Forestville Family Sues After Baseball Practice Fight

A Forestville family is suing the Silver Creek Central School District over injuries they say their son suffered in 2024 during a Silver Creek-Forestville baseball practice.

Ian and Jennifer Hodkin filed the suit in state Supreme Court in Mayville in early August asking the court to require the district to pay a claim that had been filed in July 2024 and not yet paid.

According to the Hodkins, their child was a member of the junior varsity baseball team when the child was bullied before a practice, suffering cuts, bruises and having his two front teeth injured, with the potential of losing the teeth, during a May 2024 practice.

“Upon information and belief, at all times hereinafter mentioned and relevant, the defendant failed to provide appropriate supervision or control of students on the junior varsity baseball team, despite having knowledge of prior instances of bullying and fighting during students’ baseball practices and/or games,” the lawsuit states. “Upon information and belief, at all times hereinafter mentioned and relevant, and in particular prior to the incident complained of herein, the defendant was aware, or in the exercise of reasonable diligence and observation should have been aware, of the propensity of certain students … to bully, harass and physically harm other students.”

The Hodkins are asking to be reimbursed for the cost of medical care, legal costs and any other damages the court chooses to award. The family said the written notice of claim required under state General Municipal Law and state Education Law was filed and at least 30 days have elapsed since the claim was served.

“As a result of the foregoing, the infant plaintiff has been damaged in an amount in excess of the jurisdictional limits of all lower courts which would otherwise have jurisdiction,” the lawsuit states.
