Paving company files suit against Chautauqua Lake Lodge developers

With The Lodge at Chautauqua Lake no longer under construction, a lawsuit has been filed against the developers by one of the contractors.

Lake Shore Paving Inc. of Jamestown has filed a lawsuit against The Lodge At Chautauqua Lake LLC, The Estate of James K. Webb, Sally Webb, executrix, and Webbs Harbor Restaurant & Bowling Lanes, Inc.

In the suit, which has been stayed pending mediation, the plaintiffs state that Lake Shore Paving was contracted with The Lodge to provide certain materials and services as a site work foundation contractor in connection with the construction of the Lodge at Chautauqua Lake Condominium project for $297,777.

Construction on the project, which was to be located at 74 Water St., Mayville, began on May 3, 2021; 79 Water St. was intended to serve as as parking space.

The suit alleges that Lake Shore Paving was directed by Ben Webb to deposit fill removed from 74 Water St. property to the south side of Mather Road, Mayville.

Lake Shore Paving remitted a bill on May 31 and June 30, 2021, but allegedly has not received a single payment.

According to the suit, on Feb. 25, Webb called Ryan Rambacher, controller for Lake Shore Paving, and said that he was notified by Bank of Erie that they would not be issuing a loan for construction and therefore would not be moving forward with the project.

The lawsuit states that Lake Shore Paving has performed work for which payment is due pursuant to the terms of the construction contract. The paving company is seeking $127,155 plus interest.

The suit was filed on March 17. The plaintiff is being represented by attorney Elizabeth A. Kraengel of Buffalo.
