Fredonia man accused of manufacturing child pornography

A Fredonia man has been arrested on accusations involving child pornography.

According to Fredonia Police, David M. Tobio, of 21 Carol Ave., was taken into custody on an arrest warrant issued by the Village of Fredonia Court for the charge of promoting a sexual performance by a child, a class D felony.

According to the New York state penal code, a person is guilty of promoting a sexual performance by a child when, knowing the character and content thereof, he/she produces, directs or promotes any performance which includes sexual conduct by a child less than 17 years of age.

The arrest concludes a lengthy investigation of the Federal Bureau of Investigations and the Fredonia Police Department.

A complaint reviewed by the Federal Bureau Investigations resulted in the issuance of search warrant for the residence of Tobio. The search warrant was issued by the United States District Court for the Western District of New York.

Upon execution of the search warrant, several item were seized and analyzed by the Western New York Regional Computer Forensics Laboratory in Buffalo.

Tobio was held pending arraignment in the Village of Fredonia Justice Court.
