No movement on Hanover noise ordinance

HANOVER — The noise ordinance residents requested from the Hanover Town Board has yet to be acted upon.

Residents were hoping the law would be passed as soon as possible, to prevent the propane cannons from going off this coming grape season. Ed Schintzius, council person, brought it to the board at the March 9 meeting.

“The difficulty there is a noise ordinance by itself doesn’t do it because there are two types (of laws): objective and subjective. Subjective are the ones you read that say ‘and unreasonably disturbs’ … what is unreasonably disturbed?” said Attorney Jeffrey Passafaro. “The objective type is in decibels, measuring at a certain point off the property and around the property line. But, that involves training for a town official and the purchase of decibel measuring devices, none of which is cheap.”

Schintzius said he is continuing to work on the issue with the staet Department of Environmental Conservation and Passafaro, hoping to come up with a law before grape season.
