Son sues mother over 2024 death of father

A man has sued his mother over the 2024 death of his father at the Chautauqua County garbage transfer station on Webster Road.

William Bartoo was accidentally struck July 11, 2024, while depositing garbage into the pit at the county facility. He was hit by a vehicle driven by his wife, Sharon Bartoo. He died from his injuries July 30.

William Bartoo’s son, Wesley Bartoo, subsequently sued the county. Chautauqua County also sued Sharon Bartoo over the incident. Now yet another lawsuit has come out of the tragedy, this time from Wesley Bartoo against Sharon Bartoo.

“Upon information and belief, the alleged incident… was caused as a result of the negligent, careless, reckless, and unlawful conduct on the part of the defendant,” according to Wesley Bartoo’s court filing, made on June 9.

It states that William Bartoo’s “next of kin were dependent on (him) for support, maintenance, nurture, comfort, advice, aid and society, which they are now deprived of as a result of the aforesaid incident.” Medical, burial, and funeral expenses are also mentioned.

Wesley Bartoo seeks unspecified damages from his mother in the latest lawsuit. “An amount that exceeds the jurisdiction limits of all lower courts that would otherwise have jurisdiction” is a phrase repeatedly used.
