Health Board seeks permanent ban of tobacco sales by Cloudz
Chautauqua County health leaders are recommending a Lakewood establishment be banned from ever selling any kind of tobacco products again.
During the recent county Board of Health meeting, board members discussed Cloudz Smokes and Vapes located at 361 East Fairmount Ave.
Cloudz has been cited multiple times for selling tobacco to those under 21 years of age.
In January, Cloudz had its license to sell tobacco suspended for one year by New York state.
In early March, the county Health Department followed up that suspension and discovered that the business still had tobacco products on their shelves.
They were issued a violation and ordered to appear before the Hon. Betsy Steger, the designated Board of Health Hearing Officer.
That hearing was set for March 26 but no one from Cloudz appeared at the hearing.
Steger took testimony from the county health staff about what they saw and moved to recommend a $2,500 fine, plus a $250 surcharge.
The county Board of Health agreed with the recommended fine and surcharge, and approved the $2,750 combined fee for Cloudz at its meeting.
In addition, the Board of Health voted to send a letter to the state asking that Cloudz’s license to sell tobacco products be permanently revoked.
The state Department of Tax and Finance has the final say in the matter.
This is the second time in recent memory that the county has sought to permanently ban an establishment from selling tobacco.
In 2024, the county Board of Health recommended a permanent ban of tobacco sales by Fredonia Food Mart, which the state Department of Tax and Finance eventually agreed to.
Unlike Fredonia Food Mart, there is little that Cloudz sells that is not tobacco. The business does sell glassware used to smoke items as well as other products used to smoke various items. The ban, if approved, would also include all vape products.
