Lawsuit against city, school dismissed
A lawsuit filed in January 2024 against the Dunkirk City School District and city of Dunkirk has been discontinued.
The discontinuance was filed in late May in state Supreme Court in Mayville. In addition to the suit discontinued, neither side will be awarded any legal costs.
The suit was originally filed over a child’s allegedly unsupervised injury at the School 3 playground. The claim alleges the child, a kindergarten student at School 3, was left unsupervised on the school playground while near the monkey bars.
“He subsequently fell from the monkey bars and fractured both bones in his right forearm,” the Jan. 4 legal filing continues. “He was taken to Brooks Memorial Hospital for evaluation and was transferred to Oishei Children’s Hospital (in Buffalo) for an orthopedic consult and treatment the same day.”
Parents of the child were asking for unspecified compensation for injuries and expenses.
