EVANS -- On March 16 at about 3:48 a.m., patrol was on location for a DWI accident on Erie Road. A citizen reported a van being operated erratically going east. Patrol went in that direction and immediately observed the vehicle being operated in the passing lane. The vehicle then allegedly left the passing lane and slowly changed lanes into the driving lane without indicating the lane change with a turn signal. Patrol further observed a vehicle part sticking out from the front passenger side wheel well, indicating the vehicle may have struck something. Patrol conducted a traffic stop and identified the operator as Dylan J. Seneca, 26, of Seneca Falls, NY. Patrol observed that Seneca had glassy eyes, slurred speech and impaired motor coordination. Patrol further observed substantial damage to the front end of the vehicle, including the front bumper, which contained what appeared to be fresh grass. Patrol interviewed Seneca, who replied multiple times that he did not know the damage to the vehicle existed, and denied striking anything. Seneca had also reportedly stated several times that the damage was old and it had been there. Patrol asked Seneca to step out of the vehicle, to which he complied. Seneca did allegedly stumble just after exiting the vehicle.
Patrol conducted SFSTs, all of which Seneca failed. Seneca was taken into custody, while patrol conducted an inventory of the vehicle. Patrol found several empty Budweiser beer bottles and a black plastic bag containing several small, empty liquor bottles. Seneca refused to submit to a datamaster chemical breath test and was transported to the Town of Evans Police Station. While processing Seneca's property, patrol also located a quantity of concentrated cannabis. Seneca was charged with DWI – first offense, operate motor vehicle by unlicensed driver, illegal signal from parked position, moved from lane unsafely and seventh-degree criminal possession of a controlled substance. Seneca was later arraigned in the Town of Evans Court, where he was released on his own recognizance.
