Motel cited for not submitting multiple public water documents

An Ellery motel has been fined several hundreds of dollars for not submitting water documents multiple times.

During the Chautauqua County Board of Health, board members voted to fine Lacee Pearl, doing business as Chautauqua Lake Motel and Apartments, located at 3682 Rt. 430, Bemus Point $500 for violations of the state’s Public Water Supply for failure to submitting monthly operation records.

There were other businesses that failed to submit the documents, however county Environmental Health Director Jessica Wuerstle said Chautauqua Lake Motel and Apartments was brought in for a hearing in May due to not submitting several documents over the past year and half.

Wuerstle said Pearl did not show up for the hearing. “When they did not show up for the hearing, we presented our side of the story in front of the hearing officer,” she said.

The hearing officer noted that the April violation was the second violation in the calendar year and recommended a $200 fine.

Pearl was also fined $100 for not submitting the March water monitoring documents.

Wuerstle told members of the Board of Health that of the past 13 monthly reports, only six have been submitted on time.

The reports are for their chlorination system.

Wuerstle said the county Health Department has the right to make tests themselves, however all of these businesses must still submit the regular monitoring reports.

After the meeting, Wuerstle noted that another $55 was added to the fine to cover the cost of county staff for collection and processing of a bacteria sample.

Board of Health members asked Wuerstle how much the county has to pay the hearing officer. She told them it’s $100 an hour, for a two-hour minimum, plus mileage. She added that the hearing officer may do additional research after the hearing, so they assume every time there’s a hearing it costs the county up to $400 plus mileage.

Board of Health members decided to increase the hearing officer’s recommended fees to cover what the hearing actually costs the county.

They added that they may increase the fines even higher if this facility continues to not submit its monthly reports.

Other businesses cited and fined by the Board of Health for water violations include:

— John Calamunci d/b/a Basil & Bones 2061 Foote Ave, Jamestown was fined $100 for failure to submit results of necessary biological monitoring for the fourth quarter of 2023 and fined $100 for failure to complete necessary nitrate monitoring for their public water supply for 2023.

— Jeremy Casel, d/b/a Busti Tap House, 792 Busti Sugar Grove Road Jamestown was fined $100 for failure to submit results of necessary biological monitoring for the first quarter of 2024 for their public water supply.

— Michelle Miller, d/b/a Irwin Bay Cottages, 5088 W Lake Rd, Mayville was fined $100 for failure to submit results of necessary biological monitoring for the first quarter of 2024 for their public water supply.

— Kris Kane, d/b/a Olde Chautauqua Vineyards, 6654 West Main Rd, Portland was fined $100 for failure to submit results of necessary biological monitoring for the first quarter of 2024 for their public water supply.

— Steve D’Anna d/b/a A6 Properties LLC/Wellman Road Mobile Home Park, 1151 Wellman Rd,

Ashville was fined $100 for failure to submit results of necessary biological monitoring for the first quarter of 2024 for their public water supply.

— Timothy Switaj, d/b/a Sweeteye Estates, 939 Southwestern Drive, Jamestown was fined $100 for failure to submit monthly operation records by April 10 for their public water supply for the month of March.

— Rachel Steffen, d/b/a Bemus Point Golf and Tap House, 72 Main St. Bemus Point was fined $100 for failure to submit monthly operation records by April 10 for their public water supply for the month of March.

— Daniel Bemis, d/b/a Cutting Lanes, 524 Rt. 426, Clymer was fined $100 for failure to submit monthly operation records by April 10 for their public water supply for the month of March.

— Jerry Tanner, d/b/a Dollar General 8026 Route 60, Cassadaga was fined $100 for failure to submit monthly operation records by April 10 for their public water supply for the month of March.
