County fines businesses for water regulation violations

Two county businesses have been fined for violating water regulations.

Earlier this year Bemus 16, LLC doing business as Chautauqua Lake Motel and Apartments located at 3682 Rt. 430, Bemus Point, was ordered to appear before the Hon. Betsy Steger, County Board of Health hearing officer, for failure to submit results of microbiological monitoring for the public water supply for the third quarter of 2024.

During a recent county Board of Health meeting, Jessica Wuerstle with the county Health Department said oftentimes with these types of violations, the business cited is given an opportunity to sign an agreement to settle. However Chautauqua Lake Motel and Apartments wasn’t because “they have a history of non-compliance.”

According to Wuerstle, this business was cited in 2023 and in 2024. In August, they were fined $500 but as of the June meeting had not yet paid that fine.

Wuerstle said the owners were notified of the hearing but did not attend it. The hearing took place and Steger found the defendant guilty and recommended a $500 fine. This is on top of the previous $500 fine.

The county Board of Health agreed to the recommendation and fined Chautauqua Lake Motel and Apartments $500.

Wuerstle said the Department of Health is looking to place a lien on the property should the fines not be paid.

In a separate matter, a hearing was held for Meghan Newman with Killa Kookies & Kream, located at 3423 Fluvanna Ave Jamestown for failure to submit results of microbiological monitoring for the public water supply for the third quarter of 2024.

Wuerstle said when they did submit their water sample, it came back positive for total coliform.

Wuerstle said a boil order was issued for the business.

Afterward, the business was required to submit both a treated and untreated water sample, which it did not immediately do.

During the hearing, Wuerstle said a representative with Killa Kookies & Kreme said the business had closed down.

Steger still recommended a $500 fine.

When a case goes before the Hearing Officer, the county Board of Health must approve the recommended fine, which the board did agree to and voted to fine Killa Kookies & Kreme $500.

Killa Kookies & Kreme has since reopened.

Wuerstle said the Health Department has worked with the business regarding the previous water violation to ensure the water is safe. The business also paid a different water violation fine, which it had agreed to settle.
