Jeffrey B. Kane, 46, of Grant Avenue was charged with second-degree harassment on March 20.

Jorge M. Negron-Velasquez, 29, of West Second Street was charged with third-degree aggravated unlicensed operation, having no registration and no insurance on March 27.

Pablo P. Gomez, 35, of King Street was charged with failure to signal within 100 feet, unlicensed operation and no insurance on March 27.

Jose J. Ruiz, 29, of North Jerboa Street was charged with second-degree aggravated unlicensed operation, no registration, having switched plates and no insurance on March 28.

Alissa N. Smith, 22, of Fredonia was charged with unlicensed operation and insufficient tail lamps on March 29.

Gina E. Maycock, 26, of South Roberts Road was charged with prostitution and petit larceny on March 29 on a warrant.

Chautauqua County Sheriff’s Office

POMFRET – Two residents were charged following a physical altercation Friday morning. At 2:25 a.m. deputies responded to a residence on Route 5 in the town of Pomfret. Investigation led to Marisol Mendez, 39, and Devin J. Smith, 21, both of Route 5 being charged with second-degree harassment and endangering the welfare of a child.

Both men were released on appearance tickets.

HANOVER – Brian E. Boedo, 28, of Silver Creek was charged with driving while intoxicated, driving with a blood alcohol content of .08 or greater and speeding on Friday. At 2:35 a.m. deputies stopped a vehicle on Dennison Road in the town of Hanover for speeding.

Upon investigation, Boedo, the driver, was found to be intoxicated. He was released on appearance tickets for the Town of Hanover Court.

Westfield Police

Westfield Police investigated a case of stolen cash from a purse at a sporting event at Westfield School Saturday. Officers used video surveillance from the school and found the larceny was caught on the footage. Further investigation led to a charge against Todd Reardon, 37, of Westfield, for petit larceny. Reardon was released on his own recognizance and will appear in the Westfield Village Court at a later date.

Robert M. Greenman, 57, of Bourne Street was charged with failure to keep right, driving while intoxicated, aggravated DWI and unlawful possession of marijuana on March 23. Shortly after 2 a.m., police stopped a vehicle on Bourne Street for a traffic infraction. During the stop, it was found Greenman was allegedly intoxicated. he was additionally found to be in possession of a small quantity of marijuana. He was released on appearance tickets for Westfield Village Court.

Jamestown Police

JAMESTOWN – A search warrant was issued Thursday for a residence on West Sixth Street following a drug investigation by Jamestown Police and State Police revealed narcotics were being sold from the address. Inside the apartment, investigators found Tyrone M. Smith, 28, of Jamestown. Smith was charged with felony third-degree criminal sale of a controlled substance, felony first-degree criminal nuisance and criminal possession of stolen property after several flat screen televisions, which were reported stolen, were recovered. Investigators also found a quantity of cash at the residence. Smith was taken to Jamestown City Jail awaiting arraignment. Anyone observing the illegal sale of narcotics is asked to call Jamestown Police Department’s anonymous tip line at 483-TIPS.

Chautauqua County Sheriff’s Office

PORTLAND – Leonard J. Erhard, 35, of Westfield, was charged with criminal possession of a hypodermic instrument after a traffic stop on Route 20 where Erhard was a passenger. He was taken into custody and arraigned in Westfield Court. He was sent to the Chautauqua County Jail on $500 bail and will appear in the Portland Town Court at a later date.

James P. Tilley III, 37, of Dunkirk was charged with petit larceny March 20.

Tyler Stakelum, 24, of Kennedy was charged with third-degree aggravated unlicensed operation on March 20.

Joseph Ryan Marsh, 28, of Clinton Avenue was charged with making graffiti and possession of a graffiti instrument on March 21.

Rose M. O’Connell, 19, of Center Street was charged with unlawful possession of alcohol March 22.

Mariah Maldonado, 22, of Dunkirk was charged with unlicensed operation, operating a motor vehicle while using a cell phone and failure to keep right on March 26.

John M. Wells, 30, of Westfield was charged with third-degree aggravated unlicensed operation on March 26.

Danielle N. Braun, 26, of West Main Street was charged with second-degree aggravated harassment on March 27 with a court summons.

DWI arrest in Falconer

FALCONER – On Saturday, state police from Jamestown charged Carrie Mozdy, 53, of Erie, Pa., with driving while intoxicated.

She was pulled over on Route 394 for a reported traffic violation. She reportedly failed several field sobriety tests. Mozdy was transported to the state police barracks in Jamestown where she provided a blood sample that was reported to be .14 percent.

Mozdy was processed, issued tickets reported to the Town of Ellicott Court and released to a sober individual.

Westfield Police

A 16-year-old youth was charged with second-degree harassment Tuesday. At 7:30 p.m. Westfield Police responded to a domestic on Oak Street in the village.

Officers were advised that the teen male had attacked his sister by allegedly punching her in the ribs and face multiple times.

The youth was released on an appearance ticket for the Village of Westfield Court.

Illegal possession

of Burmese python

PERRY – On Wednes-day, Environmental Conser-vation Police charged a village resident for the illegal possession of a Burmese Python under Section 11-0512 of the New York State Environmental Conservation Law. State police in Warsaw as well as the village of Perry police assisted in the investigation

Darrell Alan Boyd, 39, of 65 South Main Street, Apt. A, was issued an appearance ticket for the Village of Perry Court.

The snake was safely removed from Boyd’s residence and secured by the NYSDEC Bureau of Wildlife, Buffalo, pending disposition of the case.

Cattaraugus County Sheriff’s Office

SALAMANCA – Terry A. Jones, 41, of Big Run, Pa., was taken into custody at the Seneca Alleghany Casino Sunday around 11 p.m. on three outstanding warrants from the city of Jamestown for failure to register as a sex offender. Jones was processed, turned over to the Chautauqua County Sheriff’s Office and held on charges.

PERRYSBURG – Markie N. Graves, 21, of Perrysburg, was charged Saturday around 10:30 p.m. with driving while intoxicated, DWI with a blood alcohol content over .08 percent and failure to keep right after a traffic stop on Railroad Avenue.

She was issued appearance tickets for the Perrysburg Town Court.

Four arrested after fight in Jamestown

  • JAMESTOWN – The Jamestown Police Depart-ment reported that a fight at 429 Lincoln St. involving a burglary occurred Saturday at 2:25 a.m.

Jonathan R. Ray, 21, and Chad T. Robbins, 21, both of Falconer and Casey R. Billyard, 20, and Kaitlyn N. Billyard, 18, both of Jamestown, were all charged with second-degree burglary and fourth-degree conspiracy. Ray was further charged with third-degree criminal possession of a weapon. Casey and Kaitlyn Billyard were also charged with third-degree assault.

Officers were dispatched to a reported fight and upon arrival saw several individuals fighting in the street, one in possession of a shotgun.

Reportedly, the individuals charged went to the Lincoln Street address looking for the victims who live there and attempting to recover a debt they believed was owed. All the subjects reportedly entered the home unlawfully at which point a fight began and spilled out into the street. One subject was struck by a baseball bat and another armed himself with a shotgun. Another suspect fled the scene and the investigation is continuing.

Jamestown Police were assisted by New York State Police, Town of Ellicott Police and Alstar Ambulance.

with check fraud

  • SINCLAIRVILLE – Benjamin Gray, 22, of Sinclair-ville was charged Saturday with third-degree fraud and fifth-degree criminal possession of stolen property.

The charges are a result of an incident which took place March 1 at a business in Sinclairville. Gray allegedly cashed two checks he was not authorized to have. He cashed them by endorsing them with his own name.

Gray was issued appearance tickets.

State Police at Collins

CATTARAUGUS IND-IAN RESERVATION – On March 18, troopers charged Jessica Lay, 21, of Clinton Street in Salamanca for felony driving while intoxicated, second-degree aggravated unlicensed operation, driving a vehicle not equipped with an interlock device and other traffic violations, following a one-car rollover accident on State Route 438.

Lay was southbound when she went off the west shoulder and her vehicle overturned. She was taken to Lake Shore Hospital where she was treated and released to troopers. According to a computer check of her driver’s history, she had a revoked NYS driver’s license, and two prior DWI convictions, making this charge a felony.

She was processed, ar-raigned in Collins Court and released to a family member.

CATTARAUGUS IND-IAN RESERVATION – On Tuesday, troopers charged Robert Skeels, 35, of Townline Road in Perrysburg for aggravated driving while intoxicated following a traffic stop on Versailles-Plank Road.

Skeels was stopped after troopers saw him driving erratically. Troopers reported smelling alcohol and say Skeels failed a series of field sobriety tests.

He was processed at state police barracks at Collins where his reported blood alcohol content was .18 percent. He is due back in the Town of Collins Court.

GOWANDA – On Wednesday, troopers and the Gowanda Police Depart-ment charged Gerald Red-ford, 37, of North Water Street on a bench warrant issued by the Town of Perrysburg Court for failure to pay a fine. Redford was arraigned in Perrysburg Court and posted bail.

  • NORTH COLLINS – Troopers charged Michael Sanchez, 38, of High Street on an arrest warrant Thursday issued by the Town of Brant Court for failing to appear for a court date. He was arraigned in the Town of Brant Court and posted bail.

On Thursday, troopers charged Sara Mohawk, 17, of State Route 438 in Gowanda with unlawful possession of marijuana. Troopers answered a suspicious vehicle call in the parking lot of the old TNT bar in Collins. They located the car and while speaking with occupants found Mohawk in possession of a marijuana cigarette. She is due in the Town of Collins Court.

On Saturday, troopers charged Charles Burgess, 22, of State Route 39 in Gowanda for driving while intoxicated, following a 911 call for an erratic driver.

Reportedly Burgess was traveling south on State Route 62, returning from Hamburg where he had been celebrating his birthday, when he nearly hit another car. The driver of the car turned and followed Burgess and called 911.

Troopers spotted the Burgess vehicle near their barracks and stopped him after reportedly observing his erratic driving. Erie County Sheriff’s deputies arrived on the scene to assist. Burgess was processed at the Collins barracks. His blood alcohol content was reported to be .15 percent.

Burgess is due in the Town of Collins Court later this month.

Police seek help in Jamestown store burglary

JAMESTOWN – The Jamestown Police Department is asking for the public’s assistance identifying a suspect from a burglary at the Dollar General.

Investigators say an unknown female entered the store at 1356 Washington St. through a glass door which was smashed. The suspect is believed to be a thin Hispanic female around 5 feet tall. She was wearing a dark-colored winter coat with gray fur around the edge of the hood. The suspect was also wearing blue jeans and sneakers.

Police say she exited the store with a quantity of merchandise in a plastic garbage container.

Jamestown man arrested after stealing from locker

JAMESTOWN – Matthew J. Piscitelli, 37, of Jamestown was charged Tuesday with larceny, possession of burglary tools and violation of parole after allegedly stealing from a locker at the Jamestown YMCA. According to police, officers investigated a report that the lock on a locker at the YMCA had been cut off and cash had been removed from the locker.

Investigation found Piscitelli entered the building with bolt cutters in his duffel bag. The stolen cash was recovered. Piscitelli is being held in the Chautauqua County Jail pending a parole hearing. Parole officers from the NYS Division of Parole Buffalo Office assisted in the arrest.

Forestville man charged after threatening with a gun

HANOVER – A Forestville man was charged with two counts of second-degree menacing after allegedly pointing a gun at two individuals trying to load a disabled snowmobile into a truck.

According to the Chautauqua County Sheriff’s Office, Stephen J. Duman, of Forestville, was taken into custody Wednesday after the alleged incident on Hurlbert Road. Duman was issued appearance tickets and will appear in the Hanover Town Court at a later date.

Fredonia man charged with child abuse

Chautauqua County Sheriff’s deputies took Wilbur A. Reyes, 26, of Route 20, Fredonia into custody on a warrant after a domestic incident involving a 16-year-old youth.

According to the Chautauqua County Sheriff’s Office, Reyes allegedly choked, pushed and punched the 16-year-old at his residence. After an investigation a warrant was issued for criminal obstruction of breathing or blood circulation, second-degree harassment and endangering the welfare of a child. The charge of resisting arrest was added after Reyes resisted officers executing the warrant.

Reyes was arraigned in the Pomfret Town Court and sent to the Chautauqua County Jail in lieu of $5,000 cash or $10,000 property bail.

Personal injury accident may lead to charges

CHAUTAUQUA – A personal injury accident on Plank Road Thursday around 6 p.m. may lead to charges.

According to the Chautauqua County Sheriff’s Office, Michael N. Cochrane, 25, Brandy R. Cochrane, 26, and Hailey A. Cochrane, 1, all of Westfield were driving along Plank Road when Nicholas C. Shields , 22, of Mayville pulled out of a driveway directly in front of the Cochranes’ vehicle. Neither vehicle was able to avoid the collision and ended up T-boning each other.

Both vehicles came to rest in the ditches off the road, partially blocking the roadway.

Shields was transported to Westfield Memorial Hospital with minor injuries. The Cochranes were uninjured. Hartfield and Mayville fire departments assisted at the scene. Investigation is ongoing and charges are pending against Shields for failing to yield the right of way.

Chautauqua County Sheriff’s Office

SHERIDAN – Keith A. Mleczko, 42, of Dunkirk, was charged with failure to keep right after an accident on Route 5 around 1:35 a.m. Thursday. According to the Chautauqua County Sheriff’s Office, Mleczko lost control of his vehicle, struck a guard rail and rolled over several times. He was taken to Brooks Memorial Hospital for apparent minor injuries. He will appear in the Sheridan Town Court at a later date.

Danielle E. Gee, 19, of Brocton, was charged at 11 a.m. Friday with unlawful possession of marijuana after investigation into an incident on Vineyard Drive in the town of Dunkirk. Gee was released with appearance tickets for the Dunkirk Town Court.

BUSTI – Ian M. Anderson, 37, of Wellsville, was charged with third-degree criminal mischief Wednesday around 7 p.m. after an incident in a Lakewood Busti police patrol car. Anderson allegedly kicked the back door of the police car several times while he was being placed in the back seat and caused damage to the door. A warrant was issued and Anderson will answer to the charge in Busti Town Court.

Brocton man facing burglary, petit larceny charges

  • A Brocton man has been charged in connection with an incident that allegedly occurred in the village of Fredonia.

According to Fredonia Police Wednesday night, Harold E. Voss III, 57, was charged with second-degree burglary and petit larceny earlier that day following the conclusion of their investigation.

It is alleged Voss entered a locked apartment located on East Main Street in the village of Fredonia earlier this month.

After gaining entry, Voss allegedly stole money and personal property of the owner prior to leaving the residence. The home owner was not home at the time of the burglary, but did return a short time later and contacted the police.

Voss turned himself in to police Wednesday morning and was later released.

Silver Creek man arraigned on NY SAFE ACT charge

  • A Silver Creek man who became the first person to be charged under the New York SAFE Act appeared in Hanover Town Court Wednesday.

Benjamin Wassell, 32, is facing three felonies and a misdemeanor charge after he allegedly tried to sell two banned assault weapons to undercover state trooper. His arraignment is expected to continue on April 17.

Cheektowaga man charged with DWI

  • SINCLAIRVILLE – On Saturday, Andrew Goslin, 31, of Cheektowaga was charged with driving while intoxicated.

State police pulled him over on Route 60 for a reported traffic violation. After reportedly failing several sobriety tests, he was transported to state police barracks in Jamestown. The breath sample Goslin provided was reported to be .09 percent.

Goslin was processed, issued tickets returnable to the Town of Charlotte Court and released to a sober individual.

  • SILVER CREEK – According to the Chau-tauqua County Sheriff’s Office, two youths were charged with fourth-degree criminal mischief after incidents which took place in November and December. The two youths allegedly rode their all-terrain vehicles on the property of St. Alban’s Church on Hanover and Blanding roads without permission and allegedly caused damage to the property.

They were issued appearance tickets and will appear in the Hanover Town Court at a later date.

Man charged with reckless endangerment

  • On Saturday, Jason DeGolier, 32, of Kennedy, was charged with second-degree reckless endangerment after he turned himself in to the state police barracks in Jamestown.

In February, a trooper interviewed a cab driver who stated DeGolier intentionally broke the front passenger side window of the cab after the driver gave him a ride home from a bar. Reportedly, DeGolier, when exiting the cab, struck the window, causing the glass to shatter on the inside of the cab. Some of the glass struck the driver who sought treatment at a local hospital. The driver’s eyes were washed out, but he was not diagnosed with any injury.

DeGolier was processed and issued an appearance ticket for the Town of Poland Court at a later date. The cab company declined to have DeGolier charged for breaking the window, since he has paid for the repair.

Chautauqua County Sheriff’s Office

KIANTONE – Failure to stop at a stop sign led to an accident on Donelson Road and South Main Street Extension Monday. According to the Chautauqua County Sheriff’s Office, Matthew W. Fowler, 18, of Bemus Point, was traveling south on South Main Street Extension when he failed to stop at the stop sign and collided with a vehicle operated by Thomas W. Anderson, 55, of Russell, Pa. Anderson’s vehicle spun out and crashed in a deep ditch. Anderson was treated on the scene by the Kiantone Fire Department and Alstar Ambulance. He was taken to WCA Hospital for minor injuries. Fowler was uninjured and was given a ticket for disobeying a stop sign and will appear in Kiantone Town Court at a later date. It was noted both men were wearing seatbelts which prevented serious injuries.

MAYVILLE – Alex Lescynski, 18, of Mayville, was charged Monday with fourth-degree grand larceny and fourth-degree criminal possession of stolen property. According to the Chautauqua County Sheriff’s Office, a snowmobile was reported stolen from a residence on Burton Avenue on Feb. 20. Investigation led to the arrest of Lescynski on Monday. Lescynski was arraigned in the Chautauqua Town Court and released under the supervision of a probation officer until further prosecution.

Jordan T. Lagano, 21, of Dunkirk was charged Friday with obstruction of breathing with a warrant.

Matthew Sabul, 19, of Hendrix Hall, SUNY Fredonia was charged with violating the sewer ordinance on March 15.

Desmond Johnson, 20, of Forbes Place was charged with violating the sewer ordinance on March 15.

Nikoleta Vujovic, 21, of Temple Street was charged Saturday with having an open container and littering.

Frank Cady, 21, of Watkins Glen was charged with having an open container on March 16.

Michael Brown, 24, of Disney Hall, SUNY Fredo-nia was charged with having an open container March 16.

Matthew Dziekan, 21, was charged Sunday with two counts of seventh-degree criminal possession of a controlled substance.

Daniel P. Rothwell, 21, of Westfield was charged with disorderly conduct and resisting arrest March 18.

Marcelino Cintra, 30, of Dunkirk was charged with driving while intoxicated, DWI per se, failure to keep right and having no headlights on March 16.

Troopers conduct

traffic enforcement details over St. Patrick’s Day weekend

From Friday through Sunday, troopers participated in various traffic enforcement details aimed at preventing needless tragedies caused by impaired driving. They targeted speed, aggressive and distracted driving.

Drivers were met by sobriety checkpoints and additional DWI patrols. Bars and retail establishments were also observed for underage drinking and sales to minors.

Troopers from Troop A, which includes Allegany, Cattaraugus, Chautauqua, Erie, Genesee, Niagara, Orleans and Wyoming counties, issued 567 total tickets during the St. Patrick’s Day weekend, highlighted by 166 for speeding, 15 for driving while intoxicated, 15 for cellular phone use/texting and 45 for unlicensed operator/suspended.

The National Highway Safety Administration reports that more than 700 people were killed nationwide in crashes involving drunk drivers during the St. Patrick’s Day holiday from 2006 to 2010.

On average, every 51 minutes a person is killed in a drunk-driving related crash in the United States and the majority of these crashes involve drivers who have blood alcohol concentrations almost twice the legal limit of .08 percent.

SOUTH DAYTON – Daniel Emmett Gleason, 30, of Conewango, was charged Sunday with third-degree assault after an incident that occurred Saturday at the South Dayton American Legion. Gleason was issued an appearance ticket and will appear in the South Dayton Village Court.

Two charged in Dunkirk robbery

OBSERVER Staff Report

Dunkirk police have charged two in a robbery that took place early Saturday morning.

According to officers, Sheltear L. Brown, 22, and Justin B. Bess, 21, were charged with second-degree robbery, petit larceny and second-degree harassment. It is alleged both acted together in forcibly taking an undisclosed amount of cash and property from an individual early Saturday.

The two were taken into custody on Sunday when they were found to be passengers during a routine stop. Both were held in city jail and arraigned in city court.

There were taken to county jail and are awaiting a preliminary hearing.

Rollover accident

BROCTON – Chautau-qua County Sheriff’s were called to investigate a rollover accident on Swede Road around 4 a.m. Sunday. Cody D. Gustafson, 23, of Mayville was operating a vehicle with two passengers heading southwest. He allegedly lost control of the vehicle which came to rest on its side.

Gustafson was charged with speeding, driving while intoxicated and DWI per se. He was issued appearance tickets and will appear in the Brocton Village Court.

Chautauqua County Sheriff’s Office

Arsenio Collazo, 29, and Krizya Y. Collazo, 23, both of East Lake Road, were charged with third-degree welfare fraud, misuse of food stamps and offering a false instrument for filing. On Friday, both were issued appearance tickets after they allegedly inaccurately reported unemployment income from May to September. This allowed them to received $5,357.56 they were not entitled to. Both will appear in Jamestown City Court

Police release names in city rollover on Sunday

Dunkirk Police have released the names of those involved in an accident at the intersection of Sixth and Deer streets Sunday afternoon. According to police, a vehicle driven by Troy A. Mucha, 23, of Fredonia was traveling north on Deer Street approaching Sixth Street shortly after 3:30 p.m. As he was going through the intersection, he was struck by a vehicle driven by Garrett A. Lockett, 19, of Lake Shore Drive East. Mucha told police he was unfamiliar with the area and did not see a stop sign. Lockett and two passengers, a 15-year-old female and 17-year-old Lacharrise Clifford, were taken by Dunkirk Fire and a private vehicle to Brooks Memorial Hospital with unspecified injuries. Both vehicles were towed from the scene and Mucha was charged with failure to stop at a stop sign.

Justino Paz-Santiago, 46, of East Courtney Street was charged with third-degree aggravated unlicensed operation and failure to have a backseat seat belt for a youth on March 15.

Nelson X. Irizarry, 23, of Pike Street was charged with third-degree assault and second-degree obstruction on March 16.

Jermaine Batten of Fredonia was charged with disorderly conduct on March 17.

Emily D. Burroughs of Central Avenue was arraigned on a charge of second-degree aggravated unlicensed operation and was released on her own recognizance to return to court in April.

Cody J. Cook of Irving was arraigned on a charge of third-degree assault and was released on his own recognizance to return to court in May. Cook also pleaded guilty to local open container and underage alcohol possession violations and was fined $100.

Russell J. Faraci III of Henry Street, pleaded guilty to possession of marijuana and was fined $100.

Reginald A. Kohler II of Monroe Street pleaded guilty to a local dog at large violation and was fined $25.

Cara M. Martin of Main Road was arraigned on a charge of aggravated unlicensed operation and re-leased on her own recognizance to return to court in April.

Donald D. Pierce Jr. of Central Avenue was arraigned on a charge of fifth-degree possession of marijuana and was released on his own recognizance to return to court in April.

Man remanded to Chautauqua County Jail

ASHVILLE – On Saturday evening, Mark A. West of Ashville was charged with third-degree aggravated unlicensed operation, unlicensed operator, failure to comply with police, unlawful possession of marijuana, insufficient tail lamps, and tinted windows.

At about 9:30 p.m., a sheriff’s patrol attempted to stop a vehicle on South Maple Avenue for a tail lamp out. The driver reportedly attempted to elude the police by making several abrupt turns. The driver pulled the car into a driveway, left the vehicle, and fled on foot.

A passenger was detained and questioned, but only provided the first name of the driver.

With the assistance of the Lakewood-Busti Police, an investigation led to West who was located at his residence.

Reportedly West was violating an order of protection for having the female passenger in his presence. West reportedly had marijuana in his possession.

Lakewood-Busti police took West into custody. West was also wanted in Wayne County. He was arraigned by Lakewood-Busti police in the Town of Busti Court and sent to the Chautauqua County Jail on $20,000 bail. He will be arraigned on the traffic charged in North Harmony Court on the traffic charges at a later date.

GERRY – On Tuesday, Rodney Clyburn, 32, of Dunkirk was charged for unlawful possession of marijuana.

The car in which Clyburn was a passenger was stopped on Route 60, reportedly because the passenger was littering.

The officer reportedly smelled marijuana from inside the vehicle. A second officer responded to the scene and located a small amount of marijuana and a partially smoked marijuana cigarette inside the vehicle.

Clyburn was issued an appearance ticket.

On Saturday, two people were charged with selling alcoholic beverages to minors during an ABC law compliance detail conducted by the New York State Police, the New York State Liquor Authority, and the Jamestown Police Department. Ten out of 12 establishments checked were in compliance.

David Eriksen, 40, of Jamestown and Ashley A. Shaffer, 24, of Dunkirk were charged with selling alcoholic beverage to minors. Eriksen was working at the Roadhouse on Second Street in Jamestown, while Shaffer was working at Doon’s Tavern in Fredonia.

Eriksen was issued an appearance ticket for the City of Jamestown Court. Shaffer was issued an appearance ticket for the Village of Fredonia Court.

Bobby R. Mount, 30, of Jamestown, was sentenced to 2 1/2 years determinate in state prison plus 3 years post-release supervision for second-degree attempted burglary and time served for second-degree obstructing governmental administration.

Jensen L. Vazquez, 26, of Jamestown, was sentenced to 1 1/2 years determinate in state prison and 2 years post-release supervision for third-degree attempted criminal possession of a controlled substance.

Mathew Lanphere, 19, of Ripley, was sentenced to 5 years probation for third-degree burglary.

Chautauqua County Sheriff’s Office

ELLINGTON – Adam J. Dimpfl, 20, of East Randolph was charged with second-degree burglary and petit larceny on March 14. Deputies charged Dimpfl following an investigation into an incident that occurred on March 7 at a residence on Waterboro Hill Road in the town of Ellington. It is alleged that Dimpfl entered a residence while the occupants were away and stole property. He was arraigned in the Town of Ellington Court and sent to the Chautauqua County Jail in lieu of bail.

JAMESTOWN – Elizabeth A. Sorvelli, 39, of Russell, Pa. was charged with driving while intoxicated, having a blood alcohol content of .08 or more and speeding on March 15. Shortly after 4 a.m. deputies stopped Sorvelli’s vehicle for speeding. Following investigation, she was found to be intoxicated. She was released on an appearance ticket for Jamestown City Court at a later date.

MINA – John Rossiter, 75, of Chesterland, Ohio was charged with failure to yield the right of way at a stop sign on March 15. Deputies responded to a motor vehicle accident on Route 426 at I-86 at 2:41 p.m. According to police, Rossiter pulled out in front of a northbound vehicle causing a collision. Two occupants in the other vehicle were taken to Hamot/UPMC for treatment of non-life threatening injuries. Findley Lake Volunteer Fire Department also assisted with this call.

multiple charges after high-speed chase

CHERRY CREEK – According to the Chautauqua County Sheriff’s Office, deputies spotted Ahren B. Morano, 28, of Stockton, on Mile Strip Road Wednesday around 6 p.m. Morano was wanted for grand larceny and unauthorized use of a vehicle in the town of Stockton, as well as possession of stolen property and unauthorized use of a vehicle in the town of Ellery.

Deputies attempted to stop the vehicle operated by Morano when he fled. After a pursuit, deputies assisted by K-9 Drago stopped Morano in South Dayton. Morano was also charged with possession of marijuana, fleeing from a police office in a motor vehicle, second-degree aggravated operation, reckless driving, speeding, failure to keep right and violation of parole in the town of Cherry Creek. Morano is being held in the Chautauqua County Jail without bail.

MAYVILLE – District Attorney David W. Foley announced the following pleas and sentences in Chautauqua County Court:

Juan G. Rivera, 28, of Westfield, was sentenced to 3 years determinate in state prison plus 2 years post-release supervision for third-degree criminal sale of a controlled substance consecutive to 1-3 years in prison for violation of probation and time served for second-degree criminal trespass.

Dexter A. DeGolier, 32, of Mayville, was sentenced to 12 months in jail for third-degree burglary consecutive to 6 months in jail for petit larceny.

Wayne A. Lawrence, 37, of North Collins, was sentenced to 5 years probation, a $3,000 fine, 60 months ignition interlock device and 1 year driver’s license revocation for felony driving while intoxicated.

State police respond to disturbance, arrest teen

CATTARAUGUS INDIAN RESERVATION – On Saturday, Brandon J. Brooks, 18, was charged with disorderly conduct, second-degree obstructing governmental administration, and resisting arrest.

Collins troopers and deputies from the Erie County Sheriff’s Office responded to a disturbance involving a father and son. When patrols arrived, they reportedly observed Brandon J. Brooks, 18, in front of his residence, located at 14167 St. Route 438, attempting to fight his father.

Brooks, who was reportedly intoxicated, had to be physically separated from his father by patrols. While attempting to remove Brooks from the residence, he allegedly pulled away from a trooper and began using belligerent language and physical intimidation in an attempt to avoid being arrested.

Brooks reportedly had to physically be removed from the scene and into a patrol car.

After being arraigned in the Town of Collins Court, Brooks was remanded to the Erie County Holding Center and is due back in court at a later date.

The Seneca Nation Marshal’s Office assisted with the incident.

Jamestown man charged with

issuing bad check

JAMESTOWN – On Thursday, troopers based in Jamestown charged Michael Johnson, 27, of Jamestown with issuing a bad check.

Troopers received a complaint in December from a business owner in Kennedy who claimed that Johnson mailed him a check that was declined.

After failing to pay the balance for three months, Johnson was transported to the Jamestown state police barracks where he was processed.

He was released with an appearance ticket. He is scheduled to appear in the Town of Poland Court on a later date.

Chautauqua County Sheriff’s Office

SHERIDAN – Sue A. Carlson, 58, of Dunkirk was charged Monday with third-degree aggravated unlicensed operation after a property damage accident on Route 20. Deputies were called to the accident around 7:30 p.m. and investigation found Carlson’s license was allegedly suspended. She was issued an appearance ticket and will appear in the Sheridan Town Court at a later date.

Tye A. Kenny, 29, of Brocton, was charged Tuesday with second-degree criminal possession of a forged instrument and fifth-degree criminal possession of stolen property in the town of Pomfret. Kenny allegedly attempted to use a forged and stolen check on Jan. 10. he was issued tickets and will appear in the Pomfret Town Court at a later date.

MAYVILLE – Caz G. Stepp, 40, of Jamestown, was charged Wednesday with second-degree harassment after a domestic incident on Evans Avenue. Stepp allegedly struck a victim in the shoulder, arm and leg. Upon deputies arrival Stepp was allegedly found to be highly intoxicated and uncooperative. He was arraigned in the Mayville Village Court and sent to the Chautauqua County Jail to appear back in court at a later date.

HANOVER – Matthew J. Kreuzer, 25, of Angola was charged Tuesday with operating a motor vehicle with suspended registration after a traffic stop on Howard Street. Investigation found the registration was expired on Kreuzer’s vehicle and that he had an active warrant from the Hanover Town Court for failing to appear for charges of operating a vehicle with suspended license and registration on a previous date. He was arraigned and sent tot he Chautauqua County Jail on $500 cash bail.

Gowanda Police Department

Oswald E. Brown, 20, of Salamanca was charged with second-degree harassment, criminal mischief and criminal obstruction of breathing on Feb. 25. Police responded to the report of a disturbance at a West Main Street residence shortly after 10 p.m. Police found that a disagreement occurred between Brown and another male where Brown allegedly pushed the other male down a flight of stairs, then intentionally grabbed him by the neck and choked him. He also allegedly broke the victim’s cell phone and damaged photos.

Brown was arraigned in the Town of Persia Court and sent to the Cattaraugus County jail in lieu of $2,500 bail.

Jeffrey A. Schosek, 30, of Route 353 was charged with driving while intoxicated, driving while under the influence of drugs, first-degree aggravated unlicensed operation and refusal to submit to a breath test on Feb. 26. Police responded to the report of an erratic driver on Buffalo Street at 9:15 p.m. Police stopped Schosek in McDonald’s parking lot where he appeared intoxicated.

Schosek refused to take a breath test and it was found his license was revoked for previously refusing a breath test. He was arraigned in the Town of Collins Court and released on $1,000 bail.

Thomas R. Jones III, 19, of Route 438 was charged with petit larceny on Feb. 26. Police responded to a local business for the report of a shoplifter at 11 a.m. Jones allegedly stole two cases of beer by walking out without paying for them. He was released on an appearance ticket for the Town of Collins Court.

Reggie A. Irion, 53, of West Main Street was charged with trespass on March 1. Police responded to a Chestnut Street residence at 8:35 p.m. Irion was allegedly trespassing at a residence that had been recently burglarized. He was allegedly illegally on the property looking into vacant residence’s windows. He was released on an appearance ticket for the Town of Persia Court.

Lawrence A. Nadeau Jr., 35, of Commercial Street was charged with a warrant on March 5. Gowanda Police had previously arrested Nadeau for larceny and when he failed to appear in the Town of Persia Court, a bench warrant was issued for his arrest. Erie County Holding Center notified police that Nadeau would be released on an unrelated charge.

Nadeau was arrested and arraigned in the Town of Persia Court. He was sent to the Cattaraugus County Jail in lieu of $2,500 bail.

Jesse S. White, 30, of Bush Road was charged with driving while intoxicated and failure to keep right on March 9.

Police observed White operating a vehicle in an erratic manner on Buffalo Street at 10:45 p.m. Police observed White’s vehicle swerve in to the opposite lane while driving and he was stopped. White appeared intoxicated and failed several sobriety tests. His blood alcohol content was found to be a .17. He was released on an appearance ticket for the Town of Collins Court. New York State Police, the Erie County Sheriff’s Office and the Seneca Nation of Indians Marshals assisted.

HANOVER – D’Marcus A. Tallchief, 19, of Irving was charged Sunday with petit larceny after allegedly stealing two cases of beer. Deputies responded to an alarm at Kwik Fill in Irving. An investigation showed store personnel observed Tallchief open the rear door and take the beer. He was issued an appearance ticket to appear in the Hanover Town Court at a later date.

BROCTON – Michelle Beaujean, 28, of Fredonia, was charged Saturday with driving while intoxicated common law and DWI per se with a blood alcohol content of .08 percent or higher. Deputies along with Fredonia and Westfield Police were called to the St. Stephen’s Hotel around 2:35 a.m. for a disorderly person. Upon arrival a patron pointed out a vehicle in which the disorderly persons had left in. The vehicle was stopped on East Main Road and the driver, Beaujean, was charged. No charges were pressed for the incident in the bar. Beaujean was issued an appearance ticket to appear in the Village of Brocton Court at a later date.

Lincoln Avenue fire under investigation

OBSERVER Staff Report

The Dunkirk Fire Department has provided more information about the fire that occurred Saturday evening on Lincoln Avenue.

Firefighters responded to a reported structure fire at 128 Lincoln Ave. at about 10:20 p.m. Saturday. Crews found heavy fire in a one-and-a-half story frame house. Exterior and interior attacks were made using two two-and-a-half inch and two one-and-three-quarter inch lines.

The residence was not occupied at the time of the fire. Damage to the house was heavy with exposure damage to an exterior wall at 126 Lincoln Ave.

There were no injuries. The fire is under investigation by the Dunkirk Fire Department and the Chautauqua County Fire Investigation Team.

Ellicott man charged with

criminal possession of a weapon

On Friday, New York State Police in Jamestown charged Jeffrey Young, 54, of Merriam Street in Ellicott, with third-degree criminal possession of a weapon, a class D felony.

Young was detained following a traffic stop on Washington Avenue in Jamestown. Reportedly, he possessed a switch blade in plain view.

Young was processed at the state police barracks in Jamestown, arraigned in the City of Jamestown, and remanded to the Chautauqua County Jail.

Chautauqua County Sheriff’s Office

MAYVILLE – Albert Chapman Jr., 29, of Jamestown was taken into custody Wednesday after appearing on the Chautauqua County Most Wanted List for violation of treatment court. Chapman was taken to the Chautauqua County Jail.

On Friday at about 2 a.m., deputies charged Jose L. Maisonet, 18, of Jamestown was charged with disorderly conduct.

Reportedly Maisonet was in the roadway on E. Second Street obstructing traffic. According to deputies, he intentionally slapped a slow moving vehicle which had slowed down for his presence.

Maisonet was taken into custody and then released with an appearance ticket for Jamestown Court at a later date.

RIPLEY – At about 10 p.m. on Friday, Patrick R. Ziolowski, 31, of Route 76 in Ripley was charged with speeding 47 mph in a 35 mph zone, one headlight and third-degree aggravated unlicensed operation.

A sheriff’s deputy stopped Ziolkowski on West Main Road for speeding and for having only one working headlight. Further investigation reportedly revealed his driver’s license was suspended for failure to answer a summons.

Ziolkowski was taken into custody and later released with appearance tickets for the Town of Ripley Court.

City Court

An appearance ticket for Dunkirk City Court was issued by the building inspector to Sandra Waskiewicz for property located at 152 King St. The appearance ticket was for a charge of failure to remove unregistered vehicles from the property and failure to comply with a directive of the building inspector to remove said vehicles. Waskiewicz pleaded guilty and was fined a total of $150, $50 for each count and a $50 court surcharge.

KIANTONE – On Friday Kevin Haglund, 32, of Maple Street St. and Dominique Leeper, 27 of Arden Parkway, both in Jamestown, were charged for unlawful possession of marijuana.

They were stopped at a road check. Troopers reported that both possessed less than 25 grams of marijuana.

They were released on appearance tickets returnable to the Town of Kiantone Court on March 19.

ELLICOTT – On Saturday, troopers charged James Brown, 39, of Baker Street in the city of Jamestown for driving while intoxicated.

Troopers reported Brown was stopped for moving from lane unsafely on State Route 394. Brown reportedly failed field sobriety tests. He was taken to the state police barracks in Jamestown where he provided a breath sample reported to be .12 percent.

Brown was issued traffic tickets and is scheduled for the Town of Ellicott Court on March 19.

Randolph man charged with sex abuse

OBSERVER Staff Report

RANDOLPH – A Randolph man has been charged following an sexual abuse investigation in the town of Poland. John O. Hitchcock, 66, of Randolph was charged with seven counts of first-degree sexual abuse and endangering the welfare of a child Friday.

The Chautauqua County Sheriff’s Office and the Cattaraugus County Sheriff’s Office conducted a join investigation after Cattaraugus County Sheriff Deputies received a report alleging Hitchcock sexually abused a male juvenile. The alleged incidents took place between Randolph and Ashville in Chautauqua County between September and October 2012. Both Sheriff Offices were assisted with the investigation by the Child Advocacy Programs in Cattaraugus County and Chautauqua County, and the District Attorney Office in Chautauqua and Cattaraugus counties.

Hitchcock was picked up with an arrest warrant from Chautauqua County at his residence. He was taken to the Chautauqua County Jail.

HANOVER – Nicole Hill, 26, of Silver Creek was charged with driving while intoxicated and DWI per se .08 percent or higher on March 5. Sheriff deputies were called shortly after midnight to Christy Road for the report of a suspicious vehicle that pulled into a field. Hill was found to be the operator of the vehicle and through investigation, found to be intoxicated. She was released on appearance tickets for Hanover Town Court.

CHERRY CREEK – Diane M. George, 40, of Cattaraugus, was charged with driving while intoxicated and DWI per se .08 percent or higher on March 7. Deputies were responded to check the well-being on Route 83 in the village of Cherry Creek shortly before 4 a.m. Deputies found a vehicle in the ditch and the driver identified as George, who appeared to be intoxicated. She was released on an appearance ticket to appear in court at a later date.

POMFRET – A 17-year-old youth was charged with unlawful possession of marijuana on March 7. Deputies were called to the report of a vehicle in the ditch on Fredonia Stockton Road at 9 p.m. Police discovered that one of the passengers in the vehicle was in possession of marijuana. The youth was issued an appearance ticket for the Pomfret Town Court.

David M. Carver, 23, of Depew pleaded guilty to unlicensed operator and was fined $160.

A 16-year-old Silver Creek girl pleaded guilty to criminal trespass and will return to court in April to be sentenced.

Driving while intoxicated charges against Toni M. Elfman, 38, of Fredonia were dismissed following the conclusion of a probable cause hearing.

Clorissa D. King, 23, of Dunkirk pleaded guilty to unlicensed operator and was fined $160.

A 16-year-old Silver Creek girl was arraigned on a charge of fourth-degree criminal mischief. She was released on her own recognizance and returns to court in April.

A 16-year-old Silver Creek boy was arraigned on charges of fourth-degree criminal mischief, petit larceny, two curfew violations, and possession of marijuana. He pleaded guilty to one curfew violation and was fined $50. He returns to court in April.

Gilberto J. Rosas, 42, of Madison Street pleaded guilty to second-degree aggravated unlicensed operation and was sentenced to seven days in the Chautauqua County Jail as well as an $85 surcharge.

Andrew R. Sobilo, 23, of Dunkirk pleaded guilty to criminal trespass and was sentenced to time served (169 days) in the Chautauqua County Jail as well as a surcharge of $205.

A 17-year-old Silver Creek boy pleaded guilty to fourth-degree criminal possession of a weapon and returns to court in May to be sentenced.

Lance D. Vosburgh, 23, of Little Valley pleaded guilty to harassment and returns to court in April to be sentenced.

Area police warn residents of scam

Area police departments are warning residents of a local scam that is going around by a personally addressed letter. The letter says to have an unclaimed reward of $100 in gift savings good for either Walmart or Target. The letter instructs the resident to call a phone number, such as 877-499-2169, with a claim number. The phone number will typically reach someone in a foreign country. Residents are then asked to pay $4.95 for a shipping and handling charge and asked for a debit or credit card number. Police urge residents to not give personal information to anyone over the phone you do not know. If you are a victim of this scam, contact your local police authority. Trooper picking up dinner charges woman with aggravated DWI

COLLINS – On Monday, a trooper from Collins barrack pulled into a local pizza shop’s parking lot to pick up an order when he noticed a car stopped in the middle of Collins Road, near the intersection of State Route 62, with its turn signal on.

The trooper picked up his order, talked to the business owner and then returned to his vehicle. He saw that the car was still there. The trooper approached the car to check on the driver, later identified as Cheryl Lamoreaux, 54, of Hamburg.

Reportedly the trooper smelled alcohol and Lamoreaux appeared lost and had difficulty answering questions. To the trooper, she appeared intoxicated. The officer took her back to the Collins barracks where she was given a breath test which was reported to be .20 percent.

Lamoreaux was charged with aggravated driving while intoxicated and is scheduled to answer the charge in the Town of Collins Court at a later date.

The Village of Gowanda police assisted troopers at the scene.

North Collins man charged in domestic dispute

NORTH COLLINS – On Monday, Jeremy Yetter, 37, of Brant Road was charged with fourth-degree criminal mischief and unlawful possession of marijuana in connection with a domestic dispute with his wife.

During the dispute, the wife called 911, and reported her husband was destroying property in the house.

Troopers placed Yetter in custody and reportedly seized a small amount of marijuana on his person. Among the items reportedly damaged were a recliner, a sofa chair, and a coffee table.

Yetter was processed without incident at the Collins Barracks and is due in North Collins Court at a later date.

MAYVILLE – District Attorney David W. Foley announced the following pleas and sentences in Chautauqua County Court:

  • Victor O. Sanchez, 27, of Fredonia, was sentenced to a determinate term of 3 years in state prison with 2 years post-release supervision for fourth-degree criminal sale of a controlled substance.
  • John A. Bish, 47, of Jamestown, was sentenced to an indeterminate term of 2-4 years in state prison for two counts of third-degree burglary.
  • Vincent D. Carper, 34, of Buffalo, was sentenced to a determinate term of 2 1/2 years in state prison with 3 years post-release supervision for third-degree criminal possession of a controlled substance.
  • Andrew Santiago, 30, of Dunkirk, was sentenced to 2-4 years in state prison for third-degree criminal possession of stolen property.
  • Dominic Mooney, 19, of Silver Creek, was sentenced to 6 months in jail and 10 years probation for two counts of second-degree rape.
  • Casey M. Bennett, 21, of Dunkirk, was sentenced to 1 year in jail for fourth-degree grand larceny .
  • Erica R. Buchanan, 22, of Dunkirk, was sentenced to 30 days in jail, 3 months weekend work release and 5 years probation for third-degree robbery.
  • Jonathan M. Akers, 21, of Kennedy, was sentenced to 5 years probation for third-degree burglary.
  • Brian Hagerman, 32, of Dunkirk, was sentenced to 5 years probation for fourth-degree grand larceny.
  • Zachary A. Potter, 23, of Hawaii, was sentenced to 5 years probation and restitution for first-degree reckless endangerment.
  • Adam Robinson, 24, of Westfield, was sentenced to 9 months in jail for sexual misconduct.
  • Robert B. Lindbeck, 43, of Jamestown, was sentenced to 3 years probation for two counts of second-degree criminal contempt.
  • Wayne A. Snyder, 22, of Jamestown, was sentenced to 6 months in jail and a 3 year conditional discharge for second-degree attempted forgery.

Chautauqua County Sheriff’s Office

HANOVER – Brandon P. Orlando, 28, of Fredonia was charged Friday with failure to keep right, driving across hazard markings, driving while intoxicated common law and DWI per se. Deputies allegedly observed Orlando swerve over the yellow and white lines several times on Route 39. He was issued tickets and will appear in the Hanover Town Court at a later date.

JAMESTOWN – Sara N. Miller, 20, of Jamestown, was charged Feb. 26 with petit larceny and fifth-degree welfare fraud after she allegedly received $1,000 in SNAP/food stamp benefits while living out of state. Miller will appear in the Jamestown City Court at a later date.

Cattaraugus County Sheriff’s Office

ASHFORD – Frank Quagliana IV, 23, of Westfield, was charged Saturday with failure to keep right, driving while intoxicated common law and DWI per se after a traffic stop on Route 219. He allegedly failed field sobriety tests.

He was processed by Ellicottville Police and released with tickets.

Wendell L. Wagner, 17, of Maple Avenue was charged with unlawful possession of alcohol March 1.

Marcello E. Capalbo, 20, was charged with unlawful possession of alcohol on March 1.

Michael Sanchez, 19, of Hemingway Hall, SUNY Fredonia was charged with disorderly conduct and unlawful possession of alcohol on March 2.

Jenna Bulmahn, 19, of Williamsville was charged with unlawful possession of alcohol and having an open container on March 3.

Joshua R. Hayes, 25, of Brigham Road was charged with having an open container on March 3 with a bench warrant.

Meredith E. Leikam, 35, was charged with endangering the welfare of a child on March 4.

Wendell L. Wagner, 17, of Maple Avenue was charged with unlawful possession of alcohol March 1.

Man charged with criminal contempt

On Tuesday, Joseph J. Casel, 41, of 178 Hallock St. in Jamestown, was detained by state troopers in Jamestown for first-degree criminal contempt, a felony.

Casel is accused of violating an order of protection issued by the Town of Chautauqua Court on July 20. The court ordered him to refrain from contacting a female victim. Reportedly, Casel violated the order by contacting her by cellphone after an appearance in the Chautauqua County Family Court in Jamestown.

The action is elevated to a felony when a person has previously been convicted of criminal contempt in the first or second degree within the preceding five years. A check with the New York State Division of Criminal Justice Services indicated Casel was convicted of second-degree criminal contempt on July 20.

Casel was processed at the state police barracks in Jamestown, arraigned in the City of Jamestown Court, and remanded to the Chautauqua County Jail in lieu of $5,000 bail.

Chautauqua County Sheriff’s Office

KIANTONE – Timo-thy Himes, 34, of Frews-burg, was charged early Tuesday morning with driving while intoxicated and failure to keep right. Himes allegedly failed to keep right and lost control of his vehicle resulting in it overturning on the side of the road Route 62 at 12:56 a.m. Himes suffered minor injuries and was transported to WCA Hospital by the Kiantone Fire Department. Investigation led to the DWI charges. Himes was issued tickets and will appear in Kiantone Town Court at a later date.

Jamestown Police

JAMESTOWN – Stac-ey L. Simmers, 31, of Warren, Pa., was charged with first-degree robbery and fourth-degree conspiracy on Tuesday.

Simmers was wanted in connection with a robbery that occurred Saturday around 11 p.m. where a victim was assaulted and robbed on Charles Street in the city.

The arrest warrant was issued by the Jamestown City Court and Simmers was taken into custody around 1 a.m. She was sent to the city jail where she is being held pending arraignment.

Fredonia troopers charge Stockton man

  • Saturday at about 1:30 a.m., troopers charged Norman Blanchard, 46, of Nelson Hill Road in Stockton with aggravated driving while intoxicated.

Troopers allege Blan-chard drove left of pavement markings and moved from lane unsafely on Route 60 in the Town of Dunkirk. They report he failed standardized field sobriety tests and his blood alcohol content was .19 percent.

Blanchard is scheduled to answer the charges in Town of Dunkirk Court April 1.

Forestville man charged with

harassment and DWI

HANOVER – Hugh Sowers, 60, of 483 Route 39 in Forestville was charged Saturday with second-de-gree harassment, driving while intoxicated, aggravated driving while intoxicated and consuming alcohol in a vehicle.

Chautauqua County Sheriff’s deputies investigated an altercation that took place on Route 39. Deputies received information that Sowers was involved in the altercation, that he fled the scene and that he was still in the area of the incident.

Deputies located the vehicle a short time later and made contact with Sowers when he pulled into a parking lot in the village of Forestville. Deputies report that Sowers was intoxicated and drinking alcohol in his vehicle.

Sowers was released with traffic tickets and appearance tickets. He will appear in the Town of Hanover Court at a later date.

Mayville woman pleads guilty to Clymer robbery; other felonies reduced

CLYMER – A Mayville woman accused of robbing a Clymer credit union last April will avoid trial.

Jenifer Gens on Friday pleaded guilty to a felony robbery charge, days before her trial was scheduled to begin. According to Chau-tauqua County District Attorney David Foley, Gens faces up to seven years in prison when sentenced May 20 in front of County Court Judge John T. Ward.

However, Foley expects Gens to be sentenced to the minimum term of 1 1/2 to three years for robbing the Southern Chautauqua Fed-eral Credit Union in Clymer.

“We got exactly what we were looking for,” Foley said Sunday. “I had spoken to the assistant district attorney assigned to this case, and we made it clear (Gens) needed to plead guilty to the robbery.”

Jury selection in the trial was scheduled to begin Tuesday in Mayville. Gens’ plea also covered other pending cases against her.

Ned Barone, Chautauqua County public defender, said Gens had been facing nonviolent felony charges for three separate incidents, including the Clymer robbery. Barone said Gens was charged last year with grand larceny and criminal possession of stolen property. The incidents took place in the Jamestown area and occurred around the same time as the robbery.

By entering a guilty plea Friday, the remaining felony charges were reduced to misdemeanors, Barone said. Had she been convicted on all three charges, Gens could have faced a maximum sentence of approximately 16 years in prison.

“We were all set to go to trial for the robbery,” Barone said. “One of the other felonies was a weak, weak case and the evidence wasn’t that great.”

Asked of Gens’ reasoning for the rash of felonies, Barone said, “Sometimes when it rains it pours and it happens all at once. … Sometimes people make bad choices and are put into situations.”

A Chautauqua County grand jury in April indicted Gens on one count of third-degree robbery, a class D felony, for her part in the Clymer heist. New York State Police and the district attorney’s office handled the investigation.

State Police on April 17 were called to the 562 Clymer-Sherman Road credit union for a report of a robbery. The suspect was described as a woman with a small build and wearing a hooded sweatshirt, jeans and sunglasses.

Staff at the credit union said the subject demanded money and indicated she had a gun. More than $3,700 was taken, Barone said, noting no gun was ever shown or located.

Shortly after the robbery, police canvassed the neighborhood and reviewed surveillance footage. Several tips from area residents led authorities to Gens.

“We did a lot of work talking to people in the neighborhood,” Joseph Smith of the New York State Police said last year. “Thanks to witnesses we had a good lead about where the suspect was.”

Barone, meanwhile, said he was pleased to see all three felonies were resolved with the plea deal.

“She does have children,” he said. “She is a mother and has other responsibilities. We’re glad that we were able to get this resolved and allow her to move forward.”

  • ELLINGTON – On Wednesday, Corry Green, 25, of Randolph was charged with illegal dumping.

A trooper responded to Dean School Road for a report of illegal dumping. Discarded items included three mattresses, two recliners, a folding chair, glass, and a garbage bag containing a receipt with a name.

The trooper and NYS Environmental Conserva-tion officers conducted an investigation. Reportedly Green was paid $50 to take the garbage to the landfill but instead dumped it on the side of the road. Green was contacted and turned himself into the state police at Jamestown.

He was issued an appearance ticket.

James E. Ederle Jr., 48, of Randolph was charged with second-degree aggravated unlicensed operation on Feb. 26.

Carlos J. Rosado, 25, of Columbus Avenue was charged with petit larceny on Feb. 27 with a warrant.

Kevin Gonzalez, 19, of Swan Street was charged with unlicensed operation and having inadequate brake lights on Feb. 27.

Francisco E. Santiago, 29, of King Street was charged with unlicensed operation, having an inadequate muffler and failure to use turn signal on Feb. 28.

Anthony L. Irizarry, 19, of Doughty Street was charged with obstruction and disorderly conduct on March 1 from previous charges.

Harold E. Voss, 23, of Silver Creek was charged with unlicensed operation, having no insurance and having an inadequate muffler on March 1.

Jamestown Police Department

JAMESTOWN – Raymond L. Johnson, 32, of Jamestown was charged with third-degree criminal possession of a controlled substance, second-degree criminal contempt and criminal use of drug paraphernalia on Friday. Investigators from the Jamestown Police Department executed a search warrant at 516 W. Sixth St. at 6 p.m. following an investigation revealed that the occupant was selling and distributing crack cocaine in and around the city. Inside the residence, officers located and seized a amount of quantity of cocaine, cash and a scale. Johnson was taken to the city jail where he was later arraigned and committed to the Chautauqua County Jail. The investigation is ongoing and more arrests are expected. Steven A. Patterson, 50, of West Main Road was charged with unlawful possession of marijuana on Feb. 23.

Luke T. Haag, 20, of White Street was charged with disorderly conduct on Feb. 23.

Kaitlin Hawley, 22, of Silver Creek was charged with seventh-degree criminal possession of a controlled substance on Feb. 25 on a warrant.

Larry F. Sheldon, 22, was charged with disorderly conduct on Feb. 25 on a bench warrant.

Hanover man charged with burglary

HANOVER – On Thursday, a New York State Trooper from the Jamestown barracks charged David Mattoon, 37, of Park Street with third-degree burglary.

Troopers received a complaint of a burglary of a MIG welder from a barn on Aldrich Hill Road in the Town of Cherry Creek. After investigation, state police report that Mattoon stole the welder and sold it for parts for his broken truck.

Mattoon was processed and is due in the Town of Cherry Creek Court on March 7.

  • NORTH HARMONY – On Monday, a Pennsylvania woman was injured in an accident in the town of North Harmony.

Around 12:05 a.m., Franchesca L. Reed, 20, of Boiling Springs, Pa., was traveling northbound on Panama Stedman Road in the town of North Harmony when she lost control of her vehicle and went off the west side of the roadway and overturned in a field. Reed was taken by the Ashville Fire Department to Westfield Memorial Hospital for treatment of injuries. no charges expected.

  • FRENCH CREEK – On Monday, an Ohio man was charged with second-degree harassment, second-degree obstruction of governmental administration and second-degree resisting arrest after an incident at Peek ‘n Peak.

Around 12:40 a.m., the sheriff’s department was called to Peek ‘n Peak to assist the resort security with an incident. It is alleged James J. Kos, 57, of Royalton, Ohio, pushed a security officer, obstructed deputies while gathering further information, and resisted arrest when deputies went to arrest him. Kos was arraigned in the town of Sherman by Judge VanVolkenburg and is set to appear in French Creek court at a later date. Kos was committed to the Chautauqua County jail in lieu of $2,500 cash/$5,000 property bail.

  • STOCKTON – On Tuesday, a Dewittville man was charged with failure to maintain and second-degree aggravated unlicensed operation.

Around 7:10 p.m., it is alleged sheriff’s deputies observed a vehicle traveling on Hartfield-Stockton Road commit a violation of the state vehicle and traffic law. The vehicle was stopped and Andre Biekert, 43, of DeWittville, was identified as the operator. It was later determined that Biekert’s privileges to operate a motor vehicle in New York State had been revoked. Biekert was issued traffic tickets for the observed violation and for second-degree aggravated unlicensed operation. He is to appear in the Town of Stockton court at a later date.

  • VILLENOVA – On Tuesday, a Forestville woman sustained minor injuries after she lost control of her vehicle.

Around 4:50 p.m., sheriff’s deputies responded to a one-vehicle accident on Buttermilk Road in the town of Villenova. It appears the operator, Courtney Ellis, 21, of Forestville, was driving southbound on Buttermilk Road when she lost control of her vehicle due to slippery pavement. Her vehicle veered off to the right into a deep ditch. The position of the vehicle indicated that the vehicle left the roadway entered the ditch striking the front end and overturning onto the rooftop. Ellis was able to free herself from the vehicle and seek help from a neighbor. South Dayton EMS responded and transported Ellis to Brooks Memorial Hospital for apparent minor injuries.

  • FORESTVILLE – On Thursday, a Forestville man was jailed on a warrant arrest.

Around 1 a.m., deputies located Timothy G. Winford, 30, of Forestville, at 927 Route 39 and took him into custody without incident on an arrest warrant from Chautauqua County court for the charges of first-degree unlawful imprisonment, second-degree reckless endangerment and third-degree assault. Winford was committed to Chautauqua County jail without bail and will appear in court at a later time.

  • PORTLAND – On Monday, a Portland man was charged with unlawful possession of marijuana.

Around 10:30 p.m., deputies were speaking with James Seavy Jr., 48, of Portland, regarding an unrelated incident when it was discovered that Seavy was allegedly in possession of a small amount of marijuana. Seavy was issued an appearance ticket for unlawful possession of marijuana and will answer the charge in the Town of Portland court.
