NORTH COLLINS MOTORCYCLIST DIES IN ACCIDENT

ALLEGANY — A North Collins resident has died after a Sunday morning collision between a vehicle and motorcycle.

New York State Police in Olean say they responded to the incident on Buffalo Road after 10:30 a.m. An investigation determined that a 2019 Harley Davidson was traveling northbound on and failed to negotiate the curve, crossing into the oncoming lane and striking a 2017 Chevrolet Silverado head on. The operator of the Harley Davidson, Razvan Tuduc, 21, was pronounced deceased at the scene. The occupants in the Chevrolet were not injured.

Cattaraugus County Medical Examiners office will perform an autopsy. The Bureau of Criminal Investigation, Collision Reconstruction Unit assisted in this investigation.

JAMESTOWN POLICE DEPARTMENT

¯ Raymond Schwartzentruber, 58, of Jamestown, was charged with third-degree criminal trespass. Patrol responded at 7:53 p.m. Thursday to an address on the south side of the city for a reported suspicious situation. An investigation found that Schwartzentruber allegedly entered a condemned residence. He is scheduled to appear in court later.

CHAUTAUQUA COUNTY SHERIFF’S OFFICE

¯ SILVER CREEK — Alexis Cruz Ortiz, 39, of Kissimmee, Fla., was charged with speed in zone, driving while intoxicated and DWI per se. Deputies stopped a vehicle at 2:24 a.m. Saturday in Silver Creek for a traffic violation. An investigation determined that Cruz Ortiz was allegedly driving while intoxicated. Cruz Ortiz is scheduled to appear in court later.

¯ HANOVER — Samantha S. Kellogg, 33, of Fredonia, was charged with speed in zone, driving while intoxicated and DWI per se. Patrol stopped a vehicle at 12:04 a.m. Sunday in the town of Hanover. An investigation determined that Kellogg was allegedly driving while intoxicated. She is scheduled to appear in court later.

¯ CHAUTAUQUA — Cara J. Magill, 45, of Mayville, was charged with moving from lane unsafely, aggravated DWI with a BAC of 0.18% or higher and driving while intoxicated. Patrol responded at 7:19 p.m. Saturday to Mckay Road in the town of Chautauqua for a crash. An investigation later determined that Magill was allegedly intoxicated. She is scheduled to appear in court later.

CHAUTAUQUA COUNTY COURT

¯ Rodney Clyburn, 42, of Dunkirk, was sentenced Friday to a determinate term of eight years in state prison and three years of post-release supervision during a violation of probation hearing before County Court Judge David Foley. Clyburn had been placed on a five-year term of probation for third-degree attempted criminal sale of a controlled substance in March 2022. A violation of probation was filed by the Chautauqua County Probation Department after Clyburn was arrested in January 2023.
