DPW chief tied to vandalism

CASSADAGA — A longstanding feud between the village and Valley Outdoors owner Adam Diate took a turn this past week. Sam Alaimo, Superintendent of Public Works for the Village of Cassadaga, is facing charges following an incident at Valley Outdoors on Friday night described by Diate as vandalism.

Alaimo, 49, was charged by the Chautauqua County Sheriffs with fourth-degree criminal mischief, criminal tampering and trespass.

Chautauqua County deputies responded to the complaint regarding an incident that occurred at 9:23 p.m. Friday, June 6 at Valley Outdoors in the village of Cassadaga. After an investigation, Alaimo was identified and charged. Alaimo was given tickets and will be at the Stockton Town Court at a later date.

Valley Outdoors sells hunting, clothing and guns and is located at 16 S. Main St.

As of Wednesday evening, the village has not taken disciplinary action against Alaimo. He is still employed.

Cassadaga Deputy Mayor Bill Astry, pictured, said Superintendent of Public Works Sam Alaimo is “innocent until proven guilty.”

“At this point, there’s nothing we can do,” Deputy Mayor Bill Astry said. “He’s innocent until proven guilty.”

Diate addressed the Village Board five nights after the incident occurred at the latest Board meeting.

“He has targeted me in the past,” Diate said of Alaimo. Diate stated he plans to seek an order of protection against Alaimo to keep him away from Diate’s property.

Village resident Judith Garncarek said during public comments after Diate spoke, “I’m sorry that an employee of this village made a very poor choice. … This is very concerning.”

Just over a year ago, tensions between the village and Diate reached a boiling point, as Diate went back and forth with the Village Board and Alaimo for more than 30 minutes during the public comment portion of the meeting. Diate had been feuding with the village regarding cement blocks that were located on his property, the Valley Outdoors store located on Route 60 in the heart of the village. Diate wanted the village to remove the blocks, while the Village initially placed them at the site to protect a fire hydrant.

A year ago, Diate pressed the village for documentation of the purchase of the blocks in the first place, which the village was unable to provide at the time. In the time since, Village Board members Cathy Cruver and Danna DuBois have continually asked for more transparency with purchases from Alaimo and other employees.

Diate frequently took aim at Alaimo throughout his lengthy address a year ago. Trustee Cindy Flaherty defended Alaimo that night, stating that she trusts his judgment. She also noted at the time that Alaimo does come before the board when he makes major equipment purchases.

Village Trustee Danna DuBois expressed frustration with Alaimo’s lack of activity at the latest meeting. She began with the lack of coordination of shared services to use a street sweeper now that the Village’s own is in need of repair. DuBois stated that in the employee handbook, under the Public Works Superintendent job description, it states, “Coordinate with shared services for sweeping of paved shoulders.”

DuBois said, “Obviously, that has not been done. I have no problem contacting the Town of Stockton or any of the other towns about sweeping our streets. I can definitely do that and I will do that. But again, it shouldn’t be handled by me. I’m going to do it because every time I’ve asked for it, there has been no action, no results.”

DuBois also submitted a chart detailing every vehicle the Cassadaga Fire Department owns, including the year, make and model; whether the vehicle is in service or not and its condition; when it is expected to be replaced; and the expected cost to replace each vehicle. She stated the process took roughly 15 minutes to complete with the help of the Fire Chief. DuBois has asked for the same from the Department of Public Works on several occasions.

Alaimo was not in attendance at the latest meeting of the Village Board. He also did not submit a report to the Board.
