Chautauqua County Sheriff’s Office
MAYVILLE – Joseph R. Cenni, 41, of Penn Allen Road, Nazareth, Pennsylvania, was charged with driving while intoxicated, DWI of .08 percent or higher, no tail lights and failure to take pre-screen breath test on Saturday at around 1 a.m.
Sheriff deputies stopped the vehicle Cenni was operating due to the tail lights being out.
During the investigation, officers found that Cenni was allegedly intoxicated.
He was released with appearance tickets and will appear in Chautauqua Town Court next month.

JAMESTOWN – Austin Messere, 21, of Jamestown, was taken into custody Sunday and charged with several offenses. According to reports, troopers stopped his vehicle on Marion Street for traffic violations. After allegedly failing several sobriety tests, Messere was taken into custody. While searching Messere’s vehicle, troopers allegedly found a digital scale containing cocaine residue and an electronic stun gun. He was transferred to SP Jamestown, where he provided a breath sample of .06 percent blood alcohol content. A State Police drug recognition expert then evaluated Messere for cocaine and marijuana impairment. His charges include driving while ability impaired by a combination of drugs and alcohol, seventh-degree possession of a controlled substance and fourth-degree criminal possession of a weapon. Messere was processed, arraigned in Ellicott Town Court and taken to Chautauqua County Jail.
ELLERY – Thaddeus Johnson, 23, of Jamestown was taken into custody Sunday and charged with driving while intoxicated. According to reports, troopers responded to a report of a vehicle off the road on Route 430. Investigation allegedly revealed that Johnson was driving west on Route 430, drifted to the left, overcorrected, then left the north side of the roadway, coming to rest in the ditch. Johnson was uninjured. He was arrested after failing several sobriety tests and transported to SP Jamestown, where he provided a breath sample of .09 percent blood alcohol content. Johnson was then processed, issued tickets returnable to Ellery Town Court and released.
MINA – Shelley Wyant, 65, was taken into custody Sunday and charged with unlawful possession of marijuana. According to reports, troopers stopped her vehicle on I-86 for illegal window tint, and then smelled marijuana in her vehicle. Allegedly, a search of the vehicle turned up a jar of marijuana, two marijuana cigarettes and a grinder containing marijuana residue. Wyant was issued an appearance ticket and a traffic ticket, and will answer for herself in Mina Town Court next month.

in summer Reservation crash
Erie County Sheriff Timothy B. Howard reports members of the Crash In-vestigation Unit arrested and charged Jerry John, 19, of Perrysburg, Thursday with two felony counts for his involvement in a July 17 crash that injured nine people.
At approximately 7:45 a.m., John was operating a vehicle on Versailles Plank Road within the Seneca Nation of Indians Reserva-tion when he collided with a tree. The impact caused many occupants to be ejected resulting in several in-juries.
John was charged with two counts of felony vehicular assault and was sent to the Erie County Holding Center until his arraignment in Brant Town Court.
Pennsylvania man charged with DWI in accident
SHERMAN – A Penn-sylvania man has been charged with driving under the influence of alcohol in a motor vehicle accident Wednesday night.
According to the Chau-tauqua County Sheriff’s Office, Daniel R. Rossman, 52, of Fairview was traveling on I-86 west around 10:30 p.m. when he struck the rear-end of a tractor trailer, causing significant damage to his own vehicle. The tractor trailer driver was unaware of the accident and continued westbound.
Rossman was charged with two counts of DWI, parking on the highway and following too close.

Chautauqua County Sheriff’s Office
MAYVILLE – Richard S. Schroeder, 48, of West-field, was taken into custody and charged with several offenses Sunday at about 2:20 a.m. According to reports, deputies stopped Schroeder’s vehicle on N. Erie Street for speeding and failing to keep right; upon investigation, he was allegedly found to be intoxicated. His charges include speed in zone, failure to keep right, driving while intoxicated and DWI per se. Schroeder was released with tickets and will answer for himself in Chautauqua Town Court.
ARKWRIGHT – Denee M. Dolce, 35, of Forestville, was charged with multiple offenses after deputies stopped her vehicle on Route 83 just before 1 a.m. Saturday. Upon investigation, Dolce was allegedly found to be intoxicated. She was taken into custody and released with tickets returnable to Arkwright Town Court for failure to keep right, driving while intoxicated and DWI per se.
MAYVILLE – Steven C. Sprague, 69, of Mayville, was charged with multiple offenses Wednesday just after midnight. Allegedly, Sprague was stopped on Water Street by deputies for multiple traffic infractions, and then found to be intoxicated. His charges include driving while intoxicated, DWI with blood alcohol content of .08 percent or greater, failure to dime high beam headlights and inadequate brake lights. He was later released and will answer charges next month in Chautauqua Town Court.
Westfield Police Department
- Cory C. Casler, 42, of Ashville, was charged with unlawful possession of marijuana, consumption of alcohol in a motor vehicle and speeding on Wednes-day. At around 8:20 p.m., police observed Casler allegedly speeding. Upon investigation, Casler was allegedly founf in possession of a small amount of marijuana and two open, 12-ounce cans of an alcoholic beverage. Casler was issued traffic tickets and an appearance ticket for the above charges, and will appear back in Westfield Village Court at a later date and time.

- Kevin P. Klaich, 28, of West Seneca, was charged with and held for arraignment for disorderly conduct on Monday.
- Mary Ann Miller, 34, of Saukville, Wisconsin, was charged with driving an unregistered motor vehicle on Tuesday.

- Mark N. Sam, 52, of Dunkirk was charged with driving while intoxicated per se on Monday.
- Messiah Gonzalez, 28, of Dunkirk was charged with resisting arrest on Monday.
- Donte L. Chambers, 23, of Dunkirk was charged with unlawful possession of marijuana, fifth- and seventh-degree criminal possession of a controlled substance and first-degree unlawful dealing with a child on Tuesday.
- Corey D. Mats, 27, of Fredonia was charged with driving with a suspended registration, third-degree aggravated unlicensed operation of a motor vehicle and unlawful possession of marijuana on Wednesday.
- Melvin M. Rodriguez-Rivera, 42, of Fredonia was charged with aggravated driving while intoxicated on Thursday
Cattaraugus County Court
LITTLE VALLEY – Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday:
- Daniel P. Kleom, 27, of Olean, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a term of 2 to 4 years with the New York State Department of Corrections for his conviction of third-degree burglary, a class D felony, and 6 months incarceration for his conviction to third-degree assault, a class A misdemeanor to run concurrent.
The incident occurred on or about June 1 in the town of Persia, when the defendant knowingly entered or remained unlawfully in a building with intent to commit a crime.

Westfield Police Department
- Dale W. Reynolds, 77, of Westfield was picked up on an arrest warrant for forcible touching on Oct. 24.
On Oct. 13, Westfield Police Department received a complaint from a Westfield resident who reported that Reynolds allegedly forcibly touched the female resident when she was at a business on North Portage Street in Westfield. A warrant was signed by Judge Thomas for the above charge.
Reynolds was arrested at the Westfield Police Department on the warrant, arraigned in front of Judge LaPorte and committed to Chautauqua County Jail on $1,000 cash/$2,000 property bond bail.
- Maghan M. Dorman, 38, of Simpsonville, South Carolina, was charged with failure to stop at a stop sign, driving while intoxicated and driving with a .08 percent blood alcohol content level on Oct. 22.
At about 1:48 a.m., members of the Westfield Police Department were on patrol when they observed a vehicle fail to make a complete stop at a clearly posted stop sign on Market Street. Patrols stopped the vehicle for said violation and identified the driver as Dorman.
Upon further investigation, it is alleged that Dorman was operating the vehicle under the influence of alcohol. Dorman was charged with above charged and will appear in Westfield Village Court at a later date.

South Dayton woman injured in Monday crash
VILLENOVA – A South Dayton resident was involved in an automobile accident early Monday morning.
According to the Chautauqua County Sheriff’s Office, Trish M. Pryll, 25, of Route 83, was traveling north on Dye Road in the town of Villenova around 5 a.m. when her vehicle struck a tree in the roadway, damaging her vehicle and causing injuries to herself. She was taken to by the South Dayton Fire Department Ambulance to Lake Shore Hospital where she was evaluated.
There were no reports of any injuries to passenger Patrick J. Dawson, 32, of Route 83.
Guilty plea announced
in Evans death
BUFFALO – Acting Erie County District Attorney Michael J. Flaherty Jr. announced that 51-year-old Gabriele Ballowe of Evans pleaded guilty before State Supreme Court Justice Christopher J. Burns to the charge of leaving the scene of an incident without reporting, resulting in serious physical injury.
On Dec. 22, 2013, Ballowe was driving on Route 5 in Evans when she struck and killed a pedestrian, 52-year-old Barry Moss of Evans and fled the scene.
Ballowe faces 1 1/3-4 years in prison when she is sentenced on Dec. 20 at 9:30 a.m. by Justice Burns.
“This plea was offered with the support of Barry’s family,” Flaherty said. “The families of victims often highly value the acceptance of responsibility by the person who took the life of their loved one and the knowledge that the case is over.”
DA Flaherty commends the Town of Evans Police Department, Lt. Douglas Czora, NYS Police, the FBI and investigators from his office for their collaboration and outstanding investigative work.
Assistant district attorneys Thomas Finnerty, Paul Parisi and Nick Texido all assisted in the prosecution of this case.

On Oct. 6, Adrian Maldonado, 20, of Brocton was traveling south on Brigham Road and was unaware of how tall his cube van was. While passing under the CSX overpass, the top of the cube compartment sheared off when it struck the overpass. Maldonado pulled over on Central Avenue where he called to report the accident.o injuries were reported.

SHERIDAN – Ryan D. Holser, 34, of Fredonia, was charged with several offenses Sunday shortly before 3 a.m. According to reports, deputies came upon Holser’s vehicle backed into a ditch on Newell Road, and identified Holser as its driver. After an investigation, he was taken into custody and charged with driving while intoxicated, aggravated DWI with a blood alcohol content greater than .18 percent and unsafe backing. He will answer the charges in Sheridan Town Court.
CHAUTAUQUA – Dustin L. Camp, 34, of North East, Pennsylvania, was charged with several offenses Saturday after deputies stopped his vehicle on Route 430 just before 1 p.m. Allegedly, Camp had been traveling at a high rate of speed, and after an investigation, he was deemed to be intoxicated. His charges include driving while intoxicated, DWI per se and speeding. He will answer these charges in Chautauqua Town Court.
HANOVER – Brett C. Plucinski, 27, of Forestville, was taken into custody Thursday at about 3:40 a.m. and charged with unlawful possession of marijuana.
According to reports, deputies had observed a suspicious vehicle leave the scene of an incident on Routes 5 and 20, and stopped the vehicle on Dennison Road. Plucinski identified himself as the driver, and through an investigation, deputies al-legedly found a small baggie of marijuana in the vehicle.
Plucinski was released with an appearance ticket to answer for himself in Hanover Town Court.

On Sunday at 3:08 a.m., deputies stopped a vehicle on Route 20 in the town of Pomfret for failure to keep right.
The operator of the vehicle was identified as Keith A. Grzegorzewski of West Main Road in Portland. Upon further investigation, it was determined Grzegorzewski was intoxicated. A check of his driver’s license revealed that his operating privileges in New York state were revoked. Grzegorzewski was arrested and charged with driving while intoxicated, aggravated DWI, first-degree aggravated unlicensed operation of a motor vehicle, and failure to keep right. Grzegorzewski was released with traffic tickets and will appear in the Town of Pomfret Court at a later date.

Brett Stroud, 18, of Mount Kisco, was charged with and issued two appearance tickets for open container and unlawful possession of alcohol on Oct. 1.

Andrew E. Mergen-hagen, 18, of Buffalo was charged with second-degree harassment on Oct. 21. He was released on $100 bail.
Gowanda Police
Dakota J. Thompson, 24, of Jamestown Street, was charged with disorderly conduct and obstructing a governmental administration after allegedly yelling obscenities and threatening an officer. On Oct. 8 at around 6 a?m., the officer on scene reportedly noticed signs of intoxication as Thompson supposedly pursued to fight the officer and refused all directions given. Thompson was released on appearance tickets and will appear in Persia Town Court at a later date. The New York State Police assisted.
Lee D. Atwater, 34, of Jamestown Street, was charged with operating a vehicle with a suspended registration on Oct. 14 at 10:25 a.m. Atwater was stopped after patrol noticed an unspecified traffic violation. During the stop, the officer noticed his registration was suspended on May 5, 2016 for an insurance lapse. Atwater was released on an appearance ticket and will appear in Collins Town Court at a later date.
A 15-year-old male subject was arrested after trespassing a village residence on Oct. 17 and 18. The subject was caught on the residence on back-to-back days even though the juvenile had been instructed not to after the first offense. On both occasions, he was charged with trespassing and turned over to his parents. He will appear in Persia Town Court for both arrests at a later date.
A 15-year-old male subject was arrested for a curfew violation after walking on Buffalo Street at 10:50 p.m. on Oct. 17. The subject was turned over to his parent and will appear in Collins Town Court at a later date.
Amanda L. Bordan, 21, of Jolls Road, Perrysburg, was charged with seventh degree criminal possession of a controlled substance and arrested for a warrant on Tuesday at 4:45 p.m. Bordan was aware of the active warrant for her violation of probation from a prior conviction. Bordan was found by police passing by and during the arrest procedure, the officers allegedly found two small baggie of suspected heroin and fetanyl. Bordan was arraigned in Persia Town Court and remanded to the Cattaraugus County Jail for her probation warrant. She will return to Persia Town Court at a later date for the possession charge.

Amy M. Schuk, 38, of Dunkirk was charged with second-degree harassment on Oct. 20.
Eustaquio Bautista-Lopez, 58, of Dunkirk was charged with unlicensed operation of a motor vehicle and driving without insurance on Oct. 20.
Pedro E. Torres, 67, of Dunkirk was charged with driving an unregistered motor vehicle on Oct. 20.
Robert D. Zimmerman, 59, of Dunkirk was charged with trespass and petit larceny on Oct. 22.
Raven L. Bush, 37, of Dunkirk was charged with second-degree menacing, second-degree criminal possession of a weapon and third-degree criminal possession of a weapon on Oct. 23.
On Oct. 6, Adrian Maldonado, 20, of Brocton was travelling south on Brigham Road and was unaware of how tall his cube van was. While passing under the CSX overpass, the top of the cube compartment sheared off when it struck the overpass. Maldonado pulled over on Central Avenue where he called to report the accident.

Accident causes injury in Ellington
ELLINGTON – Tyler Boggs, 20, of Perrysburg, NY, was traveling southbound on Waterboro Hill Road in the Town of Ellington when a northbound vehicle, which had its high beams on, obstructed Boggs’ vision. Boggs failed to negotiate the corner and drove off of the southside of the roadway, striking a garage and then a tree. Ellington Fire Department as well as Conewango and Randolph Fire Departments responded to the incident. Boggs was later transported for medical attention by personal vehicle.

- FORESTVILLE – Zachary A. Franklin, 20, of Forestville was charged with fourth-degree criminal mischief on Oct. 14 stemming from an incident that occurred on King Road in the town of Hanover.
Franklin allegedly damaged a television during an altercation.
Franklin was issued an appearance ticket to appear in Hanover Town Court at a later date.
SHERMAN – Stephen S. Curtis, 35, of North East, Pennsylvania, was taken into custody Wednesday at about 12:35 a.m. and charged with multiple offenses.
Allegedly, Curtis had been driving on Osborne Street at a high rate of speed, and was stopped by deputies; investigation found him to be intoxicated.
He was charged with driving while intoxicated, DWI with a blood alcohol content of .08 percent or greater and speed in zone. He was processed and released with tickets, returnable to Sherman Town Court.

White, 22, of Versailles, was issued an appearance ticket for unlawful possession of marijuana Monday at 1 a.m. after her vehicle was stopped by deputies on Routes 5 and 20 for an alleged traffic violation and an investigation was conducted. She will answer the charge in Hanover Town Court.
CHAUTAUQUA – Kayla Koterass, 18, of Sinclairville; and Brittany Parsons, 17, of Mayville, were both issued appearance tickets for second-degree harassment Monday shortly before 6 p.m. According to reports, deputies investigated a call regarding an altercation on Davis Road involving the two females. They will answer for their actions in Chautauqua Town Court.
KENNEDY – Timothy A. Trask, 36, of Kennedy, was allegedly engaged in conduct that alarmed another individual Monday at about 11:30 p.m. After deputies conducted an investigation, Trask was taken into custody and charged with second-degree harassment. He was arraigned in Poland Town Court and released on his own recognizance. He will return to court at a later date.

CHAUTAUQUA – Tyler S. Bowen, of Mayville, was taken into custody by deputies Wednesday at about 5:50 p.m.
According to reports, Bowen was stopped on Mill Street in Hartfield for not wearing his seat belt, and during a records check, deputies found Bowen had an active arrest warrant in the village of Westfield. Allegedly, he was also found to be in possession of concentrated cannabis oil and a small amount of marijuana.
Bowen was charged with seventh-degree criminal possession of a controlled substance, unlawful possession of marijuana and no seat belt.
Bowen was turned over to the Westfield Police Department, and he will appear in Chautauqua Town Court.
FRENCH CREEK – Peter A. Zaphiris, 22, of Erie, Pennsylvania, was taken into custody Sunday just before 3 a.m.
According to reports, deputies stopped his vehicle on Old Road for an observed traffic violation, and then discovered that he was intoxicated.
Zaphiris was charged with driving while intoxicated, DWI per se (having .08 percent or greater blood alcohol content) and failure to use a turn signal. He was processed and released with citations. He will answer the charges in French Creek Town Court.

STOW – Douglas Richardson, 27, of Erie, Pennsylvania, was taken into custody Thursday by troopers.
According to reports, Richardson’s vehicle was stopped on I-86 for speeding. Troopers then, reportedly, smelled marijuana in the vehicle, and as a result of an investigation, found a gram of marijuana and a glass pipe containing marijuana residue in Richardson’s possession. He was charged with speeding and unlawful possession of marijuana, and will answer for himself in North Harmony Town Court.
JAMESTOWN – On Friday, troopers arrested Kyle Baggiano, 21, of Jamestown, for unlawful possession of marijuana.
Baggiano was pulled over on Foote Avenue Extension in Jamestown for a traffic violation and while speaking to Baggiano, troopers allegedly smelled marijuana emanating from inside the vehicle. Troopers searched the vehicle and allegedly located a bag containing approximately 3 grams of marijuana and a pipe containing burnt marijuana residue. Baggiano was placed under arrest, issued tickets and is scheduled to appear in Kiantone Town Court next month.
KENNEDY – On Saturday, troopers arrested Joseph Battaglia, 34, of Kennedy, for third-degree unauthorized use of a motor vehicle.
The complainants advised troopers that Battaglia was allegedly using their vehicle outside the scope of their permission.
Battaglia was arrested, processed at the Jamestown barracks and released with an appearance ticket for Poland Town Court later in the month.
JAMESTOWN – On Saturday, troopers arrested Quinncey King, 39, of Jamestown, for driving while intoxicated.
King was pulled over on North Main Street for allegedly speeding and after reportedly failing several field sobriety tests, King was placed under arrest. He was transported to the Jamestown barracks, where he allegedly provided a breath sample of .11 percent.
King was then processed, issued tickets returnable to Jamestown City Court and released.

ASHVILLE – Lee R. E. Kester, 39, of Ashville, was charged with failure to yield the right of way, driving while intoxicated and DWI per se of .08 of one percent or more of blood alcohol content.
On Friday at around 6 p.m., Kester was leaving a driveway when he allegedly failed to yield the right of way to traffic on Route 474. Kester struck a vehicle. Both drivers signed off on medical attention and Kester was taken into custody. He was released with an appearance ticket and will appear in North Harmony Town Court at a later date.
SHERMAN – Brandon A. Dejohn, 18, of Westfield, was charged with fifth-degree criminal possession of marijuana on Saturday at 12:53 a.m.
Deputies were called for a noise complaint on Route 76 and after further investigation, they allegedly found a digital scale and over 1 ounce of marijuana. Dejohn was released with an appearance ticket for Sherman Town Court at a later date.
Douglas L. Nichols, 30, of Westfield, was charged with driving while intoxicated, DWI per se of .08 of one percent or more of blood alcohol content, failure to stop at a stop sign and refusal to take a breath test.
On Saturday at around 1:45 a.m., officers observed a traffic violation on Route 60 and they later determined that Nichols was allegedly intoxicated. He was released with traffic tickets and will appear in Pomfret Town Court at a later date.

Springville man accused of robbing disabled elderly man
SPRINGVILLE – Erie County Sheriff Timothy B. Howard reports the arrest of Jeremy Bieber, 39 of Springville, after the Sheriff’s office received a report that a 65-year-old male was assaulted in his apartment building.
Patrol deputies and detectives arrived at the North Buffalo address in the village of Springville around 11:45 a.m. Thursday, where the victim stated the subject stole his keys and bit him. When the deputies and detectives confronted the subject in the adjacent apartment, Bieber ignored law enforcement’s commands and resisted arrest.
Following an initial investigation, Bieber was charged with robbery/causing physical injury, a C-felony, and six class-A misdemeanors including assault, criminal mischief, petit larceny, resisting arrest, criminal possession of stolen property, and obstruction of governmental administration.
Bieber was arraigned Thursday and remanded to the Erie County Holding Center in lieu of $100,000.00 bond or $25,000.00 cash bail.
During the attempt to gain custody of the subject, Deputy Ballantyne sustained an injury to his hand but the deputy is expected to make a full recovery.

FREWSBURG – Josh-ua Hattaway, 32, of Sinclairville, was taken into custody Sunday and charged with fourth-degree criminal mischief and second-degree reckless endangerment. According to reports, Hattaway was observed by multiple witnesses driving his personal vehicle through a crowded church parking lot in Frewsburg in a reckless manner, leaving grooves and tire marks on the blacktop and causing hundreds of dollars in damage. Hattaway was located at his residence by troopers and transported to SP Jamestown for processing. He will answer charges in Carroll Town Court later this month.
RANDOLPH – On Wednesday, troopers arrested Howard McAvoy, 39, of Jamestown, for third-degree aggravated unlicensed operation and unlawful possession of marijuana.
McAvoy was pulled over on Interstate 86 in Randolph for allegedly speeding and the troopers placed him under arrest after a license check revealed his driving privileges were suspended. While searching McAvoy prior to securing him in the patrol vehicle, a marijuana smoking device and a small amount of marijuana was allegedly located in his pocket.
McAvoy was transported to Randolph Town Court, where he was arraigned, remanded to the Cattaraugus County Jail and is scheduled to appear in court next month to answer the charges.

LEON – Sarah A. Burgoon, 21, of Fredonia was taken into custody Sunday and charged with several offenses. Allegedly, Burgoon had been driving while intoxicated, and run her car into a front porch on Smith Road. According to reports, when patrol arrived, deputies found Burgoon’s vehicle in the front lawn with damage to its front end. There was also damage to the porch’s railing and support pole. After failing standard field sobriety tests, Burgoon was charged with driving while intoxicated, driving while intoxicated with a blood alcohol content of .08 percent or greater and failure to keep right. She will answer these in Leon Town Court.

Fire believed to be intentional that destroyed parked boat
STOCKTON – The Chautauqua County Sheriff’s Office is investigating a fire of a parked boat that is believed to have been intentional.
A boat owned by Jason Evans, 40, of 5330 Route 380, Stockton was parked on a trailer in his driveway when it was destroyed in a blaze at 2 a.m. Wednesday. The Chautauqua County Fire Investigation Team was called to the scene and determined the fire to be an incendiary fire.
The investigation is continuing.

Kimmy, 70, of North East, Pennsylvania, was taken into custody and charged with petit larceny Saturday at about 1:45 p.m. According to reports, Kimmy took an item from a vendor at the Fall Festival and did not pay for it. Deputies were called in by Peek n’ Peek security. Kimmy will answer for her alleged actions in French Creek Town Court.
IRVING – Daniel J. Carson, 28, of Sinclairville was taken into custody Wednesday shortly after 1 p.m. and charged with three counts of seventh-degree criminal possession of a controlled substance and one count of second-degree aggravated unlicensed operation.
Allegedly, Carson had parked his vehicle behind a business on Routes 5&20, where he was discovered by deputies. After a short investigation, deputies found him to be in possession of a small quantity of narcotics and that he did not have a valid driver’s license. Carson was arraigned in Hanover Town Court and taken to Chautauqua County Jail on $1,000 cash or $2,000 property bond.

BUFFALO – Erie County Sheriff Timothy B. Howard reports the office received several calls about telephone scammers threatening businesses who don’t pay their National Grid invoice.
The scammers are threatening a technician is en route to the business to disconnect the service if the company does not pay the bill immediately. The scammer insists the company purchase pre-paid money or credit cards and call a 1-800 telephone number and follow the prompts to pay the bill.
The Erie County Sheriff’s office strongly advises individuals or companies who receive a call like this to ignore the scammer rather the office suggests they call their service provider at the number on the official bill to verify the status of their account.
This is the latest in an on-going string of telephone scams where the callers misrepresent themselves as a representative of a utility company or government agency and threaten punitive action if the issue isn’t settled immediately over the phone.

Joshua Whalen, 27, of Jamestown was sentenced on Sept. 26 on three counts to an indeterminate sentence of five and a half to 11 years in state prison, after being convicted of three counts of third-degree arson.

Nicole M. Hoffman, 31, of North Collins, was charged with issuing a check with insufficient funds on Friday after she turned herself in. The Collins Town Court issued the warrant. Hoffman was released on an appearance ticket and will appear in Collins Town Court at a later date.
Joleen M. Lone, 30, of Gowanda, was charged with criminal mischief Saturday at 5:30 a.m. after a disturbance outside her residence. Patrol was notified of a verbal altercation between Lone and a male. The altercation became physical as Lone allegedly smashed the victim’s vehicle windshield with a large rock. Lone was arraigned in Persia Town Court and released to appear in court at a later date.
Donnice L. Young, 22, of Gowanda, was charged with third-degree criminal sale of a controlled substance and criminal possession of a controlled substance on Saturday at 11 a.m. in a combined effort of the Gowanda Police Department and the Southern Tier Regional Drug Task Force’s ongoing investigation into an illegal narcotic sales in the village of Gowanda. Four subjects were arrested on Oct. 3 for possession and sales of narcotics and controlled substance, however, Young was not able to be located. Young was arrested and charged with a class-B felony of criminal sale of a controlled substance or narcotic, which was allegedly crack cocaine. Young was arraigned in the Persia Town Court and she was sent to the Cattaraugus County Jail in lieu of $5,000 bail.

STOP-DWI Enforcement Crackdown to take place Halloween
The next STOP-DWI Enforcement Crackdown will take place during Halloween weekend, Oct. 28 to Oct. 31.
Chautauqua County was recently awarded funds to continue STOP-DWI crackdowns during the New York state 2016-17 fiscal year. Funding for these events is provided by the state STOP-DWI Foundation through a grant from the Governor’s Traffic Safety Committee via the National Highway Traffic Safety Administration.
In September, Chautauqua County Agencies participated in the state STOP-DWI Labor Day Enforcement Crackdown. The Chautauqua County Sheriff, municipal law enforcement agencies and New York State Police vigorously enforced laws related to driving while impaired. They worked together to reduce the number of impaired driving injuries and deaths, with special emphasis on driving while impaired by either alcohol or drugs.
The crackdown resulted in two arrests for driving while intoxicated and 137 other vehicle stops, arrests and summonses.
“Removing intoxicated drivers from Chautauqua County roadways is one of our top priorities,” said Chautauqua County Sheriff Joseph A. Gerace. “If you choose to drink, don’t drive. Drunk drivers not only put themselves in danger, they threaten everyone who shares the highway with them.”

WESTFIELD – Eric J. Tanner, 25, of Ashville, was taken into custody Saturday shortly after 2 a.m.
According to reports, deputies stopped his vehicle on Route 394 for speeding, and upon investigation, ascertained that Tanner was intoxicated.
His charges include driving while intoxicated, DWI per se and speed over 55 miles per hour, for which he will answer in Westfield Town Court.
FRENCH CREEK – Timothy A. Cressley, 35, of French Creek was taken into custody Sunday at about 12:30 a.m. and charged with seventh-degree criminal possession of marijuana and unlawful possession of marijuana.
According to reports, deputies had checked a suspicious vehicle located in the parking lot of a closed business on Conway Road, and found Cressley inside. Upon investigation, it is alleged that deputies found a quantity of methamphetamines and marijuana.
He was processed and released with tickets, returnable to French Creek Town Court.
CHAUTAUQUA – Dustin A. Long, 22, of Chautauqua, was taken into custody Sunday at about 3 a.m.
Allegedly, Long’s vehicle was stopped on West Chautauqua Street for a speed violation, and upon investigation, Long was found to be intoxicated.
After being processed, Long was released with traffic tickets for the charges of driving while intoxicated, driving while intoxicated with a blood alcohol content of .08 percent or greater and speed in zone.
He will answer these in Chautauqua Town Court.

CONEWANGO – Austin Wade Slater, 31, of Conewango was taken into custody Friday at about 12:30 a.m. by deputies and the New York State Parole officers.
Officers of the law located Slater hiding on the roof of a Pope Road residence and took him into custody without incident for a parole violation warrant.
He was also wanted by the Chautauqua County Sheriff’s Office for multiple felony warrants, including charges from a high-speed chase in September, during which he crashed his car and fled on foot.
He was processed at the Cattaraugus County Jail and later turned over to Chautauqua County Sheriff’s deputies to face charges in their jurisdiction.

Joshua A. Satterfield, 30, of Walnut Street was arrested on Sept. 30 at 7:45 p.m. Gowanda Police previously arrested Satterfield for seventh-degree criminal possession of a controlled substance when he allegedly had a small amount of methamphetamine. Satterfield failed to appear in court and a warrant was issued for his arrest. Satterfield was arraigned in Collins Town Court and he was remanded to the Erie County Holding Center in lieu of $1,000 bail.
Kevin M. Britt, 28, of Chestnut Street was charged with second-degree menacing on Oct. 1 at 2:19 p.m. after an altercation on the road. Britt allegedly brandished and threatened another subject with a handgun after a road rage incident on Jamestown Street. Britt was arrested for the charge and released with appearance tickets. He will appear in Persia Town Court at a later date.
Shawndell M. Day, 26, of Shirley Street was arrested on Friday at 3:45 p.m. after patrol responded to a report of minor property damage on Miller Street. Day was allegedly one of the operators of the vehicles and during the computer check, it revealed her arrest warrant from the Cheektowaga Town Court. Day was turned over to the Cheektowaga Police Department to process their warrant.

SILVER CREEK – Donna K. Lugen, 60, of Dunkirk, was charged on Saturday at 12:31 a.m. with driving while intoxicated and driving while intoxicated per se.
After a situation call, officers reported to the scene at Henry Street, where they then spotted a car similar to the one in question. Lugen, who was driving that vehicle, was arrested and charged for allegedly driving while intoxicated.
Lugen will appear in Silver Creek Village Court at a later date.
CELORON – A vehicle half on the street and half off was found Saturday on Duquesne Street in Celoron.
When deputies arrived, the operator of the vehicle was allegedly fast asleep.
Jeffrey L. Bellomo, 38, of Kiantone, was behind the wheel at 6:49 a.m. as the officers quickly tested and concluded that Bellomo was allegedly drunk. His blood alcohol content was susposedly over three times the legal limit.
His charges include driving while intoxicated, aggravated DWI – having .18 percent or higher blood alcohol content and parking on pavement.
Bellomo will appear in Ellicott Town Court at a later date.

- Bradley E. Gabel, 30, of Caroline Street was charged with petit larceny and third-degree trespassing after allegedly being spotted by patrol on railroad property on Sept. 25.
The incident occurred at around 10:45 p.m. when Gabel was caught allegedly stealing items from the property.
Gabel was arraigned in Persia Town Court and remanded to the Cattaraugus County Jail in lieu of bail.

Brandon Drummond, 31, of Dunkirk was charged with reckless driving, passing in a no-pass zone, and failure to keep right on Sept. 20.
Diroy Hernandez, 34, of El Paso, Texas, was charged with reckless driving, passing in a no-pass zone, and failure to keep right on Sept. 20.
Alexander J. X. Kriefall, 21, of Schenectady was issued a traffic ticket for driving the wrong way down a one-way street on Sept. 23. During that traffic stop, Kriefall was also allegedly found to be in possession of marijuana, leading to another charge for unlawful possession of marijuana.

Jessica A. Wilson-Ignizio, 19, of Fredonia was issued an appearance ticket for underage possession of alcohol and littering on Sept. 23.
Travis L. Eggleston, 23, of Silver Creek was issued an appearance ticket for trespassing on Sept. 24.
Austin S. O’Donnell, 20, of Williamsville was charged with and held for disorderly conduct and resisting arrest on Sept. 25. Bail is set at $250.
Lyle G. Howard, 22, of Forestville was issued an appearance ticket for trespassing on Sept. 25.
Natalie A. Carr, 19, of Fredonia was issued an appearance ticket for underage possession of alcohol on Sept. 26.

JAMESTOWN – Sherod Hurst, 26, of Rochester was charged by New York State Police on Oct. 7 for Unlawful Possession of Marijuana.
Hurst was pulled over on E. 2nd Street in Jamestown for a traffic violation and while speaking to Hurst, the Troopers allegedly smelled marijuana emanating from inside the vehicle. Hurst was placed under arrest after a glass vial containing two grams of marijuana was located in the center console. Hurst was issued tickets returnable to Jamestown City Court and is scheduled to appear in person later in the month.

STOCKTON – On Oct. 6, deputies were checking a residence for a wanted individual. During the course of the investigation, John Hopkins, 44, of Mayville and Jody A. Burdett, 49, of Westfield pulled into the residence. Hopkins and Burdett were both found to be in possession of a controlled substance. Hopkins and Burdett were both charged with seventh-degree criminal possession of a controlled substance, while Hopkins had an additional charge of consumption of alcohol in a motor vehicle. Both will appear in Stockton Town Court.

On line dating leads to rape charges
COLLINS – On Wednesday, the Bureau of Criminal Investigation arrested Todd M. Wingard, 21 of Collins, on charges of third-degree rape, a class E felony.
On Tuesday, State Troopers received a report of a possible rape of a female 21 year old victim. This relationship between Wingard and the victim started from an Internet dating site. Following the sexual assault investigation Wingard was arrested and transported to State Police Collins for processing.
Wingard was arraigned in the Town of Collins Court for further proceedings.
Truck strikes railroad bridge in city
The Dunkirk Police Department responded to an accident where a tractor trailer hit a railroad bridge on Brigham Road around 5:45 p.m. Thursday. According to Sgt. Manzella, there were no injuries, no structural damage to the bridge between Fourth and Second streets and the road remains open to traffic.
Gowanda drug bust nabs four
GOWANDA -Four individuals have been charged in the conclusion of an eight month investigation of suspects selling heroin, cocaine, fentanyl and other controlled substances (pills). Two more additional arrests are pending as part of this investigation.
Tina M. Ganschow, 53, of East Main Street, Gowanda; Michael Smith, 43, of Chestnut Street, Gowanda; George A. Kennedy, 26, of St. Johns Street, Gowanda; and Travis L. Neu, 27, of Route 20, Silver Creek were all arrested on Thursday and arraigned in Persia Town Court.
Southern Tier Regional Drug Task Force – Olean Office, Gowanda Police Depart-ment, Cattarau-gus County Sheriff’s Office and the New York State Police executed arrest warrants on these four individuals that sold illegal narcotics in the village of Gowanda. The arrests all took place simultaneously early Thursday as part of a group round up.
Ganschow, Smith, Kennedy and Neu have been charged with two counts each of third-degree criminal possession of controlled substance and third-degree criminal possession of a controlled substance with intent to sell. All charges are Class-B felonies.
Bail was set on all the individuals at $5,000 cash and $10,000 property bond. All subjects were sent to the Cattaraugus County Jail pending further court proceedings.

SILVER CREEK – Lorie L. Delcamp, 57, of Fredonia, was taken into custody Aug. 7 at about 3:40 p.m. and charged with two counts of fourth-degree grand larceny, which is a felony. According to reports, a shopper at a local business accidentally left a pocketbook on a display. When she returned to retrieve it, it was missing. An investigation by deputies led to Delcamp as the one who allegedly stole the pocketbook. She will answer for her actions in Silver Creek Village Court.
MAYVILLE – Sasha L. Montanez-Vega, 29, of Youngstown, Ohio, was taken into custody Sunday at about 6:15 p.m. According to reports, Montanez-Vega had an outstanding arrest warrant for assault out of Youngstown. She was found during a traffic stop for an alleged violation, and a records check revealed the warrant. She was arraigned in Chautauqua Town Court and is being held at Chautauqua County Jail until she is extradited to Ohio.
MAYVILLE – Rance Freeman Sr., 62, of Westfield, was taken into custody Sunday at about 5:20 p.m. after deputies investigated reports of a counterfeit hundred-dollar bill being used at the Crosby Store. Allegedly, Freeman was the person responsible for doing so. An arrest warrant was issued by Chautauqua Town Court and Freeman was charged with first-degree possession of a forged instrument and petit larceny. He was arraigned in Chautauqua Town Court and taken to Chautauqua County Jail in lieu of bail.
MINA – Dawnyiel R. Smith, 23, of Erie, Pennsylvania, was taken into custody Friday at about 2 a.m. after deputies stopped her vehicle on Sunnyside Road for an alleged traffic violation. Following an investigation, reports say, it was determined that Smith was intoxicated. Her charges include driving while intoxicated, DWI per se and speed in zone, which she will answer in Mina Town Court.
MINA – Dale Cooper, 55, of Sherman, was allegedly observed by deputies making several lane violations Sept. 24 at about 2:30 a.m. on French Creek-Mina Road. Cooper’s vehicle was stopped, and following an investigation, he was taken into custody and charged with driving while intoxicated, DWI per se, failure to keep right and moving from a lane unsafely. He will answer these in Mina Town Court.

Shooting probe in Jamestown leads to drug charges
JAMESTOWN – Two teens and one 20-year-old have been charged following the investigation into an early morning shooting Sunday in the south county.
According to Jamestown Police, an investigation into reports that a suspect had fired shots at another with a pistol during an altercation at 81 Hazzard St. around 4:30 a.m. Sunday found Emil Deprospo, 20, fled the scene before police arrived.
On Monday at 4:20 p.m., police conducted a search warrant at 75 Barker St. in an attempt to locate evidence from the shooting. Police and SWAT Team members located Deprospo inside and placed him in custody for an outstanding warrant of first-degree attempted assault.
During a search of the residence, a quantity of cocaine, marijuana, prescription pills, packaging material and drug paraphernalia was also allegedly located. Donald Dean Jr., 17, and Kevin Philbrick, 18, were also occupying the residence.
Deprospo, Dean and Philbrick were charged with third-degree criminal possession of a controlled substance, a felony, two counts of seventh-degree criminal possession of a controlled substance and criminal use of drug paraphernalia. Dean was also charged with fourth-degree criminal possession of a weapon, which reportedly turned out to be a stun gun.
All are currently in the city jail awaiting arraignment.
Details released in fatal motorcycle accident in Evans
EVANS – Police have announced it was a Fredonia man who died in a motorcycle crash over the weekend.
According to the Evans Police Department, on Saturday around 3:30 p.m., Jomar Rivera-Ruiz, 25, of One Temple Square, was traveling on a motorcycle with other motorcyclists on Cain Road between South Main (Brant/Angola/Route 323) and Versailles Plank Road, when Rivera-Ruiz struck a turkey vulture from a flock that was crossing the road.
Rivera-Ruiz was transported to Lake Shore Hospital in Irving, where he died from his injuries.
Funeral services are being held today at the Larson-Timko Funeral Home, Fredonia.

JAMESTOWN – Jonathan Vega, 24, of Jamestown, was taken into custody July 22 and now faces welfare fraud charges. Allegedly, Vega had been receiving SNAP/food stamp benefits and had claimed no employment income. From May 1, 2015 to Dec. 31, 2015, Vega failed to report the employment income he was earning. Due to this, he received $938 in unentitled food stamps. His charges include petit larceny and misuse of food stamps (under $1,000); he will answer them in Jamestown City Court.
BROCTON – Justin Schwertfager, 28, of Fredonia was taken into custody Monday and charged with second-degree trespassing. Schwertfager allegedly entered a residence on Lake Avenue without the owner’s permission and ran away when the owner yelled. Police located Schwertfager a short time later on an all-terrain vehicle near the Webster Road and Highland Avenue intersection. He was arraigned in Brocton Village Court and taken to Chautauqua County Jail in lieu of $1,500 cash or $3,000 property bond.

CHAUTAUQUA – Catherine L. Wilson, 36, of Fredonia was taken into custody Saturday at about 2:15 p.m. and charged with felony driving while intoxicated. According to reports, Wilson’s vehicle was stopped by deputies on Route 430 for speeding and for failing to keep right; an investigation showed that Wilson was intoxicated. A records check reportedly showed that Wilson had been arrested in 2008 and charged with DWI then, as well, making this arrest a felony charge. Additional charges include speed in excess of 55 miles per hour, failure to keep right and DWI per se. She will answer these in Chautauqua Town Court.
PANAMA – Melissa S. Gifford, 31, of Panama was charged with making a punishable false written statement on Saturday at about 5 p.m. Allegedly, deputies had been called to a residence on Bear Lake Road due to an alleged physical altercation. Gifford stated that another individual grabbed and pushed her. Upon further investigation, it was allegedly found that Gifford made a false report about the incident. Gifford was issued an appearance ticket and will answer for herself in Harmony Town Court.
POLAND – Kevin L. Burch, 49, of Jamestown was charged with second-degree reckless endangerment on Sept. 20 at about 3 p.m. According to reports, Burch was driving in a reckless manner on Falconer Frewsburg Road; a bus driver reported that a pick-up truck pulled up beside his bus in a no passing zone and attempted to get the bus to pull over. The bus driver refused to comply due to having students on the bus. The driver stated that Burch then pulled his truck directly in front of the bus, nearly hitting it. When the bus came into Frewsburg Burch stopped his truck in the middle of the road, forcing the bus to come to a stop. Burch then allegedly got out and approached the bus and verbally abused the driver. Burch was issued an appearance ticket and will answer for his actions in Poland Town Court.
JAMESTOWN – Timothy R. Perrin, 46, of Jamestown was taken into custody and charged with welfare fraud on July 7. According to reports, Perrin had been receiving food stamp benefits and had claimed no income from his wife. However, from July 1, 2015 to Nov. 30, 2015, Perrin allegedly failed to report income his wife was receiving. Perrin also allegedly filed a false instrument during that time period for continued benefits. Due to that, Perrin received $1,785 in unentitled food stamps. His charges include fourth-degree welfare fraud, fourth-degree grand larceny, first-degree offering false instrument for filing and misuse of food stamps over $1,000, all of which are felonies. Details released in Route 430 crash
ELLERY – A Mayville woman was hospitalized and later charged with driving while intoxicated after her vehicle crashed on Route 430 Thursday night.
According to the Chautauqua County Sheriff’s Office, Carina A. Braymiller, 40, of S. Erie St. was traveling west on Route 430 in the town of Ellery around 10:40 p.m. when her vehicle crossed over the center line of the roadway and entered a field on the south side of the road. While going through the field, the vehicle struck several trees before coming to a stop.
Braymiller was transported by Maple Springs Fire Department to a local hospital for non-life threatening injuries.
Further investigation allegedly revealed Braymiller was intoxicated. She was charged with DWI and failure to keep right. She will appear in Ellery Town Court at a later date.
The Sheriff’s Office was assisted at the scene by the Maple Springs and Dewittville fire departments.

PANAMA – On Thursday, troopers arrested Matthew Mecusker, 28, of Ashville, for second-degree criminal trespass.
According to reports, Mecusker arrived at a residence in Panama uninvited and pushed past the homeowner despite being advised that he wasn’t welcome. Mecusker eventually left the scene, was located in Panama and placed under arrest.
Mecusker was transported to the Jamestown barracks, processed and arraigned in Busti Town Court. He was released and will appear in Harmony Town Court next month to answer the charge.

LITTLE VALLEY – Codie D. Capron, 26, of Little Valley was taken into custody Tuesday at about 2 p.m. after deputies investigated reports of burglaries in the area. Capron was charged with 17 counts of third-degree burglary for allegedly stealing tools and other property from garages and buildings in multiple townships across Cattaraugus County. He was arraigned in Cattaraugus County Court and released on his own recognizance.

Motorcyclist killed in crash
EVANS A motorcyclist was killed Saturday afternoon in a crash.
According to the Evans Police Department, officers were called to Cain Road around 3:30 p.m. between Route 323 and Versailles Plank Road in the town of Evans, for the report of an accident.
The victim was transported to Lake Shore Hospital in Irving, where the person was pronounced dead from injuries. The victim’s name was not released pending relative notification.
That stretch of the road was closed for investigation by the Evans Police Department Accident Investigation Unit and Detective Bureau.
Along with Evans police, the Farnham Fire Department, the Evans Center Fire Company, Rural Metro Medical Services, the Angola Fire Department and the Brant Police Department all responded to the scene.

- ELLERY – two men were charged after allegedly having drug paraphernalia in their vehicle Thursday night.
Around 10 p.m., Daniel Carlson, 28, of Johnson Road, Sinclairville and Joshua Burke, 28, of Bowlen Road, Stockton were parked along Sinclair Drive Extension in the town of Ellery. Deputies conducted a safety check. Whilte speaking to the subjects multiple glassine envelops and various pills were allegedly observed in the vehicle. Following an investigation, both were charged with seventh-degree criminal possession of a controlled substance. Carlson was additionally charged with criminally possessing a hypodermic instrument and criminally using drug paraphernalia.
HANOVER – Tanya S. Warrior, 39, of Irving, was charged with aggravated driving while intoxicated blood alcohol content of .18 percent or higher, driving while intoxicated, parked on pavement and open container of alcohol in a motor vehicle. On Sept. 23 at 2:35 a.m., officers responded to a call of a situation on Allegany Rd. Deputies identified Warrior and gave her the charges. Warrior will appear in Hanover Town Court at a later date.
IRVING – Sarah J. Bass, 21, of Hamburg, was charged on Friday at 2:50 a.m. with driving while intoxicated, driving while intoxicated per se, and speed in zone. Bass was in the town of Hanover for a traffic violation. The officers allege that Bass was intoxicated. Bass will appear in Hanover Town Court at a later date.
