Business banned from selling tobacco
A Lakewood business has had its tobacco license permanently revoked.
During the recent Chautauqua County Board of Health meeting, Jessica Wurstle, Director of Environmental Health Services, said Clouds Smokes and Vapors, located at 361 E. Fairmount Ave., previously had its tobacco license suspended for selling tobacco products to individuals who are under 21 years of age.
During the suspension, the county Health Department followed up and discovered that the business still had tobacco products on their shelves.
In June, a recommendation was made for the business to be fined $2,750, which was approved by the County Board of Health.
The county Board of Health also sent a letter to the state Department of Tax and Finance asking them to permanently ban the business from selling tobacco products.
Wurstle said the state agreed and has permanently banned them from selling cigarettes, tobacco, or vapor products.
Board of Health officials said it appears that Clouds had been open as of their latest meeting.
Wurstle responded that the business can still sell non-tobacco products, including glassware or decorative products.
Wurstle said they will be following up and informing the state if they do continue to sell tobacco products.
This is the second business in the county to have its tobacco license permanently revoked in 2025.
Earlier this year, it was announced that the state Department of Tax and Finance was permanently banning Fredonia Food Mart and Deli, located at 33 Temple St. from selling any tobacco products.
Like Clouds, they had their license suspended for a year due to multiple sales of tobacco to people under the age of 21. During their suspension, it was discovered they were still selling vapes and Gutka, a smokeless chewing tobacco.
