathing on Sunday.

Richard Reinard II, 31, of Angola was charged with third-degree aggravated unlicensed operation, having no insurance, unlawful possession of marijuana and having improper window tint on Monday.

An accident occurred at the intersection of East Fifth Street and Washington Avenue Wednesday at 1 p.m.

According to a police report, Katiria Rosario, 22, of Ruggles Street told police she was traveling westbound on East Fifth Street when William Foster, 74, of Walden Road, Brocton, was stopped at a stop sign on Washington Avenue, traveling northbound.

Foster then proceeded into the intersection into Rosario’s path. Rosario struck the rear passenger side quarter panel of Foster’s vehicle.

Foster told police he did not see anything coming when he entered the intersection.

Chautauqua County Sheriff’s Office

NORTH HARMONY – On Wednesday at 1:13 a.m., Chautauqua County Sheriff’s deputies were interviewing a subject on Panama Stedman Road.

After the man gave deputies a false name he fled on foot, and deputies later cornered him in a barn. Gregg W. Morrison was taken into custody without incident.

After a longer investigation, deputies found Morrison had an outstanding parole warrant for a driving while intoxicated felony charge.

He was committed to Chautauqua County Jail.

Morrison will answer to the above charges at a later date in the Town of North Harmony Court.

KIANTONE – On Thursday at 3:26 a.m. Sheriff’s patrol stopped a vehicle for failure to signal a turn on Warren- Jamestown Boulevard in the Town of Kiantone.

The driver, Louis M. Landy, 28, of Jamestown, was arrested for allegedly driving while intoxicated and taken into custody.

Landy will be in Kiantone Town Court at a later date.

Local man gets

hassled by Medical Alert scam

OBSERVER Staff Report

A local man recently received a harassing phone call from someone claiming to be Medical Alert.

Fred Guziec of Dunkirk was targeted by a scammer who asked him to pay his monthly bill so he could start receiving his $3,000 food coupons. After he called the toll free numbers they gave him he found out it was a scam.

The Medical Alert Foundation based in California said they “have no knowledge of this scam.” They said “Medical Alert doesn’t ever charge monthly” so that is one way to know it is a scammer.

Fredonia Police Department

Jessica Fulmer, 20, of Route 60 was charged with petit larceny on an arrest warrant on Nov. 21.

Christopher Dake, 20, of SUNY Fredonia’s McGinnies Hall, was charged with third-degree criminal trespass and fifth-degree criminal possession of stolen property on Nov. 22.

Joshua Burke, 25, of Bowen Road, Stockton, was charged with third-degree aggravated unlicensed operation and operating a motor vehicle while using a mobile device on Nov. 22.

Selena Yerico, 48, of Park Avenue, Dunkirk, was charged with following too closely and leaving the scene of a property damage accident on Nov. 22.

According to an accident report, around 5 p.m., Michele Klepfer, 48, of King Road, Forestville, was driving eastbound on East Main Street and was stopped at a red light at the intersection of Newton Street. While stopped, Klepfer told police she was rear-ended by Yerico.

The two vehicles pulled over and Yerico allegedly said there was no damage done and returned to her car and left the scene. There were minor paint scuffs on the rear bumper of Klepfer’s vehicle.

Yerico later called the police department after an officer contacted her telling her to call the station back. She told police she was operating the vehicle that rear-ended Klepfer’s vehicle.

She also told police no damage was done to her vehicle and she didn’t believe there was damage done to Klepfer’s at the time.

Robert Kaczor Jr., 19, of Liberty Street was charged with second-degree harassment on Sunday.

MAYVILLE – District Attorney David W. Foley announced the following pleas and sentences in Chautauqua County Court:

  • Jonathan N. Paddock, 29, of Jamestown, was sentenced to 2 1/2 to 5 years in state prison concurrent with 2 years in prison and 1 year post-release supervision for fifth-degree criminal sale of a controlled substance concurrent with 1-3 years in state prison for second-degree attempted criminal possession of a forged instrument and petit larceny.
  • Alexander Tylwalk, 21, of Dunkirk, was sentenced to 2-6 years in state prison for burglary in the 3rd degree.
  • Raymond Solada, 50, of Stockton, was sentenced to 2-6 years in state prison for third-degree criminal possession of a weapon.
  • George Rivera, 54, of Dunkirk, was sentenced to 4 months weekend work release, 5 years probation, $1,500 fine and 60 months ignition interlock device for felony driving while intoxicated.
  • Daniel Schroder, 34, of Jamestown, was sentenced to 1 year in jail for violation of probation.

Brocton man allegedly threatens doctor’s offices

MAYVILLE – A Brocton man has been charged following an alleged incident at a doctor’s office on East Chautauqua Street Tuesday afternoon.

According to the Chau-tauqua County Sheriff’s Office, Floyd R. Berry, 35, allegedly became disorderly while in a doctor’s appointment and stated he was going to return with a shotgun shortly after 2 p.m.

He was charged with second-degree harassment and disorderly conduct.

Berry was arraigned in Chautauqua Town Court and sent to the Chautauqua County Jail on bail.

Reservation accident results in charges

IRVING – A one-vehicle accident on the Seneca Nation of Indians Reservation Tuesday has resulted in charges for a woman who lives on the reservation.

The Erie County Sheriff’s Office responded to the accident on Route 438 near Versailles Plank Road at 12:45 p.m.

According to police, Jessica J. Garrow, 33, struck a utility pole and mailboxes in the accident. She was uninjured, but was allegedly extremely intoxicated, believed to be by drugs. She failed field sobriety tests and consented to a chemical blood test.

Garrow was charged with driving while intoxicated and other traffic violations.

She was released to family members to appear in North Collins Court at a later date.

New York State Police, the Seneca Nation Marshals and Gowanda Police assisted with the incident.

Jamestown man hurt in Ellery crash

ELLERY – A Jamestown man has been injured following a one-vehicle accident on Slide Fenner Road Monday.

The Chautauqua County Sheriff’s Office investigated the accident at 12:22 p.m., when Calvin B. Olson, 65, was allegedly traveling north when his vehicle left the east side of the road and struck a utility pole. Olson was transported to Hamot Hospital by Starflight for unknown injuries.

The investigation is continuing into the cause of the accident.

The Ellery Center and Maple Grove Fire departments also responded to the scene.

Cattaraugus County Sheriff’s Office

RANDOLPH – Skyler M. Irish, 22, of Jamestown Street was charged with criminal possession of a hypodermic instrument on Tuesday.

At 12:24 a.m., deputies and Randolph Emergency Medical Services were called to a residence to an unconscious female.

It is alleged Irish was found in possession of a hypodermic instrument at the residence.

She is to appear in Randolph Town Court at a later date.

Motorist charged after colliding with Ripley house

OBSERVER Staff Report

RIPLEY – A 24-year-old North East, Pa., man has been charged with speed not reasonable for hazardous conditions, unlicensed operation and third-degree aggravated unlicensed operation after he crashed his vehicle into a house at 4118 North Road Monday morning.

According to the New York State Police, around 6:50 a.m., Robert R. Thiem was driving north on North Road when he lost control of his vehicle due to an unsafe speed and slippery road conditions.

The vehicle went through a small ditch and continued through some small trees and brush. It then went through a yard and struck a garage attached to the North Road house.

There was substantial damage to both the vehicle and the garage structure.

Thiem was not injured in the accident and the owner of the home was not there at the time.

Thiem was issued tickets and will appear in Ripley Town Court.

Gunshot complaint prompts arrest

  • On Sunday, New York State Trooper Keith Mulawka responded to the intersection of Routes 394 and 62 in Kennedy for a gunshot complaint reported near a residence.

The complainant told Mulawka he was hunting with his minor son near the railroad tracks on their friend’s property when a shot was fired. He said the shot just missed his son.

The complainant’s son said he observed a man wearing a dark sweater and a hat on the railroad tracks where the shot originated.

Upon investigation, Mul-awka found the subject’s residence. Troopers said Kyle Ross, 17, of Kennedy allegedly borrowed a friend’s gun and fired one shot into the field near the old railroad bed in his friend’s backyard.

Ross was arrested by Environmental Conserva-tion officers for discharging a firearm within 500 feet of a residence and possession of a slug in the field with no hunting license.

Ross is scheduled to appear in the Poland Town Court.

Irving residents charged under Leandra’s Law

  • SHERIDAN – Two adults were charged under Leandra’s Law after a traffic stop Sunday.

According to the Chau-tauqua County Sheriff’s Office, John Wasierski, 38, and Darlene Bommer, 47, both of Irving were found to be allegedly intoxicated while a child was present in the vehicle.

Deputies responded to the report of a suspicious vehicle in the front yard of a residence on Route 20 where the occupants were having a reported argument around 8:15 p.m.

Deputies stopped the vehicle shortly after it left the residence and found Wasierski to be the operator. He was found to be allegedly intoxicated and was charged with felony aggravated driving while intoxicated.

During further investigation, it was found Bommer was allegedly operating the vehicle prior to Wasierski and was found to be allegedly intoxicated. She was charged with aggravated DWI under Leandra’s Law and with an additional charge of felony DWI due to a prior DWI conviction.

Wasierski was arraigned in Sheridan Town Court and sent to the Chautauqua County Jail in lieu of bail. Bommer was released with tickets.

SILVER CREEK – Bradley M. Dimmer, 22, of Howard Street was charged with unlawful possession of marijuana Monday. At 12:50 a.m. deputies found him to be in possession of an alleged marijuana pipe containing marijuana and residue. He will appear in Silver Creek Village Court at a later date.

City man busted for crack sales

Darrly J. Bray, 34, of Lake Shore Drive East, Dunkirk was taken into custody on an arrest warrant on Wednesday. The Dunkirk Police Department located Bray on the warrant at 5 p.m. at Main and West Third streets, charging him with third-degree criminal possession of a controlled substance and third-degree criminal sale of a controlled substance issued by Dunkirk City Court.

It is alleged Bray sold crack cocaine to agents of the task force on numerous occasions within the city. Bray was sent to the Dunkirk City Jail where he is being held pending arraignment. This arrest culminates a several- months-long investigation. Additional information has been obtained as a result and authorities anticipate additional arrests and the investigation continues.

The task force is comprised of officers from the Chautauqua County Sheriff’s Office and the Dunkirk Police Department.

Four horses killed after being hit by vehicle

LITTLE VALLEY – A vehicle crashed into a group of horses early this morning, killing four of them.

At approximately 2:07, David E. Mohr of Cattaraugus was traveling northbound on Route 353 when he allegedly struck the four horses with his vehicle. According to the Cattaraugus County Sheriff’s Office, the vehicle caught fire afterward and was completely burned.

The road was closed for more than three hours while the scene was investigated and cleaned up.

The investigation is continuing.

State Police at Jamestown

On Nov. 20 Troopers Jamie Szczepaniak and Daniel Alaimo pulled over a vehicle on I-86 in Kennedy for traffic violation. The driver of the vehicle, Guillermo Lopez-Rendon, 23, Mexico was unable to provide police with a passport. After contacting the United States Border Patrol police found that Lopez-Rendon was in the country illegally. He was arrested and transported to the State Police barracks in Jamestown, and turned over to Border Patrol Agent Steven Moodney. Lopez-Rendon will be held at the Erie County Jail in Erie pending further investigation.

Fredonia Police

An accident resulting in minor injuries occurred Nov. 13 at 1:50 p.m on Temple Street. Police say Jordan Fischer, 20, of Horseheads was backing out of a driveway at 49 Temple St. and allegedly failed to see Rodney Silliman, 53, of One Temple Square walking south on Temple Street along the street curb and the driving lane. Silliman was knocked to the pavement with the driver’s side rearview mirror and was taken by Alstar Ambulance to Brooks Memorial Hospital.

A 17-year-old Fredonia minor was charged with two counts of second-degree criminal sale of marijuana, two counts of endangering the welfare of a child and fourth-degree criminal possession of marijuana on Nov. 13.

Alissa Smith, 23, of East Lake Road, Dunkirk, was arrested on a warrant for second-degree burglary and petit larceny on Nov. 14.

Matthew Miller, 30, of Willow Drive, Irving, was charged with aggravated harassment on Nov. 14.

Nicholas Colilli, 18, of SUNY Fredonia’s Grissom Hall, was charged with second-degree harassment on Friday.

Byron Oaks, 25, of Norton Place was charged with seventh-degree criminal possession of a controlled substance on Monday.

Matthew Gregory, 22, of Lake Shore Drive West, Dunkirk, was charged with second-degree rape on Monday. He was committed to the Chautauqua County Jail on $5,000 cash bail or $10,000 property bond.

An accident resulting in injuries occurred Tuesday at 10 a.m. at the intersection of Route 20 and White Street. Police say Joanne Ryan, 53, of Van Buren Road, Dunkirk, was attempting to turn left out of White Street and onto Route 20. The outside driving lane on Route 20 was stopped and Kristen Wagner, 36, of Angola was driving in the inside turning lane. Ryan allegedly struck Wagner. Ryan told police her vision was blocked by the stopped vehicles. Wagner was taken by Alstar Ambulance to Brooks Memorial Hospital.

State Police at Collins

CATTARAUGUS – Troopers and New York State Environmental Conservation officers charged Damian Woodruff, 31, of First Street, Cattaraugus, and David Busenlehner, 30, of Lewiston with illegal discharge of a firearm, possessing a prohibited light with a firearm in a vehicle and misdemeanor violations of the NYS Fish and Wildlife Law on Oct. 29.

Troopers stopped the two men on State Route 353 in New Albion around noon for tinted windows. While approaching their car, troopers allegedly saw fresh blood on the rear bumper, as well as a spotlight in the center console, blood on Woodruff’s boots and a .22 long rifle on the floor in the back seat.

Troopers contacted a local ENCON officer, who responded to the scene.

Their subsequent investigation allegedly revealed that the two had illegally taken a buck the night before in the Salamanca area. Busenlehner was holding the spotlight and Woodruff shot the deer in the head.

Authorities were able to locate the deer at a friend’s home after speaking with the men.

Both are due in New Albion Town Court.

GOWANDA – Troopers took Leiondie Mohawk, 29, of Commercial Street, Gowanda, into custody on an arrest warrant for fourth-degree criminal mischief at her home on Nov. 4.

The arrest closed a two-month-old case in which Mohawk had allegedly kicked out a glass window on the Collins Town Court’s door. She was being arraigned by a Gowanda Police officer in the court and broke the glass while she was leaving for the Erie County Holding Center.

Collins court officials contacted troopers about the incident and after the lengthy change of venue process, a warrant was issued for her arrest.

She is due in North Collins Town Court later this month.

GOWANDA – Troopers arrested Angelo Smielinski, 23, of Theil Road, North Collins, for driving while intoxicated and unlawful possession of marijuana following a traffic stop on Aldrich Street Extension and State Route 438 on Wednesday.

Troopers stopped the car after Smielinski allegedly failed to stop at a stop sign and crossed a double yellow line. While speaking with him, troopers allegedly smelled alcohol and he subsequently failed a series of field sobriety tests.

While inventorying the car, troopers also found a tin foil pipe with marijuana in it. Smielinski refused a chemical test and was processed and arraigned in Collins Town Court.

SILVER CREEK – Kerry Vasquezmarte, 29, of Route 39, Forestville, was charged with second-degree harassment on Saturday.

Around 8 p.m., deputies responded to Adams Street in Silver Creek for the report of a victim that was involved in a physical altercation.

After an investigation, it was determined that Vasquezmarte allegedly punched a female victim in the face while on Buffalo Street.

Vasquezmarte was issued an appearance ticket for Silver Creek Village Court.

MAYVILLE – Rachael Palkovic, 22, of Erie, Pa., was charged with driving while intoxicated, aggravated driving while intoxicated with a blood alcohol content of .18 percent or greater, speed in zone, failure to keep right and crossing hazard markings on Sunday.

Around 1 a.m., deputies allegedly observed a vehicle driving erratically and committing several traffic infractions on South Erie Street. The vehicle was stopped and the operator was identified as Palkovic.

Following an investigation, Palkovic was taken into custody. She was later released and will appear in Chautauqua Town Court to answer the charges.

Accident sends three to hospital

SHERIDAN – An accident on Center Road sent a mother and her two children to the hospital Monday evening. According to New York State Police at Fredonia, Amanda McGinty, 34, of Dunkirk was traveling on Center Road when she lost control of her vehicle on a snow and ice covered road. McGinty and her two children were transported to Brooks Memorial Hospital for minor injury.

Resident allegedly fires cannon at neighbor

KIANTONE – A 52-year-old man has been charged after an incident involving a cannon.

According to the Chautauqua County Sher-iff’s Office, neighbors of Brian Malta of Prosser Hill Road said Malta had been firing a Civil War cannon directly at their home at 11 a.m. Wednesday. An arrest warrant and search warrant were issued and Malta was charged with three counts of second-degree menacing and three counts of second-degree harassment. Deputies searched the property and seized the alleged cannon.

Malta was arraigned in North Harmony Town Court and sent to the Chautauqua County Jail in lieu of $2,500 bail.

Daniel Ayala-Valentin, 23, of North Ermine Street was charged with third-degree aggravated unlicensed operation and violating a noise ordinance Nov. 6.

Tara Seneca, 39, of Adams Street, Silver Creek, was charged with third-degree aggravated unlicensed operation and having inadequate headlights on Saturday.

Javar Battle, 34, of Deer Street was charged Sunday with second-degree harassment.

Shannon Roche, 28, of Central Avenue was charged with petit larceny Sunday.

Orlando Rodriguez, 51, of North Main Street was charged with following too closely on Monday.

According to police, around 3 p.m., Pamela Czarniak, 53, of Temple Street, Fredonia, was sitting at the intersection of South Main Street and Lake Shore Drive East, waiting for the traffic signal to turn green. Rodriguez then rear-ended Czarniak’s vehicle. Rodriguez admitted fault and was cited.

Michael Ostler, 29, of Lake Shore Drive West was charged with second-degree aggravated unlicensed operation and having an unregistered motor vehicle Monday.

Dawn McCormick, 43, of Jamestown was charged with petit larceny on Tuesday.

SALAMANCA – John Santiago, 46, of Killbuck was taken into custody on an outstanding warrant Nov. 1. He was wanted for criminal mischief out of the town of Brant. Santiago was placed into custody and turned over to the Erie County Sheriff’s Office and is to appear in Brant Town Court.

CHAUTAUQUA – Jer-emiah J. Russin, 18, of Mayville was charged with unlawful possession of marijuana and failure to signal turn on Sunday.

Deputies saw Russin allegedly fail to make a turn onto Beaujean Road from Route 394. During the traffic stop, Russin and a passenger, Nicole R. Wlodarek, 21, of Jamestown were both allegedly in possession of a small quantity of marijuana and smoking pipes. Both were released on appearance tickets for Chautauqua Town Court.

Brittany Peterson, 22, of Lambert Avenue was charged with third-degree aggravated unlicensed operation and having a suspended registration on Friday.

Neil Keane Jr., 18, of SUNY Fredonia’s Chautau-qua Hall, was charged with unlawful possession of alcohol and having an open container of alcohol Saturday.

Taylor Page, 23, of Holley, was charged with unlawful possession of marijuana on Saturday.

Daniel Sapienza, 20, of Spencerport, was charged Sunday with unlawful possession of alcohol, having an open container of alcohol and violating a sewer ordinance.

Man charged after allegedly attempting to hit nurse

HANOVER – An Irving man has been charged after an incident where he allegedly attempted to hit a nurse Thursday.

Thomas F. Gagola, 52, was charged with second-degree harassment and disorderly conduct, according to the Chautauqua County Sheriff’s Office.

Deputies responded to Routes 5/20 at 2:30 p.m. where Gagola had allegedly used obscene and abusive language in a public place and tried to strike a nurse with a closed fist.

He was arraigned in Hanover Town Court and sent to the Chautauqua County Jail in lieu of bail.

Aggravated DWI part of charges for Brocton man

BROCTON – Raymond L. Dotson, 44, of Brocton was charged with passing on the right, improper passing, moving from lane unsafely and aggravated driving while intoxicated on Thursday.

At 6:21 p.m. deputies on patrol on Main Street observed an eastbound vehicle allegedly pass another vehicle on the right. Dotson was found to be allegedly intoxicated.

He was arraigned in Portland Town Court and released on his own recognizance to appear again in court at a later date.

Cause of Stockton fire released

The fire that destroyed a trailer in Stockton is believed to be accidental.

On Monday at around 11 a.m. area firefighters were called to a trailer located at Willowbrook Trailer Park, 7235 Route, 380 in the town of Stockton. The fire displaced six residents.

The Chautauqua County Fire Investigation Team conducted an investigation. The fire was determined to have started in the outer wall of the bathroom behind the bathtub. The cause of the fire was found to be an electrical short circuit of wiring in the wall.

Sinclairville man faces charges after domestic dispute

SINCLAIRVILLE – Angelo Spicola Jr., 52, of Sinclairville, was charged Wednesday with third-degree assault and second-degree unlawful imprisonment after an alleged domestic dispute. Spicola was allegedly involved in a verbal altercation that escalated when he allegedly grabbed a female victim violently causing a laceration and a contusion. Spicola then allegedly refused to let the victim leave the residence after she attempted to several times. She was allegedly kept in the residence against her will for approximately one and a half hours. Spicola was taken into custody and arraigned in Charlotte Town Court. He was sent to the Chautauqua County Jail on $3,000 bail. An order of protection was also issued for the victim.

Cassadaga man charged after leaving an accident

GERRY – Chautauqua County Sheriff’s Deputies responded to an accident on Route 60 Sunday around 9:50 p.m. Upon deputies’ arrival it was found the operator had left the scene. Investigation found Robert J. Austin was operating the vehicle when he allegedly failed to yield the right of way to oncoming traffic and struck another vehicle. He was charged with failure to yield the right of way, leaving the scene of a property damage accident, consumption of alcohol in a motor vehicle, driving while intoxicated and aggravated DWI. Austin will appear in the Gerry Town Court at a later date.

Woman arrested for criminal impersonation in Silver Creek

Courtney L. Ziemba, 21, was charged with second-degree criminal impersonation Wednesday.

According to State Police at Fredonia, Ziemba allegedly had used another driver’s NYS license after being stopped for speeding in the village of Silver Creek in May.

On Tuesday, Ziemba, who has no permanent address, was located in Brocton. She was allegedly found to be in possession of the other woman’s driver’s license.

She was processed and arraigned in the Silver Creek Village Court. Ziemba was sent to the Chautauqua County Jail in lieu of $1,000 cash bail or $2,000 property bond.

Ziemba will appear back in court at a later date. Further charges are pending.

Gowanda Police Department

Sammie L. Harris III, 25, of Buffalo was charged with a headlight violation, criminal possession of a weapon and unlawful possession of marijuana on Oct. 26. Harris was stopped on Aldrich Street at 11:55 p.m. for an alleged headlight violation. During the stop, Harris was found to be in possession of an alleged illegal stun gun and a small amount of marijuana. He was arraigned in Collins Town Court and sent to the Erie County Holding Center in lieu of $1,000 bail. The Erie County Sheriff’s Office assisted with this call.

Cattaraugus County Sheriff’s Office

PERRYSBURG – Tammy L. Fisher, 43, of Forestville was charged with driving while intoxicated, having a blood alcohol content of .08 or higher, failure to keep right and unsafe backing on Saturday. At 12:59 a.m. Fisher was stopped on North Road after she allegedly almost hit a patrol car head on. During the stop, Fish allegedly put her car in reverse and almost struck the patrol car. She was released on her own recognizance to appear in Perrysburg Town Court at a later date.

PERRYSBURG – David H. Buck, 43, of Conewango Valley was charged with driving while intoxicated, speeding, consumption of alcohol in a motor vehicle and unlawful possession of marijuana on Saturday.

Buck was stopped on Route 39 at 3:31 a.m. for allegedly speeding and having a tail lamp out. Buck was found to be in possession of an alleged open container and marijuana.

A passenger, Chris T. Farnham, 38, of Conewango Valley was charged with obstruction of governmental administration for allegedly refusing to comply with deputies and becoming argumentative during the stop.

Both are to appear in Perrysburg Town Court at a later date.

SILVER CREEK – Douglas E. Bastedo, 22, of Porter Avenue was charged with unlawful possession of marijuana on Tuesday.

He was charged at 10 p.m. after being allegedly found in possession of marijuana on Central Avenue. Bastedo will appear in Silver Creek Village Court at a later date.

Ryan Strickland, 25, of North Beagle Street, Dunkirk, was charged with executing an improper right turn and having an uninspected motor vehicle on Friday.

According to police, around 12:30 p.m., Judith Singer, 73, of Maple Avenue was at a stop sign on Maple Avenue waiting to turn onto Central Avenue when Strickland made a right turn from Central Avenue onto Maple Avenue, striking Singer and causing damage to both vehicles.

Strickland told police when he made the turn, he slid on wet leaves on the ground, causing him to hit Singer. Singer’s vehicle had to be towed.

A parked vehicle at 44 E. Main St. was smashed by a tree next to it when the tree fell due to very high winds Friday at 11:50 a.m.

Victoria Welch, 20, of Forbes Place was charged with unlawful possession of marijuana on Friday.

Jenna Hockwater, 18, and Riley Conklin, 18, both of SUNY Fredonia’s Nixon Hall, were both charged with unlawful possession of alcohol and possessing an open container of alcohol on Friday.

Patrick Dexle, 18, of SUNY Fredonia’s Hendrix Hall was charged with unlawful possession of alcohol and possessing an open container of alcohol on Friday.

Charles Chauncey, 23, of Brigham Road was charged with disorderly conduct on Saturday.

Regina Siegal, 18, of SUNY Fredonia’s Nixon Hall was charged with unlawful possession of alcohol, possessing an open container of alcohol and littering on Saturday.

Aaron Machelor, 18, of SUNY Fredonia’s Grissom Hall was charged with unlawful possession of alcohol, possessing an open container of alcohol and littering on Sunday.

Julio Aponte, 39, of Lincoln Avenue, Dunkirk, was charged with disorderly conduct on Sunday.

Evan Christy, 24, of Greensburg, Pa., was charged with criminal obstruction of breathing on Sunday.

Jacob Lilly, 17, of Berry Road, Fredonia, was charged with following too closely on Nov. 1. According to police, around 12:15 p.m., Virginia Bragg of Dunkirk was stopped in traffic behind other vehicles at the stop light at the intersection of Central Avenue and Howard Avenue. She was struck from behind by Lilly.

Andria Mazurkiewicz, 37, of Webster Road, Fredo-nia, was charged Nov. 1 with failure to keep right, using a cell phone while driving and having an unregistered and uninsured motor vehicle.

Andrew Sroka, 20, of Central Avenue was charged with petit larceny on Nov. 1.

DeMario Hough, 27, of South Zebra Street was charged Nov. 1 with third-degree aggravated unlicensed operation, failure to keep right, suspended registration and an uninspected and uninsured motor vehicle.

Joseph Massar, 28, of Park Avenue was charged with failure to yield the right of way at an intersection with a stop sign Saturday. Police say, at 1:45 p.m., F.J. Figueroa-Delvalle, 23, of Maple Avenue was westbound on East Sixth Street when Massar was going south on Deer Street and entered the intersection on East Sixth Street. That caused Figueroa-Delvalle to strike Massar.

Michael Pacheco, 22, of South Zebra Street was charged with airway obstruction and unlawful imprisonment on Sunday.

Derek Seegar, 22, of Eagle Street, Fredonia, was charged Monday with petit larceny.

Luis Morales, 21, of Dunkirk was charged with trespassing on Monday.

Wilberto Torres, 61, of Lincoln Avenue was charged with second-degree harassment on Monday.

Carmen Lopez, 38, of Lincoln Avenue was charged with second-degree menacing on Tuesday.

RIPLEY – Three Ripley teens were charged with third-degree assault after a report from a victim in Westfield Memorial Hospital on Oct. 26. Deputies responded to the hospital around 6:30 p.m. where a victim of an alleged assault was being treated. After investigation and interviews, Kyle M. Hannold, 19, a 16-year-old male and a 17-year-old male were charged and issued appearance tickets for the Ripley Town Court.

STOCKTON – Christopher C. Hartney, 22, of Stockton, was charged Oct. 30 with second-degree harassment after deputies received a complaint. Hartney allegedly threatened to do harm or kill another subject. He was issued an appearance ticket for the Stockton Town Court.

BROCTON – Sarah R. Langford, 23, of Fredonia, was charged Oct. 25 with second-degree criminal contempt after deputies received a complaint. Langford allegedly contacted a subject multiple times in direct violation of a valid order of protection. She was issued an appearance ticket for the Brocton Village Court.

SOUTH VALLEY – Richard M. Brian, 47, and Lisa M. Cislo, 33, both of South Dayton, Erika M. Lee, 27, of Randolph, Kyle Bartlett, 21, of Salamanca, and Matthew R. Moran, 29, of Steamburg, were all charged with trespass Oct. 30 after they were allegedly found at Gurnsey Cemetery after visiting hours. They were issued appearance tickets and were released.

MAYVILLE – District Attorney David W. Foley announced the following sentences in Chautauqua County Court in front of the Honorable John T. Ward:

  • Jonathan B. Yates, 27, of Jamestown, was sentenced to 3 1/2 years in state prison with 2 years post-release supervision for second-degree assault and time served for seventh-degree criminal possession of a controlled substance.
  • Jermaine L. Fann, 28, of Buffalo, was sentenced to 2-4 years in state prison for second-degree attempted assault.
  • Mark R. Dzielski, 28, of Brocton,was sentenced to 2 years in state prison with 2 years post-release supervision for third-degree criminal sale of a controlled substance concurrent with 10 months in jail for seventh-degree criminal possession of a controlled substance.
  • Shell S. Raymond, 45, of Jamestown, was sentenced to 1 year in jail for aggravated driving while intoxicated with a child consecutive to 6 months in jail for second-degree aggravated unlicensed operation.
  • Fred Santiago, 25, of Dunkirk, was sentenced to 6 months in jail and 5 years probation for third-degree burglary.
  • Kyle C. Langer, 24, of Sherman, was sentenced to 5 years probation for second-degree assault.
  • Felicia Cardone-Tefft, 25, of Jamestown, was sentenced to 5 years probation, a $1,000 fine and 60 months ignition interlock device for felony driving while intoxicated.
  • John E. Ley, 47, of Dunkirk, was sentenced to 45 days in jail, a $2,000 fine and a 1-year conditional discharge with ignition interlock device for misdemeanor driving while intoxicated.
