Nine businesses fined for water violations

MAYVILLE – There were nine businesses that were recently fined for violating various water regulations.

During the Chautauqua County Board of Health meeting, it was announced there were four businesses who wanted to go before the hearing officer. The remaining five agreed to settle.

Basil & Bones requested to go before the hearing officer but no one showed up for the hearing. They missed filing a water sample in January. They were fined $450 total – $200 for the missed sample plus $250 for appearing before the hearing officer.

The Board of Health generally fines businesses who are found guilty that go before the hearing officer $250 to cover the cost of bringing the officer to Maville for the hearing.

Second to go before the hearing officer was Cutting Lanes Bowling Alley of Clymer.

Jessica Wurestle with the county Health Department said they missed two monthly reports.

“However, this would be their fourth and their fifth monthly report that they’ve missed since January 2025,” she added.

Wuerstle said the respondent claimed he had emailed the report but could not show any evidence of emailing them.

Cutting Lanes was fined $950 total – $300 for the missed September report, $400 for the missed October report and $250 for appearing before the hearing officer.

The third business that was to appear before the hearing officer was Killa Kookies & Kreme of Jamestown, however no one attended the hearing.

They did not file a bacteria sample and a monthly report for November. Wuerstle said this was the second time they did not submit the bacteria sample. The first time they signed an agreement to settle and paid a fine.

Although they did not send anyone before the hearing officer, Wuerstle said in the past they had stated they were closed, however apparently they had made social media posts to the contrary.

Killa Kookies & Kreme was fined $750 total – $100 for the missed report, $400 for the missed sample and $250 for the case going before the hearing officer.

The fourth business to go before the hearing officer was Woodbury Winery of Fredonia.

Wurestle said they missed a monthly report, which is their fifth since 2025.

They were fined $650 total – $400 for the missed report and $250 for the case going before the hearing officer.

In the agreements to settle:

– Jacqueline Harrison dba The House that Jack Built of Bemus Point paid a $100 fine for a missed Water System Operation Report for October.

– Greg Huber dba Bemus Point Market of Bemus Point, Bemus Point Exit 9, LLC dba Bridgeview One Stop of Bemus Point, Elizabeth Odell-McKinley dba Compass Bar & Grille of Clymer, and Kris Kane dba Olde Chautauqua Vineyards of Portland each paid a $100 fine for a missed Water System Operation Report for November.
