Chautauqua County Sheriff’s Office

POLAND – On Saturday, at about 4:25 p.m. Sheriff’s deputies stopped a vehicle on Route 62 in the town of Poland for multiple traffic violations. Susan A. Massey, 65, of Kennedy was allegedly found to be intoxicated.

Massey was taken into custody and later released with traffic tickets for driving while intoxicated with a blood alcohol level of .08 percent or higher, failure to keep right, move from lane unsafely, consumption of alcohol in a motor vehicle, and failure with a lawful order.

She will appear in Town of Poland Court at a later date to answer charges.

CHAUTAUQUA – On Saturday, around 1:30 a.m. deputies stopped a vehicle for allegedly speeding and moving from its lane unsafely. The driver, David E. R. Lavtar, 29, of Mayville, was alleged to have been intoxicated.

He was placed in custody and later released with tickets for speeding, moving from lane unsafely, driving while intoxicated and aggravated driving while intoxicated.

He is to answer the charges in the Town of Chautauqua Court at a later date.

KIANTONE – On Nov. 17, at about 8 p.m., Sheriff’s deputies responded to a report of a vehicle in the ditch on Route 62 in the town of Kiantone.

Shawn M. Thorton, 37, of Warren Pa., was allegedly found to have been operating his vehicle while impaired by drugs. Deputies also allegedly found Thorton to be in possession of a weapon. He was taken into custody and later arraigned in Town of Kiantone Court. Thorton was remanded to Chautauqua County Jail on bail.

Thorton is scheduled to be in Town of Kiantone Court at a later date to answer charges of driving while ability impaired by drugs, move from lane unsafely, third-degree aggravated unlicensed operation, and third-degree criminal possession of a weapon.

Remains found in Kiantone not human

KIANTONE – On Thursday at about 1:45 p.m. the Chautauqua County Sheriff’s Office received a citizen report of the discovery of possible human remains in a wooded area near Route 62, in the town of Kiantone.

Deputies investigated and secured the location immediately, but determined the bones were not human remains.

ELLERY – On Wednesday at about 7:45 p.m. deputies stopped Nicole Harrell, 30, of Dewittville on Route 430 in the town of Ellery for operating her vehicle with fewer than two headlights.

Harrell allegedly had multiple driving while intoxicated related revocations and suspensions on her New York driver’s license.

She was issued traffic tickets for second-degree aggravated unlicensed operation with alcohol, failure to use interlock device, and operation with less than two headlights.

She will answer these charges at the Town of Ellery Court at a later date.

MAYVILLE – On Thursday at about 6 p.m. deputies stopped Edward Bean, 39, of Woodbridge, Va. on Sea Lion Drive in the village of Mayville for allegedly speeding.

Bean allegedly had multiple suspensions in New York and Virginia on his driver’s license.

He was charged with second-degree aggravated unlicensed operation, failure to stop at a stop sign, and speeding.

He will answer to these charges at the Town of Chautauqua Court at a later date.

ELLICOTT – On Wednesday at around 11: 45 p.m., Sheriff’s patrol stopped a vehicle on Jackson Avenue in the town of Ellicott for a lane violation and loud exhaust.

The operator was identified as Hugo T. Rosendahl, 47, of Warren, PA. Rosendahl was arrested for allegedly driving while ability impaired by drugs. He was charged with driving while intoxicated and on drugs, failure to maintain lane, and inadequate exhaust.

Rosendahl was processed and released to appear in Ellicott Town Court on a later date.

PORTLAND – On Thursday deputies stopped Jeremiah Bednarek, 33, of Gowanda for allegedly speeding and not moving over for an emergency vehicle.

Investigation revealed Bednarek, and his passenger, Michael Strawder, 38, of Gowanda were in possession of an open container of alcohol inside the vehicle.

It was determined that Bednarek was allegedly driving while intoxicated and was charged with speeding, failure to move over for an emergency vehicle, possession of an open alcoholic beverage, driving while intoxicated per se, and third-degree aggravated unlicensed operation.

Strawder was charged with possession of an open alcoholic beverage in a motor vehicle.

Both are to answer these charges at a later date in the Town of Portland Court.

Lindsey Katta, 26, of Buffalo, was charged Thursday around 1 a.m. with driving while intoxicated, DWI with a blood alcohol content of .08 percent or higher, failure to dim high beams and inadequate brake lights after a traffic stop on Route 20 in the town of Pomfret. Katta was allegedly stopped for traffic violations and was allegedly found to be intoxicated. She was released with tickets and will appear in Pomfret Town Court at a later date.

Jamestown man injured in accident

CLYMER – On Wednesday around 4:30 p.m. a vehicle was traveling eastbound on Raspas Hill Road when it lost control on the icy roads and became overturned in a ditch resting on it’s passengers side.

The driver, Jeffrey Thiem, 50, of Jamestown was extricated by Clymer and Sherman Fire departments and transported via Clymer Fire Ambulance to Hamot Hospital with non-life threatening injuries. No charges have been made.

Dunkirk Police

Nathaniel Hollins, 23, of Ruggles Street was charged with second-degree harassment on Nov. 19.

Jim Norton, 34, of Meyers Road, Forestville, was charged with failure to yield the right of way at a stop sign on Nov. 21 after a two-vehicle accident around 5:15 p.m. at the intersection of Brigham Road and West Fourth Street.

Dawn Vento, 40, of Webster Road, Fredonia, was charged with following too closely and uninsured motor vehicle on Nov. 21 after a two-vehicle, rear-end accident around 7:15 p.m. at the intersection of Lake Shore Drive East and Main Street.

Rebecca Ruiz, 25, of Franklin Avenue was charged with second-degree harassment on Sunday.

Robert Zimmerman, 57, of Lake Shore Drive West was charged with two counts of petit larceny, fifth-degree criminal possession of stolen property and third-degree unauthorized use on Sunday.

Fredonia Police

Kathryn Tennyson, 44, of Prospect Street was charged with driving while intoxicated, aggravated DWI per se, failure to keep right and unlicensed operator on Nov. 20.

Josue Baez, 26, of Lake Shore Drive East, Dunkirk, was charged with third-degree criminal possession of a controlled substance, resisting arrest, second-degree obstruction of a governmental administration, unlawful possession of marijuana, littering and open container on Saturday.

LITTLE VALLEY – On Nov. 21 at about 8:45 p.m., deputies arrived at 301 Court St. in Little Valley and charged Carol Spitale, 26, of Lakewood with seventh-degree criminal possession of a controlled substance and second-degree promoting prison contraband after allegedly finding a controlled substance in her sock during the intake process at the Cattaraugus County Jail.

Spitale was released on charged with appearance tickets and is due back in the Town of Little Valley Court at a later date.

ELLERY – Jeffrey L. Coleman, 49, of Vermilion, Ohio was charged with driving while ability impaired by drugs, two counts of seventh-degree criminal possession of a controlled substance and crossing hazard markings on Sunday. Deputies stopped Coleman’s vehicle at 3:45 p.m., on I-86 after receiving a complaint of a tractor trailer operating erratically. Coleman was found to be allegedly under the influence of drugs and found to have an alleged amount of a controlled prescription narcotic and heroin. Coleman was arraigned in Ellery Town Court and was sent to the Chautauqua County Jail in lieu of $5,000 cash or $10,000 property bail.

SILVER CREEK – Arnold D. Moore II, 50, of Robinson Street was charged with driving while intoxicated, aggravated DWI with a blood alcohol content of .18 percent or more and passed a red signal on Sunday. Deputies witnessed Moore’s vehicle allegedly commit a traffic violation on Central Avenue at 9:19 p.m. Moore was found to be allegedly intoxicated during the traffic stop. Moore was released to appear in Silver Creek Village Court at a later date.

State Police at Jamestown

JAMESTOWN – On Saturday, New York State Police arrested Marie E. Smith, 41, of Jamestown for driving while intoxicated after a traffic stop for running a red light on Buffalo Street in the city of Jamestown. Smith was transported to Jamestown barracks where a blood alcohol level of .15 percent was obtained.

Smith was issued tickets for driving while intoxicated and driving through a red light. Passenger, Brittany A. Smith, 21, was arrested for disorderly conduct after she attempted to interfere with the investigation.

Both are to appear in the City of Jamestown Court at a later date and were released to a third party.

ELLERY – On Saturday, around 2 a.m. Jamestown State Troopers responded to a report of an erratic driver speeding on Interstate 86, and observed a vehicle heading toward them traveling eastbound in the westbound lane in the town of Ellery.

A traffic stop was initiated and the driver, Vincent R. Richter, 34, of Findley Lake was arrested for driving while intoxicated. Richter was taken to Jamestown barracks for processing where a blood alcohol level of .13 percent was obtained. He was issued tickets for driving while intoxicated and released to a third party. Richter is to appear in the Town of Ellery Court at a later date.

RANDOLPH – On Saturday, New York State Police arrested Zachary J. Walters, 23, of Randolph after being dispatched to a report of a vehicle off the road on Interstate 86 in the town of Randolph.

Troopers located the vehicle and determined that it had been involved in a property damage accident. Troopers were advised that the driver had walked to his residence in Randolph after the accident. The driver, Walters was located and placed under arrest for driving while intoxicated.

He was taken to Jamestown barracks for processing where a blood alcohol level of .14 percent was obtained. Walters was issued tickets for leaving the scene of a property damage accident, speeding, driving while intoxicated and unlawful possession of marijuana.

He is to appear in the Town of Randolph Court at a later date and was released to a third party.

HANOVER – Randall M. Abbey, 34, of Angell Road was charged with second-degree harassment on Friday. Deputies responded to an Angell Road residence for a complaint at 8:19 a.m. It is alleged that during an altercation with another male, Abbey did shove the male to the ground and kick him in the face. Abbey was released to appear in Hanover Town Court at a later date.

JAMESTOWN – Christopher S. Small, 26, of Falconer was charged with driving while intoxicated, failure to obey traffic control device and unlawful possession of marijuana on Saturday. Deputies observed Small’s vehicle on East Second Street allegedly fail to stop at a red light at the intersection of Buffalo Street at 2:42 a.m. Small was found to be allegedly intoxicated and to be in possession of marijuana. Small was released to appear in Jamestown City Court at a later date.

CLYMER – Ryan M. Peters, 25, of Clymer was charged with third-degree rape and endangering the welfare of a child on Tuesday. Peters was taken into custody without incident on a warrant. Peters was arraigned in Clymer Town Court and sent to the Chautauqua County Jail.

NORTH HARMONY – On Monday, New York State Police arrested Kevin C. Cole, 50, of Sherman after the patrol checked on a vehicle off the road on Interstate 86 in the town of North Harmony.

Cole was placed under arrest for driving while intoxicated and transported to Jamestown barracks where a blood alcohol level of .23 percent was obtained.

A computer check found that Cole’s driver’s license is currently revoked for a driving while intoxicated refusal. Cole was issued tickets for driving while intoxicated and first-degree felony aggravated unlicensed operation. He is to appear in North Harmony Town Court. Cole was released to a third party.

Jamale Jemison, 34, of North Beagle Street was charged with endangering the welfare of a child and second-degree harassment on Nov. 11.

Shamaar Braggs, 33, of Grant Avenue was charged Nov. 13 with two counts of third-degree criminal possession of a controlled substance

Jose Garcia, 42, of South Roberts Road was charged with third-degree assault on Nov. 13.

Angelo Bomasuto, 46, of Central Avenue was charged with leaving the scene of a property damage accident and failure to keep right on Saturday.

According to an accident report, around 7:30 p.m., Bomasuto was traveling north on South Roberts Road near Stanislaus Avenue when he reportedly lost control due to brake failure. He then apparently slid sideways and struck a crosswalk sign, a sewer vent and a tree and allegedly ran over another sewer vent while fleeing the scene.

Bomasuto was reportedly identified from an unrelated traffic stop.

Edriese Walker, 24, of Lake Shore Drive East was charged with second-degree obstruction and disorderly conduct on Sunday.

Walter Duprey, 30, of Main Street was charged with disorderly conduct on Sunday.

NORTH HARMONY – Christopher Williams, 36, of Jamestown was charged with second-degree harassment on Nov. 9.

Around 7 p.m., deputies responded to an incident on Old Bridge Road. A female subject alleged that during an altercation between herself and Williams, Williams threw approximately $4 in quarters at her and struck her.

Williams was issued an appearance ticket for North Harmony Town Court.

ELLERY – Dustin Wilson, 30, of Dewittville was charged with second-degree harassment and endangering the welfare of a child on Wednesday.

Around 3 p.m. on Pickard Road, deputies spoke to a female complainant who alleged that Wilson intentionally grabbed her by the hair and attempted to throw her to the ground while she was holding a small child. A warrant was issued for Wilson and he was taken into custody.

Wilson was arraigned in North Harmony Town Court and released. He will appear in Ellery Town Court at a later date.

HANOVER – Fredrick Voltz, 58, of Lake Shore Road, Angola, was charged with second-degree harassment on Wednesday.

Around 10:30 p.m., Voltz allegedly punched a female victim at 845 Routes 5 and 20.

Voltz was issued an appearance ticket for Hanover Town Court.

Burglary suspects sought

The Chautauqua County Sheriff’s Office is currently searching for two men who are wanted in connection with an October burglary in the town of Chautauqua.

According to police, Chance Blanchard, 27, of Mayville and Christopher Douglas, 25, of Sherman are each wanted on two counts of third-degree burglary. It is alleged that in the early morning hours on Oct. 16 and 25 both men entered a barn owned by Josephine Crandall on Morris Road. The pair allegedly stole several older style farm tractors, lawn tractors, farm plows and a large quantity of miscellaneous scrap metal. The pair then removed the items via trailer and sold them as scrap for money.

With help from the public, police were able to identify Blanchard and Douglas as suspects but their whereabouts are unknown. Anyone with information on their location is asked to call police at 753-4925.

Chautauqua County Sheriff’s Office

ARKWRIGHT – Joshua Richter, 21, of Canon City, Colo., was charged with fifth-degree criminal possession of a controlled substance, petit larceny and endangering the welfare of a child on Wednesday.

Around 1:30 p.m., Richter was arrested in the village of Cassadaga for the charges stemming from an incident on Greenapple Road in the town of Arkwright. Richter allegedly stole prescription pills with the intent to sell them and also allegedly involved a 13-year-old youth in the incident.

He was committed to the Chautauqua County Jail in lieu of bail and will appear in Arkwright Town Court at a later date.

New York State Police at Jamestown

SHERMAN – Anthony Estela, 19, of Erie, Pa., was charged with falsely reporting an incident and moving from lane unsafely and Dennis Horwath, 27, also of Erie, Pa., was charged with seventh-degree criminal possession of a controlled substance and possession of a hypodermic instrument on Wednesday.

State police responded to a reported property damage accident on Interstate 86 in the town of Sherman. The driver, Estela, allegedly stated that a tractor trailer moved into his lane, causing him to move out of the way and strike the guardrail.

The passenger, Horwath, was interviewed and allegedly gave a different account of the events. Both subjects were interviewed again separately and both allegedly admitted there was no tractor trailer and that the driver had fallen asleep while driving.

Further investigation found Horwath to be in alleged possession of heroin and hypodermic needles with heroin residue.

Estela was issued tickets and released, while Horwath was arraigned in Sherman Town Court and released on $500 bail.

Joshua R. Pettygrove, 25, of Mechanic Street was charged on an arrest warrant on Oct. 25. Pettygrove was wanted for aggravated harassment when he failed to appear in Collins Town Court. Pettygrove was located on East Main Street and found to have an active warrant from Chautauqua County Court. He was arraigned in Collins Town Court and released on his own recognizance. Pettygrove was then turned over to Chautauqua County Sheriff’s Office.

Andrew D. Kennedy, 21, of Maple Avenue was charged with petit larceny on Oct. 28. Kennedy allegedly stole a purse from a customer at a Buffalo Street business and then took money from this purse while the victim was distracted. Kennedy was arraigned in Collins Town Court and sent to the Erie County Holding Center in lieu of $500 bail.

Randy L. Hilliker Jr., 36, of Buffalo Street was charged with second-degree harassment and second-degree criminal contempt on Oct. 29. Hilliker allegedly attacked a female at a Union Street residence by pulling this victim by the neck of her shirt and dragging her to the ground. An active order of protection from the Collins Town Court was in place for this female and Hilliker. Hilliker was arraigned in Collins Town Court and sent to the Erie County Holding Center in lieu of $5,000 bail.

Cheyenne N. Redeye, 25, of Salamanca was charged with second-degree burglary and third-degree assault on Nov. 3. Redeye allegedly, in concert with two other males, forced their way into a victim’s apartment and assaulted the victim on Sept. 17. Prior to police arrival, Redeye allegedly fled the scene but was later located by Salamanca Police on an active arrest warrant. Redeye was arraigned in Collins Town Court and was sent to the Erie County Holding Center in lieu of $1,500 bail.

Joseph A. Zontek, 54, of Cattaraugus was charged with petit larceny on Nov. 5. Zontek allegedly had hidden four blocks of cheese and left a Buffalo Street business without paying. Zontek was released to appear in Collins Town Court and all stolen items were recovered by police.

Leiondie R. Mohawk, 30, of Collins was charged on an active bench warrant on Nov. 4. Officers were notified of the warrant from North Collins Town Court and Mohawk was located on Walnut Street. Mohawk was arraigned in Collins Town Court and sent to the Erie County Holding Center in lieu of $250 bail.

Patrick M. Elvers, 59, of Springville was charged with unsafe tires and aggravated driving while intoxicated on Saturday. Police stopped Elvers’ vehicle on Buffalo Street for allegedly having a completely flat tire and driving on the tire’s rim at 1:27 a.m. Elvers was allegedly found to be intoxicated during the traffic stop and found to have a .19 percent blood alcohol content. Elvers was released to appear in Collins Town Court. The Erie County Sheriff’s Office assisted with this call.

Danielle M. Cooper, 39, of Irving was charged with operating without tail lights and aggravated driving while intoxicated on Sunday. Cooper was stopped on Buffalo Street for allegedly not having tail lights at 2:11 a.m. Cooper was found to be allegedly intoxicated and found to have a .31 percent blood alcohol content. She was released to appear in Collins Town Court.

Angi L. Witczak, 40, of Buffalo Street was charged with petit larceny on Monday. Police responded to the report of a theft at a Buffalo Street business at 2:15 p.m. Witczak allegedly stole a 30-pack of beer and left the business without paying. Witczak was located at her residence and was released to appear in Collins Town Court.

Police seeking information on fatal car crash

OBSERVER Staff Report

The Chautauqua County Sheriff’s Office is looking for the public’s help in connection with Tuesday night’s fatal crash.

The one-car crash claimed the life of Richard A. Caldwell, 57, of Route 20 in Fredonia at the intersection of Maytum and Chautauqua roads in Pomfret. Police conducted several neighborhood canvasses of the area and according to police, three sport motorcycles were seen either chasing or racing Caldwell’s vehicle.

Police say witnesses heard the crash and saw three motorcycles parked with headlights facing the vehicle with three males, who had taken their helmets off, looking at the car. When another vehicle approached the scene, the motorcycles allegedly took off heading south on Chautauqua Road.

One of the motorcycles reportedly had a blue headlight. Anyone with information is asked to contact the sheriff’s office at 753-4232.

Donna Lattuca, 51, of Hamburg was charged with trespass on Oct. 30.

Shaunquilla Davis, 23, of Main Street was charged on Nov. 4 with endangering the welfare of a child and second-degree harassment.

Jonathan Otero, 23, of Lincoln Avenue; Nelson Rodriguez, 31, of Lincoln Avenue; and Jose Olivencia, 26, of Ruggles Street were charged Nov. 5 with second-degree menacing, fourth-degree criminal possession of a weapon and trespass.

Daniel Strong, 19, of Kosciuszko Avenue was charged with second-degree harassment on Nov. 5.

Diolinda Almeida, 65, of Buffalo was charged with trespass on Nov. 6.

Three people were injured in a two-vehicle accident Nov. 6 at the intersection of East Seventh Street and Washington Avenue.

According to a report, around 3:50 p.m., Hannah Koellner, 18, of Orchard Park was traveling south on Washington Avenue and Angel Correa, 27, of Leming Street was heading east on East Seventh Street. Koellner reportedly told police she did not see Correa right before the accident. As a result of the crash, Correa’s vehicle struck a stop sign on the south-east corner of Washington Avenue.

Correa and two passengers, 3-year-old Daniella Thompson and 5-year-old Angelyce Correa, were taken to Brooks Memorial Hospital by the Dunkirk Fire Department for complaints of pain. Koellner was charged with failure to yield the right of way.

Two 17-year-old Dun-kirk residents, one of West Second Street and another of West Fourth Street, were charged with unlawful possession of marijuana on Nov. 7.

Donna Shirey, 26, of Ashville was charged with leaving the scene of a property damage accident, driving while intoxicated, failure to keep right and third-degree aggravated unlicensed operation Saturday after an accident around 3 a.m. on East Seventh Street.

According to a report, Shirey was traveling west on East Seventh Street when she struck a no parking sign on the south side of the road. Police say she was stopped shortly thereafter on Grant Avenue.

Lonnie Buchanan, 44, of Townsend Street was charged with disorderly conduct on Sunday.

Taylor Tierney, 21, of South Dayton, was charged with seventh-degree criminal possession of a controlled substance, third-degree aggravated unlicensed operation, window tint and uninsured motor vehicle on Sunday.

Thomas Millin, 50, of Central Avenue was charged with second-degree harassment on Monday.

Kristen Monsour, 28, of Morewood Drive was charged with petit larceny on Monday.

Robert Zimmerman, 57, of Lake Shore Drive West was charged with trespass on Monday.

Jonathan Gomez-Coua-zo, 24, of East Fifth Street was charged with disorderly conduct on Monday.

Augusto Rodriguez Ri-vero, 21, of Columbus Avenue was charged Tues-day with third-degree assault and second-degree menacing.

Winifred Jones, 52, of Franklin Avenue was charged with fourth-degree grand larceny on Tuesday.

HANOVER – Jesse P. Koch, 18, of Dunkirk was charged with speeding and unlawful possession of marijuana Wednesday. Depu-ties stopped Koch’s vehicle for allegedly speeding on Route 5 at 2:16 p.m. Koch was allegedly found in possession of drug paraphernalia and a quantity of marijuana. Koch was released to appear in Hanover Town Court.

New York State Police at Fredonia

BROCTON – On Tuesday, State Police charged Robert Head, 32, of Brocton with three counts of misapplication of property stemming from a complaint in October.

On Oct. 22, State Police responded to a complaint of a possible larceny of guns. Investigation revealed Head had borrowed three long guns he was to return the next day. Further investigation determined that not only had Head allegedly failed to return the guns to the owner, but had sold the guns to a gun dealer.

Head was arraigned at Charlotte Town Court and sent to the Chautauqua County Jail in lieu of bail.

On Tuesday, State Po-lice took into custody Sh-amaar Braggs, 33, of Buffalo on a bench warrant from Dunkirk Town Court for failing to appear on the following charges: third-degree aggravated unlicensed operation, license restriction violation, following too close and unlicensed driver.

Braggs was arraigned at Dunkirk Town Court and sent to Chautauqua County Jail in lieu of $2,000 cash or $40,000 bond. Braggs is to return to Dunkirk Town Court on Dec. 22.

Matthew Kreuzer, 27, of Angola was charged with fourth-degree grand larceny on Oct. 31.

Robert Abate, 41, of West Main Street, Ripley, was charged with driving while intoxicated, DWI per se, failure to stop at a stop sign, disobeying a traffic control device, no headlights and driving on the sidewalk on Nov. 4.

Austis Curtis Smith, 20, and Brittany Deming, 24, both of Columbus Avenue, Dunkirk, were charged with harassment on Nov. 5.

Joshua Diorio, 26, of Evans was charged with grand larceny on Nov. 5.

Mykell Pyatt, 24, of Lambert Avenue was charged with unlawful possession of marijuana on Nov. 7.

Delany Williams, 19, of Washingtonville was charged with fourth-degree criminal mischief, trespass and second-degree criminal impersonation on Saturday.

Carlton Coatsworth, 21, of East Aurora was charged with driving while intoxicated with a blood alcohol content of .08 percent or greater, speed in zone, failure to keep right and unregistered motor vehicle on Saturday.

SILVER CREEK – Salvatore A. Rapasadi, 25, of Buffalo was charged with third-degree aggravated unlicensed operation, unlawful possession of marijuana and having an uninspected motor vehicle on Monday. Deputies observed Rapasadi’s vehicle on Central Avenue alleged with an expired inspection certificate shortly before 1 p.m. Rapasadi was found to allegedly have drug paraphernalia in his possession. Rapasadi’s driving privileges were also found to be allegedly revoked. He was released to appear in Silver Creek Town Court.

Charles T. Cummins, 44, of Jamestown was charged with failure to keep right, driving while ability impaired by drugs, leaving the scene of a property damage accident, second-degree aggravated unlicensed operation and having a broken windshield on Monday. Cummins was stopped on Route 60 in the town of Pomfret at 12:45 p.m., after a citizen complaint of a vehicle driving erratically. Cummins allegedly struck a sign and was reportedly all over the road. Cummins was found to be allegedly operating his vehicle with a suspended license and was allegedly under the influence of drugs. Cummins was arraigned in Pomfret Town Court and sent to the Chautauqua County Jail in lieu of $5,000 cash or $10,000 property bail.

New York State Police at Fredonia

On Nov. 7 troopers stopped a vehicle on Waldorff Road in the town of Dunkirk for failing to dim the headlights.

Located in the vehicle were two marijuana roaches and a glass pipe containing burnt marijuana residue. The marijuana was claimed by the passenger, Stephen Falkner, 25, of Dunkirk.

Falkner was issued an appearance ticket for unlawful possession of marijuana returnable to Dunkirk Town Court on Nov. 17.

PORTLAND – On Nov. 9 Fredonia New York State Police stopped a vehicle on Berry Road in the town of Portland for failing to signal a turn onto North Road.

The driver, Justin Spicer, 35, of Brocton, allegedly failed standard field sobriety tests and was subsequently taken into custody for driving while intoxicated.

Spicer was transported to Fredonia barracks for processing. An alco-test was given with a blood alcohol content of .17 percent. Due to a previous conviction within the last 10 years, Spicer was charged with felony driving while intoxicated.

Spicer was issued tickets for unsafe turn/failure to signal, drinking alcohol in motor vehicle on a highway, felony operating a motor vehicle with a BAC of .08 percent or higher with a prior conviction designated offense, and a felony driving while intoxicated for a previous conviction designated offense within 10 years.

He will appear in Portland Town Court on Dec. 10. Spicer was released to a relative.

Two charged with attempted murder in Jamestown incident

JAMESTOWN – A Chautauqua County Grand Jury has handed up a five-count indictment for the two men charged in the Sept. 2 shooting outside the Appleyard Terrace on East Second Street, Jamestown.

Trenton Grant, 20, and Isaiah Pearson, 20, have been indicted on charges of second-degree attempted murder, first-degree assault, second-degree criminal possession of a weapon for the shooting as well as burglary and grand larceny in connection with a burglary of a handgun, safe, laptop computer and jewelry from a Lakewood home before the shooting. One person was injured in the shooting.

Grant and Pearson were found Sept. 5 in Madison County, Tennessee, and were extradited back to Chautauqua County. They are now being held in the Chautauqua County Jail. Grant is being held on $750 cash or $1.5 million property bond while Pearson is being held on $500,000 cash or $1 million property bond.

Sheriff’s office warns of IRS scam

Chautauqua County Sheriff Joseph Gerace is warning residents of an IRS scam county residents have reported. Residents are receiving phone calls from individuals claiming to be from the IRS and some of the calls are somewhat intimidating and demand a call back immediately. The callers are either demanding payment or trying to obtain personal information. Gerace warns residents not to give out any personal information or to make a payment to these callers.

In August, IRS Commissioner John Koskinen issued a press release stating, “These telephone scams are being seen in every part of the country, and we urge people to not be deceived by these threatening phone calls. We have formal processes in place for people with tax issues. The IRS respects taxpayer rights, and these angry shake down calls are not how we do business.”

According to the IRS release, there are five things scammers often do but the IRS will not do. Any one of these five times is a tell tale sign of a scam. The IRS will never call to demand immediate payment or call about taxes owed without first having mailed you a bill; demand that you pay taxes without giving you the opportunity to question or appeal the amount they say you owe; require you to use a specific payment method for taxes such as a prepaid debit card; ask for credit or debit card numbers over the phone; or threaten to bring in local police or law enforcement groups to have you arrested for not paying.

If you get a phone call from someone claiming to be from the IRS asking for money, call the IRS at 1-800-829-1040 if you know or think you owe taxes; IRS staff members can help you with a payment issue. If you know you do not owe taxes or have no reason to believe you do, report the incident to the Treasury Inspector General for Tax Administration at 1-800-366-4484 or at www.tigta.gov.

BRANT – Vanessa Vanorder, 23, of Watertown, was charged Oct. 19 with unlawful possession of marijuana following a traffic stop on Brant Reservation Road.

She was found to be in possession of a grinder containing marijuana and is due in Brant Town Court at a later date.

COLLINS – Kevin Goodemote, 58, of Dayton, was taken into custody Oct. 20 on an arrest warrant for aggravated unlicensed operation from the Cattaraugus County Sheriff’s Department.

Troopers stopped the vehicle on Middle Road and a computer check revealed the warrant. Goodemote was turned over to a Cattaraugus County Sheriff’s deputy at the scene for arraignment.

COLLINS – James Heineman, 34, of Yorkshire, was charged Nov. 5 with unlawful possession of marijuana following a traffic stop on Richardson Road.

Troopers stopped the car for illegal tinted windows and while speaking to the driver, they smelled marijuana. Heineman was a passenger.

Heineman was found to be in possession of a glass pipe with marijuana in it. He is due in Collins Town Court later this month.

NORTH COLLINS – Michael Kowalski, 24, of Springville was charged with driving while intoxicated on Nov. 2. Troopers stopped the truck Kowalski was allegedly driving on Genesee Road for reportedly failing to stay in his lane. He was allegedly found to be intoxicated after a series of roadside sobriety tests. He was processed at the Collins barracks with a reportable blood alcohol content of .11 percent. He is due in North Collins Town Court at a later date.

RIPLEY – Nickolas Runser, 37, of Wattsburg, Pa., was charged with driving while intoxicated, DWI per se with a blood alcohol content of .08 percent or higher and unsafe backing on Sunday. Around 2 a.m., deputies stopped a vehicle for allegedly backing unsafely on Shortman Road. The driver, Runser, was allegedly intoxicated. He will appear in Ripley Town Court at a later date.

State Police at Collins

PERRYSBURG – Eric Jones, 29, and Kristi Jones, 23, both of Main Street, were arrested on Nov. 3 after an alleged domestic dispute at their home. The two were allegedly involved in an argument that escalated into a physical altercation in the bedroom. She alleged he pushed, slapped and choked her. He maintained she hit him in the face before going into the kitchen and getting a knife. She allegedly returned and threatened him before putting the knife back. The arguing and shoving allegedly continued until she left to call for help. Eric Jones was charged with criminal obstruction of breathing and second-degree harassment. Kristi Jones was charged with second-degree menacing and second-degree harassment. Both are due in Perrysburg Town Court at a later date.

DAYTON – Kevin Dzierzanowski, 37, of State Route 62 was charged with fourth-degree criminal possession of stolen property on Nov. 4. Troopers were called to a farm on Wolfe Road by the owner, who had just returned from a livestock auction in Hinsdale. While at the auction, the farmer reportedly recognized a heifer, valued at $1,300, which had been missing from his farm for a number of weeks. A tag in the animal’s ear allegedly confirmed it was the farmer’s and the heifer was returned to him. Troopers were then able to determine Dzierzanowski had allegedly found the heifer in his pasture and never attempted to find the owner. He instead allegedly took it to auction to be sold. He is due in Dayton Town Court at a later date.

Police seek assistance after vehicle injures pedestrian

JAMESTOWN – Police here are asking for assistance in finding the vehicle and driving involved in a hit-and-run accident Friday.

Jamestown police report the incident occurred at Falconer and Bowen streets at 10:18 a.m. Witnesses observed a gold or tan-colored minivan hit the pedestrian and then drive over that person’s legs before driving away. Police believe the vehicle is a Dodge or Chrysler.

The victim was transported to WCA Hospital and is being treated for serious injuries to the legs.

JAMESTOWN – Larry W. Phillips, 43, of Jamestown was charged with misuse of food stamps and first-degree offering a false instrument for filing on Oct. 31. Phillips allegedly failed to report employment and income to the Chautauqua County Department of Social Services from June 1, 2012 through March 31, 2013. This unreported employment and income allowed Phillips to receive $3,376 in unentitled foot stamp benefits. Phillips was released to appear in Jamestown City Court at a later date.

CHAUTAUQUA – Brandon Cessna, 34, of Mayville, was charged Wednesday with unlawful possession of marijuana and operating while registration suspended or revoked after a traffic stop on East Chautauqau Avenue around 2 p.m.

During the stop Cessna was allegedly found to be in possession of marijuana.

Cessna was issued appearance tickets for Chautauqua Town Court.

Najee T. Finley, 20, of Dunkirk, was sentenced to 3 years determinate in state prison and 3 years post release supervision for second-degree attempted criminal possession of a weapon concurrent with 1 year in jail for fifth-degree criminal sale of a controlled substance.

Two Jamestown men charged with burglary

STOCKTON – The Chautauqua County Sheriff’s Office executed arrest warrants from Stockton Town Court for two Jamestown men Tuesday.

Following an investigation, Joshua J. Sweatman, 20, and Shawn A. Sweatman, 49, were charged with third-degree burglary.

Deputies allege the pair unlawfully entered and stole from property in the town of Charlotte on multiple occasions during the summer.

Both were arraigned in Stockton Town Court and sent to the Chautauqua County jail in lieu of bail. Further charges are pending.

ELLICOTT – William A. Long, 38, of Farmington Hills, Mich., was charged Oct.31 with driving while intoxicated and illegally driving in the center lane after a traffic stop on Route 60 about 2:35 a.m.

Long was allegedly observed driving in the center turn lane with no indication of making a turn resulting in the stop. Troopers allegedly smelled strong odor of alcohol. After field sobriety tests Long was taken into custody and transported to the Jamestown barracks where a blood alcohol content of .16 percent was obtained.

Long was arraigned in Ellicott Town Court and sent to the Chautauqua County Jail in lieu of $1,000 cash or $2,000 property bail.

Car-pedestrian accident victim in serious but stable condition

JAMESTOWN – The victim from Wednesday’s car-pedestrian accident on East Second Street was still listed in serious but stable condition at the Hamot Medical Center in Erie, Pa., Thursday evening.

The suspect, Lucinda Tobias, has been arraigned and committed to Chautauqua County Jail.

Tobias, 44, of Jamestown was driving a mini-van on East Third Street toward the intersection at East Second Street, when she allegedly jumped the curb and struck a pedestrian standing on the sidewalk shortly after 2:30 p.m. Wednesday, police said.

The victim, a 50-year-old female, sustained serious head injuries and was transported to WCA Hospital before being taken to Hamot by Starflight.

Tobias was charged with driving while ability impaired by drugs and first-degree aggravated unlicensed operation. Additional charges are expected pending further investigation, police said.

Jamestown Police were assisted at the scene by the Chautauqua County Sheriff’s Department’s Accident Reconstruction Team.

Underage drinking compliance check nabs three

In a proactive effort to address underage drinking, the New York State Police and Jamestown Police Department conducted an Alcohol Beverage Control compliance check on Saturday.

A total of eight establishments were checked with five found to be in compliance.

Violating the State Liquor Law by selling an alcoholic beverage to a minor at the Witch-Kitch in Sinclairville was Erin Barr, 27, of Fredonia.

Arrested at Waddington’s Bar on Main Street in Falconer was Francis Yachetta, 52, of Falconer.

Arrested at The Cherry Lounge on Cherry Street in Jamestown was Paul Constan-tine, 48, of Jamestown.

All three were issued an appearance ticket to appear at a later date.

According to an accident report, Mary Gordon, 68, of Derby was traveling west on Lake Shore Drive East when she struck a legally parked vehicle on the north side of the street. Gordon reportedly told police she did not see the vehicle.

She was taken to Brooks Memorial Hospital via the Dunkirk Fire Department for a complaint of pain.

Joseph Culmo, 27, of Newton Street was charged with third-degree criminal mischief on Oct. 23.

Lizmariel Vazquez Gonzalez, 31, of East Main Road was charged with petit larceny on Oct. 24.

Raymond Peters, 66, of East Main Street was charged with second-degree harassment on Oct. 29.

One person was injured in a bicycle accident on Thursday around 1 p.m.

According to an accident report, bicyclist Harold Voss, 25, of Brocton struck the back of a legally parked vehicle on the shoulder of West Main Street. Voss reportedly told police he was looking down at his cell phone right before the incident.

He was taken to Brooks Memorial Hospital via Alstar Ambulance for unknown injuries.

Michael Corbul-Labarbara, 20, of Orchard Park was charged with obstruction of a governmental administration and second-degree harassment on Saturday.

Joel Rosario, 21, of Eagle Street was charged with second-degree harassment on Saturday.

James Rowley, 20, of Orchard Park was charged with third-degree criminal possession of a controlled substance and resisting arrest on Sunday.

RIPLEY – Thomas E. Osteen, 45, of West Main Street was charged with third-degree aggravated unlicensed operation on warrants on Monday. Deputies took Osteen into custody after a tip came into the sheriff’s website about his location. Osteen was taken into custody on the warrants from New York State Police and Jamestown Police Department at 12 p.m. Osteen was turned over to Jamestown Police.

State Police at Fredonia

RIPLEY – On Nov. 1 New York State Police at Fredonia stopped a vehicle on State Route 20, in the Town of Ripley for moving from lane unsafely.

The operator, Brenda Winkelman, 47, of Ripley was found to be intoxicated after failing standard field sobriety tests.

Winkelman was transported to Fredonia barracks for processing and had a .13 percent blood alcohol level. Winkelman was issued traffic tickets for moving from lane unsafely, first-offense operating a motor vehicle with .08 of 1 percent or more alcohol in blood and first-offense driving while intoxicated.

All traffic tickets are returnable to the town of Ripley Court on Nov. 24. Winkelman was then turned over to a family member.

WESTFIELD – On Nov. 1 Fredonia New York State Police stopped a vehicle on State Route 20, in Westfield, for no plate lights.

While speaking to the driver, Kraig Meekins, 22, of Bemus Point noticed the smell of marijuana was emanating from inside the vehicle. Meekins was found to have a jar of 2.75 grams of marijuana in the vehicle.

Meekins was arrested and issued an appearance ticket for unlawful possession of marijuana, and a traffic ticket for no plate lights, both returnable to the Town of Westfield Court on Nov. 10.

JAMESTOWN – On Sunday at about 1:22 a.m., Fredonia New York State Police stopped a vehicle on State Route 394 in the City of Jamestown, for crossing the yellow center line and failing to signal onto Crescent Street. The driver, Thomas Giambruno, 53, of Jamestown failed standard field sobriety tests, and was arrested for driving while intoxicated.

Giambruno was transported to Jamestown barracks for processing. He had a blood alcohol level of .08 percent. He was issued tickets for first-offense operating a motor vehicle with .08 of 1 percent or more alcohol in blood, first-offense driving while intoxicated, insufficient turn signal (less than 100 feet), driving to left of pavement markings, and failure to notify change of address.

All traffic tickets are returnable to the City of Jamestown Court on Dec. 3. Giambruno was turned over to a friend.

POMFRET – On Sunday, Fredonia New York State Police stopped a vehicle on State Route 60 in the Town of Pomfret for no front license plate.

The operator, Quang Vu, 41, of Jamestown was found to have an active arrest warrant for third-degree criminal trespass out of Niagara Falls City Police Department.

Vu was issued traffic tickets for no front plate and uninspected motor vehicle returnable to the Town of Pomfret Court on Dec. 2. He was then transported and turned over to Niagara Falls City Officer Buchalski.

SHERIDAN – Kevin R. Carr, 37, of Dunkirk was charged with aggravated driving while intoxicated with a blood alcohol content of .18 percent or higher on Thursday. Deputies responded to a call at 2:20 a.m., for a male allegedly harassing a Route 20 resident. It was found that Carr allegedly drove to the residence in an intoxicated state and began to threaten another individual. Carr was released to appear in Sheridan Town Court.

FRENCH CREEK – Thomas A. Baader, 24, of Clymer was charged with felony driving while intoxicated, third-degree aggravated unlicensed operation and disobeying a stop sign on Friday. Deputies stopped Baader’s vehicle after allegedly failing to stop at a stop sign on Conway Road at 10:20 p.m. Baader was found to be allegedly intoxicated and had a previous DWI conviction within 10 years. He was released to appear in French Creek Town Court at a later date.

PORTLAND – Howard F. Nichols, 41, of Westfield was charged with speeding and felony driving while intoxicated on Friday. Deputies stopped Nichols’ vehicle on Webster Road for allegedly speeding shortly after 11:45 p.m. Nichols was found to be allegedly intoxicated during the traffic stop and had a previous DWI conviction within the past 10 years. He was released to appear in Portland Town Court at a later date.

Fabian Hernandez-Rojas, 20, of Brocton was charged with operating without headlights and driving while intoxicated on Saturday. Deputies stopped Hernandez-Rojas’ vehicle on East Main Street in the village of Fredonia for allegedly operating without headlights at 3:14 a.m. Hernandez-Rojas was found to be allegedly intoxicated and released to appear in Fredonia Village Court at a later date.

Matthew M. Buchanan-Ruiz, 23, of Dunkirk was charged with disorderly conduct on Saturday. At 2:18 a.m., deputies were responding to assist Fredonia Police on an unrelated matter when police had to stop abruptly to avoid striking Buchanan-Ruiz. He was allegedly intoxicated and walked into the path of the patrol vehicle on Water Street in the village of Fredonia. When police ordered Buchanan-Ruiz to leave the roadway, he allegedly responded with profanity and continued to use profane language while walking in the street. Buchanan-Ruiz was released to appear in Fredonia Village Court at a later date.

SHERIDAN – Andrew Studley, 32, of Forestville was charged with moving from lane unsafely, third-degree aggravated unlicensed operation and driving while intoxicated on Saturday. Deputies responded to a single-car accident on Middle Road at 1:49 a.m. Studley was found to be allegedly intoxicated and was released to appear in Sheridan Town Court. No injuries were reported.

CHAUTAUQUA – Thomas P. Lingenfelter, 49, of Bemus Point was charged with driving while intoxicated, aggravated DWI with a blood alcohol content of .18 percent or higher and speeding on Saturday.

Deputies stopped Lingenfelter’s vehicle for allegedly speeding on Route 394 at 2 a.m. He was allegedly found to be during the traffic stop.

He was released to appear in Chautauqua Town Court.

New York State Police at Jamestown

  • ELLERY – On Wednesday at 1:35 p.m. Trooper Jason Cresanti arrested Jonathan G. Galarza, 30, of Jamestown after responding to a report of a disabled vehicle on I-86 westbound in the Town of Ellery.

Police allege that as a trooper approached the vehicle, passenger Galarza exited, became irate and displayed a knife he retrieved from his sweatshirt pocket. The trooper was able to disarm Galarza after a brief struggle, and he was placed under arrest, and transported to Jamestown barracks.

Galarza was charged with a class D felony of menacing of a police officer, fourth-degree criminal possession of a weapon and resisting arrest.

Further investigation revealed Galarza was in the presence of a protected person in the disabled vehicle, and he was additionally charged with second-degree criminal contempt for violating an order of protection. He was arraigned in Ellery Town Court and sent to the Chautauqua County Jail.

Four suspects netted after Jamestown drug busts

JAMESTOWN – Four individuals were taken into custody Friday after police conducted two separate drug raids in Falconer and West Ellicott.

The first netted Watkine Watkins, 35, and Alicia Haskins, 31, at their 308 Central Ave. residence in Falconer at 11 a.m.

According to Jamestown police, investigators located more than a half ounce of powder cocaine, a quantity of heroin and cash inside.

Watkins was charged with third-degree criminal possession of a controlled substance and three counts of endangering the welfare of a child since three children were found inside the home.

Haskins was charged with obstructing and resisting arrest after she allegedly attempted to enter the home after being told not to enter by police. She then resisted arrest while holding a small child, and was later charged with endangering the welfare of a child, police said.

The second raid netted Thomas Kimbrough Sr., 44, and Thomas Kimbrough Jr., 18, at their 112 Fredrick Blvd. residence in West Ellicott at 1:55 p.m.

Investigators found more than an ounce of powder cocaine, a quantity of marijuana and cash inside, police said.

They were both charged with third-degree criminal possession of a controlled substance.

All four individuals were transported to Jamestown City Jail where they await arraignment in Ellicott Court.

The raids were executed by the Jamestown Metro Drug Task Force, which consists of members from the Jamestown and Ellicott police departments as well as the New York State Police Community Narcotics Enforcement Team.

Two charged in connection with burglaries in Westfield, Portland

A Jamestown man and a Westfield man face charges in relation to burglaries in the Westfield and Portland areas.

Russell C. Genovese Jr., 25, of 20 Barker St., Jamestown, is charged with third-degree burglary from an incident on Bliss Road, Portland, and fifth-degree criminal possession of a controlled substance in Sheridan. Adam J. Robinson, 26, of 45 Washington St., Westfield, is also charged with third-degree burglary for the Bliss Road, Portland, incident, and fourth degree criminal possession of stolen property in Jamestown, the village of Westfield and Sheridan.

They were charged at Friday after a lengthy investigation by the Chautauqua County Sheriff’s Department and Westfield police officers. Sheriff’s deputies conducted a search warrant of Robinson’s truck while deputies and Westfield police officers obtained a search warrant for Robinson’s apartment in Westfield. Deputies report finding a vast amount of stolen items in the truck and apartment which had been stolen during several burglaries in the Westfield and Portland areas.

Genovese Jr. and Robinson were taken to the Chautauqua County Jail.

Ripley woman overdoses on heroin

RIPLEY – On Thursday at about 3 a.m. the Chautauqua County Sheriff’s dispatch received a 911 call from a residence in Ripley reporting a 20-year-old female had overdosed on heroin.

Ripley Fire and Rescue were dispatched along with a deputy who was on routine patrol in the area. The deputy arrived on location first and entered the residence to offer aid.

They deployed Naloxone to the overdose victim, and within minutes she was responsive and tended to by Ripley Fire and Rescue. She was then transported to Westfield Memorial Hospital for treatment.
