Three charged after Wine Cellar fight

Three people face charges after a fight outside the Wine Cellar early Sunday morning.

According to a police report, Diondra F. Drayton, 22, of Jamestown, Lisandra Rodriguez, 32, of Dunkirk and Cesar L. Rodriguez, 28, of Dunkirk face charges after officers responded to 309 N. Main St. for a reported fight. Police report arriving to find several people fighting outside of the bar. Officers began separating individuals in an attempt to disperse a growing crowd.

Police say Cesar Rodriguez allegedly shoved one of the officers. Officers say they gave Cesar Rodriguez multiple commands to back away before Cesar Rodriguez again allegedly shoved the officer. Officers report they tried to take Cesar Rodriguez into custody; a brief struggle ensued and Cesar Rodriguez was taken into custody while the crowd began surrounding officers, according to a police report. Officers then deployed OC Spray to disperse the crowd. While officers were escorting Cesar Rodriguez to a patrol car, Diondra Rodriguez allegedly pointed her own pepper spray at officers, threatening to spray them. She was also arrested.

At that point, officers say the fighting began again. While attempting to separate individuals Lisandra Rodriguez allegedly threw a punch at an officer, hitting the officer in the eye and injuring the officer. Officers said they attempted to take Lisandra Rodriguez into custody while other people from the crowd allegedly tried to pull officers away. Lisandra Rodriguez was eventually taken into custody.

Cesar Rodriguez was charged with second-degree obstructing governmental administration and resisting arrest. Drayton is charged with second-degree menacing. Lisandra Rodriguez was charged with second-degree assault (on a police officer)

Drayton and Cesar Rodriguez were released with appearance tickets to be in Jamestown City Court later. Lisandra Rodriguez was taken to the city jail until she could be arraigned.

Jamestown police were assisted at the scene by the Ellicott Police Department, New York State Police and the Chautauqua County Sheriff’s Office.
