CHAUTAUQUA COUNTY COURT

Chautauqua County District Attorney Jason Schmidt announces the following action in county court:

¯ Stephan Easley, 34, was arraigned Dec. 28 by the Honorable David W. Foley on a 21 count indictment for an incident that occurred in October 2021. Within this indictment, Easley is charged with multiple counts of burglary, assault, strangulation and criminal obstruction of breathing, one count of aggravated family offense, and one count of tampering with physical evidence.

¯ Devonte Chandler, 29, of Jamestown, was sentenced Jan. 3 by County Court Judge David W. Foley to consecutive state prison terms totaling seven years plus five years of parole supervision after being convicted of second-degree criminal possession of a weapon, a class C felony, and third-degree criminal possession of a controlled substance, a class B felony. These convictions are a result of incidents that occurred in October 2020 and January 2021, respectively. Schmidt would like to thank the Jamestown Police Department and the state police for their assistance in the prosecution of Chandler.

¯ Marcos Reyes, 20, of Jamestown, was sentenced Jan. 3 by Judge Foley to a state prison term of two to six years after being convicted of third-degree burglary, a class D felony. This conviction is a result of an incident that occurred in July 2021. Schmidt would like to thank the Jamestown Police Department for assisting the office in the prosecution of Reyes.

WESTFIELD POLICE DEPARTMENT

¯ Kevin Weary, 21, of 43 Richard St., Fredonia, was charged with second-degree criminal contempt. According to police, On Monday, Weary was involved in an incident at 146 South Gale St., Westfield and had allegedly violated an order of protection. He was issued an appearance ticket and will appear in village court at a later date.

NEW YORK STATE POLICE

¯ KENNEDY — Troopers out of Jamestown charged Katherine Depasquale, 59, of Kennedy, with driving while intoxicated and second-degree obstructing governmental administration.

Troopers attempted to pull Depasquale over for driving erratically Saturday, including leaving the roadway on Second Street in the hamlet. After Depasquale failed several field sobriety tests, troopers attempted to place her under arrest at which point she attempted to flee the scene and continued to act disorderly after being taken into custody. At Jamestown barracks, Depasquale refused to provide a breath sample and was subsequently processed as a refusal. She was then transported to the Chautauqua County Jail.

BRANT — Troopers charged Jonathan Otero, 30, of Dunkirk, with driving while ability impaired by drugs, second-degree obstructing governmental administration and resisting arrest.

Otero was pulled over for committing a traffic violation on Route 20. After failing several field sobriety tests, troopers attempted to place Otero under arrest at which point he fled the scene. Otero was apprehended shortly afterward by Troopers and the Seneca Nation of Indians Marshalls. Otero was transported to Brooks Memorial Hospital in Dunkirk where a blood sample was secured.

Otero was then transported to Fredonia barracks where he was processed, issued tickets and released. Otero is scheduled to appear in the town of Brant Court on a later date.

CHAUTAUQUA COUNTY SHERIFF

¯ WESTFIELD — A joint investigation conducted by the Chautauqua County Sheriff’s Criminal Investigation Division, Sheriff’s Road patrol and the Westfield Police Department led to warrants being signed for Andrew S. Betts of Westfield out of the town and village of Westfield courts. On Dec. 9, a motor vehicle was stolen in the village and then involved in a one-car accident on Plank Road in the town.

Residents where the accident occurred on Plank Road reported their vehicle was also stolen from their garage and was missing. This vehicle was located by Chautauqua County Sheriff Road Patrol shortly after the incident. It was parked behind Betts’ house.

Betts, 39, of 6842 Webster Road turned himself in to the Chautauqua County Sheriff’s Office and was arraigned on charges of fourth-degree grand larceny, fourth-degree criminal mischief and third-degree unauthorized use of a motor vehicle at Centralized Arraignment in the jail. He was later released.

¯ PANAMA — James F. Chase, 34, of Panama was charged with fourth-degree criminal possession of a weapon at 3:40 p.m. Jan. 1 after a search warrant was executed at 9 School St., Panama. The warrant was executed by the Chautauqua County SWAT team, Southern Tier Regional Drug Task Force, Chautauqua County Sheriff’s deputies nad Chautauqua County EMS. Chase was taken to the Chautauqua County Jail and arraigned through the Centralized Arraignment Program.
