Town seeks law restricting battery storage

Town of Dunkirk Councilman Phil Leone urged the Town Board to take a proactive approach regarding an issue that could come up down the road. Leone asked his fellow Board members to consider enacting a local law for a moratorium to restrict battery energy storage systems in the Town of Dunkirk.

“I think with all the solar applications that we’re getting, eventually, these companies are going to want these standalone storage systems,” Leone said.

The Town has already approved several solar energy projects, including Lakeside Park Solar and Brigham Road Solar. The Town Board is currently in negotiations regarding the host community agreement with Brigham Road Solar. A battery energy storage system was recently proposed in the town of Hanover, but after several meetings filled with hours of public opposition, the project was rejected by the Hanover Town Board.

Following further discussion on the matter at the recent meeting, the Dunkirk Town Board directed Town Attorney Jeff Passafaro to begin drafting a local law regarding battery energy storage systems in the town. Once a local law is drafted, the Town Board can schedule a public hearing regarding the proposed law. Following the public hearing, the Town Board can act on the law at a regular meeting.

Following the efforts of Town Board members, three easements remain outstanding as the Town seeks to make improvements to the Shorewood Water District. Town Supervisor Priscilla Penfold stated that the Town has been trying to avoid eminent domain procedures if possible, but with three residences still not signing the easements required for the project to proceed, the Town has authorized Penfold to retain Hodgson Russ as counsel for eminent domain litigation.

A public hearing was scheduled prior to the next regular meeting of the Dunkirk Town Board, Tuesday, Aug. 12 at 5:15 p.m., to entertain public discussion regarding the acquisition of the necessary easements from property owners in the town for the Shorewood Water Project to proceed.

Following a public hearing at its most recent meeting, the Town Board voted unanimously to authorize Municipal Solutions to submit an application for Community Development Block Grant funding on the Town’s behalf.

The Town of Dunkirk is seeking more than $1 million in Community Development Block Grant funds from the state to apply to its East Lake Road Sewer District. The Town is hoping to replace its current sewer system in the East Town of Dunkirk, which is currently utilizing sewer grinders that are in need of an upgrade.

Also of note, repairs to the bridge over Willow Road are underway. Penfold stated the closure could last up to 10 weeks. Penfold stated the Town is pleased that the repair is taking place before the bridge over Canadaway Creek along Route 5 due to the potentially significant impact residents could have felt if both bridges were to be closed at the same time.

Code Enforcement Officer Ryan Mourer issued eight building permits in June for a total of $4,188. A demolition permit was issued during the month, as well.

The Town Clerk’s Office collected $1,229.75 during the month of June, including $985 in zoning fees. The Town of Dunkirk Justice Court handled a total of 255 cases in the month of June, amounting to $23,087 turned over to the Town for distribution.

The Town Board approved the Court Audit for the past year, handled by Bahgat & Laurito-Bahgat. The Board also approved Hodgson Russ LLP as special counsel for union negotiations. Mike Bohn was appointed by the Board for a one-year term with the Zoning Board of Appeals.
