City man charged threats on officers, woman

A Dunkirk man who threatened a woman and police is facing charges after an incident late Tuesday.

Dunkirk Police report officers were dispatched to an address on West Howard Avenue for a domestic dispute at 10:11 p.m. It was reported the victim fled the residence and was at a neighbor’s house. Upon arrival, officers began speaking with the woman to ascertain what had occurred and at the time could hear items being damaged inside the house the victim fled from. The suspect, identified as Josean Gutierrez, 36 then emerged from the residence with an unknown type weapon in his hand, which was later identified as a large machete.

Gutierrez threatened to shoot and kill officers and then got into a vehicle in the driveway and attempted to flee the scene. Gutierrez attempted to strike a Dunkirk Police vehicle that was preventing him from leaving, at which point a brief standoff ensued with Gutierrez in his vehicle.

Gutierrez refused to comply with the officer’s commands and continued threatening to shoot and kill officers. After attempting negotiations, officers forcefully removed Gutierrez from the vehicle, where he physically resisted arrest and fought with officers. Gutierrez was taken into custody and was ultimately transported and booked on charges of unlawful imprisonment, fourth-degree criminal mischief, second-degree harassment, two counts of second-degree reckless endangerment, second-degree obstructing governmental administration and resisting arrest.

Gutierrez was arraigned in Dunkirk City Court and released without bail.
