Gowanda Police Department

Randi A. Gates, 24, of Buffalo Street was charged with disorderly conduct and resisting arrest on May 5. Police responded to the report of an alleged disturbance on a Buffalo Street sidewalk. Gates was allegedly fighting with another subject and became aggressive toward police. He was released to appear in Collins Town Court.

Seneca L. Mohawk, 27, of Bush Road was charged with criminal trespass on May 6. Police responded to a Buffalo Street residence for an alleged report of trespassing. Mohawk had been banned from this property previously by the owner. Mohawk was released on appearance tickets for Collins Town Court.

Blaine Lay, 46, of Chestnut Street was charged with second-degree aggravated harassment on May 8. Lay allegedly was sending threatening and harassing text messages to another subject. Lay then allegedly ignored police instructions to stop. Lay, who allegedly appeared intoxicated, was released to appear in Collins Town Court. Lay was arraigned in Collins Town Court and sent to the Erie County Holding Center in lieu of $1,000 bail.

David A. Brill, 34, of Poughkeepsie was charged on a warrant arrest on May 10. Police had previously arrested Brill in 2013 on third-degree assault, child endangerment, second-degree criminal trespass and disorderly conduct. Brill allegedly failed to appear in Persia Town Court resulting in an arrest warrant being issued. Brill was arrested by Salamanca Police Department and turned over to the Gowanda Police. Brill was arraigned in Persia Town Court and sent to the Cattaraugus County jail in lieu of $5,000 bail.

Eliza M. Jimerson, 19, of Brant was charged with operating a vehicle with suspended registration and operating with a permit with no licensed driver on May 10. Jimerson was found to be allegedly operating with only a driver’s permit and with a suspended registration on Buffalo Street. She was released to appear in Collins Town Court.

Carmen C. White, 18, of Perrysburg was charged on an arrest warrant on May 10. White was a passenger in a vehicle stopped for an alleged traffic violation on Buffalo Street. A computer check revealed White was wanted by the Erie County Sheriff’s Department. She was then turned over to the sheriff’s office.

Ricky W. Barber, 58, of Commercial Street was charged with petit larceny, second-degree harassment, second-degree criminal nuisance and disorderly conduct on May 14. Police responded to a Buffalo Street business for an alleged theft. Barber allegedly stole an alcoholic beverage and became involved in a physical altercation with an employee after being confronted. Barber was arraigned in Collins Town Court and sent to the Erie County Holding Center in lieu of $500 bail.

Eric Kendall, 38, and Tammy M. Kendall, 36, both of Sardinia were charged with petit larceny on May 22. Both subjects were residing in a village apartment and when they moved out, the pair allegedly stole a washer and dryer. An arrest warrant was issued by Collins Town Court and the pair were turned over to police by the Erie County Sheriff’s Department. Both were arraigned in Collins Town Court and released on $500 bail each.

Man, 37, dies

in farming accident

CARROLL – A 37-year-old man has died as a result of a farming accident Monday.

According to the Chautauqua County Sheriff’s Office, deputies and the Frewsburg Fire Department were called out just after 3 p.m., to a Warren Road residence for the report of a male pinned under a farm tractor.

Michael T. McCray suffered fatal injuries as a result of the accident. He was pronounced dead at the scene.

Silver Creek crash sends one to hospital

HANOVER – A two-vehicle crash has sent one driver to the hospital Tuesday. Chautauqua County Sheriff’s deputies and the Silver Creek Fire Department responded to the intersection of Buffalo Street and Route 5.

According to police, Daniel Smith, 30, of Silver Creek allegedly made an improper turn onto Buffalo Street. Smith’s vehicle struck a vehicle on Buffalo Street driven by George Clees, 58, of Silver Creek.

Smith was transported to Lake Shore Hospital by ambulance.

Rodney Hawkins Jr., 25, of East Courtney Street was charged May 15 with second-degree harassment and obstruction of a governmental administration.

Jose Vazquez, 39, of Woodrow Avenue was charged with driving while intoxicated, no turning signal, failure to stop at a stop sign and third-degree aggravated unlicensed operation on May 17.

Nancy and Raul Rosa-do, both 49 and of Colum-bus Avenue, were charged with fourth-degree criminal mischief on May 17.

Keith Muniz, 25, of Matteson Street, Fredonia, was charged with criminal obstruction of breathing and second-degree criminal trespass on May 18.

Peter Paredes, 33, of West Courtney Street was charged with driving while intoxicated, third-degree aggravated unlicensed operation, failure to signal a left turn and no plate light on May 18.

James Patterson, 34, of Townsend Street was charged with second-degree harassment on May 19.

Mathiew Skubis, 25, of Eagle Street was charged with second-degree harassment on May 19.

Luis Fuentes, 24, of Webster Street was charged with petit larceny and second-degree criminal possession of a forged instrument on May 19.

A 16-year-old Deer Street resident was charged with second-degree harassment on May 20.

Kathryn Hanlon, 18, of Central Avenue was charged with third-degree aggravated unlicensed operation, no inspection, suspended registration and no insurance and Jasmine Jones, 23, of Chautauqua Road, Fredonia, was charged with failure to yield the right of way after an accident involving both of their vehicles on May 22. The accident occurred at the intersection of West Sixth Street and Eagle Street.

Adrian Rivera-Velez, 36, of Columbus Avenue was charged with petit larceny on May 23.

Yajaira Melendez, 32, of Franklin Avenue Lower was charged with petit larceny on May 23.

Matthew Gregory, 23, of Lake Shore Drive West was charged with disorderly conduct on Sunday.

Jonathon Jaszcak, 22, of Lambert Avenue, Fredonia, was charged with petit larceny on Monday.

Esteban Delgado, 42, of Lincoln Avenue was charged with third-degree assault on Tuesday.

Kim Don, 53, of Central Avenue was charged May 20 with disorderly conduct.

Amy Johnson, 36, of Eagle Street was charged with driving while intoxicated, aggravated DWI and failure to use designated lane early Sunday morning after she allegedly struck and damaged a telephone pole owned by National Grid that was located on Central Avenue just north of Middlesex Drive.

Cheryl Kulpa, 46, of Gowanda was charged with second-degree harassment on Sunday.

State Police at Collins

PERRYSBURG – Kristina M. Kennedy of North Tonawanda was arrested at 10:24 p.m. after she reportedly drove into the ditch while attempting to make a three-point turn. No injuries were reported.

Kennedy was transported to the Collins station. A breath test was administered recording a .11 percent blood alcohol level.

She was released to a third party and is scheduled to appear in the Town of Perrysburg Court.

Chautauqua County Sheriff’s Office

KIANTONE – Ray-mond O. Camacho, 18, of Jamestown was charged with driving while ability impaired by drugs, failure to keep right, moving from lane unsafely, unlicensed operation and unlawful possession of marijuana on Monday.

At 9:15 p.m., deputies stopped Camacho’s vehicle for alleged traffic violations. Camacho was allegedly found to be operating impaired by drugs during the stop. He will appear in Kiantone Town Court.

HANOVER – Thomas R. Krause, 23, of North Tonawanda was charged with violating the sewer ordinance on Monday. Deputies were on patrol in Sunset Bay at 7:05 p.m., and observed Krause allegedly urinating in a public parking lot. He was released to appear in Hanover Town Court.

HANOVER – Devin Scagnelli, 18, of Depew was charged with having an open container, unlawful possession of alcohol under 21 and littering on Monday. At 5:15 p.m., deputies were on patrol in Sunset Bay and observed Scagnelli in alleged possession of an open container. Scagnelli allegedly discarded the open container and left the immediate language. He was released to appear in Hanover Town Court.

FORESTVILLE – A 17-year-old female from Water Street was charged with fourth-degree criminal mischief Tuesday. At 8:05 p.m., deputies were called to Water Street for the report of a disturbance. The youth allegedly damaged property belonging to another individual. The female was released to appear in Hanover Town Court.

HANOVER – Michael G. Weber, 51, of Irving was charged with driving while intoxicated, aggravated DWI with a blood alcohol content of .18 percent, failure to take a pre screen and failure to use a turn signal on Wednesday. At about 3 a.m., deputies stopped a vehicle on Ann Street for an alleged traffic violation. It was found that Weber allegedly was intoxicated. He was released to appear in Hanover Town Court.

Reservation crash leads to DWI charges

IRVING – A Develan man has been charged with driving while intoxicated following a one-vehicle crash Monday. The Erie County Sheriff’s Office, responded to the scene at 11 p.m., on Route 438 near Taylor Hollow Road.

After an investigation, Jonathan C. Dombrowski, 24, was charged with aggravated DWI, imprudent speed, failure to maintain the roadway and failure to keep right. A breath test revealed Dombrowski’s blood alcohol content to be .20 percent, over twice the legal limit. He was processed at the North Collins substation and re-leased on appearance tickets.

State Police in Jamestown

RANDOLPH – Nicole L. Spinler, 28, of Napoli, was charged with driving while intoxicated on May 22 after a traffic stop. Troopers allegedly smelled alcohol on Spinler and performed field sobriety tests. She was taken into custody and was found to have a .14 percent blood alcohol content. She was also found to be wanted in the town of Cold Spring for DWI. Spinler was issued a ticket for the Randolph Town Court and was transported to the Cold Spring Town Court, where she was arraigned and sent to the Cattaraugus County Jail in lieu of $2,500 bail.

JAMESTOWN – Char-les Marshall Jr., 43, of James-town, was charged May 14 with driving while intoxicated after a traffic stop for no headlights. Troopers performed field sobriety tests and took Marshall into custody. He was found to have a blood alcohol content of .19 percent. He was issued tickets and released to appear in Jamestown City Court.

RANDOLPH – Timo-thy Johnson, 52, of Gerry, was charged Friday with felony driving while intoxicated after a traffic stop for speeding. Johnson was taken into custody after field sobriety tests. He was found to have a blood alcohol content of .11 percent. His DWI charge was a felony due to prior convictions. Johnson was arraigned in Randolph Town Court and was sent to the Cattaraugus County Jail in lieu of $1,000 bail.

State Police in Fredonia

SHERIDAN – Leah Hopkins, 17, of Sheridan, was charged Sunday with unlawful possession of marijuana after a traffic stop on Route 20 around 2:30 a.m. for no plate lamps. Hopkins was the passenger in the vehicle and was allegedly found in possession of several containers with marijuana inside. She was issued an appearance ticket to appear in the Sheridan Town Court.

Ricardo Negrogarcia, 26, of Dunkirk, was charged Saturday with second-de-gree harassment and Ruth Santiago, 30, of Dunkirk, was charged with second-degree obstruction of governmental administration after a report of a roadside domestic dispute on Route 5 in the town of Dunkirk. Both were taken into custody and arraigned in Dunkirk Town Court. They were released on their own recognizance to appear back in court at a later date.

Janine Smith, 31, of Buf-falo, was charged Monday with felony driving while intoxicated under Leandra’s Law, speeding and child not in appropriate restraint after a traffic stop on Route 60 in Pomfret. Smith allegedly failed field sobriety tests and had a 5 and 7 year old inside the vehicle. She was issued tickets and will appear in Pomfret Town Court.

State Police at Collins

COLLINS – According to troopers, William R. Brooks, of Gowanda was arrested at 5:30 p.m. on State Route 62 for driving while intoxicated.

Brooks refused a breath test. He was charged with felony driving while intoxicated and felony first-degree aggravated unlicensed operation plus several other vehicle and traffic charges.

Brooks was arraigned in the Town of Collins Court and released on $1,000 bail.

BRANT – Jeremie C. Somers of Cherry Creek was charged with driving while intoxicated, reckless driving and several other vehicle and traffic charges following his arrest on Route 5 at 12:55 a.m.

Somers was found asleep at the wheel with the motor running, the transmission in gear and his foot on the brake. The vehicle was stopped partially on the sidewalk and in the eastbound driving lane.

Somers was taken to the Collins barracks where he submitted to a breath test and recorded a blood alcohol level of .11 percent. Somers is scheduled to appear in the Town of Brant Court on June 17 at 6 p.m.

Erie County Sheriff’s Office

SPRINGVILLE – Denise J. Schauer, 42, of Gowanda was charged with driving while intoxicated and other traffic violations Saturday. At 12:45 a.m., deputies charged Schauer following a traffic stop on West Main Street. She submitted to a chemical breath test which resulted in a .13 percent blood alcohol level. Schauer was released to a third party and will appear in Springville Village Court.

Chautauqua County Sheriff’s Office

SHERIDAN – John E. Swogger, 57, of Sheridan was charged with second-degree aggravated unlicensed operation of a motor vehicle, unlicensed operation and failure to keep right on Tuesday. At 3 a.m., deputies stopped Swogger’s vehicle for an alleged violation on Middle Road. He was allegedly found to have a revoked driver’s license and numerous revocations due to prior alcohol-related traffic offenses. He will appear in Sheridan Town Court.

HANOVER – A 17-year-old female from Niagara Falls was charged with unlawful possession of alcohol under 21 Monday. At 1:25 p.m., deputies were on foot patrol on Allegany Road in Sunset Bay when the female was allegedly found in possession of alcohol. The youth, whose name was not released by police, was issued an appearance ticket.

HANOVER – A 19-year-old male from Clarence was charged with unlawful possession of alcohol under 21 Monday. At 2 p.m., deputies were on foot patrol in Sunset Bay when the male was found to be in alleged possession of alcohol. The male was released to appear in Hanover Town Court.

HANOVER – An 18-year-old male from Tona-wanda was charged with unlawful possession of alcohol Monday. At 2:26 p.m., deputies were on foot patrol on South Shore Drive in Sunset Bay and found the male allegedly in possession of alcohol. The male was released to appear in Hanover Town Court.

HANOVER – Derrick Scheelar, 31, of West Seneca and Kayla Kmitch, 24, of Orchard Park were charged with having an open container Monday. At 2:30 p.m., deputies were on foot patrol on and found Scheelar and Kmitch to be in alleged possession of open containers. Both were released to appear in Hanover Town Court.

HANOVER – Alicia Godfrey, 23, of Cheekto-waga, Elizabeth Palmeri, 23, of Depew and Richard Marr, 24, of Depew were charged with having an open container in a motor vehicle Monday.

At 2:45 p.m., deputies were on foot patrol on Allegany Road in Sunset Bay when they found the three subjects in alleged possession of open containers in a motor vehicle. All three were released to appear in Hanover Town Court.

Westfield man charged after stabbing

Westfield Police responded to a report of a stabbing May 21 on East Main Street around 7:50 p.m. Police spoke with the victim at Westfield Memorial Hospital, where he was seeking treatment for his wounds. It is alleged Benjamin Alexander, 22, of Westfield, stabbed another male in the back with a knife. Alexander was taken into custody without incident. He was charged with second-degree assault and fourth-degree criminal possession of a weapon and arraigned in Westfield Village Court. Alexander was sent to the Chautauqua County Jail without bail. Further charges are pending.

Joshua A. Powell, 28, of Mayville, was charged May 22 with seventh-degree criminal possession of a controlled substance, criminal possession of a hypodermic instrument and second-degree criminally using drug paraphernalia after police investigated a suspicious person in the area of East Main and South Portage streets. Police allege Powell was in possession of hypodermic needles. He was arraigned in Westfield Village Court and sent to the Chautauqua County Jail with bail. Further charges may be filed pending the results of the investigation.

Jacob M. Saddler, 20, of Westfield, was charged May 14 with driving while intoxicated with a blood alcohol content of .08 percent or higher, uninspected motor vehicle and consumption of alcohol inside a vehicle. Westfield Police investigated a report of a suspicious vehicle in a business parking lot on Route 20 around 12:05 a.m. It is alleged Saddler was operating the vehicle and was allegedly intoxicated. He was issued tickets and released on his own recognizance to appear in Westfield Town Court at a later date.

CHAUTAUQUA – Troy D. Hess, 42, of Mayville, was charged Monday with trespass after he allegedly knowingly and unlawfully entered a property on Elmwood Road around 6:30 a.m. It is alleged Hess went to the residence several times throughout the morning to start an argument. He was issued a ticket and arraigned in Chautauqua Town Court. He was sent to the Chautauqua County Jail in lieu of $500 cash bail or $1,000 property bond.

HANOVER – Justin C. Donnarmma, 22, of Wellsville, an 18-year-old male youth of Sloan and three 19-year-old female youths from Niagara Falls and Cheektowaga were charged with unlawful possession of marijuana Monday around 3:40 a.m. after a report of an under-age party on Iola Drive. Deputies allegedly found a small quantity of marijuana at the residence. It is also alleged the two female youths from Cheektowaga gave an incorrect birth date to deputies and were charged with false impersonation. All were released with tickets and will appear in Hanover Town Court at a later date.

NORTH HARMONY – Curtis D. Wood, 47, of Panama, was charged Sunday with driving while intoxicated, DWI per se and speeding after a traffic stop on Route 474. Wood was allegedly found to be intoxicated and was taken into custody. He was later released with tickets to appear in North Harmony Town Court at a later date.

SILVER CREEK – Brittany Deloe, 24, of Silver Creek, was charged Sunday with second-degree obstruction of governmental administration, resisting arrest, second-degree harassment and disorderly conduct after deputies responded to a Hickory Street residence for a report of a disturbance. It is alleged when deputies arrived around 10:15 p.m., Deloe became irate and was screaming obscenities outside the residence. She also reportedly shoved deputies several times and physically resisted being taken into custody. Deloe was arraigned in Silver Creek Village Court and released on her own recognizance to appear back in court at a later date.

SHERIDAN – William J. Barnes, 53, of Silver Creek, was charged Sunday with driving while intoxicated, DWI per se with a blood alcohol content of .08 percent or higher and speeding after a traffic stop on Route 20 around 2 a.m. It was allegedly found Barnes was intoxicated and he was taken into custody. He was released with tickets to appear in Sheridan Town Court at a later date.

Three arrested for DWI over weekend

OBSERVER Staff Report

Three people were arrested by Chautauqua County Sheriff’s deputies for driving while intoxicated in separate incidents over the weekend.

Brian Truax II, 30, of Jamestown was charged with felony DWI, unlawful possession of marijuana, improper turn and no signal on Saturday around 3 a.m. after deputies stopped his car on West Sixth Street in Jamestown. In addition to allegedly being intoxicated, Truax reportedly had a small amount of marijuana. A record check showed Truax had a DWI conviction within the past 10 years, making this arrest a felony. He will appear in Jamestown Court.

Jerremy Dossey, 26, of Jamestown was charged with DWI with a blood alcohol content of .08 percent or greater and disobeying a stop sign on Saturday around 2:30 a.m. after deputies stopped his car on Newland Avenue in Jamestown. Deputies reportedly observed Dossey’s vehicle pass through a stop sign without stopping. He will appear in Jamestown City Court.

Andrew Bankowski, 61, of Buffalo was charged with DWI with a BAC of .08 percent or greater on Sunday around 12:30 a.m. during an Operation Crackdown stationary road check on Routes 5 and 20 in the town of Hanover. After a further roadside investigation, Bankowski was arrested and subsequently released. He will appear in Hanover Town Court.

PORTLAND – On Wednesday, troopers arrested William Petsch Jr., 28, of Portland on a parole violation warrant issued by New York State Parole.

Petsch was transported to Chautauqua County Jail and was incarcerated there.

  • RIPLEY – Joseph Gross, 54, of Burton Street was charged with driving while intoxicated Thursday. Deputies responded at 8:35 p.m. to a disturbance on Route 20. Gross was found to be allegedly intoxicated. He was released to appear in Ripley Town Court.

RIPLEY – On Monday, the Chautauqua County Sheriff’s Office arrested Dale W. Reynolds, 74, of Ripley for an incident that occurred on May 13.

He was charged with first-degree criminal contempt, disorderly conduct, and trespassing.

Reynolds was taken into custody, and arraigned in the Town of Ripley Court, and committed to the Chautauqua County Jail in lieu of $10,000 cash / $20, 000 property bail.

Ashville man, 39, charged following alleged relationship with minor

NORTH HARMONY – An Ashville man has been arrested after allegedly being involved in a physical relationship with a juvenile female.

According to the Chautauqua County Sheriff’s Office, William P. Stratton, 39, of Butts Road allegedly had relations with the female at various times and locations in the town of North Harmony from December 2009 through August 2013. Following an investigation by the sheriff’s office and Chautauqua County Child Protective Services, a warrant from North Harmony Town Court was issued. Stratton was taken into custody on Tuesday without incident.

Stratton is charged with second-degree course of sexual conduct against a child, third-degree rape, third-degree sexual abuse and endangering the welfare of a child. He was arraigned and sent to the Chautauqua County Jail in lieu of $20,000 cash or $40,000 property bail.

Accident sends two to hospital by helicopter

CHAUTAUQUA – A two-vehicle accident on Route 394 sent two people to the hospital by helicopter Tuesday.

According to the Chau-tauqua County Sheriff’s Office, Scott Boardman, 38, of Mayville was traveling north when a vehicle driven by Edward L. Schlabach, 22, of Mayville allegedly pulled in front of him while exiting a parking lot. The two vehicles collided and came to rest in a lawn on the west side of the roadway.

Boardman was not injured but his passenger, Autumn Boardman, 37, of Mayville was flown to Hamot Medical Center for non-life threatening injuries. Schlabach was extricated from his vehicle and flown to Hamot Medical Center.

The investigation is continuing and charges are pending. Chautauqua Insti-tution Police Department, Mayville Fire Department and Chautauqua Fire Department also responded to the scene.

New York State Police at Fredonia

BROCTON – On Tuesday, Fredonia State Troopers arrested Steven Seavy, 23, of Brocton on a second-degree arrest warrant for harassment and physical contact.

The arrest warrant was issued after an incident that took place on Pullman Street on April 25. Seavy was transported to the Village of Brocton Court and arraigned. He was released on own recognition and is to return to court on June 4.

POMFRET – On Tuesday, Fredonia State Police arrested Brandon Ervin, 29, of Columbus, Ohio, as a fugitive from justice.

Brandon was stopped on State Route 60 for speeding. Further investigation revealed there was an active warrant from Franklin County Pleas Court in Ohio for two counts of nonsupport/contributing to nonsupport of a child.

Franklin County Pleas Court requested Ervin be held for extradition to Ohio. Ervin was processed at the Fredonia Station and is currently being held at the Chautauqua County Jail awaiting extradition to Ohio.

On Tuesday, Fredonia State Police arrested Kevin Weary, 49, of Fredonia for shoplifting at the Tops Market, on Vineyard Drive in Dunkirk.

Weary left the Tops Market store with a cart of stolen groceries valued at $765.03. Weary was arrested for petit larceny in the Tops Market parking lot and given an appearance ticket returnable to the Town of Dunkirk Court on May 26.

CHARLOTTE – On Tuesday, Fredonia State Troopers arrested Christopher Dellahoy, 25, of Jamestown for unlawful possession of marijuana.

State Troopers responded to Pine Acres Trailer Park on Route 60, Cassadaga to assist EMS with a male subject who had put his arm through a bedroom glass window and was being disorderly.

He was issued an appearance ticket for unlawful possession of marijuana to appear in the Town of Charlotte Court on Tuesday at 7:30 p.m.

New York State Police at Jamestown

ELLINGTON – On Saturday, New York State Police arrested Tyler J. Lokietek, 19, of Fredonia for driving while intoxicated.

Lokietek was transported to Jamestown State Police for processing where a blood alcohol level of .10 percent was obtained. He was issued issued tickets for driving while intoxicated, returnable to the Town of Ellington Court and released to a third party.

ELLICOTT – On Saturday, Jamestown State Troopers arrested Mikol V. Rockwood, 24, of Irving for felony driving while intoxicated after a traffic stop on Wade Hill Road.

Rockwood and a 17-year-old passenger were transported to Jamestown State Police where a blood alcohol level of .13 percent was obtained from Rockwood. He was charged with felony driving while intoxicated, due to a prior conviction, felony first-degree aggravated unlicensed operation, unlawful dealing with a child – give/sell alcohol to a person under 21, and unlawful possession of marijuana.

Rockwood was arraigned in the Town of Ellicott Court and committed to Chautauqua County Jail with bail pending the District Attorney’s recommendation.

CELORON – Nicholas A. Guzda, 25, of Waverly Avenue was charged with second-degree trespass and a parole violation on Monday.

Guzda was arrested at his residence at 3:30 p.m., by deputies along with Ellicott Police Department. He was wanted on several warrants from Jamestown Police and New York State Parole department.

Guzda was turned over to the Jamestown Police Department.

Dunkirk man sentenced in 2013 arson

MAYVILLE – A Dunkirk man is headed to state prison for starting a house fire in the town of Portland.

According to the Chautauqua County District Attorney David Foley, James Moreland, 55, of Dunkirk, was sentenced to 4-8 years in state prison for third-degree arson.

Moreland was charged following a fire at 6360 Route 20, Portland.

Firefighters arrived at the multi-family home the night of May 17, 2013 to a fully-involved fire in the front of the house. No one was home at the time of the fire, but the house was declared a total loss.

The cause of the fire was ruled arson and Moreland was indicted for second- and third-degree arson on July 24, 2013.

Student charged after narcotics found at CVCS

SINCLAIRVILLE – A 16-year-old student has been charged with seventh-degree criminal possession of a controlled substance on Wednesday.

Chautauqua County sheriff’s deputies report the male, who was not identified, was in possession of two bottles of the controlled substance, which were prescribed to another Sinclairville youth. The teen was arrested and will be in Gerry Town Court at a later date.

WESTFIELD – Shawn M. Cettell, 26, of East Main Road was charged with second-degree harassment on Sunday. Cettell allegedly made threats to harm other residents in the area shortly after 12 a.m. He was arraigned in Westfield Town Court and released on his own recognizance to the custody of his mother.

Phillip L. Reichardt, 38, of Jamestown, was sentenced to 2 1/2 years in state prison with two years post release supervision for unlawful manufacturing of Meth in the third degree.

Montel C. Cooper, 27, of Dunkirk, was sentenced to two years determinate in state prison and three years post release supervision for attempted criminal possession of a weapon the third degree.

Julia L. Nelson, 48, of Falconer, was sentenced to 1-3 years in state prison and one year license revocation for felony DWI.

Rodney E. Thomas, 49, of Jamestown, was sentenced to one year in jail for criminal possession of stolen property in the fourth degree.

Randy Koon, 31, of Silver Creek, was sentenced to six months in jail and five years probation for grand larceny in the fourth degree.

Samuel J. Cettell, 34, of Westfield, was sentenced to five years probation for criminal sale of a controlled substance in the fifth degree.

Natalie R. Corll, 21, of Jamestown, was sentenced to five years probation and restitution for forgery second and criminal possession of stolen property fourth.

Jason M. Tomkiewicz, 37, of Fredonia, was sentenced to 5 years probation, a $5,000 fine and one-year license revocation for felony DWI.

Javiel Valle, 27, of Lehigh Acres, Florida, was sentenced to 45 days in jail and five years probation for attempted burglary in the third degree.

Scott Fry, 35, of Cassadaga, was sentenced to five years probation, a $1,500 fine and five years ignition interlock device for felony DWI.

Arrest in library graffiti made

A 20-year-old city resident is being charged with the graffiti incidents at the Dunkirk Free Library.

Dunkirk Police report Jesus X. Reyes of Lincoln Avenue was charged with two counts of making graffiti tied to the incidents inside the Dunkirk Free Library occurring on April 8 and 15. The graffiti fully covered the new rear stairwell and the lavatory room in the building.

He was issued appearance tickets and is to be arraigned in City Court on Monday. Other similar graffiti incidents throughout the city have been noted and the investigations into these are continuing.

Darin Butts, 45, of Temple Street was charged with second-degree aggravated unlicensed operation and failure to keep right after an accident around the intersection of Temple and Leverett streets on May 9. Police say Butts sideswiped a legally parked vehicle.

HANOVER – On Thursday Deputies responded to a residence on Angell Road for the report of a neighbor dispute. After an investigation on scene, it is alleged that Robert K. Shumaker, 33, of Silver Creek trespassed on a male victim’s property, and then threaten the same victim with physical violence.

Deputies served Shumaker with an appearance ticket for second-degree harassment and trespass. The defendant will appear in the Town of Hanover Court at a later time to answer to the charges.

ELLICOTT – On Friday at around 3 a.m. deputies observed a vehicle traveling east on Route 394 with a tail lamp out.

Robert E. Mitchell III, 46, of Cassadaga was arrested for driving while intoxicated and on drugs.

He was taken into custody for processing and later released. He will appear in Ellicott Town Court on a future date.

burglary still being investigated

The Dunkirk Police Department is still working on the burglary at Old Sarge’s Drop Shop, but city residents should have no worries about what was stolen, according to Police Chief David Ortolano.

“Our investigation is ongoing,” the chief told the OBSERVER. “All the property related to this incident was recovered by our Department and there is no public safety concerns.”

Old Sarge’s was broken into around 3 a.m. Wednesday.

SHERIDAN – Katelyn T. Kozak, 26, of Center Road was charged with second-degree forgery, a class D felony, on Monday. Deputies took Kozak into custody without incident at 10 a.m., on a Chautauqua County Court warrant. Kozak was taken to the Chautauqua County Jail pending arraignment in county court.

FALCONER – Devin W. Powell, 22, of Youngsville, Pa., was charged with driving while intoxicated, unlicensed operator and driving without headlights on Sunday. At 3:29 a.m., deputies stopped a vehicle on West Main Street for allegedly operating without its headlights. Powell was found to be allegedly intoxicated and operating without a license. He was released to appear in Ellicott Town Court at a later date.

ELLINGTON – Franklin G. Brown, 20, of Salamanca, Jackson R. John, 20, of Great Valley and Tad P. Battie, 18, of Salamanca were all charged with unlawful possession of alcohol under 21 on Sunday. Deputies stopped a vehicle on West Main Street at 2:07 a.m., after observing it allegedly fail to signal a turn coming off 28th Creek Road. A quantity of alcoholic beverages were allegedly found in the vehicle. All three subjects were released to appear in Ellington Town Court.

ELLINGTON – Xavier A. Berrios, 20, of Dunkirk, Dontae N. Clarke, 20, of Brooklyn, Michael J. Donaldson, 20, of Dunkirk and Patrick J. Lamattina, 19, of Dunkirk were charged with unlawful possession of alcohol under 21 on Sunday. Deputies stopped a vehicle on 28th Creek Road at 12:53 a.m., for a traffic infraction. The four occupants were allegedly found to be in possession of alcoholic beverages. The males were released to appear in Ellington Town Court. The female driver was only cited for a stop sign violation after it was found she had not been drinking. Police did not release the driver’s name.

JAMESTOWN – Tina M. Vespro, 40, of Lakewood, was charged Wednesday around 10:50 p.m. with driving while intoxicated per se, failure to keep right and no turn signal after a traffic stop on Fairmount Avenue. She was taken into custody, processed and released with tickets to appear in Jamestown City Court at a later date.

COLDSPRING – David L. Bobseine, 70, of Gowanda was charged with driving while intoxicated, aggravated DWI and failure to keep right on May 9. Deputies stopped Bobseine’s vehicle on Route 394 at 10:09 p.m., where he was found to be allegedly intoxicated. He was released to appear in court at a later date.

Woman, young son injured in accident

NORTH HARMONY – A woman and her son were sent to the hospital following a motor vehicle accident Tuesday. According to the Chautauqua County Sheriff’s Office, Mary E. Hetrick, 26, of Jamestown and her 3-year-old son were injured in the crash.

Deputies plus the Ash-ville and Panama Fire de-partments responded to the crash on Panama-Stedman Road at 8:15 p.m. Hetrick was traveling south when she allegedly failed to reduce speed on a curve, losing control of the vehicle. The vehicle went onto the shoulder of the roadway, then came back onto the road. Crossing the center line, it rolled over an embankment on the east side. The vehicle came to a rest on its roof.

Hetrick and her son were taken to WCA Hospital by ambulance. Hetrick was treated for apparent minor injuries while her son was transferred to Buffalo Women and Children’s Hospital as a precaution.

Hetrick was charged with speed not reasonable or prudent.

NORTH HARMONY – On May 8, New York State Police were conducting a traffic road check on State Road 394 when a vehicle was observed stopping north of the road check.

The occupants changed drivers and turned around driving away from the road check. A patrol caught up with the vehicle and initiated a traffic stop. The driver Heather A. Valdez, 37, and passenger Benny J. Valdez, 45, both of Crescent City, Florida had 34 grams of marijuana, cocaine and two open cans of beer. A DMV check showed Benny to be suspended in New York. They were placed under arrest and transported to Jamestown State Police for processing.

Heather was charged with felony fifth-degree criminal possession of a controlled substance and consumption of an alcoholic beverage in a motor vehicle.

She was arraigned in the Town of North Harmony Court and committed to Chautauqua County Jail in lieu of $2,000 bail.

Benny was charged with felony fifth-degree criminal possession of a controlled substance, criminal possession of marijuana, consumption of an alcoholic beverage in a motor vehicle, unlicensed operator and aggravated unlicensed operation.

He was also arraigned in Town of North Harmony Court and committed to Chautauqua County Jail in lieu of $5,000 bail.

Dental records used to identify body located in Cattaraugus Creek

The body of a woman located in Cattaraugus Creek May 6 by a local fisherman has been positively identified through dental records.

On May 6, State Police responded to Cattaraugus Creek, in the Town of Perrysburg, after receiving a call from the Seneca Nation Marshall’s Office of possible human remains being found by a local fisherman. The State Police SCUBA Team and Aviation Unit were utilized to remove the body from the creek and the gorge.

With the assistance of the Cattaraugus County Sher-iff’s Office dental records were used to identify the deceased as Kimberly Militello, 59, of Gowanda.

Militello was reported missing to the Cattaraugus County Sheriff’s Office on Dec. 22, 2013.

Boater dies after boat capsizes in Chautauqua Lake

ELLERY – A Pennsyl-vania man lost his life after a boat accident on Friday.

New York State Police in Jamestown investigated a fatal boating incident in Chautauqua Lake.

Investigation revealed that at 3:50 p.m. two subjects were fishing 200 yards offshore on Chautauqua Lake in a 14-foot 1961 Crestliner boat with an outboard motor. Weather conditions began to deteriorate. The boat was anchored and began taking on water, becoming unstable. High winds and rough waters caused the boat to capsize, ejecting both subjects into the water.

Passing boaters found the two men – both wearing life vests – near the sunken boat and pulled them from the water. They were brought to Bemus Point Rescue.

Robert W. Knell, 66, of Duke Center, Pa., was unresponsive and transported to WCA Hospital where he was pronounced dead on Saturday, due to cardiac pulmonary arrest.

Roy L. Barclay, 65, of Derrick City, Pa., was taken to WCA Hospital where he was treated for exposure to the cold water and released.

New York State Police were assisted by the Chau-tauqua County Sheriff’s Department Water Rescue Team in recovering the overturned boat.

Dunkirk man found allegedly slumped over wheel charged

CHAUTAUQUA – A Dunkirk man has been charged with driving while intoxicated after being found allegedly slumped over his steering wheel.

According to the Chau-tauqua County Sheriff’s Office, Kevin M. O’Brien, 54, was charged with consumption of alcohol in a motor vehicle and driving while intoxicated Monday.

Deputies responded to Route 394 for a vehicle on the side of the road. Police found O’Brien to be allegedly intoxicated.

A record check showed O’Brien had been convicted of driving while ability impaired by drugs within the past 10 years, making this charge a felony. He was released to appear in Chautauqua Town Court.

POLAND – A Kennedy man has been charged following an investigation into debris cleanup on Route 62.

According to the Chau-tauqua County Sheriff’s Office, Jordan P. Ricotta, 20, was charged with driving while intoxicated on Sunday.

Shortly before 3 a.m., deputies noticed several individuals cleaning debris from the roadway on Route 62. While police were investigating this situation, Ricotta allegedly pulled up to the scene and was found to be intoxicated.

Teen allegedly stole truck, crashed while drunk

OBSERVER Staff Report

A 19-year-old Portville teenager was handed several charges after police say he stole another person’s vehicle and attempted to drive away, but got into an accident right after leaving a Fredonia bar on May 3.

According to the Fredonia Police Department, around 1:30 a.m., Tyler Veno took a truck without the registered owner’s permission and at-tempted to use it to leave the bar, located on West Main Street. Veno allegedly hit a tree on Chestnut Street near Berry Road. Minor damage was done to the vehicle.

Veno was charged with fourth-degree grand larceny, driving while intoxicated, aggravated DWI with a blood alcohol content of .18 percent or greater, failure to keep right and failure to use designated lane.

One car rollover leaves driver with minor injuries

ELLERY – Chautauqua County Sheriff’s deputies responded to a single-vehicle rollover accident early Saturday on Bellview Road. It was found Sierra Speranza, 18, of Bemus Point, was operating the vehicle when she crossed the center line and crashed into a ditch. The vehicle came to rest on its roof. Speranza complained of minor injuries and was taken to WCA Hospital by the Fluvanna Fire Department to be evaluated. She was charged with failure to keep right and will appear in Ellery Town Court at a later date.

  • NORTH HARMONY – Matthew E. Hall, 45, of Ashville, was charged Saturday with driving while ability impaired by drugs, failure to stop at a stop sign and failure to use a turn signal after a traffic stop on North Maple Street. Hall was taken into custody and release with tickets. He will appear in the North Harmony Town Court at a later date.

Neil D. Burrs, 35, of Bradford, Pa., was charged with driving while intoxicated and speeding on Thursday. Deputies stopped Burrs’ vehicle at 8:39 p.m., for allegedly speeding on Route 60 in the town of Pomfret. Burrs was found to be allegedly intoxicated. He was released to appear in Pomfret Town Court at a later date.

Investigation continues into April city shooting

The Dunkirk Police Department announced Friday it is continuing its investigation into a shooting incident that occurred in early morning hours of April 20.

As part of the investigation, a search warrant was executed at the DK Bandits Club House on East Fourth Street. Police are asking anyone who was in the area at the time of the incident and has information, to call the department. Officers may be reached at 366-2266 or the confidential tip line at 363-0313.

Jamestown man arrested on drug charges twice in one week

JAMESTOWN – A Jamestown man engaged in drug sales was taken into custody for the second time in a week early Friday morning.

Simeon A. Leeper, 37, was arrested on a felony warrant for third-degree criminal sale of a controlled substance, and additionally charged with obstructing governmental administration and resisting arrest at approximately 1 a.m.

Jamestown police officers observed Leeper exit the Bullfrog Hotel and enter a vehicle in the parking lot at 1414 E. Second St. in the city.

According to Captain Robert F. Samuelson, division commander of the Jamestown Police Department, an arrest warrant out of Jamestown City Court had already been issued for Leeper on May 8 after he reportedly sold drugs to undercover members of the JPD and New York State Police earlier in the week.

Officers advised Leeper multiple times to turn off and exit the vehicle, but he remained locked inside, continuously putting his hands in his pockets and reaching around the vehicle.

When officers broke the passenger side window to gain access, Leeper exited the vehicle on his own, but refused to comply with multiple directives to get down on the ground.

Once officers forced him to the ground, he continued to struggle and prevent himself from being handcuffed.

Leeper was eventually transported to Jamestown City Jail without further incident and is currently being held there pending arraignment.

On May 2, Leeper was picked up when investigators and the SWAT team executed a search warrant at 846 Lafayette St., Apt. 1. Inside, Leeper and another man were found with a quantity of crack cocaine, drug paraphernalia and a quantity of cash.

Leeper was also observed flushing a quantity of drugs into a toilet.

Charged with criminal tampering with physical evidence and second-degree obstructing governmental administration, which are misdemeanor charges, Leeper posted bail and was released the same day.

Alleged assault by two men leaves another with broken hip

JAMESTOWN – A 58-year-old man suffered a broken hip after allegedly being assaulted by two local men early Friday morning.

Robert C. Ruper, 45, of Jamestown, and James M. Miller, 25, of Ashville were both charged with second-degree robbery, third-degree assault, tampering with physical evidence and trespassing after the incident, which occurred near the railroad tracks south of Center Street near Crane Street shortly after 3 a.m.

Police responded to the area to assist emergency medical services with the injured 58-year-old man. While approaching the scene, officers observed Miller throw a small amount of cash and a lighter on the side of the tracks. As officers escorted Miller to the injured subject, they encountered Ruper, who was also at the scene.

Further investigation revealed that the 58-year-old had been tackled to the ground and had suffered a broken hip.

The cash that was thrown on the ground was found to be stolen property that Miller and Ruper had allegedly taken from the male victim.

The 58-year-old victim was transported to WCA Hospital to receive immediate medical attention.

Miller and Ruper were taken to Jamestown City Jail where they are currently awaiting arraignment.

Cattaraugus County Sheriff warns of phone scam

The Cattaraugus County Sheriff’s Office is warning residents of a phone scam. The sheriff’s office received a complaint Friday from a resident regarding an ongoing phone scam. The resident received two threatening phone calls in the past three days from a subject claiming to be an Officer John Roberts from the IRS.

This alleged officer demanded the resident or her attorney to return his phone call due to a “very extreme situation.” The caller’s voice had a foreign accent. The resident contacted the IRS and advised that this officer is not an employee; the IRS would also not contact citizens and demand a phone call.

The sheriff’s office would like to remind residents to be wary of phone calls that utilize scare tactics, as they often are scam artists attempting to gain personal information to defraud their victims.

Forestville teen charged after alleged fight

FORESTVILLE – A teenager has been charged after an alleged fight that occurred at Forestville High School on Tuesday.

According to the Chau-tauqua County Sheriff’s Office, a 17-year-old female allegedly punched another female youth on school property. Deputies responded to a Versailles Road residence at 3:15 p.m., in connection with the fight.

The female youth was charged with second-degree harassment and was released to appear in Hanover Town Court.

Busti man charged with rape

KIANTONE – On Tuesday, New York State Police arrested Michael D. Clark, 27, of Busti for third-degree rape and endangering the welfare of a child after a lengthy investigation conducted by New York State Police and the Jamestown Police Department.

Clark is alleged to have had sexual intercourse with a 16-year-old female last summer in Kiantone.

Clark was arraigned in the Town of Kiantone Court and committed to Chautauqua County Jail in lieu of $25,000 bail.

ELLERY – Jared L. Hunt, 24, of Mayville was charged with failure to keep right, seventh-degree criminal possession of a controlled substance and unlawful possession of marijuana on Wednesday.

Hunt’s vehicle was stopped on Route 430 for an alleged traffic violation. Hunt was found to be allegedly in possession of a small quantity of marijuana as well as a controlled substance. He was released to appear in Ellery Town Court.

New York State Police at Jamestown

RANDOLPH – On Wednesday, New York State Police arrested Jonathan Riddell, 32, of Conewango Valley after a traffic stop for a window tint violation on State Route 241.

Riddell was placed under arrest for allegedly driving while intoxicated and transported to Jamestown State Police for processing where a blood alcohol level of .13 percent was obtained.

He was issued tickets for driving while intoxicated and window tint violation returnable to the town of Randolph Court. He was released to a third party.

Kurt Wolnik of Dunkirk was flown by Starflight to ECMC with non-life threatening injuries.

Teenager charged under zero tolerance in city

A teenager has been charged under zero tolerance following a traffic stop in Dunkirk Sunday.

According to the Chautauqua County Sheriff’s Office, Robert M. Piotrowicz, 19, of Hamburg was charged under zero tolerance in addition to unlawful possession of alcohol under 21 and speeding.

Deputies stopped a vehicle around 2:15 a.m., on Millard Fill-more Avenue for speeding. Piot-rowicz, the driver, and passenger Tyler Gaglia, 18, from Hamburg, were found to had allegedly consumed alcohol and allegedly had alcohol in their possession. Gaglia was subsequently charged with unlawful possession of alcohol.

Piotrowicz was not intoxicated but charged under the zero tolerance law for allegedly having consumed alcohol then operating a motor vehicle while underage.

Both men will appear in Dun-kirk City Court while Piotrowicz will have to appear at a DMV hearing for the zero tolerance law.

Chautauqua County Sheriff’s Office

Mark C. Majka, 24, of Depew was charged with driving while intoxicated, aggravated DWI and speeding Saturday. Deputies stopped Majka’s vehicle on Brigham Road in Fredonia for speeding shortly after 3:30 a.m. Majka was allegedly found to be intoxicated with a reportable blood alcohol content of .18 percent or higher. Majka was released to appear in Fredonia Village Court at a later date.

FORESTVILLE – Michael A. Campaign, 44, of Pearl Street was charged with fourth-degree criminal mischief, second-degree har-assment and second-degree reckless endangerment Tuesday. Dep-uties were called for an alleged domestic dispute on Pearl Street at 3:30 p.m. Campaign allegedly broke a vehicle window while a female victim was inside. When the victim tried to call for help, Campaign allegedly obstructed her from doing so. He was arraigned in Pomfret Town Court.

ARKWRIGHT – Fredonia State Police arrested Tyler J. Gleason, 24, of Stow, for second-degree criminal contempt violating a court order without incident.

Gleason was issued an appearance ticket and is to appear in town of Arkwright Court.

Fredonia State Police re-ceived a complaint of a suspicious small gray car in the area of the Lakeside Trailer Park on East Lake Road in the town of Dunkirk along with a description of a suspicious passenger going through park residents’ vehicles.

Investigation revealed the two subjects in the vehicle were in possession of stolen property taken from vehicles in the trailer park parking lot. This led to the arrest of Nicholas Colilli, 18, of Rochester on two counts of petit larceny and two counts of fifth- degree criminal possession of stolen property and Irma Ulici, 21, of Webster, for two counts of fifth-degree criminal possession of stolen property. They were processed and given appearance tickets for Town of Dunkirk Court.

Fredonia State Police arrested Anthony Amoroso, 24, of James-town for driving while intoxicated on the Fredonia Stockton Road.

The vehicle’s registration was also expired. The operator was transported to Fredonia State Police for processing and issued appearance tickets to appear in the Town of Pomfret Court. He was then released to a relative.

Fredonia State Police arrested Kassandra Estimar, 20, of Cortlandt Manor, for shoplifting at Tops Market on Vineyard Drive in Dunkirk. Estimar shoplifted $41.87 worth of cosmetics. She was processed and given an appearance ticket to appear in the Town of Dunkirk Court.

JAMESTOWN – On April 27 New York State Police arrested Kristy M. Wisniewski, 30, of Jamestown after a traffic stop on Washington Street.

Troopers had been flagged down by a motorist reporting an erratic driver and after locating the vehicle, observed the driver fail to use the turning signal, drive up onto the curb and veer between lanes. Wisniewski was transported to Jamestown State Police where a blood alcohol level of .26 percent was obtained. She was charged with driving while intoxicated, aggravated driving while intoxicated, and felony first-degree aggravated unlicensed operation.

She was arraigned in the Town of Ellicott Court and committed to Chautauqua County Jail.

JAMESTOWN – On Saturday, New York State Police arrested April M. Nelson, 25, of Jamestown after a traffic stop on Pratt Street to see if the occupants needed any assistance.

Nelson was transported to Jamestown State Police for processing where a blood alcohol level of .14 percent was obtained.

She was issued appearance tickets for driving while intoxicated and released to a third party.

JAMESTOWN – On April 23 at 9:30 p.m. a Jamestown State Trooper heard the sound of a window breaking .

The trooper pulled into the driveway and shined the spotlight on the house and observed a broken door and a male on the porch.

The 16-year-old suspect was taken to Jamestown State Police for processing and issued appearance tickets for fourth-degree criminal mischief, trespass and resisting arrest, all returnable to Jamestown Court. The suspect was released to a guardian.

Gowanda Police

Blain Lay, 46, of Chestnut Street was charged with third-degree assault, criminal obstruction of breathing, resisting arrest and obstruction of governmental administration on April 7. Police responded to the report of a violent domestic in progress at a Chestnut Street residence. It is alleged Lay, who allegedly appeared to be intoxicated, slapped, punched and threw a female to the floor. Lay then allegedly tried to choke the victim and was belligerent with police. Lay was arraigned in Persia Town Court and sent to the Cattaraugus County Jail in lieu of $500 bail.

Eric Stoltman, 42, of Cheektowaga was charged with second-degree criminal contempt on April 8. Stoltman turned himself into police from a previous complaint. Stoltman allegedly violated an order of protection numerous times. He was released to appear in Persia Town Court.

Jodi L. Harbinson, 44, of Jamestown Street was charged with failure to comply with a stop sign and aggravated unlicensed operation on April 14. Harbinson allegedly failed to stop at a stop sign at the intersection of Caroline and Seneca streets. During the traffic stop, it was found her license was suspended in March for failure to pay a fine. Harbinson was released on an appearance ticket for Collins Town Court.

Delancey Jimerson, 56, of Lawtons was charged with failure to keep right, driving while intoxicated and having an open container on April 19. Jimerson was allegedly operating her vehicle in an erratic manner on Buffalo Street. He was found to be allegedly intoxicated and have an alleged open container in the vehicle. Jimerson’s blood alcohol content was found to be a reportable .15 percent. He was released to appear in Collins Town Court.

Hannah G. Cleland, 20, of Dayton was charged with aggravated unlicensed operation, operating with a suspended registration and operating with no insurance on April 22. The license plate reader alerted police to Cleland’s vehicle while on patrol. Cleland’s license was allegedly suspended the previous day while her registration was allegedly suspended in March. She was released to appear in Collins Town Court.

Randy L. Hilliker Jr., 36, of Buffalo Street was charged with criminal trespass, third-degree criminal mischief and second-degree harassment on April 23. Hilliker allegedly attempted to enter a residence on Union Street where he was an unwanted guest. Hilliker allegedly caused damage to the door and allegedly pushed a female resident in the face. He was arraigned in Collins Town Court and released on $1,000 bail.

Gerald K. Redford II, 38, of Walnut Street was charged with unlawful possession of marijuana on May 1. Redford was being questioned for his involvement in a larceny incident. During questioning, Redford was allegedly found to be in possession of marijuana. Redford was arraigned in Persia Town Court and sent to the Cattaraugus County Jail in lieu of bail.

Frank D. George, 46, of Palmer Street was charged with aggravated unlicensed operation, operating with a suspended registration and operating with no insurance on May 2. The license plate reader alerted to George’s vehicle on West Main Street. George’s licensed was allegedly suspended in April and his registration was suspended in March. He was released on an appearance ticket for Persia Town Court.

Woman charged after allegedly striking pregnant victim

GOWANDA – A Go-wanda woman has been charged after allegedly being involved in an altercation with a pregnant woman. According to Gowanda Police, Jennifer M. Montfort, 36, of South Chapel Street was charged with second-degree reckless endangerment, third-degree menacing and fourth-degree stalking on April 28.

Police responded to the complaint of a disturbance on East Main Street where Montfort allegedly had started a verbal altercation with a pregnant woman. Montfort allegedly returned to this residence numerous times threatening the victim and escalated her threats by allegedly punching, kicking and pulling the hair of the victim.

The confrontation continued outside the residence where Montfort allegedly attempted to strike the victim with her vehicle. Montfort was arraigned in Collins Town Court and released on her own recognizance. The New York State Police and the Erie County Sheriff’s Office also responded.

Man charged after allegedly chair throw

ARKWRIGHT – An Arkwright man has been charged with second-degree harassment after he allegedly threw a chair Tuesday.

According to the Chau-tauqua County Sheriff’s Office, Richard P. Lloyd, 47, of Route 83 was involved in a disagreement with another resident when he allegedly threw a chair, striking the individual at 7:40 a.m. The individual struck substained minor injuries.

Lloyd was released on an appearance ticket to appear in Arkwright Town Court.

WESTFIELD – Dillon Ward, 21, of Shore Drive was charged as a fugitive of justice on Tuesday.

Sheriff deputies from Pennsylvania issued a warrant for failure to appear on a charge of conspiracy receiving stolen property. The charges stem from a lengthy investigation conducted by the CCSO and Pennsylvania State Police involving a burglary of a Route 5 residence.

Ward was arrested at his residence at 9:55 a.m. He was arraigned in Westfield Court and sent to the County Jail in lieu of bail.

Police charge two motorists under zero tolerance

Two drivers were charged under the zero tolerance law over the weekend. Accord-ing to the Chautauqua County Sheriff’s Office, two underage motorists were found to be allegedly intoxicated in two separate incidents.

Deputies stopped Hunter D. Giordano, 20, of Buffalo for allegedly speeding on Route 60 in the town of Dunkirk at 1:42 a.m., Satur-day. Giordano was allegedly found to be intoxicated under the age of 21. He was also found to be in alleged possession of marijuana.

Giordano was charged with speeding, unlawful possession of marijuana and zero tolerance. He will appear in Dunkirk Town Court at a later date and will appear in front of a DMV law judge to answer the zero tolerance violation.

In a separate incident on Sunday, Amanda R. Klemowski, 20, of Buffalo was stopped for allegedly not having tail lamps or head lights on Route 60 in the town of Pomfret at 3:21 a.m. Deputies found Klemowski to be allegedly intoxicated under 21. She was charged with having no head lights, having no tail lamps and zero tolerance. She was released to appear in Pomfret Town Court at a later date. She will also appear in front of a DMV law judge to answer the zero tolerance violation.

Randolph man charged under Leandra’s Law

SOUTH DAYTON – A Randolph man has been charged under Leandra’s Law on Thursday. Accord-ing to the Cattaraugus County Sheriff’s Office, Joshua J. Dash, 34, was charged with driving while intoxicated, aggravated DWI with child in vehicle and two counts of endangering the welfare of a child.

Police receive numerous complaints that Dash was allegedly driving in an intoxicated state with his two children in the vehicle. He was located in the village of South Dayton and arrested.

Dash was arraigned in Persia Town Court sent to the Cattaraugus County Jail in lieu of $3,000 bail. He is due back in court at a later date.

Man allegedly found with five pounds

of marijuana

JAMESTOWN – A Jamestown man has been charged after allegedly having several pounds of marijuana during a traffic stop. Matthew A. Zimmerman, 27, of Price Street was charged with second-degree criminal possession of marijuana on Friday.

Zimmerman was stopped on West 11th Street at 3:50 p.m., as a result of a joint investigation by the South-ern Tier Regional Drug Task Force, Jamestown Police Department and New York State Police Department. During the stop, Zimme-rman was found to be allegedly in possession of five pounds of marijuana. Zimmerman was arraigned in Jamestown City Court and released to appear again in court at a later date.

MAYVILLE – Joshua A. Powell, 28, of Jamestown was charged with seventh-degree criminal possession of a controlled substance and promoting prison contraband on April 17. Powell was being booked in the Chautauqua County Jail when a search of his belongings showed he was allegedly in possession of a strip of a suboxin hidden in some toilet paper. Powell was arraigned in Chautauqua Town Court where bail was set at $1,000 cash. Powell is still being held at the county jail on other charges.

Patrick F. Donohue, 20, of Buffalo was charged with failure to stop at a red light and driving while intoxicated on Sunday. Deputies stopped Donohue’s vehicle on Route 20 in Fredonia for allegedly failing to stop at a red signal. Donohue was found to be allegedly intoxicated. He was released on his own recognizance to appear in Fredonia Village Court at a later date.

Erie County Sheriff’s Office

NORTH COLLINS – Mark A. Igel, 51, of North Collins was charged with driving while intoxicated under the influence of drugs and several other traffic infractions on Saturday. At 8:10 p.m., deputies stopped Igel’s vehicle on Route 62 near Cain Road for alleged erratic operation. A blood test was taken to determine Igel’s level of intoxicated by drugs. He was released to appear in North Collins Court.

Pomfret man charged after striking grapes, two guardrails

A 45-year-old Pomfret man was charged with aggravated driving while intoxicated and leaving the scene of a property damage accident after police say he fled an accident Saturday in which he hit a row of grapes and two guardrails.

According to the Chau-tauqua County Sheriff’s Office, Peter Moldenhauer II of Van Buren Road was driving on Chestnut Road in the town of Dunkirk around 5:40 p.m. when he allegedly went of the roadway. Deputies responded to the accident, but the driver reportedly fled the scene.

Moldenhauer allegedly struck a guardrail in the southbound lane and another in the northbound lane when the accident occurred.

Deputies found him and also charged him with refusal to take a roadside screening test and failure to maintain lane. He will appear in Dunkirk Town Court.

The Dunkirk Police Department also responded to the incident.

Teenager allegedly steals potato chips

MAYVILLE – A 17-year-old male has been charged after allegedly stealing snacks.

According to the Chau-tauqua County Sheriff’s Office, the youth from Dun-kirk put a can of Pringles under his shirt and walked out of a North Erie Street business without paying.

The youth, whose name was not released by police, was charged with petit larceny and will appear in Chautauqua Town Court.

Man allegedly attempts to flee from police custody

GOWANDA – A Go-wanda man briefly escaped handcuffs while being arrested Thursday. According to Gowanda Police, Randy L. Hilliker, 36, of Buffalo Street intentionally slipped out of his handcuffs and attempted to flee.

Police responded to a complaint of an unwanted guest at 4 p.m., on West Hill Street. Hilliker allegedly entered the residence and refused to leave. He allegedly repeatedly attempted to make physical contact with a female at this residence, going against an order of protection issued by Collins Town Court. When other occupants of this residence attempted to intervene, Hilliker allegedly assaulted a victim, causing notable facial injuries.

After being arrested, Hil-liker allegedly intentionally slipped out of his handcuffs and attempted to flee. He was captured immediately. Hilliker was charged with second-degree criminal trespass, a misdemeanor, first-degree criminal contempt, second-degree assault and second-degree escape, all three which are felonies.

Hilliker was arraigned in Persia Town Court and sent to Cattaraugus County Jail in lieu of $4,000 bail.

PORTLAND – James M. Coccarelli, 29, of Pecor Street was charged with second-degree assault and endangering the welfare of a child on Saturday. Deputies served a warrant on Coccarelli who was outside a residence for the charges. Coccarelli was taken into custody and arraigned in Portland Town Court. He was sent to the Chautauqua County Jail without bail.

SHERMAN – Joshua M. Berner, 24, of North Tonawanda was charged with petit larceny on Wed-nesday.

Deputies receive a report of theft of an auto repair business on Armenian Road. Berner allegedly took a book of New York state inspection stickers, all of which were recovered. Berner was released to appear in Sherman Town Court at a later date.

PERRYSBURG – Da-vid Singh, 29, of Second Street was charged with a New York state parole absconder warrant on April 19. Troopers responded to Singh’s residence for an alleged harassment complaint. During an investigation, a computer check revealed the active warrant. Singh was taken into custody and transported to the Cattaraugus County Jail pending arraignment.

CONCORD – Ryan Brown, 19, of Springville was charged with aggravated driving while intoxicated on April 20.

Troopers saw Brown’s vehicle allegedly fail to stop at a stop sign at Trevett Road and Route 39 and continue south on Trevett Road. Police began to follow Brown’s vehicle and observed him allegedly fail to negotiate a curve, leave the road and spin out. Brown was found to be allegedly intoxicated with a reportable blood alcohol content of .18 percent. He was released to appear in court.

SOUTH DAYTON – Daniel Weaver, 19, of Cherry Creek was charged with unlawful possession of marijuana Friday.

Troopers were on patrol and stopped a vehicle for an alleged equipment violation. Weaver, a passenger in the vehicle, was found to be in alleged possession of a marijuana pipe. He was released to appear in court.

Cattaraugus County Sheriff’s Office

SALAMANCA – On Wednesday at about 9:10 p.m., David C. Presons, 32, of Salamanca was arrested on a Family Court bench warrant.

Presons was transferred to the custody of the sheriff’s department and taken to New Albion Court for arraignment.

He was remanded to the Cattaraugus County Jail in lieu of $5,000 cash bail. He is due in Olean Family Court on a later date.

State Police charge two following burglary

COLLINS – Two men have been charged following a burglary in Versailles that occurred in early April. According to New York State Police at Collins, Thomas Jones, 20, of Irving was charged with second-degree burglary and fifth-degree criminal possession of stolen property and Jeffrey Hittle, 18, of Angola was charged with fifth-degree criminal possession of stolen property on Wednesday.

Theses arrests conclude a three-week investigation into a burglary to a home on Burning Springs Road in Versailles. That afternoon the homeowner left the residence, returning an hour later. Jones allegedly entered the home and stole two flat screen TVs while the owner was gone.

Following the incident, troopers interviewed numerous neighbors, and additional information led police to a video game and pawn shop in Derby. At this business, police located the two stolen TVs, along with surveillance video of Jones, Hittle and a third subject, yet to be charged, bringing the TVs into the store.

Hittle was released on an appearance ticket for Evans Town Court. Jones was arraigned in Perrysburg Town Court and sent to the Cattaraugus County Jail on $1,000 cash bail. He will also appear in Evans Town Court at a later date.

Two face drug charges in Jamestown

JAMESTOWN – Police have taken two more men into custody in the ongoing investigation into the sale and trafficking of narcotics in the city.

At 2:15 a.m. Friday morning, investigators and members of the SWAT team executed a search warrant at 846 Lafayette St., Apt. 1 and took 45-year-old Tyrone C. VanHook and 37-year-old Simeon A. Leeper into custody. Inside the apartment, a quantity of crack cocaine, drug paraphernalia and a large quantity of cash was located.

Upon initial entry into the residence, investigators saw Leeper flush a quantity of drugs into a toilet.

VanHook was charged with third-degree criminal possession of a controlled substance and criminal use of drug paraphernalia. Leeper was charged with criminal tampering with physical evidence and second-degree obstructing governmental administration.

Both subjects are currently being held in city jail awaiting arraignment.

Man arrested following short pursuit

GOWANDA – A Tonawanda man led New York State Police on a brief pursuit Saturday morning. According to police, Marquelle Porter-Everette, 24, was taken into custody following the pursuit through the village around 1 a.m.

Troopers were on patrol on Aldrich Street when they observed a vehicle allegedly with no tail lights. Police attempted to stop the vehicle but Porter-Everette failed to comply, leading police on a pursuit up West Main Street onto South Chapel Street, before finally coming to a stop on Jamestown Street. During the pursuit troopers observed Porter-Everette allegedly throw something from the driver’s window. Gowanda Police and the Erie County Sheriff’s Office responded to the scene to check the area. Troopers and a sheriff deputy subsequently found a folded $20 bill with cocaine residue in it on the street.

Porter-Everette was also found in alleged possession of a container with marijuana in it. He was charged with seventh-degree criminal possession of a controlled substance, unlawful possession of marijuana, operating a vehicle not equipped with an interlock device and numerous other traffic tickets.

During the stop, police also discovered Porter-Everette allegedly had two outstanding warrants for Erie County Probation and Buffalo City Court. He was taken to the Erie County Holding Center pending his arraignment on the probation warrant. Porter-Everette will answer the other charges in Persia Town Court on a later date.

Jamestown man one of 32 indicted in ‘Operation Crazy Train’

State Attorney General Eric T. Schneiderman and New York State Police Superintendent Joseph A. D’Amico today announced the indictment of 32 people charged, including a Jamestown man, with operating two related, large-scale drug distribution networks that funneled narcotics into Rochester, Buffalo and neighboring communities. The multi-agency, 13-month investigation, known as “Operation Crazy Train,” included covert surveillance and hundreds of hours of wiretaps.

Jamestown man charged following search warrant

JAMESTOWN – A Jamestown man has been charged following an investigation into the illegal sales and trafficking of cocaine within the city. Laval A. Johnson, 29, has been charged with third-degree criminal possession of a controlled substance Thursday.

A search warrant was executed at a Lafayette Street residence at 10:25 a.m., by Jamestown Police and New York State Police. Johnson was located inside the apartment and allegedly had in his possession a quantity of crack cocaine and cash. Johnson was taken to the Jamestown City Jail pending arraignment.

Police also took Antonio A. Sanders, 25, into custody on two outstanding warrants for failing to appear in court for a first-degree contempt charge. Sanders was taken to the city jail pending arraignment.

Dunkirk Police Department

Julian Duman, 18, of Main Street was charged with fourth-degree criminal possession of a weapon and unlawful possession of marijuana on April 24.

Carrie Paul, 19, of Falconer was charged with aggravated harassment on April 25.

Stephanie Martinez, 25, of Maple Avenue was charged with second-degree reckless endangerment and leaving the scene of a personal injury accident after an accident at 12:50 p.m. on Leopard Street just north of East Seventh Street on April 23. Martinez allegedly hit a pedestrian, who was taken to Brooks Memorial Hospital for unknown injuries.

Samuel Barreto, 23, of East Courtney Street Upper was charged with obstruction and menacing an officer on April 26.

John Whitcomb Jr., 35, of Hanover Road, Forestville, was charged with driving while intoxicated, first-degree aggravated unlicensed operation, failure to keep right and failure to use designated lane on Sunday.

Christopher Lockett, 24, of South Roberts Road, Jacob Lockett, 18, of Lincoln Avenue, Alex Crossan, 18, of Eagle Street, Samuel Pepe, 18, of West Howard Avenue and Daniel Mancuso, 18, of Central Avenue were all charged with unlawful possession of marijuana on Tuesday. Christopher Lockett was also charged with failure to yield a left turn and no taillight.

Fritz Boettcher, 52, of Antelope Street was charged with second-degree harassment on Thursday.

City man, 26, charged in wild ride to beach

A Dunkirk man has been charged in the Sunday evening ride that led to a car breaking through a guard rail, going airborne and landing on a beach.

City police report this morning that Matthew J. Jessie, 26, of 209 Lake Shore Drive East, was allegedly driving the vehicle at a high rate of speed around 11:30 p.m. that evening.

He was charged with third-degree aggravated unlicensed operation of a motor vehicle as well as speed not reasonable and prudent.

He will be in city court on May 12 to answer the charges.

Car stuck in grape vineyard leads to charges

RIPLEY – A Westfield man is being charged with driving while intoxicated after his vehicle was found in a vineyard. According to the Chautauqua County Sheriff’s Office, Joseph A. Timmerman, 32, of West Main Road was charged with DWI early Wednesday morning.

Just before 1 a.m., police responded to the report of a suspicious vehicle stuck in a grape vineyard on Route 5. Deputies found Timmer-man’s vehicle allegedly stuck in an irrigation ditch.

It was found that Timmerman was allegedly intoxicated. He was released to appear in Ripley Town Court at a later date.

According to police, other charges may be filed pending an investigation into the property damage at the vineyard.

Bus driver seriously injured in crash

CONCORD – A bus driver for the Springville-Griffith Institute was seriously injured in a two-vehicle accident Wednesday. According to the Erie County Sheriff’s Office, the accident happened at the intersection of Genesee and Springville-Boston roads shortly after 8:30 a.m.

David Barry, 26, of Denton, Md., was traveling west on Genesee Road and allegedly failed to stop for the stop sign. His tractor trailer was struck by a school bus driven by Marlene Golabek, 56, of Springville who was traveling south on Springville-Boston Road. No students were aboard the bus at the time of the crash.

Golabek was flown by Mercy Flight to Erie County Medical Center where she is listed in stable condition. Barry was uninjured. East Concord Fire Company and Springville Fire Department responded to the scene.

Barry was charged with failure to obey a stop sign, failure to yield the right of way and a log book violation.

The investigation is continuing.

Chautauqua County Sheriff’s Office

HANOVER – Frank M. Pachetti III, 19, of Irving was charged with criminal possession of a hypodermic instrument on Wednesday.

Deputies were called to an East Spears Road residence for the complaint of an alleged disorderly person at 12:49 a.m. Pachetti was allegedly involved in a verbal altercation with another male. He was later found to be in possession of an alleged hypodermic needle. Pachetti was released to appear in Hanover Town Court.
