Court sides with Fredonia in lawsuit over water project

A state Supreme Court of Chautauqua County decision this week may pave the way for Fredonia’s future water plans.
On Wednesday, Justice Grace Hanlon denied a request to annul the Sept. 10 resolution by the village for the Fredonia Water System Improvement Project.
The challenge came from James Lynden, Gladys Sedota and Marie Sedota. The three filed a lawsuit in October against the village taking issue with the resolution to share water with Pomfret and decommission the dam and reservoir. The resolution also made a “negative declaration” under the State Environmental Quality Review Act (SEQRA).
The trio claimed the resolution does not comply with the state’s SEQRA and General Municipal Law, or Fredonia’s own zoning code. The court ruled against all those claims.
Last month, Fredonia’s trustees approved a $2.975 million engineering agreement with LaBella for work on connecting village water to the North County Water District.
