Four jurors seated in Tucker Richard trial

MAYVILLE – Four jurors have been seated in the trial of an Ellicott resident who was accused of killing his stepfather.

Tucker Richard, 20, has been charged with second-degree murder. On Jan. 6, 2023, Richard allegedly shot and killed 57-year-old Scott Blake, whom Richard lived with at 2256 Willard St. Extension not far from the Jamestown city line following an argument between the two.

The trial, which is taking place in Chautauqua County Court, requires 12 jurors plus two alternatives.

Judge David Foley told jury members to expect the trial to begin on Monday.

Richard is being represented by Public Defender Nathan Barone. Schmidt is serving as lead prosecutor.

This trial has been delayed twice before.

Originally the trial was going to take place in March, but the defense requested and was approved of a delay due to a late lab report.

Then the trial was set to take place in August, however it was again delayed after the defense argued that they received “late discovery” from the prosecution.
