Chautauqua County Sheriff’s Office

  • Timothy Weaver, 48 of Irving was charged with leaving the scene of a property damage accident on Thursday Chautauqua County Sheriff’s Deputies responded to a vehicle on the embankment of Catta-raugus Creek near the end of Triangle Drive in Irving.

Upon arrival, the vehicle was unoccupied. After investigation, it was found that Weaver had been operating the vehicle at the time of the incident and left the scene. Weaver was issued a traffic ticket and is scheduled to appear in the Town of Hanover Court at a later date.

  • Patrick R. Abram, 21 of Jamestown and James D. Mawhir, 26, of mayville were each charged with two counts of seventh-degree criminal possession of a controlled substance on Monday. Chautauqua County Sheriff’s Deputies on patrol stopped a vehicle for an observed violation on South Erie Street in Mayville. The driver was identified as Abram, and a passenger was identified as Mawhir. Further investig ation and subsequent search of the vehicle found both men to allegedly be in possession of a quantity of Suboxone strips and methamphetamine. Both men were charged, and Abram was additionally charged with unlicensed operator and failure to stop at a stop sign. Both men were released with appearance tickets directing them to appear in Town of Chautauqua Court at a later date.
  • Collin George Ram-pado, 19, of Buffalo was charged with open container and unlawful possession of alcohol on Monday. Deputies observed Ram-pado allegedly walking down Shady Lane in Sunset Bay with an open can of Labatt’s Blue Lite Beer. Rampado was issued an appearance ticket to the Town of Hanover Court at a later date.
  • Jevon F McCorkle, 17, of Ripley was charged with speed not reasonable and operating out of license restrictions on Monday. Chautauqua County Sheriff Deputies responded to a motor vehicle accident at the Hannum Road Gorge inthe town of Chautauqua. McCorkle was traveling west on Hannum Road when he lost control of his vehicle and struck two trees, resulting in the vehicle to roll over and catch on fire. McCorkle, along with three other passengers, two age 16 and one age 17, were able to safely exit the vehicle before it became fully engulfed in flames. Three of the occupants were taken to Westfield Memorial Hos-pital for minor treatment while one of the occupants was flown by Starflight to Hamot Hospital in Erie, PA for a reported neck injury. Investigation into the accident is continuing.
  • Tommy K Luangraj, 24, of Buffalo was charged with Aggravated Driving While Intoxicated (blood alcohol content .08 percent or higher) on Monday. Deputies were dispatched to a reported fight in a parking lot in Sunset Bay. Upon arrival, a male subject in the altercation was observed operating a vehicle, attempting to leave the scene. The male subject was stopped and detained by deputies and upon investigation, Luan-graj was arrested for allegedly driving while intoxicated.

Luangraj was issued tickets to appear in the Town of Hanover Court at a later date.

NORTH HARMONY – Brian D. Conklin, 21, of Lakewood was charged Sunday with unlawful possession of marijuana and failure to stop at a stop sign after Deputies stopped a vehicle for an observed traffic infraction on Route 394. Investigation led to the operator of this vehicle, Conklin, to be allegedly in possession of a small quantity of marijuana. Conklin was charged, released and will appear in North Harmony Court next month to answer the charges.

SILVER CREEK – Jason P. Hughes, 32, of Kenmore was charged Sunday with second-degree harassment after deputies responded to 1 Andrus St. for a report of a disturbance.

Upon arrival, officers reportedly found a verbal disagreement occurring between multiple subjects. While officers were investigating the matter, they arrested Hughes for actions he took against another person in the presence of officers.

Hughes was charged and taken to the Hanover Sheriff’s Substation and was released to a third party a short time later with a court appearance date for next month.

Jason E. Lack, 35, of Dunkirk was charged Sunday with driving while intoxicated, aggravated DWI per se and consumption of alcohol in a motor vehicle after Deputies and Dunkirk Police responded to a report of an erratic operator on Route 5 in the town of Dunkirk.

Officers located the vehicle and Lack was allegedly found to be operating in an intoxicated condition and was arrested for DWI. He was taken to the Pomfret Sheriff’s Substation where he consented to a chemical breath test. Based on the results of the chemical test, Lack was additionally charged with aggravated DWI for having a blood alcohol content of .18 percent or greater. He will appear in Dunkirk Town Court later.

BUFFALO – James A. Waterman, 35, of Irving was charged Saturday with driving while intoxicated after Troopers reportedly observed a vehicle failing to maintain its lane while on Chicago Street.

The vehicle was stopped and the driver, Waterman, failed field sobriety tests. Waterman was arrested, processed and provided a breath sample of .14 percent. Waterman was released with appearance tickets to appear in Buffalo City Court on a later date.

Gowanda Police Department

  • Michael J. Visiko Jr., 24, of Wardtown Road in Perrysburg was charged with driving while intoxicated on May 22. Patrol responded to a citizen’s complaint of a possible intoxicated driver on Buffalo Street. Patrol observed and stopped this vehicle at a Buffalo Street business, where they observed Visiko as the operator of this vehicle. Visiko exhibited signs of intoxication and he failed several standard field sobriety tests. He was arrested for allegedly driving while intoxicated. A chemical breath test of Visiko resulted in a conclusion of .14 blood alcohol content level, almost twice the legal limit. Visiko was then released on an appearance ticket to appear in the Town of Collins Court at a later date.
  • Bethany S. Lyndley, 33 of South Quaker Road in Gowanda was charged with second-degree aggravated unlicensed operation of a motor vehicle on May 23. Lyndley was operating a vehicle that was stopped by patrol for an unspecified traffic violation. During this traffic stop, a DMV computer check revealed that Lyndley’s license was suspended a total on nine times from 2008 to 2013 in various courts all for her failure to answer traffic summons. Lyndley was arrested and arraigned in the Town of Persia Court. She was released after posting $250 bail.
  • Marjorie L. Betts, 23, of William Street in Buffalo was charged with third-degree aggravated unlicensed operation of a motor vehicle on May 23. Betts was operating a vehicle that was stopped by patrol for an unspecified traffic violation on South Chapel Street. During this traffic stop, a DMV computer check revealed that Betts’ license was suspended a total of four times from Oct. 29, 2014 to May 15, 2015 in various courts, all for her failure to answer traffic summons and failure to pay driver’s responsibility. Betts was arraigned in the Town of Persia Court and released after posting $500 bail.
  • Jason D. Fairbanks, 28, of College Street in Gowanda was charged with second-degree harassment and third-degree criminal mischief on May 23. Patrol responded to the report of a disturbance at Fairbanks’ residence. Patrol was notified that Fairbanks was involved in a verbal altercation with a female acquaintance. This altercation escalated into a physical altercation with Fairbanks allegedly grabbing this victim’s arm, causing bruising. This victim then tried to flee the area, at which time Fairbanks allegedly chased her vehicle and broke her windshield with his fists. Fairbanks was arrested and charged, the arraigned in the Town of Persia Court and was remanded to the Cattaraugus County Jail in lieu of $2,000 bail.
  • John T. Irwin, 21, of Bader Street in Gowanda was arrested on an arrest warrant on May 27. On March 5, Gowanda Police arrested Irwin for driving while intoxicated, leaving the scene of a motor vehicle accident and criminal mischief. When Irwin failed to appear in the Town of Persia Court to answer to these charges, the Town of Persia Court issued a warrant for Irwin’s arrest. On May 27, the Erie County Holding Center notified Gowanda Police that Irwin was at that facility on an unrelated matter, and that he was being released from that facility. Patrol picked Irwin up from the Erie County Holding Center and arrested him on the warrant. Irwin was arraigned in the Town of Persia Court, and he was remanded to the Cattaraugus County Jail in lieu of $2,500 bail.

  • BEMUS POINT – Brady J. Wesp, 22, of Bemus Ellery Road was charged with driving while intoxicated, DWI with a blood alcohol content of .08 percent or higher, failure to keep right and failure to maintain lane on Saturday. Around 2 a.m., deputies stopped a vehicle on Center Street in Bemus Point for multiple lane violations. Investigation led to the operator, Wesp, to be discovered as allegedly intoxicated. Wesp will appear in Ellery Town Court.

Gowanda Police

  • Anthony R. Lang, 58, of East Main Street was charged with second-degree harassment on May 5. Patrol responded to a report of a disturbance on East Main Street and was informed that a verbal altercation between Lang and another male escalated to a physical altercation. Lang allegedly punched the other male subject in the facial area. Lang will appear in Collins Town Court.

SILVER CREEK – Robert K Shumaker Jr., 35, of Angell Road in Silver Creek was charged with disorderly conduct on Thursday.

Around 7:10 p.m., Chautauqua County Sheriff deputies allegedly observed Shumaker yelling obscenities and displaying obscene gestures in the presence of the public. He was placed into custody and charged with disorderly conduct.

Shumaker was arraigned in the Town of Hanover court and sent to the County Jail in lieu of bail.

Dunkirk responds to Warsaw Street fire

  • The Dunkirk Fire Department answered an alarm for a reported structure fire at 120 S. Warsaw St. at 3:30 a.m. Thursday.

According to officials, the resident discovered the fire, evacuated the house and used a garden hose to knock the initial fire down. Fire Department crews extinguished the remaining fire.

There was moderate heat damage to the rear wall of the house. The Fire Department was on location for approximately 30 minutes. There were no injuries. The residents were able to occupy the house after the fire.

The fire is under investigation.

Two charged after drug bust

CHAUTAUQUA – Two men are facing charges after the Southern Tier Regional Drug Task Force and the Chautauqua County Sheriff’s SWAT Team executed search warrants at 5543 and 5545 Mayville Sherman Road on Tuesday afternoon.

The search warrants entries were made without incident and once inside, the occupant Kyle Langer was taken into custody.

During the course of the search of the residences agents of the Task Force seized a quantity of cocaine, LSD, packaged marijuana, growing marijuana, scales for weighing controlled substances and U.S. currency.

As a result of the search Langer, 26, was charged with two counts of third-degree criminal possession of a controlled substance, fifth-degree criminal possession of a controlled substance, second-degree criminal possession of marijuana, second-degree criminally using drug paraphernalia and unlawfully growing marijuana. Langer was subsequently arraigned in the town of Chautauqua Court and then remanded to Chautauqua County Jail without bail pending further action of the court.

While agents were searching the residences, Derick Durbin of 110 Cornish St., Sherman, came to the residence and was found to have a quantity of marijuana visible on him. Durbin was issued an appearance ticket for the town of Chautauqua Court and was charged with unlawful possession of marijuana.

Steamburg man charged in death of Salamanca pedestrian

RED?HOUSE?- A 19-year-old Steamburg man has been charged with second-degree manslaughter and first-degree assault after allegedly driving his van into two parked cars and a pedesrian who later died.

After an investigation by the Criminal Bureau of the Cattaraugus County Sheriff’s Department, Cyrus N. Spruce, 19, of 8500 Sawmill Road, was charged in the incident that occurred early Sunday morning on the decommissioned section of Old State Route 17 in the town.

After striking the vehicles and Watson M. Cooper, 23, of Salamanca, who later died after being transported to Erie County Medical Center in Buffalo, Spruce fled the cene.

Spruce was arraigned in town of Salamanca court and held without bail. He will be in the town of Red House court at a later date.

  • Kristen L. Yonkers, 27, of Dunkirk was charged with failure to stop at a red light, driving while intoxicated, and DWI per se on May 6. Yonkers was issued three traffic tickets and was released on her own recognizance to appear in court at a later date.
  • Tom B. Mum, 20, of Fairport was charged with and issued two appearance tickets for open container and unlawful possession of alcohol on May 7.
  • Bertrum I. Cohen, 18, of Montgomery was charged with and issued two appearance tickets for open container and unlawful possession of alcohol on May 7.
  • Ellie E. Patarniti, 20, of Jamestown was charged with and issued two appearance and a traffic ticket for open container, unlawful possession of alcohol and possession of a fake I.D. on May 7.
  • Morgan B. Vail, 20, of Fredonia was charged with and issued an appearance ticket for open container and unlawful possession of alcohol on May 7.
  • Garret B. Moore, 23, of Arcade was charged with and issued two appearance tickets for open container and littering on May 7.

  • Niko P. Messina, 22, of Fredonia was charged with and held for arraignment for second-degree criminal contempt, fourth-degree criminal mischief, resisting arrest, second-degree obstructing government administration and disorderly conduct on May 14.
  • Deborah Parks, 57, of Fredonia was charged with petit larceny on May 15. Parks was released on her own recognizance to appear in court on a later date.

ELLERY – Bethany L. Shaw, 31, of Fredonia was charged with several offenses after deputies stopped her vehicle May 21 just after midnight on Route 430. Allegedly, she had been speeding, and following an investigation, she was found to be intoxicated. She was taken into custody and charged with driving while intoxicated, aggravated DWI with blood alcohol content .18 percent or higher and speed in zone. She will answer for herself in Ellery Town Court.

HARMONY – Cordell D. Wheeler, 21, of Panama was allegedly found behind the wheel of a vehicle parked in the middle of Wilcox Road on May 21 shortly before 4 a.m., intoxicated. He was taken into custody and charged with driving while intoxicated, DWI per se and parked on pavement. He will answer for his actions in Harmony Town Court.

HANOVER – Allen W. Harris Sr., 54, of Silver Creek was charged Saturday with driving while intoxicated, aggravated DWI with blood alcohol content .18 or higher and moving from lane unsafely after deputies allegedly observed a vehicle commit multiple vehicle and traffic violations on Routes 5 and 20.

After a short investigation, Harris was charged and will appear in Hanover Town Court.

VILLENOVA – Guochang Wang, 32, and Chunxie He, 51, both of Duncanville, Pennsylvania; along with Walter Boldt, 66, of Java Center were involved in an accident on May 22 as deputies were called to the scene at Balcom Corners.

Guochang reportedly failed to stop at a stop sign and collided with Boldt, who was going through the intersection of routes 83 and 322. Both vehicles were heavily damaged and towed from the scene.

Guochang and his passenger, He, were transported to Brooks Memorial Hospital for non-life threatening injuries by South Dayton Rescue. Boldt was transported to Lakeshore Hospital for non-life threatening injuries by Cherry Creek Rescue.

Guochang was ticketed for failure to stop at a stop sign and is to appear in Villenova Town Court.

Annual Click It or Ticket campaign starts on Monday

BUFFALO?- Erie County Sheriff Timothy B. Howard once again is reminding motorists to Click It or Ticket.

As part of the national seat belt enforcement campaign, law enforcement agencies around the country will be stepping up enforcement Monday to June 5, just ahead of one of the busiest travel weekends of the year.

“Every day, unbuckled motorists are losing their lives in motor vehicle crashes,” Sheriff Howard said. “As we approach Memorial Day weekend and the summer vacation season, we want to make sure people are doing the one thing that can save them in a crash: buckling up.”

According to the National Highway Traffic Safety Administration, nearly half of the 21,022 passenger vehicle occupants killed in crashes in 2014 were not restrained. At night from 6 p.m. to 5:59 a.m., that number soared to 57 percent of those killed. That’s why one focus of the Click It or Ticket campaign is nighttime enforcement.

Erie County Sheriff’s deputies will be taking a no-excuses approach to seat belt law enforcement, writing citations day and night. In New York, the maximum penalty for a seat belt violation is $150 for the first offense.

Almost twice as many males were killed in crashes as compared to females, with lower belt use rates, too. Of the males killed in crashes in 2014, more than half (53 percent) were unrestrained. For females killed in crashes, 40 percent were not buckled up.

The Erie County Sheriff’s Office will have multiple dedicated road patrols and the possibility of road check sites set up throughout the county during this campaign.

Sheriff Howard stated, “The bottom line is that seat belts save lives. If these enforcement crackdowns get people’s attention and get them to buckle up, then we’ve done our job.”

New York State Police at Jamestown

  • FREWSBURG – Kayla Johnson, 22, of Kennedy was charged with aggravated driving while intoxicated on Saturday.

Johnson was pulled over on Route 62 in Frewsburg for a traffic violation, and after allegedly failing several standard field sobriety tests, Johnson was placed under arrest.

Johnson was transported to the Jamestown barracks, where she provided an alleged breath sample of .20 percent. Johnson was then processed, issued tickets returnable to Carroll Town Court, and released.

  • JAMESTOWN – Justin Putt, 21, of Jamestown was charged with driving while ability impaired on Saturday.

Putt was pulled over on Willard Street in Jamestown for reportedly driving erratically, and after allegedly failing multiple standard field sobriety tests, Putt was put under arrest.

Putt was transported to the Jamestown barracks, where he provided a breath sample of .07 percent. He was then processed, issued tickets returnable to Jamestown City Court, and released.

Silver Creek man rescued after canoe overturns in creek

IRVING – A Silver Creek man is recovering after being rescued from Cattaraugus Creek Thursday afternoon.

According to the Chautauqua County Sheriff’s Department, around 5 p.m. Joshua Pfeiffer of Springville was fishing on the island in the middle of Cattaraugus Creek when he noticed someone splashing. Robert Burau of Silver Creek was in a canoe that had capsized and was trying to make it to shore. Burau was wearing a life jacket that kept him afloat.

Pfeiffer helped Burau to the shore of the small island and called 911. Deputies and the Sunset Bay/Silver Creek Fire Rescue responded to the scene. They assisted in returning Burau and his canoe back to the boat launch by boat. Burau was then taken by ambulance to Lakeshore Hospital to be treated for hypothermia.

NORTH HARMONY – Douglas G. Williams, 60, of Clymer; and Freda J. Farnsworth, 78, of Ashville were involved in a personal injury accident on Route 394 Tuesday at about 3 p.m. According to reports, Farnsworth’s vehicle rear-ended Williams’ vehicle as he was attempting to make a left-handed turn. Farnsworth sustained apparently minor injuries and was transported to WCA Hospital for evaluation. Sheriff’s deputies were assisted by New York State Police and the Ashville Fire Department.

MAYVILLE – Jonathan T. Kimes, 26, of Rockville, Maryland was taken into custody and charged with unlawful possession of marijuana and speed in zone Thursday shortly before 1 a.m. Allegedly, Kimes was stopped for speeding, then he was found to be in possession of marijuana. He was released with tickets and will answer charges in Chautauqua Town Court.

Traffic stop leads

to drug charges for 4

JAMESTOWN – Police have charged four people with drug possession after a traffic stop on East Second and Stowe streets at 3:50 a.m. Tuesday.

Joshua T. Berg, 27, a passenger in the vehicle, was charged with third-degree criminal possession of a controlled substance and seventh-degree criminal possession of a controlled substance.

Jacob A. Trippy, 22, also a passenger in the vehicle, was charged with two counts of third-degree criminal possession of a controlled substance after he was allegedly found to have cocaine and methamphetamine and with obstructing after allegedly refusing to follow police officers’ directions for officer safety and investigative purposes.

Tiffany A. Mahoney, 34, a passenger in the vehicle, was charged with two counts of fourth-degree criminal possession of marijuana and third-degree criminal possession of a controlled substance after allegedly having 73 grams of marijuana and a quantity of methamphetamine and heroin.

The driver of the vehicle, Michelle N. King, 32, was charged with multiple traffic violations and seventh-degree criminal possession of a controlled substance after she was found to allegedly be in possession of methamphetamine.

All four were arraigned in Jamestown City Court and will be in court later.

Timothy Warrior, 60, of Jamestown was charged with second-degree falsifying business records after four Jamestown teens were arrested in April for stealing a vehicle, one of which claimed to be 15 years old.

As a result, the teen was issued a Chautauqua County Family Court appearance ticket and turned over to parent Warrior. Troopers were later contacted by the teen’s probation officer, advising that he was 16, therefore subject to the same arrest process as an adult.

Investigation revealed Warrior was aware of this information, but chose to withhold the actual date of birth, causing inaccurate paperwork to be filed with the wrong court. He was processed at the Jamestown barracks and issued an appearance ticket returnable to Ellicott Town Court.

Karla Fontanez, 19, of Jamestown; Angel Nales Roman, 24, of Jamestown; Christian Leon Nazario, 25, of Jamestown; and Jose Torres Perez, 21, of Ceiba, Puerto Rico, were charged May 12 with unlawful possession of marijuana after Fontanez was pulled over on Route 60 in Jamestown for a traffic violation and while speaking to her and the occupants, the troopers smelled marijuana emanating from inside the vehicle.

The subjects and vehicle were searched and the subjects were found to be in possession of several marijuana cigarettes, a pipe containing marijuana residue and a bag containing a small amount of marijuana.

All subjects were arrested and issued appearance tickets returnable to Ellicott Town Court. Leon Nazario was turned over to Jamestown Police officers on an outstanding warrant for unpaid parking tickets.

Sloan Milne, 26, of Rew, Pennsylvania, was charged May 18 with driving while intoxicated after being pulled over in Frewsburg for speeding.

After failing several field sobriety tests, Milne was placed under arrest and transported to the Jamestown barracks where she provided a breath sample of .13 percent. Milne was then processed, issued tickets returnable to Carroll Town Court and released. She is scheduled to appear in Carroll Town Court.

Information released on Villenova crash

VILLENOVA – Three people were injured in a head-on crash Monday.

According to the Chau-tauqua County Sheriff’s Department, around 1 p..m. David Doner, 39, of Conewango, was traveling north on Route 83 when his vehicle crossed over into the south bound lane. Doner’s’ vehicle then struck another vehicle head-on which was occupied by John Korbar, 51, of Helox Texas and Sandra Korbar, 73 of Gowanda. All three were taken to Brooks Memorial Hospital with non-life threatening injuries.

Doner was issued a traffic ticket for failure to keep right.

Along with the Chautau-qua County Sheriff’s De-partment, responding to the crash were the Forestville and South Dayton fire departments and Alstar.

New York State Police in Jamestown

Robert Tyler, 35, of Cassadaga was charged on My 10 with second-degree unlawful imprisonment, fourth-degree criminal mischief, third-degree menacing and second-degree harassment after Troopers responded to Clay Pond in Falconer for a report of a domestic dispute.

Troopers allegedly interviewed Tyler, the victim and a witness. Investigation revealed that an argument between Tyler and the victim began at a different location and continued in Tyler’s truck on the way to Clay Pond.

Tyler refused to pull over for the purpose of letting the victim out and once at Clay Pond, Tyler restrained the victim from leaving and took her cell phone.

Tyler was arrested on scene for the above charges, transported to the Jamestown barracks and processed. Tyler was then arraigned in Poland Town Court, remanded to the Chautauqua County Jail in lieu of $500 bail and is scheduled to appear again in Poland Town Court.

ELLERY – Charlotte M. Coghill, 31, or Fishers, Indiana, was taken into custody Saturday at about 11:30 p.m. after an incident on Interstate 86. Deputies allegedly noticed Coghill speeding, and when they stopped her vehicle, ascertained that she was intoxicated. Her charges include driving while intoxicated, DWI per se and speed in zone. She will answer for herself in Ellery Town Court.

Edward T. Wilson, 21, of Dunkirk was charged with several offenses after deputies stopped his vehicle on Route 60 in the town of Dunkirk Saturday shortly before 3 a.m. According to reports, Wilson had been speeding, and when deputies investigated, they found him to be intoxicated. His charges include driving while intoxicated, DWI per se and speed in zone – for which he will answer in Dunkirk Town Court.

HANOVER – Thomas J. Loera, 44, of Irving was taken into custody Friday just after 1 a.m. and charged with driving while intoxicated, DWI per se, failure to keep right and moving from a lane unsafely. Allegedly, he had made several lane violations, prompting the deputies to stop his vehicle on Routes 5 and 20 and investigate. He will answer the charges in Hanover Town Court.

Kimberlee M. Bush, 44, of Angola was charged with driving while ability impaired by drugs, speed in zone and open container of alcohol in a motor vehicle after deputies stopped her vehicle on Route 20 in Pomfret Sunday shortly before midnight. They took her into custody after an investigation. She will answer for herself in Pomfret Town Court.

PORTLAND – Aaron Clark, 28, of Brocton was taken into custody and charged with second-degree harassment and endangering the welfare of a child Sunday shortly after 2 p.m. According to reports, Clark shoved and made unwanted physical contact with a victim in the presence of three children. He is being held at Chautauqua County Jail on $250 cash bail.

CHAUTAUQUA – Stephen P. Murphy, 36, of Pittsburgh, Pennsylvania, was charged Saturday with driving while intoxicated, DWI with a blood alcohol content of .08 percent or greater and failure to keep right after deputies allegedly observed a vehicle on Route 430 cross the center line of the roadway for no apparent reason at 2:50 a.m.

The vehicle was stopped and the operator was identified as Murphy. After investigation, he was reportedly found to be intoxicated and was taken into custody.

Murphy was later released with traffic tickets and will appear in Chautauqua Town Court at a later date to answer the above charges.

SILVER CREEK – Joshua D. Heimerl, 19, of Angola was taken into custody on Wednesday at about 3:40 p.m. According to reports, Heimerl had felony warrants out for his arrest issued by Chautauqua County Court. Further investigation found Heimerl in possession of a quantity of crack cocaine as well as a number of hydrocodone pills, both which were allegedly packaged for street sale. In addition to the outstanding warrant, Heimerl was charged with third-degree criminal possession of a controlled substance and fifth-degree criminal possession of a controlled substance. Heimerl was arraigned in Silver Creek Village Court and taken to Chautauqua County Jail without bail.

Jamestown man charged in assault, stealing taxi

JAMESTOWN – A city man was charged after assaulting a taxi driver and stealing her taxi cab at 1:58 a.m. Friday.

Jamestown police officers responded to the area near Maple Street and Everett Avenue after receiving a report of a man who assaulted a taxi driver and discovered the man had stolen the taxi and left the scene. Police found the taxi and pulled it over on Camp Street, near the Jamestown city line. They found Victor Rosa Jr., 40, of Jamestown, driving the taxi while intoxicated and with a revoked driver’s license.

Police report the woman was driving the taxi when Rosa grabbed the taxi driver by the hair, shoving her into the seat and holding her down. He then stole the taxi once the taxi operator left the cab.

Rosa was charged with second-degree robbery, second-degree reckless endangerment, criminal obstruction of breathing or blood circulation, third-degree unauthorized use of a motor vehicle, second-degree unlawful imprisonment, driving while intoxicated and first-degree aggravated unlicensed operation. He was taken to the Jamestown City Jail until he can be arraigned.

Fresco Pizza and Wings robbed by employee

In what some might call an “inside job,” an employee at Fresco Pizza and Wings unlawfully entered the business late Saturday and was further charged with burglary.

Peter P. Golonka, 37, of Jamestown, was arrested following a report of a subject unlawfully entering the premises at 2 E. Second St. in Jamestown without permission, breaking open a cash register and removing a quantity of cash. The entire incident was captured on surveillance cameras within the business and investigators were able to use the video to identify Golonka.

He was taken into custody on Monday and charged with third-degree burglary. Golonka appeared for a preliminary hearing this morning and was remanded to the County Jail in Mayville with bail set at $10,000 cash or $20,000 property bond.

Rochester man charged with drug possession in Jamestown

JAMESTOWN – A Rochester man was charged Thursday after allegedly attempting to leave a Jamestown address with a quantity of crack cocaine.

At 3:30 p.m., investigators with the Jamestown Metro Drug Task Force apprehended 28-year-old Timothy R. Wilson in the parking lot of a 30 Charles St. address.

Police said Wilson was in possession of crack cocaine, cash and drug paraphernalia. He was charged with third-degree criminal possession of a controlled substance, criminal use of drug paraphernalia and third-degree aggravated unlicensed operation.

Wilson was taken to the Jamestown City Jail to await arraignment.

Randolph youth faces charges after alleged bomb threat

RANDOLPH – A 13-year-old student attending Randolph Central School, unnamed due to their age, was charged with second-degree falsely reporting an incident on May 12.

This occurred when it was found that the student allegedly wrote what appeared to be a bomb threat to the school.

The juvenile is set to appear in Family Court to answer to the above charge.

Jamestown drug bust nets 400 envelopes of heroin, 50 capsules of powder cocaine

JAMESTOWN – Two Jamestown residents face charges after a Monday drug bust on East Second Street.

Jamestown Police Department officials report serving a search warrant at 1094 E. Second St., Jamestown, after an investigation by the Jamestown Metro Drug Task Force and State Police CNET team revealed heroin was being sold from the home. The warrant was served with assistance from the Jamestown Police Department SWAT Team.

Inside, investigators found more than 400 envelopes of heroin, 50 capsules filled with powder cocaine and drug packaging material. Investigators also found five children ranging in age from 1 to 9 years of age.

Misha C. Gonzalez, 34, and Juan A. Valasquez-Rodriguez, 37, both have been charged with two counts of third-degree criminal possession of a controlled substance, one count of criminal possession of drug paraphernalia and five counts of endangering the welfare of a child.

They were taken to the city jail until they can be arraigned.

Dog’s death under investigation

Dunkirk Police are involved in an ongoing investigation regarding a 3-month-old puppy found dead in its owner’s backyard on Main Street, stuffed behind a suitcase late on May 10.

According to Buffalo media outlets, family members state that they flagged down a nearby police officer after stumbling upon the upsetting scene around 9:30 that evening.

The investigation is ongoing. More information will be released as it is received.

FALCONER – Sarah Nazzaro, 22, of Falconer was charged on May 9 with unlawful possession of marijuana after she was pulled over on Route 380 for reportedly failing to dim her high beams.

A vehicle search was conducted after the Troopers allegedly smelled marijuana emanating from inside her vehicle. Nazzaro was taken into custody after a bag containing marijuana was located between the driver seat and door. Nazzaro was released with an appearance ticket and is scheduled to appear in Ellicott Town Court later in the month.

RIPLEY – Richard F. Eimers, 71, of Ripley was charged with second-degree harassment after an alleged incident took place on Main Street Monday at about 8:20 a.m. He was issued an appearance ticket.

Milady Aponte, 23, of Fredonia was taken into custody and charged with several offenses relating to welfare fraud on Wednesday at about 9 a.m. This concludes a joint investigation by the Chautauqua County Sheriff’s Office and the Department of Health and Human Services Program Integrity Unit. According to reports, Aponte failed to notify social services of employment income and took steps to conceal that income in order to gain unentitled benefits. It is alleged that Aponte filed two false applications which denied having employment income. As a resulted of her alleged conduct, Aponte received $91 in unentitled food stamps. Her charges include two counts of first-degree offering a false instrument for filing, fifth-degree welfare fraud, petit larceny and misuse of food stamps. She has appearance tickets directing her to an arraignment in Jamestown City Court.

HARMONY – Nicholas E. Weitschat, 25, of Ashville was charged Wednesday shortly after midnight with several offenses after an incident on Blockville-Watts Flats Road. According to reports, deputies stopped a vehicle for an observed violation, and the operator identified himself as Weitschat. Investigation found that Weitschat was intoxicated while operating the vehicle. A check also showed Weitschat’s New York driver privileges were revoked for a previous conviction of driving while intoxicated within 10 years. After being placed in custody, Weitschat was also found to be in possession of a quantity of marijuana. Weitschat was charged with felony driving while intoxicated, first-degree felony aggravated unlicensed operator, operating without interlock device, no front plate, uninspected motor vehicle, and unlawful possession of marijuana. He was arraigned in the town of Clymer court on behalf of the town of Harmony and remanded to the Chautauqua County Jail without bail.

LITTLE VALLEY – Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court:

  • Andrew Usyk, 24, of Gowanda, was arraigned and entered a plea of not guilty to an indictment that charges him with two counts of driving while intoxicated and failure to keep right. The incident occurred on or about Dec. 27 in the town of Perrysburg, when the defendant operated a motor vehicle in an intoxicated condition, having a .10 percent blood alcohol content. The matter has been adjourned for motions.
  • Josh Turbury, 31, of Jamestown, was sentenced to five years probation for his conviction of third-degree attempted criminal possession of a controlled substance. The incident occurred on or about May 14, 2015, in Salamanca, when the defendant knowingly and unlawfully attempted to possess a narcotic drug with intent to sell it.

  • Spencer Burke, 23, of Stockton, was sentenced by Judge Paul Wojtaszek to an indeterminate sentence of one to three years in state prison, after being convicted of third-degree burglary.

MAYVILLE-A Jamestown man linked to a grisly drive-by shooting at the Washington Street Tops last year was sentenced to eight years in state prison.

Michael R. Robinson, 31, received the determinate sentence Monday in Chautauqua County Court by Judge Paul Wojtaszek.

Robinson will also serve five years of post-release supervision.

According to Patrick Swanson, acting Chautauqua County district attorney, Robinson entered into a plea agreement earlier this year, in which he pleaded guilty to first-degree assault.

His cohort, 24-year-old Alexander J. Jewell, was handed a determinate sentence in April of 10 years in state prison with five years of post-release supervision for first-degree assault.

Swanson said Jewell received a harsher sentence than Robinson because he is believed to be the shooter in the incident.

On July 24, Robinson and Jewell were involved in a drive-by shooting in front of the Washington Street Tops, in which a male victim was struck in the abdomen and leg.

Jewell and Robinson were taken into custody the following day after investigators located an unoccupied vehicle on a south side street that matched the suspect vehicle’s description. Police also recovered a shotgun that was allegedly used in the shooting

The victim was last reported to be recovering from his injuries.

PORTLAND – Marcia Burgess, 42, of Westfield was charged on May 8 with driving while intoxicated after troopers were allegedly checking the welfare of a female driver, later identified as Burgess, unconscious behind the wheel of her vehicle on the side of the road on Route 5.

Burgess was taken into custody after reportedly failing multiple field sobriety tests and transported to the Fredonia barracks for processing. She was issued tickets returnable to Portland Town Court and is scheduled to appear in court later in the month to answer the charge.

SILVER CREEK – Brittany Deloe, 26, of Silver Creek was charged on May 8 with driving while intoxicated after troopers reportedly observed what appeared to be a disabled vehicle at Route 20 and Walnut Road.

Deloe was placed under arrest after failing allegedly multiple field sobriety tests and transported to the Fredonia barracks.

Deloe provided a breath sample of .09 blood alcohol content. Deloe was then processed, issued tickets returnable to Sheridan Town Court and released.

Dunkirk man arrested in case of mysterious Saturday stabbing

State Police in Fredonia have made an arrest following a bizarre stabbing incident involving two Dunkirk men Saturday afternoon.

According to Troopers, 31-year-old Rafael Zabala allegedly stabbed 32-year-old Edwin Rivera-Rivera in the chest with grape shears on Water Street in the town of Pomfret.

Following the incident, Rivera-Rivera reportedly showed up at the door of the New York State Police barracks at Fredonia with a 1.5-inch stab wound around 4 p.m. Saturday.

Investigation revealed the victim and a co-worker were engaged in an altercation during which Zabala used a set of grape shears to stab the victim.

Rivera-Rivera went to the Fredonia barracks to report the incident and Zabala fled to a residence in Dunkirk.

Following Rivera-Rivera’s arrival at the Fredonia barracks, EMS transported him to an area hospital where he was then flown by Starflight to the Erie County Medical Center and treated for his chest wound.

Zabala was later found within the city and taken into custody.

ASHVILLE – James R. Stearns, 67, of Ripley was allegedly involved in a property damage accident Friday at about 6 p.m.

Deputies arrived on the scene and conducted an investigation, determining that Stearns, who had been driving, was intoxicated and had struck another vehicle. After processing, Stearns was charged with aggravated driving while intoxicated, DWI per se, consumption of alcohol in a motor vehicle, and uninspected motor vehicle. He was issued tickets.

HARMONY – Peggy J. Stravato, 42, of Panama was arrested and charged with driving while intoxicated, DWI per se having .08 percent or higher blood alcohol content, failure to stop at stop sign, and failure to keep right on Saturday. Chautauqua County Sheriff’s Deputies on patrol stopped Stravato’s vehicle for multiple traffic violations on Niobe Road in the town of Harmony. After an investigation, deputies found that Stravato had allegedly been operating the vehicle while intoxicated. Stravato was processed and released with citations directing her to appear in Harmony Town Court.

SHERMAN – Patrick J. Fellows, 20, of Jamestown was charged with unlawful possession of marijuana on Thursday. Chautauqua County Sheriff’s Deputies on patrol stopped Fellows’ vehicle for an observed alleged traffic violation on Park Street in the village of Sherman.

During the interaction, Deputies discovered that passenger Fellows was allegedly in possession of a quantity of marijuana and drug paraphernalia.

Fellows was issued a citation directing him to appear in the Sherman Court.

FRENCH CREEK – Philip R. Wisniewski, 45, of Clymer was arrested for and charged with driving while intoxicated and driving while intoxicated with a blood alcohol content level of .14 percent on May 5.

Wisniewski was stopped by the Chautauqua County Sheriff’s Office for failing to keep right on state Route 426 in the town of French Creek.

During the traffic stop, it was determined that Wisniewski was allegedly under the influence of alcohol and placed under arrest for driving while intoxicated.

He was later released on his own recognizance.

  • JAMESTOWN – On Saturday, the New York State Police arrested Darlene Daniels, 49, of Jamestown, for second-degree harassment.

Several police agencies responded to The Bullfrog in Jamestown for a report of a subject who had just been assaulted. Investigation revealed that the victim had been struck several times by Daniels without provocation so Daniels was placed under arrest.

Daniels was issued an appearance ticket.

  • JAMESTOWN – Michael Hutley, 25, of Jamestown, was charged with aggravated driving while intoxicated Saturday. Hutley was pulled over on Falconer Street in Jamestown for driving erratically, and after failing several Standard Field Sobriety Tests, Hutley was placed under arrest.

Hutley was transported to State Police Jamestown, where he provided a breath sample of .23 percent. Hutley was then processed, issued tickets and released, to appear in the City of Jamestown Court.

James L. Langendorfer, 53, of Fredonia was charged with petit larceny after allegedly being found shoplifting from Wal-Mart on April 14.

Yalitza Nieves, 36, of Dunkirk was charged with petit larceny after allegedly being found shoplifting from Wal-Mart on April 14. Nieves has been previously charged with second-degree harassment in 2015, third-degree aggravated unlicensed operation and failure to yield the right of way in 2013, with driving while intoxicated in 2013 and aggravated driving while intoxicated with a BAC of .18 percent or more in 2012.

Gayang Ayol, 24, of Fredonia was charged with, held and issued warrants for obstruction of breathing, second-degree criminal trespassing and two counts of fifth-degree criminal possession of stolen property on April 15. Ayol was also was held for alleged disorderly conduct and fourth-degree criminal mischief earlier this year.

Kelvin A. Mynoz, 24, of Fredonia was charged with, held and issued warrants for obstruction of breathing, second-degree criminal trespassing and fifth-degree criminal possession of stolen property on April 15.

Victoria M. Gonzales, 20, of Staten Island was charged with and issued appearance tickets for littering, open container and underage possession of alcohol on April 15.

Vincent J. Eberhart, 19 was charged with and issued appearance tickets for littering, open container and unlawful possession of alcohol on April 15.

Corey James Hollister, 21, of Perry was charged with open container and violating the sewer ordinance on April 16. He was released on $100 bail.

Erica M. Gentile, 19, of Williamsville was charged with and issued three appearance tickets for littering, open container and underage possession of alcohol on April 16.

C.E. Eckerdt III, 33, of Fredonia was charged with and issued two traffic tickets for driving with a loud muffler and bald tires on April 18.

Messiak M. Gonzalez, 28 was charged with and issued an arrest warrant for fourth-degree grand larceny and third-degree burglary on April 18. Gonzales was also charged with second-degree harassment in 2015, with first-degree criminal contempt, fourth-degree criminal mischief and second-degree harassment in 2014, with two counts of third-degree assault from previous charges and second-degree assault in 2012, with first-degree criminal contempt and second-degree harassment in 2011, with second-degree criminal contempt in 2011, with assault and menacing in 2010 and with assault twice in 2008.

Megan E. Rupp, 19, of Cape Vincent was charged with and issued an appearance ticket for open container and underage possession of alcohol on April 22.

Esteban Delgado, 44, of Dunkirk was charged with criminal obstruction of breathing, fourth-degree criminal mischief and second-degree harassment on April 11. Delgado was also charged with third-degree assault in 2014, with disorderly conduct in 2011, with assault in 2010 and with assault and obstruction of governmental administration in 2009.

Alvin J. Jusino, 22, of Dunkirk was charged with second-degree harassment on April 12. Jusino was also charged with seventh-degree criminal possession of a controlled substance earlier this year; with disorderly conduct, resisting arrest and fourth-degree criminal mischief in 2014; with second-degree harassment twice in 2014; with seventh-degree criminal possession of a controlled substance, obstruction and resisting arrest in 2013; with disorderly conduct, second-degree obstructing governmental administration and third-degree criminal possession of a controlled substance in 2013; with fourth-degree criminal possession of a weapon twice in 2012 and with fourth-degree criminal possession of a weapon in 2011.

Brandon A. Deblasi, 20, of Dunkirk was charged with insufficient turn signal of less than 100 feet and second-degree aggravated unlicensed operation of a motor vehicle on April 12. Deblasi was also charged with unlawful possession of marijuana, unlicensed operator, insecure license plate and unlawful possession of marijuana in 2015 and with second-degree harassment and third-degree aggravated unlicensed operation in 2015.

Adam Jesse, 26, of Dunkirk was charged with petit larceny and two counts of criminal possession of a hypodermic needle on April 13. Jesse was also charged with assault in 2008.

Jordan C. Kujawa, 23, of Dunkirk was charged with third-degree criminal possession of a controlled substance and unlawful possession of marijuana on April 13. Kujawa was also charged with seventh-degree criminal possession of a controlled substance earlier this year; with insufficient use of a turn signal less than 100 feet from a turn, which led to a charge for unlawful possession of marijuana earlier this year; with unlawful possession of alcohol under 21 and having an open container in 2012 and with possession of fireworks in 2009.

Devin J. Smith, 24, of Dunkirk was charged with second-degree harassment and fourth-degree criminal mischief on April 15. Smith was also charged with second-degree obstructing governmental administration, fourth-degree criminal possession of a controlled substance, third-degree criminal possession of a controlled substance and second-degree criminal possession of a weapon in 2015; was sentenced to 6 months in jail and 5 years probation for third-degree criminal possession of a weapon in 2014; and was charged with third-degree criminal possession of a weapon in 2014; with second-degree harassment, second-degree menacing and first-degree criminal contempt in 2014; with second-degree harassment, fourth-degree criminal mischief and first-degree criminal contempt in 2013; with third-degree aggravated unlicensed operation in 2013; with second-degree harassment in 2013; with leaving the scene of a property damage accident and failure to maintain lane in 2012 and with second-degree harassment in 2012.

Jerry J. Murphy, 22, of Forestville was charged with unlawful possession of marijuana on April 16. Murphy was also charged with third-degree criminal trespassing in 2013.

Lisa A. Farner, 50, of Silver Creek was stopped for allegedly failing to use a turn signal. During the traffic stop after an investigation, Farner was allegedly also charged with seventh-degree criminal possession of a controlled substance on April 17. Also in the car were Martin J. Wisniewski, 41, of Dunkirk and Vicki Lynn Badia, 51 of Zephyrhills, who were both also charged with seventh-degree criminal possession of a controlled substance.

Farner was previously charged with third-degree criminal possession of a controlled substance and third-degree criminal sale of a controlled substance in 2014.

Jose M. Corea, 36, of Dunkirk was charged with second-degree harassment and third-degree criminal mischief on April 17. Corea was previously charged with petit larceny in 2013.

Thomas Fafinski, 33, of Dunkirk was charged with second-degree burglary and fifth-degree criminal possession of stolen property on April 20.

Jessica Falco, 30, of Dunkirk was charged with fourth-degree criminal possession of stolen property on April 21. Falco has been previously charged with third-degree assault in 2015 and with unlawful use of a credit card and fourth-degree criminal possession of stolen property in 2011.

Dakota P. Murphy Jr., 18, of Dunkirk was charged with second-degree harassment on April 21.

Hilda M. Menpoza-Torres of Dunkirk was charged with second-degree harassment on April 21.

Tyler Kubasik, 20, of Dunkirk was charged with unlawful possession of marijuana on April 24.

Amber Alequin-Duman, 38, of Dunkirk was charged with petit larceny on April 25. Alequin-Duman was previously sentenced to 6 months in jail and 5 years probation for criminal sale of fifth-degree controlled substance in 2014.

Two hurt in Pomfret crash

Two people were injured following a crash Friday morning in the town of Pomfret.

According to the Chautauqua County Sheriff’s Department, Cody Merrill, 22, of Brocton was traveling east on Route 20 around 7 a.m. when his vehicle crossed the center line and struck a vehicle driven by Joel Green, 47, of Fredonia.

Both operators were transported to Brooks Memorial Hospital for non-life threatening injuries.

Merrill was issued a traffic ticket for failure to keep right.

ELLERY – Carl E. Case, 48, of Bemus Point was allegedly observed making a traffic violation Wednesday at about 1:40 a.m. on Dutch Hollow Road by deputies, who stopped Case’s vehicle. After a brief investigation, deputies determined Case was intoxicated. He was taken into custody and charged with driving while intoxicated per se, DWI common law and failure to use a turn signal. Case was then released to a sober third party. He will return to Ellery Town Court to answer for himself.

SHERMAN – Mark A. Kopta Jr., 37, of Clymer was charged with third-degree aggravated unlicensed operation and operating a vehicle while registration suspended Thursday shortly before 10 a.m. He was taken into custody by deputies after they stopped his vehicle on Park Street. After being issued tickets, he was released with tickets and will answer charges in Sherman Village Court.

Michael R. Nichols, 49, of Ashville was stopped by deputies on Fredonia-Stockton Road in the town of Pomfret Thursday shortly after midnight. He was allegedly speeding. Following an investigation, deputies determined Nichols was intoxicated. He was taken into custody and charged with driving while intoxicated, DWI per se and speeding. During the investigation, deputies found that Nichols had an outstanding warrant for his arrest in the village of Fredonia for petit larceny. He was processed, then turned over to Fredonia Police.

CARROLL – Chad M. Swan, 26, of Kennedy was charged with several offenses after an incident on West Main Street Friday at about 2:30 a.m. At that time, deputies responded to a property damage motor vehicle accident, and identified Swan as the driver. Allegedly, he was intoxicated. He was taken into custody and charged with driving while intoxicated, DWI with a blood alcohol content of .08 percent or greater, third-degree aggravated unlicensed operation, consumption of alcohol in a motor vehicle and failure to keep right. He was released with tickets and will answer charges in Carroll Town Court.

Police nab Lakewood man, 22, after chase

JAMESTOWN – A Lake-wood man faces several charges after trying to evade police when they tried to pull his vehicle on Monday.

Police report that around 5:20 p.m. Monday, South-ern Tier Regional Drug Task Force agents, Jamestown Metro Drug Task Force and new York State Parole officers were trying to serve an active parole arrest warrant on Dylan M. Abbey, 22, of 1 Packard Way, Lakewood.

As officers followed Abbey he attempted to elude officers in a vehicle. Then, a marked Jamestown Police Department vehicle tried to pull Abbey’s vehicle over and Abbey fled at high speed. Other patrol units assisted along with narcotics investigators and parole officers.

After fleeing in the vehicle for a short distance Abbey abandoned the vehicle and fled on foot. Officers gave chase and then took him into custody a short time later.

Abbey was initially charged with the New York State Parole arrest warrant and is being held without bail on that charge. As a result of the pursuit Abbey is charged with numerous vehicle and traffic law violations as well as three counts of first-degree reckless endangerment, third-degree unlawfully fleeing a police officer in a motor vehicle and resisting arrest. He is additionally charged with one count of fifth-degree criminal possession of stolen property after it was determined the vehicle that Abbey was driving had been stolen. Other charges are expected because of items found in the vehicle.

Once the chase had ended, the Southern Tier Regional Drug Task Force, Chautauqua County Sheriff’s SWAT team, Lakewood Busti Police Department, Jamestown Metro Drug Task Force and New York State Parole executed a search warrant at 2291 Fairmount Ave. in Busti. As a result of the execution of this search warrant there will be additional charges filed against Abbey in Busti Town Court later.

Abbey was taken to the Jamestown City Jail until he could be arraigned.

Cattaraugus County Sheriff’s Office

On Monday, Donald Stevens, 28, of Lawtons entered a plea of guilty to third-degree assault, a Class A misdemeanor, to satisfy a pending indictment. The incident from which his arrest stemmed happened July 29 in the town of Persia, when Stevens intended to cause serious physical injury to another person. Senten-cing is scheduled for Aug. 8.

JAMESTOWN – Joathylet M. Ruedas, 31, of Jamestown was charged on Thursday just after 5 p.m. with several felony offenses relating to welfare fraud. This concludes a joint investigation by the Chautauqua County Sheriff’s Office and the Department of Health and Human Services Program Integrity Unit. It is alleged that Ruedas failed to report earned income to DHHS. From Sept. 1, 2014 through May 31, 2015 she allegedly filed five separate false applications which failed to report her income. As a result of this fraud, Ruedas received $910 in cash assistance, $1,547 in food stamps, and $515 in HEAP. This totals $2,972 in unentitled benefits that was stolen from DHHS. Ruedas is charged with five counts of first-degree offering a false instrument for filing, fourth-degree welfare fraud, fourth-degree grand larceny and misuse of food stamps. She was issued appearance tickets for her June 2 arraignment in Jamestown City Court. Instances of suspected welfare fraud may be reported by calling the hotline at 1-800-288-5365.

Eladio Merced, 27, of Gowanda was charged with multiple offenses after deputies came upon his stopped vehicle in the middle of Route 60 in Pomfret Saturday shortly before 2 a.m. After an investigation, Merced was deemed to be intoxicated and taken into custody. A records check revealed that he had a previous driving while intoxicated conviction in the last 10 years, making this arrest a felony. His charges include felony DWI, DWI per se and parking on pavement. He was arraigned in Pomfret Town Court and remanded to Chautauqua County Jail in lieu of bail.

SHERIDAN – Dalton A. Stetter, 18, of Williamsville was taken into custody Sunday at about 2:30 a.m. after deputies stopped his vehicle on Route 20 for inadequate brake lights. After an investigation, deputies concluded he was intoxicated. His charges include driving while intoxicated, DWI per se and inadequate brake lights. He will answer charges in Sheridan Town Court.

John C. Tinstman, 49, of Dunkirk was taken into custody Saturday just before 11 p.m. due to an incident on Millard Fillmore Drive in Dunkirk. According to reports, deputies observed Tinstman operating a vehicle without proper headlights and pulled him over to investigate. After an investigation, Tinstman was found to be intoxicated. His charges include driving while intoxicated, DWI per se and operating a vehicle with less than two headlights. He will answer for himself in Dunkirk City Court.

Donald D. Freitas, 47, of Fredonia was taken into custody on April 24 and charged with aggravated driving while intoxicated, DWI and moving from a lane unsafely. According to reports, deputies observed Freitas make several lane violations while driving on Route 60 in the town of Dunkirk and stopped his vehicle to investigate. He will answer his charges in Dunkirk Town Court.

State Police in Fredonia

Peter Moldenhauer II, 47, of Dunkirk was charged on Friday with driving while ability impaired by drugs and alcohol after he was pulled over on Progress Drive in the city of Dunkirk for allegedly speeding.

Investigation revealed that Moldenhauer was intoxicated, took two Valiums and a Sudafed prior to driving, and was placed under arrest after failing field sobriety tests.

Moldenhauer was transported to the Fredonia barracks where he reportedly provided a positive breath sample, a urine sample and was evaluated by a Chautauqua County Drug Recognition Expert. Moldenhauer was then issued tickets returnable to Dunkirk City Court where he is scheduled to appear in June.

New York State Police arrested a 17-year-old resident for driving while intoxicated, unlawful possession of marijuana and failure to pay a fine , the latter of which was a warrant issued by Westfield Town Court.

While investigating a one-car property damage accident on Temple Road in Dunkirk, the Trooper reportedly observed the 17-year-old driver showing signs of impairment and the driver was arrested after failing field sobriety tests.

The 17-year-old suspect was also in allegedly possession of two glass pipes containing burnt marijuana. The suspect was transported to the Fredonia barracks where he refused to provide a breath sample. The suspect was then processed, arraigned in Pomfret Town Court and remanded to the Chautauqua County Jail.

Dalaute Buchanan, 39, of Dunkirk was charged on May 1 for aggravated driving while intoxicated after Buchanan was pulled over on Bennett Road in Dunkirk for littering, and after reportedly failing several field sobriety tests, Buchanan was placed under arrest.

Buchanan was transported to the Fredonia barracks where he provided a breath sample of .24. Buchanan was then processed and issued tickets returnable to Dunkirk Town Court later in the month.

Robert Henssler, 70, of Fredonia was charged on May 1 with driving while intoxicated after he was approached by the Trooper who observed Henssler allegedly drive his vehicle at a high rate of speed toward a group of pedestrians who were standing in a private driveway in Fredonia.

After failing several field sobriety tests, Henssler was placed in custody. Henssler was transported to the Fredonia barracks where he provided a breath sample of .09.

Henssler was then processed and issued tickets returnable to Fredonia Village Court.

On May 2, New York State Police arrested a 17-year-old student at Randolph Academy in Randolph for seventh-degree criminal possession of a controlled substance.

The trooper responded to a call at the Randolph Academy when the staff members discovered the student was in possession of five capsules that contained 2.1 grams of amphetamine. The student was placed under arrest, transported to the Jamestown barracks and processed.

The suspect was then arraigned in Conewango Town Court and remanded to the Cattaraugus County Jail.

Crash victim’s

condition moves to ‘serious but stable’

OBSERVER Staff Report

The unidentified driver who was found in his upside-down vehicle in a ditch at 3438 Werle Road in the town of Dunkirk Saturday has had his condition upgraded from critical to “serious but stable,” according to New York State Police.

Police, EMS and the Sheridan Fire Department were on the scene at approximately 8 p.m. Saturday and the victim had to be extricated from the vehicle, which was found 20 to 30 feet down in a ditch.

According to State Police, the driver was traveling toward Harrington Road at a high rate of speed, lost control, went over an embankment and into the creek, leaving skid marks on the ground going into the creek just before the guardrail began.

State Police also say the driver was semi-conscious when the crew arrived.

The driver was transported to the Erie County Medical Center by Mercy Flight.

State Police stated charges are pending and the case remains under investigation.

MAYVILLE – Kathryn S. Fisher, 38, of Farming-ton, Ohio, was charged Sunday as a fugitive of justice after Fisher was visiting at the Chautauqua County Jail.

During a check prior to entering the jail, it was allegedly determined that Fisher was wanted out of Geauga County, Ohio. Fisher was detained and subsequently arraigned on fugitive from justice charges.

JAMESTOWN – Erica L. G. Burkholder, 28, of Jamestown was charged Friday with five counts of second-degree forgery, petit larceny, seventh-degree criminal possession of a controlled substance, two counts of endangering the welfare of a child and third-degree possession of forged instrument after the Chautauqua County Office of the Sheriff served a warrant on Burkholder in regard to the five forgery charges. Subsequent investigation lead to the additional charges.

Joshua A. Carvalho, 20, of Fredonia was charged Sunday with second-degree criminal sale of marijuana after Sheriff’s Deputies served an arrest warrant for Carvalho in the town of Pomfret.

Carvalho reportedly had an active probation warrant for his arrest on the above charge and was taken into custody without incident. Carvalho was committed to the Chautauqua County Jail.

Mayville man injured, charged after rollover

OBSERVER Staff Report

CHAUTAUQUA – A Mayville man involved in a rollover accident Saturday morning on Plank Road is facing a number of charges.

Chautauqua County sheriff’s deputies report Craig A. Hayward, 49, was driving northbound around 5:50 a.m. when he apparently failed to negotiate a curve on the road. His vehicle left the road, causing it to roll over multiple times.

Hartfield rescue transported Hayward to Westfield Memorial Hospital for non-life threatening injuries.

Hayward was charged with third-degree aggravated unlicensed operator, speed not reasonable or prudent, failure to stop at a stop sign, and unlawful possession of marijuana.

He will be in Chautauqua Town Court at a later date.

Chautauqua County Sheriff’s Office

  • Dean T. Campese II, 20, of Dunkirk was arrested for and charged with driving while intoxicated, aggravated DWI with a blood alcohol content of .18 percent or greater, speed in zone and possession of an alcoholic beverage in a motor vehicle on Friday.

Campese was stopped on Brigham Road after being observed speeding and was allegedly found, after an investigation, to be found in an intoxicated state.

Campese was released with appearance tickets and is due back in Dunkirk Town Court at a later date.

  • Robert J. Cole, 68, of Cassadaga was arrested and charged with driving while intoxicated, DWI per se, moving from a lane unsafely, driving across hazard markings and failure to use turn signal on Saturday.

Sheriff’s deputies stopped Cole’s vehicle on Route 60 in the town of Pomfret for multiple traffic infractions. After an investigation, it was determined that Cole was allegedly intoxicated.

Cole was released with traffic tickets and will appear in Pomfret Town Court at a later date.

STOCKTON – Michael R. Peterson, 27; and Aaron A. Johnson, 21, both of Jamestown, face charges after an incident Monday that occurred at about 9:30 p.m. on Route 60. Deputies and New York State Police were dispatched to the area for a vehicle complaint. Upon locating the vehicle and speaking with the occupants it was discovered that Johnson was in possession of a quantity of marijuana and Peterson was in possession of a hypodermic instrument. Johnson was issued an appearance ticket for unlawful possession of marijuana and Peterson was issued an appearance ticket for criminally possessing a hypodermic instrument. Both are due back in Stockton Town Court at a later date.

  • Hector W. Quinones, 54, of Dunkirk was traveling on Lamphere Street and West Doughty Street in the city on Saturday when he reportedly backed up into traffic and struck the front end of a vehicle operated by Shontike N. Morgan, 28, of East Second Street while waiting for a train crossing.

No injuries were reported.

Gowanda Police Department

  • Brandon J. Brooks, 21, of Gowanda was arrested for and charged with aggravated harassment on Wednesday.

Gowanda Police received a complaint from a female subject stating that she had been receiving numerous texts from Brooks, who was allegedly making threats of personal harm to her family.

Brooks was contacted by patrol and turned himself in. He was subsequently arraigned in Collins Town Court and was released on his own recognizance to appear at a later date.

Brooks was previously charged with driving while intoxicated, DWI per se and failure to stop at a stop sign in 2014; disorderly conduct, second-degree obstructing governmental administration and resisting arrest in 2013; trespass in 2012 and second-degree reckless endangerment and endangering the welfare of a child in 2012.
