Buffalo man pulled from vehicle and handcuffed during stop

EVANS — On April 4 at roughly 7 p.m., patrol was dispatched to Erie Road for reports of a vehicle speeding and failing to maintain lane.

Evans police officers located the vehicle and initiated a traffic stop. After running the license of the driver, Jonathan R. Marsh, 29, of Buffalo, the report said it was suspended.

Marsh was told by police he was under arrest and was asked to exit his vehicle. Marsh allegedly stated, “no,” picked up his phone and made a phone call. Marsh was again told he was under arrest and asked to exit the vehicle, to which he again replied, “no.”

Officers said they unclipped Marsh’s seat belt and grabbed him by the wrist, prompting Marsh to pull away. Officers then pulled out a taser and displayed it in front of Marsh, which prompted Marsh to start screaming “stop tazin’ me!”

Officers pulled Marsh from the vehicle and attempted to handcuff him. Marsh allegedly refused to be handcuffed and was taken to the ground, where he continued to resist arrest. Eventually, Marsh was placed in handcuffs.

During this time, officers noticed that the license plates on Marsh’s vehicle did not belong to that vehicle. Marsh was transported to Evans Police Department for booking, where he complained of a bump on the head he claims happened while resisting arrest. Marsh was evaluated and signed off for transport.

Marsh was charged with second-degree obstruction of governmental administration, resisting arrest, operating an unregistered motor vehicle on highway, failure to keep right, operating a motor vehicle with improper plates, operating a motor vehicle without valid inspection and third-degree aggravated unlicensed operation of a motor vehicle.

Marsh’s vehicle was impounded and the license plates were confiscated. Marsh was later arraigned by Judge John Glascott, who released him on his own recognizance.

Chautauqua County Sheriff’s Office

HARMONY — On Wednesday, April 10 at roughly 4 p.m., deputies responded to an address on Route 474 for a report of a physical altercation between two individuals.

Further investigation found that Shawn M. Battle, 27, of Jamestown, was allegedly trespassing on property he had no right to be at. While on the property, Battle allegedly damaged a cell phone that did not belong to him, and then fled the scene. Battle was later found, taken into custody and charged with third-degree criminal mischief, fourth-degree criminal mischief, endangering the welfare of a child, second-degree harassment, seventh-degree criminal possession of a controlled substance and second-degree criminal trespass.

Battle was taken to Chautauqua County Jail to await arraignment.

Evans Police

≤ On March 25 at roughly 6:20 p.m., an unspecified arrest warrant was issued for Janet R. Kaczmarczyk, 58, of Evans, out of Evans Court. Kaczmarczyk was picked up by patrol and transported to Evans Court for arraignment. Kaczmarczyk was released on her own recognizance and issued a return date of April 22.

≤ On March 30 at about 2 a.m., patrol stopped a vehicle on Erie Road for moved from lane unsafely and no/inadequate plate lamp.

Patrol made contact with the driver, Anthony J. Barsaloe, 37, of Blasdell, and allegedly observed a clear yellow container with pill inside. Patrol inquired what the pills were, and Barsaloe replied, “They’re prescribed to me. Lortab 10s.” Barsaloe was removed from the vehicle, placed under arrest and charged with seventh-degree criminal possession of a controlled substance, controlled substance in non-original container, moved from lane unsafely and no/inadequate plate lamp.

Barsaloe was later released with appearance and traffic tickets and his vehicle was impounded.

≤ On March 31 at around 7:15 p.m., patrol was dispatched to Lake Shore Road for a report of a suspicious female. The female was identified as Tina M. Shell, 50, of Evans. Upon further investigation, officers said there was a bench warrant for Shell from Town of Evans Police Department. Shell was taken into custody, and a search of her person revealed a crack pipe in her coat pocket.

Shell was charged with two counts of seventh-degree criminal possession of a controlled substance and was later released with an appearance ticket.

¯ On March 31 at roughly 10:35 p.m., Buffalo Police Department contacted Evans Police Department in an attempt to locate Frank J. Damon, 40, of Evans, who was under investigation for a reported larceny.

Officers later observed Damon’s listed vehicle fail to signal while turning onto Glidden Circle. A traffic stop was initiated and Damon was identified by patrol. While checking his license, patrol discovered that it had been revoked and Damon was taken into custody.

As Damon exited his vehicle, officers allegedly observed several small crack rocks on the driver’s seat, as well as a crack pipe next to the driver’s seat.

Damon was charged with second-degree aggravated unlicensed operation, seventh-degree criminal possession of a controlled substance and unsafe turn/failure to signal.

Damon’s vehicle was impounded, and he was later released with appearance tickets, before being turned over to Buffalo police.

≤ On April 3 at approximately 12:40 a.m., Frank R. Scamacca, 57, of Elma, was turned over to the Evans Police Department by the Depew Police Department. During a traffic stop, Depew officers were made aware of Scamacca’s valid arrest warrant issued by the Town of Evans Court for property maintenance.

Following booking, Scamacca was released on $250 bail, and is scheduled to return to Town of Evans Court at a later date.

¯ On April 3 at about 8:30 a.m., a teacher at Lakeshore High School reported the scent of marijuana coming from the ladies’ bathroom. Tylaniemarie Benton, 18, of Brant, was taken out of the bathroom and was allegedly passively resistant before eventually complying with officers. Benton reported she had a “pen” on her, and that she had “oil” in it. The oil was seized and tested for cannabis, resulting in a positive for concentrated cannabis.

Benton was charged with seventh-degree criminal possession of a controlled substance and given an appearance ticket.

¯ On April 3 at around 7 p.m., officers stopped a vehicle on Versailles-Plank Road for speeding. After running the Seneca Nation identification of the driver, Ayden N. Jimerson, 20, of Perrysburg, it was reported to be suspended.

Jimerson was placed under arrest and charged with third-degree aggravated unlicensed operation and speed in zone. Jimerson was booked and later released with traffic tickets.

¯ On April 4 at approximately 5:50 p.m., officers stopped a vehicle being operated illegally. Officers said they had direct knowledge that the driver, Shaun R. Barringer, 40, of Evans, had his license revoked from a refusal hearing that took place March 28.

Officers also ran Barringer’s New York State identification which confirmed his license was revoked on March 28.

Barringer was placed under arrest and charged with second-degree aggravated unlicensed operation. He was booked and later released with a traffic ticket.

¯ JAMESTOWN — On Wednesday, April 10, troopers pulled over a vehicle on East 2nd Street for a traffic violation. While speaking to the driver, Anthony Slaughter, 23, of Jamestown, troopers said they smelled marijuana emanating from inside the vehicle. A search of Slaughter and his vehicle allegedly revealed one marijuana cigarette. Slaughter was charged with unlawful possession of marijuana, issued an appearance ticket and a traffic ticket.

¯ BEMUS POINT — On Friday, April 12, troopers responded to Dutch Hollow Road for a report of a vehicle off the road. After allegedly failing several field sobriety tests, troopers arrested Emily Rechin, 25, of Bemus Point, and charged her with driving while intoxicated. Rechin was uninjured after driving her vehicle off the road and was transported to State Police Jamestown, where troopers said she provided a breath sample of .15 and was issued a traffic ticket.
