Dayton man, 20, charged with

sexual misconduct

DAYTON – A Dayton man has been charged with sexual misconduct and endangering the welfare of a child following an investigation.

Cattaraugus County Sheriff’s Office Criminal Investigation Bureau allege Dustin L. Bennett, 20, engaged in sexual intercourse with a 15-year-old female without her consent in February. The investigation is continuing and additional charges are expected.

Bennett was arraigned in the Persia Town Court and was sent to the Cattaraugus County Jail in lieu of $1,500 bail.

Police release name in fatal accident

The Chautauqua County Sheriff’s Office has released the name of the victim in Wednesday’s train accident. Brian P. Kircher, 31, of Greenwood, Calif. died when he fell from a CSX train at 5 p.m. Kircher was illegally riding the train in the town of Sheridan and sustained fatal injuries in the fall and was found deceased at the scene. The Silver Creek Police Department also assisted.

HANOVER – Robert K. Shumaker, 32, of Silver Creek was charged with fifth-degree criminal possession of stolen property on Thursday. The charge stems from an incident that occurred on May 23 where Shumaker allegedly possessed stolen property. He was released on an appearance ticket for Hanover Town Court.

PORTLAND – Alan Dejonghe, 62, of Dunkirk was charged with second-degree menacing on Thurs-day. Dejonghe allegedly threatened another subject with a hand gun in the Van Buren area.

Dejonghe was released on an appearance ticket for the Portland Town Court.

Thomas A. Schul-maksz, 35, of Armadillo Street was charged with second-degree criminal contempt and fourth-degree criminal mischief May 21.

Kayode J. Jordan of Main Street was charged with first-degree criminal contempt May 21.

Najee T. Finley of Park Avenue was charged with second-degree harassment on May 23.

Zachary Plumley, 17, of South Roberts Road was charged with a warrant on May 23.

Micheala Rae Koch, 18, of Deer Street was charged with unlawful possession of marijuana on May 23.

Robert J. Mangus Jr., 32, of Eagle Street was charged with operating a vehicle while using a cell phone and unlicensed operation on May 24.

Ethan R. Mosier, 18, of Townsend Street was charged with operating a motorcycle without a helmet, unregistered motorcycle, operating out of license class and operating a motorcycle without insurance on May 24.

Steven J. Pleszewski, 28, of Second Street was charged with having an unregistered vehicle and unlicensed operation on May 24.

Melanie R. Murphy, 20, of Camillus was charged with third-degree aggravated unlicensed operation and having no turn signal on May 25.

James A. Howard, 19, of Pomfret was charged with driving while intoxicated, third-degree criminal trespassing and fourth-degree criminal mischief on May 25.

Angel G. Flores, 42, of King Street was charged with operating an ATV on a highway, wearing no helmet, speed not reasonable and prudent, having no insurance, failure to comply and third-degree aggravated unlicensed operation May 25.

Rosemarry Robles, 20, of Main Street was charged with speeding and unlicensed operation May 25.

Hammad R. Zaidi, 42, was charged with fourth-degree criminal mischief and second-degree unlawful imprisonment on May 26.

Frederick C. Long Jr., 54, of Central Avenue was charged with second-degree harassment on May 26.

Shawn L. Pryor, 40, of West Sixth Street was charged with having an open container on May 27.

Norman I. Geddis, 43, of Lincoln Avenue was charged with second-degree harassment on May 28.

Cici Acevedo-Arocho, 19, of Buffalo was charged with having improper license plates, having no inspection, no insurance, no registration and violation of license restrictions May 29.

Gowanda Police Department

Traig McMahon, 24, of North Water Street was taken into custody on an arrest warrant on May 24. Gowanda Police responded to two burglary calls on North Water Street and evidence at the scene led to McMahon.

McMahon has been a fugitive from justice after a warrant was issued by New York State Parole office.

Police received a tip that McMahon was hiding out in Ellicottville, at which time the Ellicottville Police Department arrested him in a parking lot.

He was transported to Gowanda Police and sent to Cattaraugus County Jail on the arrest warrant. Burglary charges are pending.

Four males steal marshal’s vehicle

KILLBUCK – Four men have been charged in connection with a stolen Seneca Nation of Indians Marshal’s vehicle.

On May 23, Kevin M. Stafford, 21, and Kevin M. Beaver, of Salamanca were charged when they took the vehicle while the marshal was responding to another call in Killbuck. The pair picked up two other males, Jordan Buffalo, 26, and Thomas Williams, 20, both of Salamanca. The four continued to a gravel pit, causing an estimated $2,664.92 of damage to the vehicle.

Stafford and Beaver were charged with third-degree grand larceny, second-de-gree criminal mischief and possession of stolen property. They were arraigned in County Court and held on $5,000 cash bail. Buffalo and Williams were charged with possession of stolen property and second-degree criminal mischief. Both males were arraigned in Salamanca Town Court and held on $5,000 cash bail.

Coughing leads

to one-car accident

MAYVILLE – A coughing attack caused a driver to lose consciousness and strike a tree Tuesday.

Just before 8 p.m., deputies responded to the report of an accident on Whallon Street. According to police, Scott E. Hess, 46, of Elm Street stated he was eastbound on Whallon Street when he began to cough vigorously and then briefly lost consciousness. His vehicle drove through a lawn and struck a tree at 10 Whallon St. Hess was transported by Mayville Rescue to Westfield Memorial Hospital, then transported to Buffalo General Hospital with non-life threatening injuries. He was charged with failure to keep right.

Crash injures one

STOCKTON – A one-car accident sent one to the hospital Monday. At 11:21 a.m. Chautauqua County Sheriff’s Office investigated an accident on Cummings Road. According to police, a vehicle driven by Jeremy J. Burke, 20, of Bowen Road, was traveling south, left the road and struck a metal culvert, launching the vehicle into the air. The vehicle struck a small tree and came to land in the ditch.

A passenger in the vehicle, Spencer T. Burke, 20, of Mill Road, sustained injuries and was flown by Starlight to Hamot Hospital in Erie, Pa., for non-life threatening injuries. The driver refused treatment.

Stockton Fire Depart-ment and Alstar Ambulance also responded to the scene.

JAMESTOWN – Jas-mine Wheeler, 24, of Dunkirk was charged with fourth-degree grand larceny, fraudulent receipt of benefits and misuse of food stamps on May 14.

According to police, it is alleged Wheeler failed to notify the Chautauqua County Department of Social Services of her employment from July through November 2011. Wheeler received $2,090.01 in benefits for which she was not entitled to. Wheeler was released on appearance tickets for the City of Jamestown Court.

ELLICOTT – James D. Adams, 23, of Jamestown was charged with aggravated driving while intoxicated, aggravated unlicensed operation and passing through a red light Tuesday. Just after 5 a.m. deputies observed Adams’ vehicle traveling west on Route 394 when he passed through a red light and nearly struck a patrol car. Investigation led to Adams being intoxicated. He was released on appearance tickets.

MAYVILLE – Brooke M. Blanchard, 33, of South Erie Street was charged with two counts of fifth-degree criminal possession of stolen property Wednes-day. After an investigation into several area burglaries in February on Overlook Avenue in Bemus Point, deputies received a search warrant for Blanchard. Dep-uties executed the search warrant and found Blan-chard in possession of several stolen items taken from two residences. She was released on an appearance ticket. The investigation is continuing.

Several arrests made in Sunset Bay

HANOVER – The Chau-tauqua County Sheriff’s Office made several arrests over the holiday weekend in Sunset Bay.

  • Melissa Filock, 26, Chi-cago was charged with driving while intoxicated, DWI with a blood alcohol content of 0.08 or higher and failure to stop at a stop sign on Saturday. At 2:16 a.m. deputies observed Filock’s vehicle fail to stop at a stop sign on Iola Drive in Sunset Bay. She was found to be intoxicated and released on appearance tickets.
  • Alexa White, 22, of Dunkirk was charged with DWI with a blood alcohol content of .08 or higher, failure to stop at a red light, failure to keep right and first-degree aggravated unlicensed operation Monday. At 2:30 a.m. police saw White’s vehicle operating on Alleghany Road which failed to stop at the red light leaving Sunset Bay before turning onto Routes 5 and 20. Deputies followed White’s vehicle and saw her failing to keep right. White was found to be intoxicated and was released on appearance tickets.
  • Steven R. McMindes, 22, of Cheektowaga was charged with disorderly conduct Monday. At 5:25 p.m. police found an individual exposing himself and urinating in public in the Sunset Bay Beach Club parking lot. He was released on an appearance ticket.

Ten minutes later, deputies were on foot patrol in the parking lot and investigating an odor of marijuana coming from a vehicle. Deputies found a quantity of marijuana inside the vehicle and charged Nicholas M. Rogalski, 18, Jacob D. Latello, 18, Vincent D. Agentieri, 18, Mitchell P. Grahnert, 18, and Jonathan J. Jerge, 18, all of Lancaster, with unlawful possession of marijuana. All were released on appearance tickets.

  • Sean M. Drescher, 24, and Edward J. Jakubowski, 22, both of Buffalo were charged with drug possession following a police tip in the parking lot. At 6:16 p.m. police found the males in possession of cocaine. Both were charged with seventh-degree criminal possession of a controlled substance. Drescher was found to be in possession of marijuana and additionally charged with unlawful possession of marijuana. Both were released on appearance tickets.

Chautauqua County Sheriff’s Office

HANOVER – Deputies charged a 17-year-old male with fourth-degree criminal mischief Saturday. Reportedly, he became irate and broke two chairs that did not belong to him.

He was arraigned Sheridan Court and remanded to the Chautauqua County Jail on bail.

SHERMAN – Barbara J. Wright, 71, of Oak Park, Ill., was charged Thursday with driving while intoxicated and unsafe backing.

At 5:30 p.m. deputies were dispatched to a property damage accident on Clymer-Sherman Road. Reportedly Wright was attempting to back into a driveway to turn her vehicle around when she failed to negotiate the driveway and her vehicle entered a ditch.

Reportedly, she was operating her vehicle while intoxicated. She was processed and issued appearance tickets.

State police conduct saturation patrols in Chautauqua County

JAMESTOWN – Memorial Day marks the start of the summer travel season. bringing increased traffic volume and additional risks associated with it. The New York State Police want to increase the public’s awareness of the dangers they face during this period, in addition to enforcing the law.

The New York State Police at Jamestown conducted dedicated saturation patrols in Chautauqua County from 9 p.m. Friday through 3 a.m. Saturday. In addition, a fixed sobriety checkpoint was held on Fairmount Avenue in the Town of Ellicott.

As a result of the initiative, several individuals were charged.

Kelly Davis, 42, of 21 Stoneman Ave., Lakewood, was charged with driving while intoxicated. Reported-ly, she approached the stationary road check and exhibited signs of intoxication and later failed field sobriety tests. Her blood alcohol was reported to be .15 percent according to a chemical test administered at the Jamestown barracks. She was arraigned in the Town of Ellicott Court and remanded to the Chautauqua County Jail in lieu of $1,000 bail.

Matthew R. Howard, 19, of 2145 Hanson St. in Falconer, was charged with unlawful possession of marijuana. He was stopped for a broken windshield on Allen Street in Ellicott. Reportedly, he possessed 19 grams of marijuana. He was issued an appearance ticket for the Town of Ellicott Court.

Shane Cook, 30, of 6800 King’s Corners in Panama, was charged with driving while intoxicated. He reportedly was stopped for driving a motor vehicle without head lamps activated at 2:10 a.m on Lakeside Drive in Bemus Point. He reportedly failed field sobriety tests. A chemical test administered at the barracks in Jamestown reportedly found his blood alcohol content was .12 percent. He was issued traffic tickets returnable to the Town of Ellery Court on June 10.

at Fredonia

HANOVER – Early Monday, Timothy Zydel, 43, of Cheektowaga was charged with driving while intoxicated, having no motorcycle insurance, and using an unapproved helmet.

Troopers reportedly saw him going through the red light at Allegany Road and Routes 5 and 20 on his motorcycle. He reportedly failed sobriety tests and his blood alcohol content was .11 percent.

Zydel was issued tickets for Town of Hanover Court.

On Sunday evening, Julia Palmer, 18, of Brocton was charged with unlawful possession of marijuana after a vehicle and traffic stop on Route 60 in the Town of Dunkirk.

Troopers stopped her vehicle because it reportedly had an inadequate exhaust and seatbelt. Upon interviewing Palmer, the troopers noticed a smell of marijuana emanating from inside the vehicle. Troopers reportedly found a glass smoking pipe with marijuana residue.

Palmer is scheduled to answer the charge in the Town of Dunkirk Court.

at Jamestown

NORTH HARMONY – Alyssa Payne, 21, of Jamestown was charged Saturday with second-de-gree unlicensed operation.

Troopers pulled her over on Interstate 86 for reportedly speeding. The trooper discovered that her driving privileges in New York had been suspended for an alcohol-related conviction.

She was arraigned in the Town of Ellery Court and released on her own recognizance. She is scheduled to appear in the Town of North Harmony Court.

FINDLEY LAKE – On Sunday, a trooper arrested Matthew Scolton, 52, of Jamestown for aggravated driving while intoxicated.

Scolton was pulled over on I-86 for driving erratically. He reportedly failed sobriety tests. He was transported to the state police barracks in Jamestown where the breath sample he provided was reported to be .19 percent.

Since Scolton had been convicted within the preceding of DWI within the past 10 years, the charge was upgraded to a felony. He was processed, issued tickets returnable to the Town of Mina Court and released to a sober individual.

Jamestown resident faces charges relating to order of protection

Randall Langworthy, 30, of Jamestown was charged Sunday with two counts of second-degree criminal contempt, two counts of resisting arrest and second-degree obstructing governmental administration.

At about 3:10 a.m. officers from the Jamestown Police Department were dispatched to 221 Cherry St. following a report that Langworthy was there violating an order of protection and he had an outstanding warrant. Reportedly, he was knocking on the door of the residence of the person protected by that order.

When officers attempted to speak to him, he fled from the scene. Officers were not able to locate him until 5:30 a.m. when he was spotted in the area of East 2nd and East 3rd streets. When the officer attempted to detain him, he tried to flee again. At that point, he was subdued and taken into custody.

He was transported to Jamestown City Jail and held for arraignment. Jamestown Police were assisted by Alstar Ambulance services and Ellicott Police.

Jamestown woman charged following

three-car accident

ASHVILLE – On Sunday, state police from Jamestown responded to a three-car personal injury accident on Route 394. According to the investigation, Jesse Szablewski was traveling west on Route 394 and slowed to make a left turn into her driveway. Lori Watson, 42, of Jamestown was also traveling west on Route 394 behind Szablewski’s vehicle and rear-ended it. The collision pushed Szablewski’s car into the eastbound lane of traffic where it was struck by a car driven by Jody L. Bzdak, 44 of Jamestown. Occupants of all three vehicles were transported to area hospitals and treated for non life-threatening injuries.

Watson was issued a ticket for following too closely.

Fredonia man charged with DWI

SHERIDAN – On Fri-day, state troopers from Fre-donia charged James Stel-mack, 68, of Fredonia with driving while intoxicated.

Troopers report they saw him drive over the center line three times on Whitaker Road. Stelmack reportedly failed field sobriety tests. He was processed at the Fredonia barracks where his blood alcohol content was reportedly .13 percent.

Troopers issued Stelmack tickets for Town of Sheri-dan Court and released him.

Sinclairville residents charged with drug violations

WEST ELLICOTT – On Saturday, Ashley Miller, 22, of 13 Reed St. Sinclairville was charged with unlawful possession of marijuana. Erik Nollinger, 34, of the same address was charged with fourth-degree criminal possession of a controlled substance, fifth-degree criminal possession of a controlled substance, third-degree criminal possession of marijuana and second-degree criminal use of drug paraphernalia.

The two were stopped during a road check conducted by state police from Jamestown on Route 394. The trooper reported that while he was speaking to Miller, he could smell marijuana emanating from inside the vehicle. Miller was reportedly in possession of partially smoked marijuana cigarettes and a jar containing a small amount of marijuana.

When the trooper searched the vehicle he reportedly found: 50 grams of marijuana in the center console, a box containing 236 grams of marijuana on the rear seat, a digital scale, numerous baggies and 1.2 ounces of concentrated marijuana.

Nollinger reportedly admitted to ownership of the items inside the vehicle.

Miller was released with an appearance ticket for the Town of Ellicott Court on June 4.

Nollinger was transported to the Jamestown barracks and processed, then arraigned in the Town of Ellicott Court and remanded to the Chautauqua County Jail with no bail set.

Intoxicated driver slams into Sherman home

SHERMAN – A 29-year-old driver crashed into a home on Franklin Street in the village of Sherman early Friday morning.

According to the Chau-tauqua County Sheriff’s Office, Sean Smith of Ripley was allegedly driving when he sideswiped the front portion of the house at 2 a.m. The crash caused minor structural damage to the house, but significant damage to the vehicle.

Sheriff’s deputies at the scene reportedly observed Smith to be under the influence of alcohol. He was subsequently arrested for driving while intoxicated. Other charges included failure to keep right and driving without a seatbelt.

Smith did not sustain any injuries in the crash. He was released with traffic tickets and will appear in Sherman Village Court.

Man on the loose after Jamestown pot bust

JAMESTOWN – An in-vestigation into a residence at 146 Barrows St. revealed that the address was being used as a location to grow marijuana, leading police to obtain two warrants for the arrest of Marcus Caceres, 26, of Jamestown.

According to the James-town Police Department, a search warrant was executed Thursday morning around 10 a.m. at the residence, following the investigation. Inside the location, investigators found 59 individual potted marijuana plants and multiple items of equipment used in the growing process.

Investigators also located a .50 caliber muzzle loader rifle inside the residence. It was revealed that the grow operation was coordinated by Caceres, though he was not inside the residence at the time of the search.

The two warrants out for Caceres’ arrest include the unlawful growing of marijuana and criminal possession of a weapon in the fourth degree.

Crack cocaine bust in Jamestown

JAMESTOWN – Invest-igators from the Jamestown Police Department took a 23-year-old man into custody Friday afternoon after an ongoing investigation into the illegal sale of crack cocaine in the area.

Alex Oliveras, of Jamestown, allegedly sold and distributed the crack cocaine. He was taken into custody on Harrison Street around 3 p.m. and charged with the criminal sale and possession of a controlled substance, both in the third degree.

Oliveras is being held in the city jail, where he is awaiting arraignment.

CARROLL – Thomas C. Wallace, 22, of Frewsburg was charged with endangering the welfare of a child on Friday. At 12:30 p.m. Sheriff deputies responded to a civil complaint in the town of Carroll on Warren Road. The complaint escalated into Wallace allegedly threatening harm to an uninvolved 11-year-old boy. Wallace was released on an appearance ticket for the Town of Carroll Court.

Jamestown Police

JAMESTOWN – Jamestown Police arrested a burglary suspect early Thursday morning.

Sky P. Ryder, 27, of Jamestown was arrested early morning in connection with a burglary. Police investigated a burglary that had occurred overnight on West Harrison Street. Investigators were able to locate some personal property as well as forensic evidence at the scene that linked Ryder to the crime. Police located Ryder sleeping outside of his Spring Street apartment early Thursday and the subsequent investigation led to Ryder being charged with third-degree burglary, fifth-degree criminal possession of stolen property and petit larceny.

Further investigation revealed that Ryder also committed a burglary on May 21 at a Forest Avenue residence. He was additionally charged with burglary, larceny and criminal possession of stolen property. Ryder is currently being held in the Jamestown City Jail awaiting arraignment.

Westfield Police Department

Nathan J. Jaynes, 29, of Fredonia was taken into custody on an arrest warrant on May 18. Police came into contact with Jaynes behind a local business on East Main Street shortly before 3 a.m. Jaynes had a valid arrest warrant from Fredonia Police Department. He was arrested and turned over to the Fredonia Police Department.

An 18-year-old youth was charged with resisting arrest, obstruction of governmental administration, criminal mischief, disorderly conduct and second-degree harassment on May 19.

Police responded to an East Main Street bar for a fight after 2 a.m. Upon arrival, officers found multiple disorderly subjects, including the 18 year old. The youth would not comply with officers’ commands to leave the area and did continue to yell obscenities toward police. The youth did allegedly push a police officer and did resist arrest causing a physical altercation. Further investigation led to the determination that the youth smashed a cell phone of a patrol at a local bar leading to a fourth-degree criminal mischief charge. The youth was arraigned in the Village of Westfield Court and bail was set at $2,000 cash or $4,000 property.

Robert C. Ervolina, 23, of South Dayton was charged with failure to dim headlights on May 19. Police stopped Ervolina’s vehicle on East Main Street for a traffic infraction at 1 a.m. During the stop it was found a passenger, Haley Zilka, 21, of West Seneca was in possession of a small quantity of marijuana and was subsequently charged with unlawful possession of marijuana. Another passenger, Chelsea M. Bridge, 22, of Hamburg was found in possession of oxycodone pills, adderall pills, ecstasy and a small quantity of marijuana. She was charged with three counts of seventh-degree criminal possession of a controlled substance, unlawful possession of marijuana, and two counts of possessing a controlled substance outside of its original container. Ervolina and Zilka were released on appearance tickets for Village of Westfield Court. Bridge was arraigned and sent to the Chautauqua County Jail in lieu of bail.

Daniel Dunmore, 22, of Washington Street was charged with second-degree harassment on May 20. Police responded to a harassment complaint from a victim on Washington Street just before 10 p.m. It is alleged that Dunmore stated he was going to stab the victim. Dunmore was released on appearance tickets for the Village of Westfield Court.

Three arrested in area burglaries

Three suspects, all in their early 20s, were arrested in connection with two burglaries last Monday in the towns of Sheridan and Arkwright.

New York State Police and the Chautauqua County Sheriff’s Department responded to a burglary-in-progress call on State Route 39 in Sheridan. The suspects’ vehicle left the scene and was located and stopped in the village of Fredonia. Proceeds from the burglary were located in the vehicle and William Jackson, Jr., 25, and Alese Kircher, 21, both of Jamestown, were arrested for burglary in the second degree. They were arraigned in Sheridan Town Court and remanded to the Chautauqua County Jail.

Further investigation led to the arrest the following morning of Quentin Watts, 20, of Dunkirk, on two counts of criminal possession of stolen property. Police found Watts in possession of additional property which was stolen from a residence on State Route 83 in Arkwright, which occurred on May 15. He was remanded to the Chautauqua County Jail after arraignment in Fredonia Village Court.

Motorcycle accident in Charlotte

CHARLOTTE – A deer is to blame for a motorcycle accident in the Town of Charlotte that left a 68-year-old man with minor injuries early Wednesday morning.

According to the Chautauqua County Sheriff’s Office, John Way, of Dunkirk, was traveling south on Route 60 when he struck a deer that entered the roadway. He managed to stay on the bike as it slid a short distance to the side of the roadway. Sheriff’s Deputies arrived at the scene around 6 a.m.

Way sustained minor facial and hand injuries and was transported to Brooks Memorial Hospital for treatment.

No charges will be filed as a result of the accident.

Local residents arrested for

multiple felonies

HARMONY – On Sunday, James Hall, 22, of Harmony was charged with second-degree burglary, fourth-degree conspiracy, fifth-degree criminal possession of stolen property, second-degree trespass and violating probation. Scott McChesney, 23, of Panama was charged with second-degree burglary and fourth-degree conspiracy.

Troopers from James-town responded to a residence in Harmony for a report of a past burglary. They interviewed the complainant and area witnesses. The complainant reported she had located Hall inside her residence without permission, but drove him home when he said he didn’t have a ride. McChesney allegedly entered her home and took an X-box, two X-box games and a CD. The complainant said she returned to find her house burglarized. Hall and McChesney reportedly sold the X-box to Gamerz Haven in Jamestown for $71 and used the money to purchase heroin.

Troopers located both suspects and processed them at state police barracks in Jamestown. The two were arraigned in the Town of Harmony Court and remanded to the Chautauqua County Jail.

One-car crash with infant in Cherry Creek; no injuries

CHERRY CREEK – A 21-year-old woman was involved in a one-car crash with her 4-month-old son in the backseat after she failed to negotiate a 90-degree curve on Davison Road on Wednesday.

According to the Chau-tauqua County Sheriff’s Office, Samantha Seekings, of Jamestown, was operating a 2001 Pontiac Sunfire southbound. She left the roadway at around 2 a.m. and struck the ditch and a patch of small trees, causing airbag deployment. Seekings and her son, who was secured in a proper child passenger restraint, appeared to be uninjured.

Police on the scene summoned the Cherry Creek Fire Department to evaluate Seekings and the baby due to the seriousness of the crash’s impact. Both were transported to Women’s Christian Association Hospital in Jamestown as a precautionary measure.

Adrian Velez-Rivera, 35, of Columbus Avenue was charged with two counts of criminal obstruction of airway, two counts of endangering the welfare of a child and second-degree menacing on May 10.

Jonathan R. White, 36, of Bucknor Street was charged with second-degree harassment on May 10.

Askia K. Faison, 17, of South Gazelle Street was charged with criminal ob-structing of an airway and third-degree assault May 12.

Joelle E. Dwczarek, 27, of Park Avenue was charged with fourth-degree criminal mischief and harassment on May 12.

Aquita Davis, 17, of West Second Street was charged with disorderly conduct on May 14.

Kuntis J. Hantz, 41, of Fredonia was charged with petit larceny on May 15.

Jason R. Tolbert, 24, was charged with second-degree harassment, second-degree menacing and endangering the welfare of a child on May 15.

Aquita Davis, 17, of East Second Street was charged with fourth-degree criminal mischief May 15.

Jeremiah D. Toliver, 33, of Deer Street was charged with three counts of first-degree criminal contempt and disorderly conduct on May 15.

Noel Jiminez-Navarro, 40, of Brocton was charged with second-degree harassment on May 16.

Timothy Kulig, 25, of East Sixth Street was charged with petit larceny May 17.

Joanne M. Geibner-Cornier, 44, of Fredonia was charged with second-degree harassment on May 18.

Maryann Moreland, 67, of Grant Avenue was charged with second-degree harassment on May 20.

HARMONY – Lindsay Schmidt, 21, of Lakewood, was charged with criminal possession of a hypodermic instrument on Sunday. At around 4:30p.m., Sheriff’s deputies were investigating a complaint about an unwanted individual at 6047 Route 474. Schmidt was allegedly found to be in possession of the instrument and was taken into custody. She was released and is expected in Harmony Town Court at a later date.

Stephen Dando, 34, of Fredonia, was charged with driving while intoxicated after police allegedly observed his vehicle fail to stop at the flashing red light on Porter Road in Laona on Friday. Shortly after midnight, Dando was stopped, arrested, and issued traffic tickets. He is to appear in Pomfret Town Court.

KIANTONE – Justin Samuelson, 27, of James-town, was charged with driving while intoxicated and speeding shortly after 11 a.m. on Wednesday. Police allegedly stopped Samuelson on Busti Stillwater Road and arrested him after observing he was intoxicated. He was taken into custody and was released after being scheduled to appear in Kiantone Town Court.

MAYVILLE – Alex-andria Earls, 20, of Water Street, was charged with disorderly conduct and resisting arrest after deputies responded to an incident on Water Street shortly after 6 a.m. Sunday. Earls allegedly threw multiple items from the second story of a residence onto a patrol vehicle. She became disorderly and used obscene language while outside the residence, where she was taken into custody after struggling with authorities. She was arraigned in Chautauqua Town Court and remanded to Chautau-qua County Jail on $2,000 cash/$4,000 property.

Hanover motorcycle accident leads

to minor injuries

HANOVER – An accident at the intersection of Angell Road and Hanover Road on Tuesday led to a 24-year-old Forestville man receiving minor injuries.

Shortly after 3:30 p.m., police found that 49-year-old Jose Reyes of Fredonia had failed to yield the right of way at the stop sign on Angell Road. Reyes started from the stop sign and pulled into the path of Matthew Greenough, who was operating a motorcycle eastbound on Hanover Road.

Greenough was thrown from the motorcycle and suffered what appeared to be non-life threatening injuries. He was treated at the scene by EMS personnel prior to being airlifted by Starflight to Erie County Medical Center for further evaluation.

Reyes was issued uniform traffic tickets for the violations causing the accident. He will appear in Hanover Town Court at a later date.

Westfield Police Department

Sergio L. Dros, 22, of Rochester was charged with petit larceny on a warrant on May 15. At 1:55 a.m., police noticed a suspicious male at the intersection of Market and Clinton streets in the village. Police found the suspect, Dros, was found to have a warrant out of the Village of Westfield Court.

He was taken into custody, arraigned and sent to the Chautauqua County Jail in lieu of bail.

Travis Franklin, 25, of Dunkirk, was arrested Sunday morning for driving while intoxicated.

Shortly after midnight, police allegedly observed Franklin fail to stop at the posted stop sign on Webster Road at the Fredonia Stockton Road intersection.

He is charged with failure to stop at a stop sign, driving while intoxicated and driving with a blood alcohol content level above the legal limit.

Franklin is due in Pomfret Town Court at a later date.

HANOVER – Patrick Brockhaus, 26, of Irving, was arrested Tuesday and charged with unlawful possession of marijuana.

Around 7 a.m., Sheriff deputies investigated an incident on South Shore Drive, where Brockhaus was allegedly found to be in possession of a small quantity of marijuana.

He is scheduled to appear in Hanover Town Court on a later date to answer the charge.

MAYVILLE – Alex-andria A. Earls, 20, of Mayville was charged Sunday with disorderly conduct and resisting arrest. Deputies responded to Water Street around 6:20 a.m. Earls allegedly threw several items onto the patrol car from the second-story window. Deputies allegedly observed Dando fail to stop at the light on Porter Avenue. He was stopped and allegedly found to be intoxicated. He was issued tickets and will appear in Pomfret Town Court at a later date.

COLLINS – On May 7, troopers charged Edward Witaszek, 32, of Meadow Lane in Angola with five counts of first-degree offering a false instrument for filing. The troopers worked with the NYS Attorney General’s Office. They charge that Witaszek, a former NYS Corrections Officer, had falsified business records while he was on workers’ compensation from a work-related injury which occurred while working for the Department of Corrections.

Witaszek was processed and is scheduled to appear in the Town of Evans Court.

SUNSET BAY – On May 7, troopers charged Stephanie Green, 36, of Maple Avenue in South Dayton with unlawful possession of marijuana.

Troopers stopped her on Allegany Road and determined she was driving on a suspended driver’s license. Reportedly she was in possession of a homemade pipe containing marijuana.

She is scheduled to appear in the Town of Hanover Court.

BRANT – On May 9, troopers charged Linda Kollar, 52, of Tew Street in Silver Creek with driving while intoxicated.

Troopers stopped her car on Route 5 after they reportedly observed it cross over the center line. Troopers reportedly smelled alcohol in her vehicle. They reported she failed standardized field sobriety tests.

She was processed at state police barracks in Collins where her blood alcohol content was reported to be .13 percent. She is to appear in the Town of Brant Court.

LAWTONS – On May 11, troopers charged Lucas Beaver, 17, of Mileblock Road in Lawtons for disorderly conduct and resisting arrest after a domestic incident at his home.

Troopers, Erie County Sheriff’s deputies and Seneca Nation of Indians marshals responded to the residence around 8:30 p.m. for a reported disturbance. At the scene they reportedly found Beaver in the rear of a pickup truck, refusing to get out so a family member could leave. Once Beaver got out, he reportedly continued arguing with family members and refused to cooperate with police.

After repeated attempts to get Beaver to calm down and leave, he was charged. He was processed at the Collins barracks and is due in the Town of North Collins Court.

COLLINS – On May 11, troopers charged Todd Gasaway, 45, of Conger Road with aggravated driving while intoxicated. Troopers also found there was an outstanding arrest warrant for him from the Erie County Sheriff’s Office.

Troopers stopped his car on Jennings Road near Conger Road for a reported traffic violation. Troopers reported he failed a series of standardized field sobriety tests. He was processed at the barracks in Collins. His blood alcohol content was reported to be .21 percent. He is to appear in the Town of Collins Court.

Gasaway was turned over to a sheriff’s deputy for arraignment on the outstanding warrant.

PERRYSBURG – On May 12, troopers charged Martin Twoguns, 29, of Bush Road on the Catta-raugus Indian Reservation with third-degree assault and fourth-degree criminal mischief following a domestic dispute on Main Street.

Twoguns was at his girlfriend’s home when an argument between them began. During the argument, he reportedly punched his girlfriend in the face, breaking her glasses. She left the apartment and was picked up by a family member. After she reported the incident to troopers, Twoguns turned himself in and was processed.

He was arraigned in the Town of Perrysburg Court and released on bail.

On May 14, troopers charged Alicia Coleman, 23, of High Acres in Bemus Point with seventh-degree criminal possession of a controlled substance and unlawful possession of marijuana.

Troopers stopped her vehicle on Webster Road. She was reportedly in possession of 14 grams of marijuana, a pipe with marijuana in it and five 10 milligram Hydrocodone tablets.

She is to appear in the Town of Pomfret Court..

COLLINS – On May 17, troopers detained Vincent Gray, 35, of Cross Road in Springville on a family court warrant from Cattaraugus County.

Gray was a passenger in a car stopped for equipment violations on Richardson Road. A computer check revealed the warrant. He was turned over to a Cattaraugus County Sheriff’s deputy for arraignment.

KIANTONE – On Sunday, Crystal R. Borst, 23 of Warren, Pa., was charged with driving while intoxicated, blood alcohol content of .08 percent or greater, and speeding.

At about 3:35 a.m., sheriff’s patrol stopped Borst on Route 62 for reportedly speeding. Officers report that she was intoxicated. She was processed and released.

She is scheduled to appear in Kiantone Court.

HANOVER – An 18-year-old female from Silver Creek was charged with unlawful possession of alcohol on Saturday. At 1:15 a.m. deputies observed the female with alcohol at the town of Hanover beach on South Shore Drive. She was released on an appearance ticket.

HANOVER – A 17-year-old female was charged with violating the curfew on Saturday. At 1:15 a.m. deputies saw the female loitering on the town of Hanover beach on South Shore Drive. She was issued an appearance ticket.

RANDOLPH – Zachary D. Ellis, 29, of Fredonia was charged with driving while intoxicated with a blood alcohol content of .08 or more, first-degree aggravated unlicensed operation, stopping or standing on a highway and failure to maintain lane Wednesday. At 11:28 p.m., officers stopped Ellis’ vehicle on Cemetery Street in the village of Randolph on a traffic stop. He was released on appearance tickets for the Town of Randolph Court at a later date.

SOUTH DAYTON – On Friday, Jeffery S. Caparco, 29, of 6016 Route 62, Conewango Valley was charged with reckless endangerment of property, fourth-degree criminal mischief, leaving the scene of a property damage accident, unsafe start, reckless driving, failure to keep right, and uninspected motor vehicle. The charges came from an investigation into a hit-and-run accident May 12 on Pine Street.

Caparco was issued appearance tickets for the Village of South Dayton Court.

LEON – On Friday, Cattaraugus Sheriff’s deputies charged Michelle, l. Rogers, 33, of Cattaraugus with second-degree harassment after she allegedly pushed another family member to the ground.

She is scheduled to appear in the Town of Leon Court on June 3 to answer the charges.

Machele N. Gilbert, 27, of Central Avenue, Dunkirk, was arraigned for second-degree aggravated harassment. She was remanded to Chautauqua County Jail in lieu of $1,000 bail and returns to court June 5.

Cody J. Cook, 21, of Jackson Street, Irving, was arraigned for third-degree assault. He was remanded to Chautauqua County Jail in lieu of $2,000 bail and returns to court June 5.

A 17-year-old Christy Street, Silver Creek, male was arraigned for third-degree assault and curfew violation and was released under the supervision of his mother and returns to court June 5.

James M. Hurley, 19, of Jackson Street, Irving, was arraigned on third-degree assault. He was remanded to Chautauqua County Jail in lieu of $2,000 bail and returns to court June 5.

Gowanda Police Department

Michelle M. Kielar, 34, of Jamestown Street was charged with fourth-degree criminal mischief, second-degree harassment and trespassing on May 11. Police responded to an incident of trespass on Jamestown Street at 10:20 p.m. where Kielar had allegedly ignored a no trespass sign. Kielar had been previously instructed to not enter onto the property.

Once on the property, Kielar intentionally tipped over a young child’s sandbox causing damage. Kielar was released on an appearance ticket for the Persia Town Court.

Joshua W. Schiefer, 20, of Erie Avenue was charged with seventh-degree criminal possession of a controlled substance and unlawful possession of marijuana on May 12. At 8:41 p.m. police responded to an East Main Street residence as part of a continuing investigation where Schiefer opened the door. Police observed marijuana inside the residence and a small baggie containing cocaine. Schiefer was released on an appearance ticket for the Collins Town Court.

Jordan L. Acevedo, 17, of Jamestown Street was taken into custody on a warrant on April 17. Police were notified of an active warrant from Chautauqua County Court and located Acevedo. He was turned over to the New York State Police.

Charles T. Bennett, 39, of Park Street was charged with second-degree harassment and disorderly conduct on April 17. Patrol responded to the report of a disturbance on East Main Street at 8 p.m. Bennett, who appeared intoxicated, allegedly ran across the parking lot and began striking a male victim in the face. He was released on an appearance ticket for the Town of Collins Court. The Erie County Sheriff’s Office and North Collins Police Department assisted with this call.

Barry J. Martin, 26, of Buffalo was taken into custody on a warrant on April 17. Police responded to a Commercial Street residence for an unwanted guest at 10 p.m. Police found Martin at the residence as the guest who was wanted on an arrest warrant for the Town of Alabama Court. He was turned over to the New York State Police.

Seneca L. Mohawk, 35, of Buffalo Street was taken into custody on a warrant on April 29. Mohawk was previously arrested by Gowanda Police for falsely reporting an incident. The Town of Collins Court issued an arrest warrant when he failed to appear. He was arraigned in the Town of Collins Court and sent to the Erie County Holding Center in lieu of $500 bail.

Roquel Crouse, 25, of Jamestown Street was taken into custody on a arrest warrant on May 1. Police responded to a disturbance on Jamestown Street at 9:15 p.m. Crouse was found to have an arrest warrant from the Town of North Collins Court. He was turned over to the Erie County Sheriff’s Department.

Jason E. Ring, 23, of North Collins was charged with fourth-degree criminal possession of a weapon and unlawful possession of marijuana on May 5. Patrol was called to a village business on Buffalo Street for the report of an individual going through parked cars at 11:15 a.m. Police found Ring in possession of an illegal spring loaded knife and a pipe containing a small amount of marijuana. Ring was released on an appearance ticket for the Town of Collins Court.

Jeremy J. Sauer, 36, of Bader Avenue was charged with fourth-degree criminal possession of a weapon, third-degree menacing, third-degree criminal mischief, disorderly conduct, second-degree obstruction of a governmental administration and resisting arrest on May 5. At 12:55 a.m. police responded to the report of a disturbance on Bader Avenue. Sauer allegedly tried to use a sledgehammer in an attempt to break the front door of the residence to gain entry and threatened a female victim. Sauer, who appeared intoxicated, became aggressive and combative with police when they attempted to arrest him. He was arraigned in the Town of Collins Court and sent to the Erie County Holding Center in lieu of $1,000 bail.

David A. Brill Jr., 22, of Salamanca was charged with third-degree assault, third-degree criminal trespass, disorderly conduct and endangering the welfare of a child on May 6. At 12:38 p.m. police responded to the report of a disturbance on Chestnut Street. Brill had allegedly forced his way into a female acquaintance’s apartment, pushed the victim’s head into a hard object, pushed her to the floor and spit on her in the presence of children. Brill was released on an appearance ticket for the Town of Persia Court.

NORTH HARMONY – Sean P. Reardon, 51, of Ashville, was charged Wed-nesday with second-degree aggravated unlicensed operation, unlicensed operation and speeding after a traffic stop on Route 394.

Reardon was stopped around 10:15 a.m. when it was found his license had been revoked from a prior drug related driving offense. He was issued tickets.

Jamestown Police

JAMESTOWN – An investigation into the sale and trafficking of crack cocaine in the city of Jamestown resulted in the seizure of a large quantity of crack cocaine, cash and charges against a Jamestown man Wednesday.

Jamestown Police drug investigators were assisted by New York State Police Community Narcotics Enforcement Team with a vehicle stop on Cole Street around 11:20 a.m. Joseph S. Zaso, 29, of Jamestown, was a passenger in the vehicle when he was allegedly found to be in possession of more than three ounces of crack cocaine and over $2,000 in cash. It is believed the drugs were to be sold in the city.

Zaso was charged with third-degree possession of a controlled substance. He is being held in Jamestown City Jail pending arraignment. The investigation is ongoing and further arrests are expected.

City man charged with larcenies

  • FORESTVILLE – After a lengthy investigation by the Chautauqua County Sheriff’s Office into numerous car larcenies and an April 3 burglary, warrants have been issued for Alex E. Sam, 25, of Dunkirk.

It is alleged Sam entered the vehicles and a garage in the Forestville area. He was charged with third-degree burglary, fourth-degree grand larceny and two counts of petit larceny.

Sam is being held in the Chautauqua County Jail on unrelated charges and warrants were issued as detainers. He will appear in the Hanover Town Court at a later date.

MAYVILLE – District Attorney David W. Foley announced the following pleas and sentences in Chautauqua County Court:

  • David M. Austin Jr., 27, of Webster Road, Brocton, was sentenced to 3 1/2 years determinate in state prison with 5 years post-release supervision for second-degree burglary.
  • Brian S. Montanez, 24, of King Street, Dunkirk, was sentenced to 2 years determinate in state prison with 2 years post-release supervision for fourth-degree criminal possession of a controlled substance.
  • Mickey A. Darling, 37, of Jamestown, was sentenced to 2 years determinate in state prison and 2 years post-release supervision for two counts of third-degree criminal sale of a controlled substance.
  • Matthew L. Gifford, 46, of Keller Road, Ashville, was sentenced to 2-4 years in state prison and restitution for fourth-degree criminal possession of stolen property.
  • Kenneth G. Moore, 36, of Gerry, was sentenced to 6 months of weekend work release program and 5 years probation for third-degree criminal possession of marijuana.

Greenhurst man charged after bar incident

GREENHURST – On Sunday, Donald Paulson, 21, of Greenhurst was charged with third-degree criminal mischief (felony), two counts of fourth-degree criminal mischief, two counts of second-degree reckless endangerment, and unlawful possession of marijuana.

State police from James-town and Ellicott police responded to a bar in Green-hurst for a report of disorderly conduct. Reportedly, Paul-son became unruly when the bartender refused to serve him because he was intoxicated. When he exited the establishment, he struck the door, causing damage to the window frame. Once outside, he picked up a large planter urn and threw it through the front window. The urn landed close to bar patrons, and though some were struck by flying glass, no injuries were reported. Paulson was also reportedly in possession of a bag containing seven grams of marijuana.

Paulson was transported to state police headquarters where he was processed. He was arraigned in the Town of Ellery Court, and remanded to the Chautauqua County Jail.

SHERIDAN – On Saturday at about 2 a.m., John Ley Jr., 46, of Dunkirk was charged with felony driving while intoxicated.

Troopers stopped him for reportedly having inadequate plate lamps and going over the fog line. In addition, his passenger threw a cigarette out the window.

Ley reportedly failed field sobriety tests. He was brought to the station where he provided a breath sample. His blood alcohol content was reported to be .14 percent. The charge was a felony because he had a previous conviction within the last 10 years.

Ley was issued traffic tickets for the Town of Sheridan Court.

On Saturday, Erika A. Stevens, 20, of Route 438 in Gowanda was charged with shoplifting about $62 worth of merchandise and endangering the welfare of a child.

Troopers responded to the TJ Maxx store on Vineyard Drive for the report of a shoplifter. Reportedly, Stevens secreted the merchandise in a diaper bag. At the time, her 7-month-old cousin was with her.

She was processed at state police barracks in Fredonia and released with an appearance ticket. She is to answer the charges in the Town of Dunkirk Court on May 20. The child’s mother was notified of the arrest.

On Sunday, troopers charged Andrew Pesicek, 21, of Dunkirk with unlawful possession of marijuana and third-degree unlicensed operation following a traffic stop on Route 60 in the town of Dunkirk.

Pesicek was pulled over for reportedly having inadequate plate lamps. A check revealed that his license was suspended. In addition, he was allegedly in possession of a small baggie of marijuana.

He was issued tickets for the Town of Dunkirk Court for May 20.

SHERIDAN – On Sunday, at about 3:15 a.m. troopers charged Stephanie Sipp, 31, of Dunkirk for driving while intoxicated after a traffic stop on Route 20.

Troopers made a traffic stop after reportedly observing her driving over the white fog line. She reportedly failed field sobriety tests. Her blood alcohol content was reported to be .10 percent.

She is scheduled to answer charges in the Town of Sheridan Court on June 13.

Chautauqua County Sheriff’s Office

ELLINGTON – Two were injured after an accident on Waterboro Hill Road Thursday.

According to deputies, Robert Behnke Jr., 28, of Cattaraugus, was trying to back up a tanker truck into a farm, when the vehicle driven by Donna Burdic, 62, and passenger NoraJo Rogers, both of Kennedy, crested the hill and collided with the front of the tanker truck.

It was found Burdic failed to reduce her speed on the hill and was issued a ticket to Ellington Town Court.

Burdic and Rogers were transported by Ellington and Kennedy Ambulance to WCA Hospital for injuries sustained in the accident.

New York State Police also assisted on the scene.

HANOVER – Lydia R. Baake, 18, of Angola was charged with speed not reasonable and prudent and failure to keep right following a two-car accident on Routes 5 and 20 Friday. Just after 7:30 p.m. Baake’s vehicle was traveling east when she lost control and hydroplaned into oncoming traffic. She struck a vehicle operated by John W. Peterson, 78, of Dunkirk then continued forward and collided with a building. Baake and her passenger, Matthew J. Mardino, 20, of North Collins were uninjured. Peterson was not hurt but his passenger, Carol D. Peterson, 73, of Dunkirk was transported to Lake Shore Hospital for minor injuries. Baake was released on appearance tickets.

JAMESTOWN – Carla J. Cameron, 41, of Lakewood was charged with driving while intoxicated and inadequate directional signals on Friday. At 2:26 a.m. Cameron was stopped on Falconer Street after being observed without signaling. Upon interviewing Cameron, deputies found the vehicle’s front turn signal lamp was not functioning and it was also found she was intoxicated. She was taken into custody and released on her own recognizance. More charges are pending the outcome of a chemical blood test.

PORTLAND – Scott Stein, 28, of Brocton was charged with driving while intoxicated, third-degree aggravated unlicensed operation, failure to signal and failure to stop at a stop sign on Friday. At 2:25 a.m. deputies observed Stein’s vehicle traveling on Highland Avenue and fail to stop at a stop sign at Webster Road. Investigation found Stein to be intoxicated and driving with a suspended license. He was released on appearance tickets.

HANOVER – On Thursday, Ryan A. Davis, 23, of 57 Center St., Angola was charged with third-degree criminal tampering. The charges stem from an incident on May 6 during which Davis allegedly tampered with the property of another person, intending to cause substantial inconvenience.

Davis was issued an appearance ticket to appear in Hanover Town Court.

POMFRET – On May 4, Jeramie Klahn, 36, of Fredonia was charged with driving while intoxicated common law, driving while intoxicated per se .08 percent blood alcohol content or higher, and failure to keep right.

Deputies stopped Klahn for reportedly crossing over the center line. Reportedly he was intoxicated.

Klahn was released with traffic tickets. He is to appear in the Town of Pomfret Court at a later date to answer the charges.

Westfield Police

Charlene D. Lanneaux, 28, of East Main Street was charged with third-degree assault on May 8. Police were called to a domestic dispute on East Main Street on May 6. Upon arrival, Lanneaux had left the residence. She allegedly assaulted a victim by striking her several times about the body and dragged the victim on the floor by her neck, causing injury. A warrant was signed for Lanneaux’s arrest. She turned herself into police on May 8. She was arraigned and sent to the Chautauqua County Jail on $1,000 cash or $2,000 property bail.

Dunkirk City Court

Terry Sweet was issued an appearance ticket for City Court by the building inspector for the condition of property he owns at 136 Lake Shore Drive E.

The appearance ticket was to answer allegations of failing to maintain property free from any accumulation of rubbish or garbage; failing to dispose of rubbish in a clean and sanitary manner by placing in approved containers; and failing to comply with directives from the city building inspector to do both.

On April 3, Sweet plead guilty in City Court and was given a $50 court surcharge to pay and a conditional discharge if he keeps the property in compliance.

Charles Perry was issued an appearance ticket for City Court by the building inspector for the condition of property he owns at 28 St. Hedwig’s Ave.

The appearance ticket was to answer allegations of failing to remove refuse from property; failing to remove an unregistered vehicle from the property; and failing to comply with directives from the building inspector to do both.

On April 10, Perry plead guilty in City Court and was given a $100 fine and a $50 court surcharge fee.

Perry was given a conditional discharge provided he keeps the property in compliance.

Chautauqua County Sheriff’s Office

HANOVER – Herbert J. Michaels, 55, of Forestville was charged Wednesday with felony driving while intoxicated, felony aggravated unlicensed operation, operating a motor vehicle without interlock and speeding after a traffic stop on King Road. Deputies noticed Michaels speeding around 7:45 p.m.

He was allegedly found to be intoxicated and his license was revoked from a previous DWI conviction. He was arraigned in the Hanover Town Court and sent to the Chautauqua County Jail.

MAYVILLE – Mark R. Burch Jr., 20, of Jamestown, turned himself in Tuesday on a warrant for fourth-degree grand larceny. He was featured on the Chautauqua County Wanted List.

ELLINGTON – Two were injured after an accident on Waterboro Hill Road Thursday. According to deputies, Robert Behnke Jr., 28, of Cattaraugus, was trying to back up a tanker truck into a farm, when the vehicle driven by Donna Burdic, 62, and passenger NoraJo Rogers, both of Kennedy, crested the hill and collided with the front of the tanker truck. It was found Burdic failed to reduce her speed on the hill and was issued a ticket to Ellington Town Court. Burdic and Rogers were transported by Ellington and Kennedy Ambulance to WCA Hospital for injuries sustained in the accident. New York State Police also assisted on the scene.

Fredonia teen bicyclist sent to Brooks Hospital

On Monday, Lorismar Alicea, 18, of 3742 E. Main Road, Fredonia, was riding her bicycle south on the sidewalk when she was struck by a vehicle exiting the Country Fair Parking lot at the intersection of Routes 60 and 20.

Douglas Taylor, 38, of 56 South St., Cattaraugus, was the driver of the vehicle. When turning right onto Route 60, he failed to see Alicea and knocked her down.

Alicea was taken to Brooks Hospital for treatment of non-life-threatening injuries. State police issued Taylor a summons for failure to yield the right of way. He is to appear in the Pomfret Court to answer the charges.

Mary L. Randall, 20, of Rochester was charged with having an open container, littering and unlawful possession of alcohol on May 4.

Christopher D. Smith, 20, of Jamestown was charged with having an open container, littering and unlawful possession of alcohol on May 4.

Silver Creek men charged with endangering the

welfare of a child

  • BRANT – On April 27, troopers from Collins charged Douglas Bastedo, 22, and Derek Bastedo, 20 both of Porter Avenue in Silver Creek for endangering the welfare of a child, seventh-degree criminal possession of a controlled substance and criminal possession of a hypodermic instrument.

Seneca Nation of Indians Marshals called troopers to the Seneca One-Stop on State Routes 5 and 20 after a store employee alerted the marshals of a suspicious car in the parking lot. The employee reportedly witnessed the two men injecting themselves with drugs.

After the troopers arrived and spoke with the employee and the marshals on the scene, they detained the two men.

Reportedly troopers found numerous used and unused needles inside the car as well as Douglas Bastedo’s infant daughter. The child was turned over to a family member who came to the scene.

The Bastedos were processed at state police barracks in Collins and are to appear in the Town of Brant Court.

COLLINS – On April 22, troopers charged Jasper Wolfe, 36, of Main Street in Arcade and Samantha Guizzoti, 20, of Church Street in Yorkshire for unlawful possession of marijuana

Troopers stopped the car Wolfe was driving for a reported equipment violation on State Route 62. The officers reported smelling marijuana coming from inside the car. Wolfe reportedly possessed a silver pipe containing marijuana as well as a plastic baggie with 3.5 grams of marijuana in it. Guizzoti reportedly possessed a plastic baggie containing one gram of marijuana in it.

Both are scheduled to appear in the Town of Collins Court at a later date.

BRANT – On April 27, troopers charged Cody Haring, 21, of Brant Reservation Road in Irving with unlawful possession of marijuana, after a traffic stop on Brant Reservation Road.

Troopers reported that Haring had 1.5 grams of marijuana in his possession.

He is due in the Town of Brant Court at a later date.

CATTARAUGUS – On Wednesday, troopers charged Pamela Clees, 21, of North Franklin Street in Cattaraugus with driving while intoxicated following a personal injury accident investigation.

Troopers responded to Leon Road in New Albion after Clees’ vehicle left the road and hit a utility pole. Reportedly, she swerved while driving to avoid a deer in the roadway and lost control of her car.

Numerous first responders from the Cattaraugus Volunteer Fire Department and ambulance assisted at the scene. A passenger in the car was taken to Erie County Medical Center by Star Flight with non life-threatening injuries.

Clees was processed at state police barracks in Collins where her blood alcohol content was reported to be .14 percent. She is due in the town of New Albion Court later this month.

CATTARAUGUS IND-IAN RESERVATION – On Friday, troopers charged Brandon Bennett, 28, of State Route 438 with aggravated driving while intoxicated following a stop on State Route 438 for alleged speeding.

The troopers administered a series of field sobriety tests and reported Bennett was intoxicated.

He was processed at state police barracks in Collins where his blood alcohol level was reported to be .21 percent, nearly three times the legal limit of .08 percent.

Bennett is due in the Town of Collins Court later this month.

Chautauqua County Sheriff’s Office reports DWI incidents

PORTLAND – Ari Paff, 29, of Brocton was charged with driving while intoxicated, and failure to signal a turn.

On Friday at about 1:30 a.m., deputies stopped a vehicle for reportedly failing to signal a turn at the intersection of Webster Road and Route 380. Paff was the operator of the vehicle. Deputies investigated and report that Paff was intoxicated.

He was released with traffic tickets and is scheduled to appear in the Town of Portland Court at a later date.

POMFRET – David J. Belovarac Jr., 22, of Bemus Point was charged with driving while intoxicated and failure to maintain lane.

On Saturday at about 4:15 a.m., sheriff’s patrol stopped Belovarac when he was reportedly observed swerving out of his lane of travel on Route 60

He was later released and is scheduled to appear in the Town of Pomfret Court at a later date.

ELLERY – Meryl L. Roush, 28, of Ellicottville was charged with driving while intoxicated.

On Saturday morning at about 5:20 a.m., deputies responded to a one-car property damage accident on Route 430. The officers found the vehicle but no one around the vehicle. They located Roush walking away from the scene. Investigation led to the charge.

The defendant is to appear in the Town of Ellery Court at a later date.

GERRY – Jacob Meier, 25, of Falconer was charged with driving while intoxicated and speeding.

On Sunday at about 2:05 a.m., sheriff’s patrol stopped Meier for reportedly speeding on Route 60, 72 mph in a 55 mph zone. According to officers, Meier was intoxicated.

Meier was released and is scheduled to answer charges in the Town of Gerry Court at a later date.

Clymer man charged with third-degree grand larceny

FRENCH CREEK – On Tuesday, Tyler L. Gabriel was charged with felony third-degree grand larceny by state police from Jamestown.

Gabriel reportedly stole a tractor from a farm located on Marks Corners Road and sold it to a scrap yard. The tractor was valued at $3,500. The tractor was sold to the yard on Dec. 8, but the owner only recently realized that it was missing.

Gabriel is scheduled to appear in the Town of French Creek Court at a later date to answer the charge.

Donte Chambers, 19, of Brooks Avenue was charged with second-degree obstruction and unlawful possession of marijuana on April 30.

Tony L. Stewart, 30, of South Gazelle Street was charged with fourth-degree criminal mischief and harassment on April 30.

Joseph D. Tucker, 43, of South Gazelle Street was charged with disorderly conduct on April 30.

Juli A. Thomas, 44, of Lake Shore Drive East was charged with disorderly conduct on April 30.

Luis A. Santiago-Mendez, 19, of Deer Street was charged with violating the noise ordinance, unlicensed operation and having no insurance on April 30.

Daniel W. Seeley, 47, of Silver Creek was charged with seventh-degree criminal possession of a controlled substance on May 1.

Jacob W. Soggs, 30, of Irving was charged with seventh-degree criminal possession of a controlled substance and criminal use of drug paraphernalia on May 1.

Michael Munson, 52, of Dunkirk, was convicted of driving while intoxicated and will be sentenced on June 5.

Michael S. Musilli, 23, of Central Avenue, Silver Creek, pleaded guilty to three counts of petit larceny and will be sentenced June 5.

A 16-year-old Silver Creek boy pleaded guilty to criminal trespass. He will be sentenced in November.

Jose Pratts, 27, of Fredonia, pleaded guilty to unlicensed operation and was fined $160.

Sara Ramsdell, 27, of Monroe Street, Silver Creek, pleaded guilty to disorderly conduct and was fined $225.

A 17-year-old boy from Maple Place, Silver Creek, pleaded guilty to criminal possession of a weapon and received a one-year conditional discharge.

Justyn J. Vara, 21, of Fenner Street, Silver Creek, pleaded guilty to petit larceny and will be sentenced July 3.

NORTH HARMONY – Jeremiah J. Kays, 25, of Erie, Pa. was charged with having improper plates, unlicensed operator, unregistered motorcycle, operating without a helmet and criminal possession of a hypodermic needle on Friday.

Deputies stopped Kays on Route 394 in the town of North Harmony for riding a motorcycle without a helmet at 2:30 p.m. It was discovered Kays was wanted from the state of Pennsylvania.

He was arraigned in the Town of North Harmony Court as a fugitive from justice and the above charges and was sent to the Chautauqua County Jail.

GERRY – Edward J. Nickerson, 17, of Sinclairville was charged with failure to keep right on May 2. Nickerson was traveling east on Gerry Ellington Road when he allegedly fell asleep at 4:25 p.m.

The vehicle overturned several times, coming to rest in the opposite lane. He was transported by Gerry Rescue to WCA Hospital for minor injuries.

Nickerson was released on his own recognizance and will return to court at a later date.

City man facing slew of drug charges after foot chase

In a report issued Thursday, Zacre T. Jasinski is facing third- and fourth-degree criminal possession of a controlled substance felony charges as well as resisting arrest, obstructing governmental administration and unlawful possession of marijuana charges after officers became aware of a suspicious situation between Antelope and Gazelle streets earlier this week.

Upon investigation, a city officer observed a strong odor of marijuana coming from a parked vehicle. The officer attempted to interview Jasinski, who then exited the vehicle and attempted to flee. After a brief chase, Jasinski was nabbed and found to be in possession of 13 baggies of marijuana and 13 baggies of cocaine.

Jasinski was arraigned by Judge Walter Drag after being charged on Sunday.

Gary T. Ortolano, 51, of Eagle Street was charged with seventh-degree criminal possession of a controlled substance and criminal possession of a hypodermic instrument on April 24 on a warrant.

Walter A. Montanez, 42, of East Main Street was charged with having an expired registration and unlicensed operation on April 26.

Stephanie M. Bona, 23, of Cheektowaga was charged with third-degree aggravated unlicensed operation and failure to keep right on April 26.

Fernando Martinez Jr., 22, of Dunkirk was charged with petit larceny and fourth-degree criminal mischief on April 26.

MAYVILLE – District Attorney David W. Foley announced the following pleas and sentences before the Honorable John T. Ward in Chautauqua County Court:

  • Chauncey Robinson, 27, of Jamestown, was sentenced to a determinate term of 4 years in state prison with 2 years post-release supervision for two counts of third-degree criminal sale of a controlled substance.
  • Jose J. Ruiz Jr., 25, formerly of Dunkirk, was sentenced to 2 1/2 years in state prison with 1 year post-release supervision for fifth-degree criminal sale of a controlled substance.
  • Alexander J. Jewell, 21, of Jamestown, was sentenced to 6 months in jail and 5 years probation for second-degree assault.
  • Walter L. Conkright, 46, of Jamestown, was sentenced to 5 years probation and restitution for third-degree grand larceny.
  • Clarence T. Curtis, 65, of South Main Street, Dunkirk, was sentenced to 5 years probation for third-degree criminal sale of a controlled substance.
  • Dean John Nelipowitz, 44, of Buffalo, was sentenced to 5 years probation, a $2,000 fine, ignition interlock and 1 year driver’s license revocation for felony driving while intoxicated.
  • Clifford Latta, 39, of Mayville, was sentenced to a 1 year conditional discharge with restitution for fourth-degree criminal mischief.

Chautauqua County Sheriff’s Office

PORTLAND – Michael Dimmer, 56, of Fredonia, was charged Sunday with driving while intoxicated common law, DWI per se with a blood alcohol content of .08 percent or higher, failure to keep right and driving too slowly after a traffic stop on Route 20.

Around 1 a.m. deputies observed Dimmer’s vehicle swerving over the center line several times and impede traffic with his slow speed.

Dimmer was pulled over and issued tickets to appear in the Portland Town Court at a later date.

CHAUTAUQUA – Douglas A. Swan, 45, of Chautauqua, was charged Monday with second-degree criminal contempt after he allegedly violated an order of protection.

Swan was arraigned in the Chautauqua Town Court and was released on his own recognizance.

PORTLAND – Keith Danler, 29, of Westfield, was charged Sunday with driving while intoxicated, DWI per se, moved from lane unsafely and drove across hazard markings after a traffic stop on Route 20.

Deputies stopped Danler around 2:30 a.m. for swerving saveral times. He was allegedly found to be intoxicated and was issued tickets to appear in the Portland Town Court at a later date.
