Brocton addresses parking issue with violation notice

BROCTON — The village has been discussing how to deter on-street parking in the winter months for over a year. At a recent meeting, something tangible finally came from the discussions.

Village Attorney Peter Clark presented the Board with a sample parking violation notice that will be utilized for violators of the village’s on-street parking law. The law states that on-street parking is not permitted overnight from the hours of 1 a.m. until 6 a.m. through March 31.

The first violation notice will serve as a warning. After that, towing vehicles in violation is an option being considered by the Village Board. Highway Superintendent Ken Becker stated he wants to contact Mayor Craig Miller or one of his designees before making the final call to tow a vehicle.

Notice has already been sent to village residents accompanying a recent electric bill.

“It’s not like we’re just going to tow it and be jerks. We’ll give them fair warning to move it, and then if they don’t comply, then worst-case scenario, we have the vehicle towed. We don’t want to make this miserable and to punish people,” said Village Trustee Kari Doino.

Clark stated that rather than issuing an appearance ticket for court, making the vehicle owner retrieve their vehicle and pay a fee for the vehicle being impounded was viewed as a stronger deterrent. “Let’s give it a try, at least, with a warning,” Clark said.

Becker pushed for some sort of resolution to protect the Highway Department from having to frequently navigate through the streets with cars parked in the way of snow plows throughout the winter.

“If it’s one snow event, it’s something that we can deal with or work around. But when it’s all winter long, that’s when it’s a real pain,” Becker said.

The law itself, Section 353-2 of the Village of Brocton local law No. 2-1989, states, “All-night Parking will be prohibited within the Village of Brocton between 1:00am and 6:00am during the period beginning November 1st, and ending March 31st, of each year on all highways within the Village of Brocton and also no vehicle shall stop, stand, or park between the sidewalk and the curb line or if there is no sidewalk within 8 feet of the paved street and further no vehicle shall stop, stand, or park on any sidewalk.”
